Where Is Abel Thy Brother? Reframing The Theological Horizons For Catholic Theories Of Just War, Philip J. Rossi Jan 2014

Where Is Abel Thy Brother? Reframing The Theological Horizons For Catholic Theories Of Just War, Philip J. Rossi

Theology Faculty Research and Publications

This essay starts from a presupposition that there is need for rethinking the theological framework within which the Catholic Church has articulated its understanding of the principles and the application of the theory of "just war" in the social teaching it has proposed since the conclusion of World War II. While it may also be the case that the articulation of just war principles within other Christian theological traditions needs a similar re-framing, my primary concern is with the place it has occupied within Catholic moral and social teaching for the last sixty years. I will first provide a brief …

Pragmatic Liberalism: The Outlook Of The Dead, Justin Deystone Jan 2014

Pragmatic Liberalism: The Outlook Of The Dead, Justin Deystone

Publications

At the turn of the twentieth century, the legal profession was rocked in a storm of reform. Among the sparks of change was the view that "law in the books" had drifted too far from the "law in action." This popular slogan reflected the broader postwar suspicion that the legal profession needed to be more realistic, more effective, and more in touch with the social needs of the time. A hundred years later, we face a similarly urgent demand for change. Across the blogs and journals stretches a thread of anxieties about the lack of fit between legal education and …

The Judge And The Drone, Justin Deystone Jan 2014

The Judge And The Drone, Justin Deystone

Publications

Among the most characteristic issues in modern jurisprudence is the distinction between adjudication and legislation. In the some accounts, a judge's role in deciding a particular controversy is highly constrained and limited to the application of preexisting law. Whereas legislation is inescapably political, adjudication requires at least some form of impersonal neutrality. In various ways over the past century, theorists have pressed this conventional account, complicating the conceptual underpinnings of the distinction between law-application and lawmaking. This Article contributes to this literature on the nature of adjudication through the resuscitation of a structuralist mode of legal interpretation. In the structuralist …

Constitutional Concern, Membership, And Race, Sarah Krakoff Jan 2014

Constitutional Concern, Membership, And Race, Sarah Krakoff

American Indian Tribes in the United States have a unique legal and political status shaped by fluctuating federal policies and the over-arching history of this country’s brand of settler-colonialism. One of the several legacies of this history is that federally recognized tribes have membership rules that diverge significantly from typical state or national citizenship criteria. These rules and their history are poorly understood by judges and members of the public, leading to misunderstandings about the “racial” status of tribes and Indian people, and on occasion to incoherent and damaging decisions on a range of Indian law issues. This article, which …

Assessment And Analysis Of Genomic Diversity And Biomarkers In Sabahan Indigenous Populations / Kee Boon Pin, Boon Pin Kee

Student Works (2010-2019)

Ever since the proposal of the recent African origin of modern humans and its various opposing concepts, evolutionary studies have been focusing on the discovery of timelines for such events based on traceable records in archaic remains and contemporary human populations. Although the migration of anatomically modern humans between the 7 major continents in the near 120,000 years has been explained and fit well in the “out of Africa” hypothesis, human movement within these continents remains elusive. Human demic events in Southeast Asia region have also been the heat of debate among researchers. It has been proposed that this region …

The Mediating Role Of Innovation Between Family Influence And Business Performance Of Public Listed Family Businesses In Malaysia / Chong Wei Ying, Wei Ying Chong

Student Works (2010-2019)

Innovation is a sine qua non for many businesses in today’s competitive, complex and capricious environment. Plenty researches have highlighted that innovation is closely linked with business performance. Yet, to date, scant attention has been given to innovation in the world dominant form of business - family business. Even pertaining researches carried out in the past, the focuses are normally on the family versus nonfamily business dichotomy on innovation performance. However, in reality, family influence on business is multidimensional and continuous. The involvement and pattern of family influences vary from business to business. This dissertation seeks to fill these gaps …

Bone Age Assessment Using Hand And Clavicle X-Ray Images / Marjan Mansourvar, Marjan Mansourvar Jan 2014

Bone Age Assessment Using Hand And Clavicle X-Ray Images / Marjan Mansourvar, Marjan Mansourvar

Student Works (2010-2019)

Bone age assessment (BAA) is a method for evaluating the level of skeletal maturity to estimate the actual age of a person. It is usually performed manually by comparing an X-ray image of a left hand-wrist with an atlas, which contains a collection of images of known persons in the clinical procedure. The manual methods are based on analyzing special regions of the images of the hand bones or the whole bones of the images. Both approaches are prone to observation variability, time-consuming, and decision made on bone age is subjective. As a result, there is a pressing need to …

Student Works (2010-2019)

Materialism among today’s youth has received strong interest among educators, parents, consumer activist and government regulators. Although materialism has long been of interest to consumer researchers, it is not clear whether specific socialization agents in general, and communication environment in particular, can instil materialism in people. The overall objectives of this study are to analyze the effect of family communication, television viewing, and peer communication on young adults’ orientation towards materialism. The theoretical foundation of this study lies on several established theories, which include consumer socialization theory, social comparison theory, social learning theory, cultivation theory, self-determination theory, Maslow’s human need …

The Importance Of Institutional Culture At A Technical College, Sarah Adams

Dissertations (1934 -)

This is a qualitative study about the importance of institutional culture at a particular technical college in Wisconsin. It examines the administrators' understanding of their institution's culture, the importance they attach to the culture, and how they perceive they both manage and influence their institution's culture. Bergquist and Pawlak's (2008) work, Engaging the Six Cultures of the Academy, is used as the analytic framework. Key factors that emerged were the importance and role of the college's mission, the importance of the college's responsiveness to the community, and the necessity of administrators being purposeful in their involvement in the culture of …

The Word Is An Angel Of The Mind: Angelic And Temple Imagery In The Theology Of John Mansur, The Damascene., Elijah Nicolas Mueller Jan 2014

The Word Is An Angel Of The Mind: Angelic And Temple Imagery In The Theology Of John Mansur, The Damascene., Elijah Nicolas Mueller

Dissertations (1934 -)

This dissertation looks at the scriptural images of angel and temple, as they occur in key works by John Damascene: on the Heresies, chapter 100 "On the Ishmaelites;" Three Treatises on the Divine Images, and on the Orthodox Faith. Angelic and temple imagery forms an important core which holds together liturgy, ascesis, and theophany. These types of images constitute a consistent mode for understanding theology and anthropology. As part of revelation, they are important in the early Islamic context. Angel and temple imagery were used by John Damascene to push back against Islamic revelation claims and Islamic challenges to the …

Love For God And Earth: Ecospirituality In The Theologies Of Sallie Mcfague And Leonardo Boff, Rebecca A. Meier-Rao Jan 2014

Love For God And Earth: Ecospirituality In The Theologies Of Sallie Mcfague And Leonardo Boff, Rebecca A. Meier-Rao

Dissertations (1934 -)

This dissertation examines the theologies of North American Ecofeminist Sallie McFague and Latin American liberation theologian Leonardo Boff in order to answer the question - What are the features of a Christian spirituality capable of helping people to clear vision, transformation and hope in this time of socio-ecological crisis? In the sixth chapter I also briefly engage the work of Carmelite contemplative Constance FitzGerald, as she both reinforces and deepens the theologians' answer to the above question.

The dissertation begins with a short explanation of the interlocking ecological and social crises, and offers a basic understanding of Christian spirituality as …

"Heavenly Theologians": The Place Of Angels In The Theology Of Martin Luther, Christopher J. Samuel Jan 2014

"Heavenly Theologians": The Place Of Angels In The Theology Of Martin Luther, Christopher J. Samuel

Dissertations (1934 -)

This dissertation examines a virtually untouched aspect of Martin Luther's theology: his angelology. Specifically, it argues four main points: that Luther does, over his corpus, present an angelology; that his angelology is indebted to and in conversation with the prior theological tradition; that his concern with the angels is evident throughout his career; and that his major angelological concerns are pastoral in nature. Furthermore, it presents Luther's answers to four basic angelological questions: 1) what are the angels?; 2) what is the angels' role in Creation?; 3) what is the nature of their relationship with humanity?; and 4) what is …

Filling The Gap: Nonviolent Strategies For Civilian Self-Protection During Mass Atrocities, Danny Hirschel-Burns , '14 Jan 2014

Filling The Gap: Nonviolent Strategies For Civilian Self-Protection During Mass Atrocities, Danny Hirschel-Burns , '14

Senior Theses, Projects, and Awards

This thesis seeks to highlight and understand the phenomenon of civilian self-protection during mass atrocities. I begin by demonstrating the structural barriers to international atrocity prevention and mitigation, and why civilian self-protection is therefore necessary. Next, to contexualize civilian self-protection, I look at why mass atrocities happen and how they work, arguing they are elite-led processes, but occur in a complex conflict system. The core of the thesis looks at empirical examples of civilian self-protection, theorizes their dynamics, and proposes avenues for their improvement. Finally, I use civilian self-protection to bridge divides between various theories and disciplines. This thesis is …

Sustainability Policy’S Inherent Dilemmas – Exemplified Via Critical Examination Of The Las Vegas Metropolitan Sustainability Campaign, Kathryn A. Zimmerman Jan 2014

Sustainability Policy’S Inherent Dilemmas – Exemplified Via Critical Examination Of The Las Vegas Metropolitan Sustainability Campaign, Kathryn A. Zimmerman

All Master's Theses

In response to a dual problem of critical water scarcity and rapid population growth, leaders of metropolitan Las Vegas implemented a region-wide, internationally marketed sustainability campaign. Preliminary studies found that, while sustainability policy attains its rhetorical goals, solutions initiated not only perpetuate but also purposefully expand the original dual problem to justify continuous water resource acquisitions. To examine this sustainability conundrum constructed by leadership—problem-perpetuation rather than problem-resolution—a critical examination in resource management asked two basic questions: what is being sustained and by what means? Via this inquiry, specific processes by which leaders perpetuate problems can be identified; and, so-informed, new …

The Museum As An Inclusive Community: A Blueprint For Moving Forward, Howard P. Scott Jan 2014

The Museum As An Inclusive Community: A Blueprint For Moving Forward, Howard P. Scott

All Master's Theses

The focus of this study is museum accessibility for patrons with disabilities. The history of museums and their evolution into institutions that strive to create an inclusive community means that many aspects of the Americans with Disabilities Act of 1990 as well as the Architectural Barriers Act of 1968 are applicable. Developing a tool for assessing museum compliance with the law was key to gathering data to use for improving compliance with the law. Using this data and comparing current compliance in four museums to three major legal cases against museums showed common areas for improvement in accessibility in all …

Empathy: A Possible Link Between Charismatic Megafauna And Environmental Concern, Anthony Joseph Carr Jan 2014

Empathy: A Possible Link Between Charismatic Megafauna And Environmental Concern, Anthony Joseph Carr

All Master's Theses

Environmental organizations have long used charismatic megafauna - popular large animals - as strategic figureheads to summon support for conservation actions. While the animals chosen as flagship species usually have anthropomorphic features, such as large body size and forward-facing eyes, there is no commonly accepted explanation for why these similarities influence people's willingness to help these species. In this study, empathy was found to be predictive of perceived need and willingness to help in a conservation scenario. While framing a threatened ecosystem as the habitat of an unspecified animal species with cultural characteristics increased reports of situational empathy, perceived need …

The Middle Of Nowhere? : Managing Northern Rocky Mountain Ghost Towns, Krista Evans Jan 2014

The Middle Of Nowhere? : Managing Northern Rocky Mountain Ghost Towns, Krista Evans

All Master's Theses

Numerous abandoned hard rock mining settlements in the American West are now referred to as ghost towns. As tourist attractions and significant historic resources, preserving and managing these remote ghost towns can be challenging. Heritage managers face a number of issues, from implementing an appropriate preservation strategy to attracting enough visitors to remain economically viable. The purpose of this study is to perform a comparative analysis of current management methods used at several notable ghost towns. Additionally, the study explores how tourist perceptions of these landscapes can influence ghost town preservation strategies. I accomplish this by performing case studies at …

The Making And Unmaking Of An Autocrat: Edwin Eells And The Skokomish Reservation, 1871-1885, Adam Bradford Griffith Jan 2014

The Making And Unmaking Of An Autocrat: Edwin Eells And The Skokomish Reservation, 1871-1885, Adam Bradford Griffith

All Master's Theses

Much has been written about Ulysses S. Grant's Indian Peace Policy. This paper will examine the progress of its implementation on the Skokomish Reservation in Washington Territory through the work of Indian Agent Edwin Eells and analyze the likely causes of his autocratic style of management. The paper will show that Eells' professional mindset was modeled by missionary parents with a tradition of intense, narrowly focused religious commitment and influenced general white racism towards Indians. However, while the peace policy was based on an earlier European colonial model, the paper will also show that while Eells attempted to exert his …

There Oughta Be A Law—A Model Law, Mary Whisner

Librarians' Articles

Uniform and model laws are frequently proposed to standardize “what the law is or should be” for specific jurisdictions. These model acts can come from national or international drafting organizations, such as the Uniform Law Commission, or from interest groups or associations that want to promote specific policies. Ms. Whisner provides an overview of the various types of model laws that researchers should know about.

Illustrated Tales Of Little Sister Fox: Stories About A Clever Fox From Russian Fairytales, Rachel W. Smoot

Senior Honors Theses

This thesis examines the interaction of pictures and words in children’s storybooks. The illustrations placed alongside the text of the book are just as important to understanding the story as are the words. “Illustrated Tales of Little Sister Fox” combines elements of several traditional Russian folktales into a single story. Illustrations are hand sketched and digitally painted.

The Right To Include, Daniel B. Kelly Jan 2014

The Right To Include, Daniel B. Kelly

Emory Law Journal

Recent scholarship has created renewed interest in the "right to exclude." Many contend that, because owners have a right to exclude, private property has a tendency to promote individualism and exclusion. But, as I will argue, property can promote sociability and inclusion by providing owners with various ways of including others. Owners can assert their "right to include" by waiving exclusion rights, dividing existing rights by contracts or property forms, and creating new co-ownership arrangements. Inclusion is socially beneficial insofar as it enables sharing and exchange, facilitates financing and risk-spreading, and promotes specialization.

A Survey Of Dramaturgical Practices In Contemporary American Theater: The Dramaturg In Process, Maggie Bell Jan 2014

A Survey Of Dramaturgical Practices In Contemporary American Theater: The Dramaturg In Process, Maggie Bell

All Master's Theses

A review of the literature on dramaturgical practices in the American theater from the past thirty years revealed a significant paucity of first-hand accounts by dramaturgs about their work and especially about the contributions dramaturgs make to the production process. In general, the literature addresses dramaturgical practices in abstract or theoretical terms, without documenting the specific contributions that dramaturgs make to the creation of productions and events as performances. This thesis documents and defines the dramaturgical process through interviews with a select sample of early career and established dramaturgs. The interviews conducted follow the narrative method of open-ended questions and …
