Punitive Damages, Chinese Tort Law, And The American Experience, Vincent R. Johnson
Punitive Damages, Chinese Tort Law, And The American Experience, Vincent R. Johnson
Faculty Articles
In a country such as China, with abundant consumer products and the inevitability of product defects, claims for punitive damages are sure to arise under Article 47 of the new Chinese Tort Law. Article 47 provides that “(w)hereany producer or seller knowingly produces or sells defective products, causing death or serious damage to the health of others, the injured party may request appropriate punitive damages.” As Chinese jurists and scholars interpret Article 47, they may wish to consider whether lessons can be drawn from the American experience. During the past two decades, few areas of American law have changed more …

From Novel Of Ideas To Pop Phenomenon: The Transmission Of Atlas Shrugged Into Popular Culture, Stephen E. Snyder
Electronic Theses and Dissertations
Ayn Rand published her most famous novel, Atlas Shrugged, in 1957. Since then, the novel has continued to grow in popularity, and today, Atlas Shrugged is purchased by hundreds of thousands of people each year, and the philosophy that the novel espouses, Objectivism, continues to influence our culture in a myriad of ways. Atlas Shrugged has not only greatly influenced American politics; it has become a popular culture phenomenon. Representations of her ideas show up in radio talk shows, on nightly Fox News programing, on popular television series, on YouTube clips, Twitter posts, and everywhere between. The influence of Rand …

Ruminal Degradabilities And Intestinal Digestibilities Of Canola Meals And The Production Response Of Cows Fed Canola Meal With Varying Concentration Of Starch Sources, Nadeesha Kumari Jayasinghe
Electronic Theses and Dissertations
Canola meal (CM) is a by-product in the manufacturing process of canola oil which can be performed with or without using solvent extraction. It is a protein supplement which has grown its importance in dairy cattle feeding competing with soybean meal (SBM). However, final quality of the feed depends on the oil extraction process and the production conditions used by the individual processing plant. Two studies were conducted to investigate: 1) the variability among the CM produced in different processing plants and 2) the best starch source or the most suitable proportion of corn and barley to be fed with …
The Relationship Between Nonverbal Immediacy And Therapeutic Alliance In Higher Education Client-Counselor Interactions, Valerie Kleinjan
The Relationship Between Nonverbal Immediacy And Therapeutic Alliance In Higher Education Client-Counselor Interactions, Valerie Kleinjan
Electronic Theses and Dissertations
Communication is essential to a successful patient-provider interaction. Within health communication literature, a substantial body of research has focused on verbal communication; however, few studies have fully dedicated to nonverbal communication research. The study examined the relationship between perceptions of client nonverbal immediacy and ratings of the therapeutic alliance. Additionally, the study provided an analysis comparing counselor and client ratings of both client nonverbal immediacy and the therapeutic alliance. Results indicated a significant relationship between counselor ratings of client nonverbal immediacy and counselor ratings of the therapeutic alliance. Counselors and clients also rated client nonverbal immediacy similarly, indicating that the …
Exploring Community Engagement In The Indianapolis Opera Scene, Nicole Vasconi
Exploring Community Engagement In The Indianapolis Opera Scene, Nicole Vasconi
Undergraduate Honors Thesis Collection
Despite its long history, the majority of today's society no longer holds this art form in such high regard. This is especially true for American culture, where opera companies are operating amidst a tumultuous time of foreclosures. The reasons for opera's continued decline in popularity among American audiences is a hotly debated topic for music historians and administrators, but the fact remains that the general public who once regarded opera as popular entertainment now rejects it as paltry and pointless. It is too Like many contemporary American opera companies, Indianapolis Opera and easy to cite the operas themselves as the …
Effects Of Tylenol And Social Rejection On Memory, Karina Ashley Hamamouche
Effects Of Tylenol And Social Rejection On Memory, Karina Ashley Hamamouche
Undergraduate Honors Thesis Collection
Individuals tend to describe physical pain and social pain with the same terminology (DeWall & Baumeister, 2006; Eisenberger, et aI., 2003; Way, et aI., 2009). There is a neurobiological overlap between the systems that control physical pain and social pain. During both physical pain and social rejection, the same brain areas (insulae in the central cortical fissure) are active. DeWall (2011) found that individuals who received a dose of acetaminophen had less activity in the bilateral anterior insula and bilateral posterior insula during a social rejection stimulation. Because social rejection also increases memory (Pajkos, et aI., 20 I 1), subjects …
Characterization Of The Role Of Salicylic Acid In Plant-Pathogen Interactions In Moss, Erica Grabinski
Characterization Of The Role Of Salicylic Acid In Plant-Pathogen Interactions In Moss, Erica Grabinski
Undergraduate Honors Thesis Collection
The central objective of this project is to explore defense systems that are induced in two moss species, Amblystegium serpens and Physcomitrella patens, upon inoculation with the fungus, Pythium irregulare. In vascular plants, systemic defense is associated with the plant hormone salicylic acid (SA). I hypothesize that when the moss are treated exogenously with SA, the organisms will undergo a systemic defense response, which will involve the induction of defense-related genes and increased resistance to future P. irregulare infection, that is directly correlated with the amount of hormone applied. If the role of SA in plant defense in A. serpens …

In "The Metamorphosis" and "The Hunger Artist," Kafka has gifted us with two characters who, in Kafkaesque fashion, "pay a terrible price when, willingly or not, [they go] against 'nature, '" as Joachim Neugroschel writes in the introduction to his translation of The Metamorphosis, In the Penal Colony, and Other Stories (Kafka xix). Gregor awakes one morning to discover that he has been turned into a giant vermin, and the hunger artist attempts to cope with his tragedy of not enjoying the taste of food by putting himself on public display, likening his role in society to that of a …
The Influence Of Light On Bryophytes And Their Response To Pathogen Infection: A Story Of Mnium Cuspidatum And Physcomitrella Patens, Bryce James Fawcett
The Influence Of Light On Bryophytes And Their Response To Pathogen Infection: A Story Of Mnium Cuspidatum And Physcomitrella Patens, Bryce James Fawcett
Undergraduate Honors Thesis Collection
The influence of light on non-vascular plant-pathogen interactions were studied in two moss species, Mnium cuspidatum and Physcomitrella patens, using a fungal pathogen, Pythium irregulare, and a commonly used pathogenic elicitor (beta-glucan). The findings of this study suggest that light does playa role in moss defense but speci fic mechanisms remain unclear. In P. patens it was found that the defense gene AOe was up-regulated in the light compared to the dark when treated with beta-glucan elicitor. A phenotypic study of M. cuspidatum revealed that P. irregulare will infect and M cuspidatum will subsequently mount a defense response. Unexpectedly, samples …
The Folly Of Expecting Evil: Reconsidering The Bar's Character And Fitness Requirements, Leslie Levin
The Folly Of Expecting Evil: Reconsidering The Bar's Character And Fitness Requirements, Leslie Levin
Faculty Articles and Papers
The bar's character and fitness requirement is based on the largely untested premise that an applicant's past history helps predict whether that individual possesses the moral character needed to be a trustworthy lawyer. The primary purpose of the character inquiry is to protect the public and the judicial system from potentially problematic lawyers. The inquiry may also signal to the public that lawyers possess "good character" and deserve to be trusted with their important legal matters, thereby facilitating client representation and the administration of justice. An alternative-and more critical characterization of this purpose is that it is designed to protect the …

Affordable Care Act, Remedy, And Litigation Reform, The, Brendan Maher
Faculty Articles and Papers
The Patient Protection and Affordable Care Act of 2010 (“ACA”) rewrote the law of private health insurance. How the ACA rewrote the law of civil remedies, however, is — to date — a question largely unexamined by scholars. Courts everywhere, including the United States Supreme Court, will soon confront this important issue. This Article offers a foundational treatment of the ACA on remedy. It predicts a series of flashpoints over which litigation reform battles will be fought. It identifies several themes that will animate those conflicts and trigger others. It explains how judicial construction of the statute’s functional predecessor, the …
Misreading Like A Lawyer: Cognitive Bias In Statutory Interpretation, Jill Anderson
Misreading Like A Lawyer: Cognitive Bias In Statutory Interpretation, Jill Anderson
Faculty Articles and Papers
Statutory interpretation dilemmas arise in all areas of law, where we often script them as scenes of conflict between a statute's literal text and its animating purpose. This Article argues that, for an important class of disputes, this supposed discord between text and purpose is an illusion. In fact, lawyers are overlooking ambiguities of literal meaning that align well with statutory purpose. The form of ambiguity in question inheres not in individual words, but at the level of the sentence. What triggers a split in readings are verbs that linguists classify as "opaque," which are perfectly common in legal texts: …
Corporate Law Constraints On Political Spending, James Kwak
Corporate Law Constraints On Political Spending, James Kwak
Faculty Articles and Papers
Corporations currently can participate in electoral politics in the United States through various means: affiliated PACs, super PACs, 501(c)(6) organizations like the Chamber of Commerce, 501(c)(4) social welfare organizations, and traditional 501(c)(3) charitable organizations. Corporate law, as generally interpreted by the courts, places few constraints on the ability of corporate insiders to engage in politics as they choose. I argue that existing statutes and case law could be interpreted to impose greater constraints on corporate political activity. Political contributions should be reviewed as potential violations of the duty of loyalty whenever they could provide personal benefits to board members and …

The Treatment Of Congenitally Developed Fused Vulva Labia In A Brown-Swiss Heifer, Oktay Yilmaz, Ebubeki̇r Yazici, Mehmet Uçar, Muhammed Kürşad Bi̇rdane
Turkish Journal of Veterinary & Animal Sciences
A case of congenitally developed fused labia in a 13-month-old Brown-Swiss heifer, an uncommon entity, is described. On gross appearance of vulva, it was observed that there were only 2 small openings in the dorsal and ventral vulvar commissures. Ultrasonography of the genital tract revealed the presence of left and right ovaries, uterine horns, and cervix uteri. The abnormality of the vulva was surgically corrected. The heifer was synchronized and artificially inseminated postsurgically. During delivery, no complication was observed and a healthy male calf was born. To the authors' knowledge, this is the first report describing both the surgical treatment …

The Problem With Neurolaw, David W. Opderbeck
The Problem With Neurolaw, David W. Opderbeck
Saint Louis University Law Journal
This Article describes and critiques the increasingly popular program of reductive neuroLaw. Law has irrevocably entered the age of neuroscience. Various institutes and conferences are devoted to questions about the relation between neuroscience and legal procedures and doctrines. Most of the new “neuroLaw” scholarship focuses on evidentiary and related issues, and is important and beneficial. But some versions of reductive neuroLaw are frightening. Although they claim to liberate us from false conceptions of ourselves and to open new spaces for more scientific applications of the law, they end up stripping away all notions of “selves” and of “law.” This Article …

"Wouldn't Harm A Fly" : An English Translation Of "Du Mal A Une Mouche" By Anne-Lise Grobety, Anna Strozza
Graduate Research Theses & Dissertations
This thesis is an English translation of the Swiss-French novel Du mal a une mouche by Anne-Lise Grobety. The book is about a woman's journey into a bureaucratic afterlife, where she is given a list of everything that she has ever killed in her life, from insects, kittens, and everything in between.||My translation finds a balance between what the author intended to say in the native language, as well as a naturalization of the target language, in this case, English. This book has never been translated into English before, and it will hopefully one day be published.

Conferring Dignity: The Metamorphosis Of The Legal Homosexual, Noa Ben-Asher
Conferring Dignity: The Metamorphosis Of The Legal Homosexual, Noa Ben-Asher
Elisabeth Haub School of Law Faculty Publications
The legal homosexual has undergone a dramatic transformation over the past three decades, culminating in United States v. Windsor, which struck down Section 3 of the Defense of Marriage Act (DOMA). In 1986, the homosexual was a sexual outlaw beyond the protection of the Constitution. By 2013, the homosexual had become part of a married couple that is “deemed by the State worthy of dignity.” This Article tells the story of this metamorphosis in four phases. In the first, the “Homosexual Sodomite Phase,” the United States Supreme Court famously declared in Bowers v. Hardwick that there was no right to …

Department of Biochemistry: Faculty Publications
Background: Cell walls are essential for most bacteria, archaea, fungi, algae and land plants to provide shape, structural integrity and protection from numerous biotic and abiotic environmental factors. In the case of eukaryotic algae, relatively little is known of the composition, structure or mechanisms of assembly of cell walls in individual species or between species and how these differences enable algae to inhabit a great diversity of environments. In this paper we describe the use of camelid antibody fragments (VHHs) and a streamlined ELISA assay as powerful new tools for obtaining mono-specific reagents for detecting individual algal cell wall components …
Intention To Screen For Sexually Transmitted Infections: A Terror Management Health Model Perspective, Bernadette Jones
Intention To Screen For Sexually Transmitted Infections: A Terror Management Health Model Perspective, Bernadette Jones
Master's Theses and Doctoral Dissertations
The present studies assessed intention and willingness to screen for sexually transmitted infections from a Terror Management Health Model perspective. TMHM proposes that when facing a health decision, people tend to cling to what increases their self-esteem rather than behave in a way that would actually minimize the health threat. The first study hypothesized that exposure to a brochure rife with reminders of “creatureliness” would increase death thought accessibility, while a control brochure would not. No significant difference was found. The second study hypothesized that those with low body-esteem would cling more to what todays culture deems an acceptable body …

The Emergence Of The New Woman In Victorian Children's And Family Literature, Geneva Korykowski
Senior Honors Theses and Projects
In the Victorian era, the first wave of feminism surfaced in several influential family novels that modeled the "New Woman" instead of reinstating the "Old Girl." Characters from the novels Little Women, Villette, Jane Eyre, and The Little Lychetts as they modernize the Victorian women in the fin de siecle. Now we see a trend similar to first wave feminism beginning to happen with biology, The Hunger Games and Will Grayson, Will Grayson show examples of how a "New Man" is defined in contemporary society.

Early Intensive Behavioral Intervention For Autism: Is It Actually More "Intensive" Than A Typical Child's Day?, Caitlyn B. Sorensen
Master's Theses and Doctoral Dissertations
Autism Spectrum Disorder (ASD) is a pervasive developmental disorder characterized by deficits in social interaction, communication, and excessive ritualistic and repetitive behavior. Numerous treatments for autism devised over the last half-century have proven ineffective, or have never been scientifically evaluated. Despite the state of the research, the most demonstrably effective treatment, Early Intensive Behavioral Intervention (EIBI), has been a target of much criticism, including accusations of being too intense. A large number of learning trials in relatively short periods of time supposedly induce children to have disordered stress responses. To explore the intensity of EIBI, behavior samples from children engaging …
