Vince brings a battery action against Dan based upon an encounter between the two men. Dan claims that he was acting in self-defense and wants to testify that Ed sent him the following text message minutes before the encounter: “Vince is coming to see you to collect on that drug debt that you owe him.” Dan could argue that he is offering the statement not to prove the truth of the matter asserted but to prove its “effect on the listener,” making it nonhearsay Specifically, Dan could claim that he is offering the statement to prove that, regardless of whether …

National “Harmony”: An Inter-Branch Constitutional Principle And Its Application To Diversity Jurisdiction, Jesse M. Cross Jan 2014

National “Harmony”: An Inter-Branch Constitutional Principle And Its Application To Diversity Jurisdiction, Jesse M. Cross

Faculty Publications

Most constitutional interpretation continues, in the words of John Hart Ely, to be "clause-bound" in nature: it presumes that each constitutional clause can be studied in isolation from each other clause. As a result of this shortsighted methodology, constitutional scholars have overlooked a single organizing metaphor that was used at the Constitutional Convention to shape a host of constitutional clauses scattered across Articles I and III: the metaphor of national "harmony." Within the rhetoric of Enlightenment science, the term "harmony" was used in the Founding era to identify those forces that extended between the independent parts of a larger system …

Before Ptsd: Combat Trauma In The Civil War Short Stories Of Kate Chopin, Adam Kotlarczyk

Faculty Publications & Research

“The Civil War,” writes Robert Penn Warren, “is, for the American imagination, the single greatest event of our history” (3). Indeed, it has been estimated that the American imagination has been inspired to the tune of some 60,000 historical books on the subject (Lafantasie). Kate Chopin, probably best known for The Awakening and short stories like “The Story of an Hour,” spent her adolescence in a divided and tumultuous St. Louis during the Civil War. Like the women in her family with whom she lived, including her mother, grandmother, and two aunts, young Kate was a southern sympathizer (Ewell 7). …

Assessing The In Situ Fertilization Status Of Two Marine Copepod Species, Temora Longicornis And Eurytemora Herdmani; How Common Are Unfertilized Eggs In Nature?, Rachel S. Lasley-Rasher, Andrew M. Kramer, Victoria Burdett-Coutts, Jeannette Yen

Integrative Biology Faculty and Staff Publications

We utilized an egg staining technique to measure the in situ fertilization success of two marine copepod species, Temora longicornis and Eurytemora herdmani from May to October 2008 in coastal Maine and correlated fertilization success with environmental conditions in their habitat. T. longicornis is a free spawning species that releases eggs into the ambient seawater after mating. In contrast, E. herdmani carries eggs in an egg sac until they hatch. The proportion of fertilized eggs within E. herdmani egg sacs was significantly higher than the freely spawned clutches of T. longicornis. This may be a result of the asymmetrical costs …

Effects Of Acute And Chronic Sleep Deprivation On Eating Behavior, Stephanie Frank Jan 2014

Effects Of Acute And Chronic Sleep Deprivation On Eating Behavior, Stephanie Frank

Lewis Honors College Capstone Collection

Sleep-deprivation is thought to be a factor in the rising American obesity epidemic. Altered sleep cycles affect appetite-regulating hormone levels and enhance the hedonic effect of food consumption. As a result, sleep restriction has been associated with an increased daily energy intake of more than 500 calories and high-carbohydrate/high-fat consumption. However, past studies have not examined the relationship between sleep deprivation and decreased intake of nutrient-dense fruits and vegetables as a factor in increased energy consumption. This paper aims to 1) determine the affect average hours of sleep or acute sleep deprivation (defined as less than 6 hour sleep per …

Self-Evaluation With And Without External Feedback To Increase Room Cleaning Skills In Students With Mild Intellectual Disabilities Or Behavior Disorders, Allison Smith Varisco Jan 2014

Self-Evaluation With And Without External Feedback To Increase Room Cleaning Skills In Students With Mild Intellectual Disabilities Or Behavior Disorders, Allison Smith Varisco

Theses and Dissertations--Early Childhood, Special Education, and Counselor Education

As students with disabilities age out of school-age resources, the need for self-evaluative skills in work tasks becomes more important. This study compared self-evaluation with reinforcement and self-evaluation with reinforcement plus external evaluation when completing room cleaning skills. The younger students did not demonstrate the ability to self-evaluate without external evaluation. Both conditions were effective when evaluating the older group of students. The author proposes additional research in looking at self-evaluative skills for specific age groups and conditions.

Nuclear Import And Interactions Of Potato Yellow Dwarf Virus Nucleocapsid, Matrix, And Phosphoprotein, Gavin Lloyd Franklin Anderson Jan 2014

Nuclear Import And Interactions Of Potato Yellow Dwarf Virus Nucleocapsid, Matrix, And Phosphoprotein, Gavin Lloyd Franklin Anderson

Theses and Dissertations--Plant Pathology

Potato yellow dwarf virus (PYDV) is the type species of the genus Nucleorhabdovirus and, like all members of this genus, replication and morphogenesis occurs inside the nuclei of infected cells. Protein localization prediction algorithms failed to identify a nuclear localization signal (NLS) in PYDV nucleocapsid (N) protein, although PYDV-N has been shown to localize exclusively to the nucleus when expressed as a green fluorescent protein (GFP):N fusion in plant cells. Deletion analysis and alanine-scanning mutagenesis identified two amino acid motifs, 419QKR421 and 432KR433, that were shown to be essential for nuclear import and interaction with …

Ether Bridge Formation And Chemical Diversification In Loline Alkaloid Biosynthesis, Juan Pan Jan 2014

Ether Bridge Formation And Chemical Diversification In Loline Alkaloid Biosynthesis, Juan Pan

Theses and Dissertations--Plant Pathology

Loline alkaloids, found in many grass-Epichloë symbiota, are toxic or feeding deterrent to invertebrates. The loline alkaloids all share a saturated pyrrolizidine ring with a 1-amine group and an ether bridge linking C2 and C7. The steps in biosynthesis of loline alkaloids are catalyzed by enzymes encoded by a gene cluster, designated LOL, in the Epichloë genome. This dissertation addresses the enzymatic, genetic and evolutionary basis for diversification of these alkaloids, focusing on ether bridge formation and the subsequent modifications of the 1-amine to form different loline alkaloids.

Through gene complementation of a natural lolO mutant and comparison …

The Effects That Liquid And Solid Cattle Manure Have On The Water Quality Of Drainage Ditches In Putnam County, Ohio, Janelle Horstman Jan 2014

The Effects That Liquid And Solid Cattle Manure Have On The Water Quality Of Drainage Ditches In Putnam County, Ohio, Janelle Horstman

Honors Projects

Lake Erie has experienced harmful algal blooms with increased frequency since the mid-1990s due to excess nutrients from Rivers, such as the Maumee River, and largely agricultural watersheds. Nonpoint source pollution from agriculture contributes to eutrophication, algal blooms, and the degradation of water quality. This creates stress on aquatic fauna, reduced aesthetic quality, odor, and limits of the water for usage of drinking, recreation, and industry. This research paper asks what the contributions of having access to manure application records, soil records, and information about antibiotics have on what is known about manure management and antibiotic resistance, which has been …

The Correlation Between Snakebites And Meteorological Variations, Chang Na Jan 2014

The Correlation Between Snakebites And Meteorological Variations, Chang Na

Public Health Theses

Background: In the United States, approximately 45,000 snakebites occur annually and affect many people including veterinarians and farmers.1 Snakebites can cause significant pain and morbidity such as severe bleeding and skin necrosis. Better predictive information on snakebite risk could help prevent snakebites by identifying high risk time periods, weather patterns, and locations.

Methods: This was a retrospective analysis of the New Mexico State Poison Control Center data between January 1998 and December 2012. Monthly average meteorological data were obtained from the Parameter-elevation Regressions on Independent Slopes Model climate group. Locations of the bites were categorized as urban or rural based …

Warning! You Are About To Enter "The Friend Zone": College Students' Experiences With The Friend Zone And Perceptions Of Fictional Characters In Friend-Zone Roles, Ashley Chapman

Honors Projects

People are put into “the friend zone” when they want to pursue a romantic relationship with a friend but find that their friend wants only a platonic relationship. With this research I (a) estimated the frequencies of heterosexual college students' having put an opposite-sex friend into the friend zone and having been put into the friend zone by an opposite-sex friend, (b) examined the emotions associated with these friend-zone experiences, and (c) explored college students' perceptions of characters navigating a friend-zone experience as depicted in two short video clips. Discussion focuses on results concerning the ubiquity of friend-zone experiences, the …

Developing Voice Through Narrative Writing, Katherine Gaskill Jan 2014

Developing Voice Through Narrative Writing, Katherine Gaskill

Honors Projects

Among the many rules taught to students as they engage in the writing process is the instruction to remain objective and avoid writing in first-person. Though there are certainly instances in which it is inappropriate for students to use the word 'I" in their writing, students often misunderstand this instruction and their writing suffers as a result. Students often produce writing which lacks voice in their struggle to remain objective. This project seeks to prove the importance of voice in all forms of writing and provide a method for teaching students how to include voice in their own work. The …

The Power Of Parody And Satire In The 21st Century English Classroom, Ashley N. Shelton Jan 2014

The Power Of Parody And Satire In The 21st Century English Classroom, Ashley N. Shelton

Honors Projects

A frequent question in today’s high school English classroom is how "the classics" fit into our 21st century curriculum. Students ask, "How is this relevant to me?" and complain that the literature they are reading in class is outdated and difficult to understand. Therefore, my project embraces a few canonical texts that are most frequently used in America's schools and presents them in an innovative way that students will not only understand, but engage on a critical level. Based on emerging research in the education field, my project explains how modern technology and the techniques of parody and satire can …

Evaluation Of Genomic Predictors For Red Angus Cattle, Stephen D. Kachman, Matthew L. Spangler

Nebraska Beef Cattle Reports

Purebred Red Angus genotypes, via the Ilumina BovineSNP50 assay, and expected progeny differences (EPD) were used to evaluate the accuracy of genomic predictors for traits that are currently reportedthrough the American Red AngusAssociations’ National Cattle Evaluation. Two genomic predictors were evaluated, one derived using prediction equations from the National Beef Cattle Evaluation Consortium and the other from Zoetis.
