Animal, Dairy, and Veterinary Science Faculty Publications

Dairy herd-level prevalence of Mycobacterium avium subsp. paratuberculosis (MAP), causative agent of Johne’s disease (JD), Mycoplasma spp., and Bovine Viral Diarrhea (BVD) virus were estimated in Utah and surrounding states and compared to previous surveillance results. Milk was collected at 3-4 day intervals on 5 dates (duplicate samples) from each bulk tank on participating farms, samples analyzed separately. One frozen sample was shipped to a laboratory for JD/MAP testing with ELISA and real-time PCR, the other paired sample was shipped to another laboratory for mycoplasma and BVD testing. Mycoplasma was cultured on modified Hayflick medium, standard methods; BVD testing was …

The Durability Of Private Claims To Public Property, Bruce R. Huber Jan 2014

The Durability Of Private Claims To Public Property, Bruce R. Huber

Journal Articles

Property rights and resource use are closely related. Scholarly inquiry about their relation, however, tends to emphasize private property arrangements while ignoring public property — property formally owned by government. The well-known tragedies of the commons and anticommons, for example, are generally analyzed with reference to the optimal form and degree of private ownership. But what about property owned by the state? The federal government alone owns nearly one-third of the land area of the United States. One could well ask: is there a tragedy associated with public property, too? If there is, here is what it might look like: …

Private Law In The Gaps, Jeffrey A. Pojanowski Jan 2014

Private Law In The Gaps, Jeffrey A. Pojanowski

Journal Articles

Private law subjects like tort, contract, and property are traditionally taken to be at the core of the common law tradition, yet statutes increasingly intersect with these bodies of doctrine. This Article draws on recent work in private law theory and statutory interpretation to consider afresh what courts should do with private law in statutory gaps. In particular, it focuses on statutes touching on tort law, a field at the leading edge of private law theory. This Article's analysis unsettles some conventional wisdom about the intersection of private law and statutes. Many leading tort scholars and jurists embrace a regulatory …

Lays: Halal/Haram Crisis, Jami Moiz, Nida Aslam Khan

Business Review

The following case revolves around Frito Lays which is a highly popular Snack-food Company in various Muslim nations. One of Frito Lays biggest brands, Lays Potato Chips, is a major competitor in the Pakistani Snack foods market. However in 2009, Lays faced a major controversy when it was targeted with a campaign saying that an ingredient found in the manufacturing is Haram (prohibited for Muslims). This claim proved to be disastrous from Lays as it meant a loss in the consumer base as well as a dent onto the Brand's image amongst its wide base of Muslim consumers. The case further …

China's Business-Tax-To-Vat Reform: An Interim Assessment, Wei Cui Jan 2014

China's Business-Tax-To-Vat Reform: An Interim Assessment, Wei Cui

All Faculty Publications

The reform to replace the Business Tax (BT) with the VAT is the largest tax reform initiative in China since 1994. This article assesses the first two years of the reform from a tax policy perspective. It shows that the government has tried to preempt resistance to reform through highly unusual tax design and by allowing local governments to retain revenue from pilot sectors. The VAT for pilot sectors is characterized by two new reduced rates that apply to a wide range of business-to-business transactions as well as consumer services (such as internet and mobile data services) not generally regarded …

Transnational Business Governance Interactions: Conceptualization And Framework For Analysis, Burkard Eberlein, Kenneth W. Abbott, Julia Black, Errol Meidinger, Stepan Wood Jan 2014

Transnational Business Governance Interactions: Conceptualization And Framework For Analysis, Burkard Eberlein, Kenneth W. Abbott, Julia Black, Errol Meidinger, Stepan Wood

All Faculty Publications

This article demonstrates the value of studying interactions in transnational business governance (TBG) and proposes an analytical framework for that purpose. The number of TBG schemes involving non-state authority to govern business conduct across borders has vastly expanded in a wide range of issue areas. As TBG initiatives proliferate, they increasingly interact with one another, and with state-based and other normative regimes. The key challenge is to understand the implications of TBG interactions for regulatory capacity and performance – the most fruitful initial focus – and ultimately for the impacts of regulation on social and environmental problems. To gain purchase …

What Jurors Want To Know: Motivating Juror Cognition To Increase Legal Knowledge And Improve Decisionmaking, Sara Gordon Jan 2014

What Jurors Want To Know: Motivating Juror Cognition To Increase Legal Knowledge And Improve Decisionmaking, Sara Gordon

All Faculty Publications

What do jurors want to know? Jury research tells us that jurors want to understand the information they hear in a trial so they can reach the correct decision. But like all people, jurors who are asked to analyze information in a trial—even jurors who consciously want to reach a fair and accurate verdict—are unconsciously influenced by their internal goals and motivations. Some of these motives are specific to individual jurors; for instance, a potential juror with a financial interest in a case would be excluded from the jury pool. But other motivations, like the motive to understand the law …

Effects Of D-Amphetamine On Temporal Control In A Peak-Interval Procedure In Lewis And Fischer 344 Rats, Meagan E. Follett Jan 2014

Effects Of D-Amphetamine On Temporal Control In A Peak-Interval Procedure In Lewis And Fischer 344 Rats, Meagan E. Follett

Graduate Theses, Dissertations, and Problem Reports (ETD)

The present study assessed temporal control in LEW and F344 rats using a peak-interval procedure, in which fixed-interval (FI) trials were randomly presented with peak-interval (PI) trials, during which the interval was extended and no reinforcement was delivered. The peak time, or the average time at which response rates were the highest, was compared to the FI value as a measure of temporal control across three FI/PI conditions (10/30, 30/90, 60/180 seconds). There were no significant differences in temporal control as assessed by the PI procedure between LEW and F344 rats across three different conditions as well as following acute …

Transsynaptic Delineation Of The Rabbit Eyeblink Premotor Pathway: Identifying Anterior Interpositus Neurons And Their Synaptic Changes As A Function Of Learning, Jimena Gonzalez-Joekes Jan 2014

Transsynaptic Delineation Of The Rabbit Eyeblink Premotor Pathway: Identifying Anterior Interpositus Neurons And Their Synaptic Changes As A Function Of Learning, Jimena Gonzalez-Joekes

Graduate Theses, Dissertations, and Problem Reports (ETD)

The main goal of this dissertation was to identify eyeblink projection neurons of the anterior interpositus nucleus (AIN) and to examine learning-specific changes in excitatory and inhibitory somatic synapses after eyeblink conditioning (EBC). In order to identify the specific subset of AIN neurons involved in EBC, a retrograde transneuronal viral tracer was injected into the eyelid (orbicularis oculi muscle) of the rabbit to reveal hierarchical chains of synaptically connected neurons involved in the eyeblink response. Experiment 1 was designed to provide a complete delineation of the rabbit eyeblink premotor pathway and to characterize the multiple neuronal types in the AIN …

Cultural Identity, Vocational Development, And The Meaning Of Work Among Appalachian Coal Miners: A Qualitative Study, Susan Chamberlain Jan 2014

Cultural Identity, Vocational Development, And The Meaning Of Work Among Appalachian Coal Miners: A Qualitative Study, Susan Chamberlain

Graduate Theses, Dissertations, and Problem Reports (ETD)

In this study I explore what coal mining means to underground miners in Appalachia, and how these meanings interact with participants' cultural and vocational identities. Using narrative data from eight underground coal miners, the study investigates the connections between cultural values, career, and personality. These connections are singularly intertwined in Appalachia, where economic and social landscapes have been heavily influenced by coal mining for over a century. The resulting relationships have blurred the lines of identity among career, family, and community. This qualitative study is based on data from semi-structured interviews; participant language was analyzed using grounded theory to create …

Floodplain Mapping In Response To Surface Mine Reclamation, Erin E. O'Leary Jan 2014

Floodplain Mapping In Response To Surface Mine Reclamation, Erin E. O'Leary

Graduate Theses, Dissertations, and Problem Reports (ETD)

Surface mining and the associated reclamation cause changes in land use and land cover. This change can affect the hydrologic balance. In some cases, an increase in number and magnitude of flood events is observed both on site and in surrounding areas. This research analyzed the hydrologic effects downstream of a reclaimed surface mine, considering the impact of an alternative reclamation technique. Geomorphic landform design (GLD) is a reclamation method that considers the development mature landform shapes to help create a long-term hydrologic balance. Flood maps were created for the pre-mined condition and compared to maps created for three reclamation …

Brown Capuchins (Cebus Apella) Exhibit Self-Control On A Delay Of Gratification Food Exchange Task When Food Options Differ Qualitatively, Kimberly Ann Fisher Jan 2014

Brown Capuchins (Cebus Apella) Exhibit Self-Control On A Delay Of Gratification Food Exchange Task When Food Options Differ Qualitatively, Kimberly Ann Fisher

Honors Theses

Self-control allows an individual to obtain a more preferred outcome by forgoing an immediate interest. Self-control is an advanced cognitive process because it involves the ability to weigh the costs and benefits of impulsive versus restrained behavior, determine the consequences of such behavior, and make decisions based on the most advantageous course of action. Self-control has been thoroughly explored in Old World primates, but less so in New World monkeys. There are many ways to test self-control abilities in non-human primates, including exchange tasks in which an animal must forgo an immediate, less preferred reward to receive a delayed, more …

Capuchin Monkeys (Cebus Apella) Fail To Be Equitable In An Ultimatum Game, Mackenzie Florence Smith Jan 2014

Capuchin Monkeys (Cebus Apella) Fail To Be Equitable In An Ultimatum Game, Mackenzie Florence Smith

Honors Theses

The ultimatum game is a commonly used economics game testing humans' sense of fairness. In the game, a "proposer" is given a sum of money and is told they can split it however they want with another human partner. The partner can then either accept the division and both proposer and responder receive the proposed amounts, or the responder can reject the offer and neither player will get anything. Human subjects from most western cultures typically share almost half of an allotted amount, but it remains unknown whether our close primate relatives share this generosity. Recent attempts to present chimpanzees …

Policy And Programme Considerations For Arv-Based Prevention For Women: Insights From Key Opinion Leaders In Zimbabwe About Tenofovir Gel, Samukeliso Dube, Barbara Friedland, Saiqa Mullick, Martha Brady, C. Elizabeth Mcgrory

HIV and AIDS

Zimbabwe has seen a tremendous shift in the HIV landscape in the last decade, particularly regarding prevalence. Yet many people, especially women, are still at high risk and efforts to identify and implement additional HIV-prevention options remain critical. After nearly 20 years of microbicides research, 1 percent tenofovir gel is the first vaginal microbicide to show promise. Since 2011, Zimbabwe has been scaling up use of tenofovir-based regimens as first-line therapy for adults infected with HIV. A randomized, placebo-controlled, double-blind trial demonstrated that women assigned to use 1 percent tenofovir gel had a 39 percent lower risk of HIV infection …

Class Actions A Thing Of The Past … Or Are They? A Look At The Circuit Courts' Application Of Comcast V. Behrend, 48 J. Marshall L. Rev. 335 (2014), Christine Frymire

UIC Law Review

This Comment addresses recent developments in the law of class action waivers and certification. Specifically, it looks at three cases—Comcast, Concepcion, and Wal-Mart—in which the Supreme Court limited class action litigation and class arbitration. This Comment also addresses how the circuit courts are hesitant to follow the Supreme Court’s precedent.

"Wood For The Coffins Ran Out": Modernism And The Shadowed Afterlife Of The Influenza Pandemic, Elizabeth Outka Jan 2014

"Wood For The Coffins Ran Out": Modernism And The Shadowed Afterlife Of The Influenza Pandemic, Elizabeth Outka

English Faculty Publications

Here’s what we already know—during the First World War, soldiers and civilians often had remarkably different experiences of the war corpse. Dead bodies were omnipresent on the front line and in the trenches, an inescapable constant for the living soldier. As critic Allyson Booth notes, “Trench soldiers . . . inhabited worlds constructed, literally, of corpses.”1 In Britain and America, however, such corpses were strangely absent; unlike in previous conflicts, bodies were not returned. This dichotomy underscores some of our central assumptions about the differences between the front line and the home front: in the trenches, dead bodies and …

Symptom-Based Gun Control Symposium Article, Fredrick E. Vars Jan 2014

Symptom-Based Gun Control Symposium Article, Fredrick E. Vars

Connecticut Law Review

People out of touch with reality should not have guns. This Article proposes empowering police officers to take away guns and gun rights from individuals suffering from delusions or hallucinations. This proposal is inspired by the Navy Yard shooting, but is also supported by evidence showing a correlation between these psychotic symptoms and violence. The proposal is constitutional because of this correlation and for other reasons. For example, the motivating principle behind the right to bear arms is selfdefense; a criminal defendant may only invoke self-defense if he “reasonably” feared great bodily harm, and such a fear is not “reasonable” …

The Necessity Of An Equity And Comity Analysis In Younger Abstention Doctrine Note, Drew Alan Hillier Jan 2014

The Necessity Of An Equity And Comity Analysis In Younger Abstention Doctrine Note, Drew Alan Hillier

Connecticut Law Review

Today, courts and commentators treat the Younger doctrine as a central rule with several enumerated exceptions. This prevailing view is incorrect. An analysis of the exceptions to the Younger abstention doctrine demonstrates that the exceptions are merely applications of the equity and comity principles that the Younger Court used to justify abstention. If federal courts blindly apply the exceptions to Younger v. Harris, as if the exceptions have independent legal justifications, they risk incorrectly determining the very cases that Younger doctrine requires them to avoid. Instead, federal courts should always consider whether abstention is mandated under the principles of equity …

Nonprofits, Speech, And Unconstitutional Conditions, Lloyd Hitoshi Mayer Jan 2014

Nonprofits, Speech, And Unconstitutional Conditions, Lloyd Hitoshi Mayer

Connecticut Law Review

This Article proposes a new constitutional framework for approaching the issue of speech-related conditions on government funding accepted by nonprofits and demonstrates its application by reviewing the Court’s landmark decisions in this area. It argues that speech rights are generally inalienable as against the government under the First Amendment, and therefore any abridgement of such rights by the government—whether direct or indirect—is subject to strict scrutiny. As a result, the government is not permitted to buy an organization’s speech absent a compelling governmental interest in doing so and then only if the purchase is done in a manner that is …

Regulating Firearms Through Litigation Symposium Article, Patrick Luff Jan 2014

Regulating Firearms Through Litigation Symposium Article, Patrick Luff

Connecticut Law Review

As a result of relatively weak regulation, firearm use leads to massive negative externalities. Efforts to minimize these social costs via legislation have been unsuccessful, which have led individuals and government entities to seek regulation through another avenue: litigation. This use of the courts as a regulatory gap-filler raises vital questions, among which perhaps the most vital is whether courts are effective at performing this role. This Article seeks to answer that question by comparing the courts as an institution with other institutions, such as markets, legislatures, and administrative agencies. I consider a number of factors that can be used …
