The conflict between state marijuana legalization and the blanket federal marijuana prohibition of the Controlled Substances Act (CSA) has created a federalism crisis in which the duties of state officials to adhere to state or federal law are unclear. Current federalism doctrine cannot even tell us whether or not a local police officer who encounters a person in state-authorized possession of marijuana must arrest the person and seize the marijuana. The two most clearly applicable federalism doctrines - the Tenth Amendment anti-commmandeering doctrine and federal preemption of state law under the Supremacy Clause - offer only unsatisfactory answers. A Seasonal, Density-Dependent Model For The Management Of An Invasive Weed, Esther Shyu, Eleanor A. Pardini, Tiffany M. Knight, Hal Caswell

The population effects of harvest depend on complex interactions between density dependence, seasonality, stage structure, and management timing. Here we present a periodic nonlinear matrix population model that incorporates seasonal density dependence with stage-selective and seasonally selective harvest. To this model, we apply newly developed perturbation analyses to determine how population densities respond to changes in harvest and demographic parameters. We use the model to examine the effects of popular control strategies and demographic perturbations on the invasive weed garlic mustard (Alliaria petiolata). Attacks targeting Web system vulnerabilities have shown an increasing trend in the recent past. A contributing factor in this trend is the deployment of Web 2.0 technologies. Due to the ability of users to create their own content, Web 2.0 applications have become increasingly popular and in turn this has made them attractive targets for malicious attacks. Given these trends there is a need to better understand and classify malicious cyber activities. Though primarily associated with white Southerners, bluegrass music is actually the product of over three hundred years of black and white musical interaction that occurred in the American Southeast. This document begins by reviewing the first complete definition of bluegrass music written by Mayne Smith. It then proceeds to explore the history of cross cultural exchanges in the South, particularly in the Appalachian Mountains, that began when the first slaves were brought to the New World. In the South, these interactions created the folk music that would eventually develop into country music and later bluegrass in the twentieth century. Black …

To date, no research studies in the eastern United States have addressed the spatial ecology of black bears (Ursus americanus) in urban and suburban habitats, and there is limited information regarding black bear space use, habitat selection, and harvest vulnerability. School consolidation has become commonplace in the West Virginia, with a declining student population as West Virginia has lost population over the last several decades. Consolidated schools offer school districts the opportunity to provide greater offerings in terms of coursework and extracurricular activities, while also allowing a reduction in some operating costs since fewer facilities are maintained and few administrative staff are needed to operate them. Peripheral vascular disease is a pathological disease state whereby the peripheral vascular system becomes progressively limited in its ability to adequately perfuse extremities despite increases in metabolic demand. One of the primary risk factors for development of peripheral disease is the Metabolic Syndrome. It is the presentation of three simultaneous comorbidities, with obesity being the most common denominator in most metabolic syndrome patients, but also including a pro-inflammatory state, pro-oxidant state, pro-thrombotic state, increased blood pressure, atherogenic dyslipidemia, or insulin resistance. This study examined the relationship between the leadership style of principal investigators (PIs) of interdisciplinary research teams at academic health science centers and the collaboration satisfaction of their team members. Two stage sampling was used. One hundred NIH-funded principal investigators at eight regional health science centers completed a team identification form, identifying their teams as interdisciplinary and providing the names and emails of team members. An online survey instrument that included a basic demographic questionnaire, the Bolman and Deal Leadership (Others) Survey, and the Collaboration and Transdisciplinary Integration Survey was then sent to team members. A classical biometric system digitizes the human body and uses this digitized identity for human recognition. In this work, we introduce the concept of mixing biometrics. Mixing biometrics refers to the process of generating a new biometric image by fusing images of different fingers, different faces, or different irises. The design of a solid-membrane folding wing for use on a tube launched micro air vehicle (MAV), and experimental wind tunnel results of the wing integrated on an engineering MAV model are presented herein. Due to the sizing and performance requirements of the MAV, the wing must provide sufficient wing area while minimizing its stowed footprint. Many current available methods for folding the wing for such a MAV sacrifice aerodynamic efficiency or are cost prohibitive. Research shows that a moderate to large cohesion-performance relationship exists, suggesting teams that build strong social and task cohesion are more likely to be successful. This effect has also found to be stronger in female over male teams. Peer leadership positions are somewhat overshadowed by coach positions on sport teams but can have an important influence on a team's task and social cohesion. This study investigated the influence gender has on the peer leadership-cohesion relationship. Participants were 381 NCAA Division I male and female soccer players from 67 different universities. The use of the ocular region as a biometric cue has gained considerable traction due to recent advances in automated iris recognition. However, a multitude of factors can negatively impact ocular recognition performance under unconstrained conditions (e.g., non-uniform illumination, occlusions, motion blur, image resolution, etc.). This dissertation develops techniques to perform iris and ocular recognition under challenging conditions. The first contribution is an image-level fusion scheme to improve iris recognition performance in low-resolution videos. In 2000, approximately 10 million women were taking hormone replacement therapy (HRT) for alleviation of menopausal symptoms. A number of prior animal studies also suggested that HRT may be neuroprotective and cardioprotective as well. Although estrogen is neuroprotective in young adult animal models of stroke, clinical trials demonstrate that estrogen increases the incidence and severity of stroke in aged women. We have previously shown that experimental stroke pathophysiology differs between young adult and aged rats. In the first study, we show that aged rats treated with 17beta-estradiol had significantly increased infarct volumes compared to placebo-treated aged rats. Young adult rats …

The Impartial Jury Clause of the Sixth Amendment requires that the venire from which the state and the defendant draw a twelve-person petit jury be a fair cross-section of the community. The Supreme Court announced a three-prong test in Duren v. Missouri to help courts determine whether there has been a Sixth Amendment violation: (1) whether a distinctive group in the community was excluded; (2) whether the venire was not a fair and reasonable representation of the county population as a whole; and (3) whether that underrepresentation was the result of systematic exclusion. Since the turn of the century, the Supreme Court has regulated noncapital sentencing under the Sixth Amendment in the Apprendi line of cases (requiring jury findings of fact to justify sentence enhancements) as well as under the Eighth Amendment in the Miller and Graham line of cases (forbidding mandatory life imprisonment for juvenile defendants). Although both lines of authority sound in individual rights, in fact they are fundamentally about the structures of criminal justice. The Effects Of Gender On Anxiety Sensitivity In Relation To Interoceptive Task Performances : An Exploratory Study., Brittany Deanne Miller

This study examined whether males or females have higher anxiety sensitivity, and how this may affect performance on interoceptive tasks. Females in this study, reported significantly higher rates of anxiety sensitivity than males, as measured by the Anxiety Sensitivity Index-3 (Taylor et al., 2007). No significant gender differences were found on either of two interoceptive sensitivity tasks, the Schandry Heartbeat Detection task (Schandry, 1981) and the Mindfulness Interoceptive Sampling Task (Dreeben, 2012). Results of this study suggest that, although females have higher self-reported anxiety sensitivity than males, this does not appear to either enhance or hinder their performance on interoceptive …
