"Cancer incidence continues to rise. Standard cancer management therapies are known to cause oral complications, such as mucositis (OM), that can range from mild to very severe. Severe OM can require interruption of treatment, and possibly hospitalization for IV rehydration, pain control, and nourishment. Utilizing good oral care practices during treatment has been shown effective to help limit severity and/or reduce duration of OM. Patient education on this concept, and on ideal products and self-care techniques are integral to patient implementation of supportive oral health practices. Unfortunately, patients may not receive comprehensive oral health education that promotes good oral health. …

"Invasive winter annual grass (IWAGs) abundance has increased throughout much of the western United States, with serious consequences for biodiversity and ecosystem function. While a variety of tools have been used to control IWAGS, they often fail to achieve the goal of creating a self-sustaining native plant community. Therefore, a major goal of my thesis has been to explore and test restoration approaches that might help realize such plant communities. These approaches include ecologically based invasive plant management (EBIPM) and assisted succession. "Although members in social sororities and fraternities have historically been praised for contributing to the development of leadership skills and striving for excellence, they have also been the target of negative stereotypes and prejudice (Barlow, 1996; Wells & Corts, 2008). The present study examined the effects of stereotype-consistent priming on stereotypes regarding sorority and fraternity members by using a 2 (experimenter gender: male, female) x 3 (t-shirt priming condition: Greek letter/stereotype-confirming, Greek letter only, or plaint-shirt) between subjects design. "Gratitude has often been called the "poster child" of positive psychology as a result of demonstrated links to a number of positive outcomes across diverse areas of life (Wood, Froh, & Geraghty, 2010). This study investigated four possible inhibitors of trait gratitude: cynicism, materialism/envy, indebtedness, and narcissism. The study sample consisted of upper-level undergraduate psychology college students from a university in eastern Washington. These potential inhibitors were measured, along with trait gratitude, at Time 1. Two months later, inhibitors and trait gratitude were once again measured. Partial correlational analyses were computed between Time 1 inhibitors and Time 2 gratitude while …

This study determined which kokanee stock performed best in Lake Roosevelt, WA: Lake Whatcom, Meadow Creek, or F1 mixed stock. The F1 mixed stock was created by collecting eggs from Lake Whatcom, Meadow Creek and non-marked kokanee that returned to Hawk Creek and raising them to the residualized smolt stage at the Spokane Tribal hatchery for release back into Lake Roosevelt. Fall spawning run data (2009 – 2012) were analyzed to assess the percentage and sex ratios of each stock returning to spawn in Lake Roosevelt. "Service-Learning (SL) is widely used in education today. Little is known about the use of SL pedagogy on dental hygiene students. SL in dental hygiene is an ideal teaching medium and use frequently; however, few studies have specifically studied if it is being done effectively. This study aimed to increase the knowledge available about SL in dental hygiene educational facilities and to discover if SL was being used appropriately in dental hygiene education. "Recommendations to alter the current dental coding system maintained by the American Dental Association (ADA) have been suggested by American Dental Education Association (ADEA), the American Dental Hygienists' Association (ADHA), and explored in various dental education and public health settings. However there is no research surveying dentists and dental hygienists in a regional format on what their opinions are concerning the current system and potential addition of diagnostic codes. "Foraging animals face decisions about when and where to forage based, in part, on prey availability, which can fluctuate temporally as well as spatially. For temperate insectivorous bats, wetlands are important forage habitats because they provide water and high abundances of insects. My overall objective was to identify abiotic and biotic factors that influence bat foraging activity over wetlands in the channeled scablands of eastern Washington. I surveyed 12 wetland sites at Turnbull National Wildlife Refuge (TNWR) in Cheney, Washington, 3 or 4 times during summer 2012. Although not often recognized, social justice education in the U.S. is historically and philosophically tied to the twentieth century's human rights initiatives. The efforts of human rights pioneers, such as those who authored the Universal Declaration of Human Rights, have indelibly shaped social justice efforts, including within education, in the U.S. Reframing social justice education in light of human rights gives clarity to and concretizes our work as social justice educators: It strengthens a vision of education as central to promoting rights and justice; it refocuses attention on a broader array of fundamental rights, and it explicitly contests our globalized …

Scholars and judges often say that the United States imported the shareholder derivative action from England, but that is not entirely accurate. What the United States imported from the English Court of Chancery was the necessary parties rule and its exceptions. During the 1800s, U.S. courts recognized an exception to the necessary parties rule that permitted representative lawsuits, but the contours of these actions differed from such actions in England. Today, these lawsuits would be classified as class actions and shareholder derivative actions in the United States. The shared history of these two forms of representative litigation has long been …

In contemporary Russia there is widespread support for the death penalty. Recent Russian presidents have endorsed the nation’s entry into the European Community (EC). The dilemma is that the price of membership into the EC is total abolition of capital punishment. The Russian Duma is much less popular than the president, even though it sides with public opinion in supporting capital punishment. Since 1997, these conflicting political positions have been temporarily neutralized by leaving capital punishment legislation in place but allowing the Russian president to offer clemency to all sentenced to death. Strange Traffic: Sex, Slavery & The Freedom Principle, Anders Walker

This article uses the recent prosecution of a sex trafficking case in rural Missouri to argue three points. One, the federal law of trafficking is currently being used in unanticipated ways, including the apprehension of individuals who pay for sex. Two, trafficking invites creative use precisely because it provides prosecutors with a more salient justification for punishment than either legal moralism or harm; a rhetorical plea to anti-slavery that enjoys a longstanding but under-theorized role in criminal law rhetoric. Three, anti-slavery’s recurrence in criminal law rhetoric underscores a larger doctrinal point, namely that H.L.A. Hart’s version of the harm principle …

This article recovers the plight of legal education during the Great Depression, showing how debates over practical training, theoretical research and the appropriate length of law school all emerged in the 1930s. Using Bramble Bush author Karl Llewellyn as a guide, it strives to make three points. One, Depression-era critics of law school called for increased attention to practical skills, like today, but also a more interdisciplinary curriculum – something current reformers discount. Two, the push for theoretical, policy-oriented courses in the 1930s set the stage for claims that law graduates deserved more than a Bachelor of Laws degree, bolstering …

The rise of human resources departments parallels the increase in the myriad statutory and regulatory requirements that govern the workplace. The Supreme Court's decisions in labor and employment law cases are largely monitored and implemented by HR professionals who must carry out these directives on a daily basis. This article looks at the Roberts Court's labor and employment law cases through the lens of human resources. In adopting an approach that is solicitous towards HR departments and concerns, the Roberts Court reflects a willingness to empower these private institutional players. This essay approaches the scholarship of the late Professor Larry Ribstein from a progressive vantage point. It argues that Ribstein's revolutionary work upended the "nexus of contracts" theory in corporate law and provided a potential alternative to the regulatory state for those who believe in worker empowerment and anti-cronyism. Progressive corporate law scholars should look to Ribstein's scholarship not as a hurdle to overcome, but as a resource to be tapped for insights about constructing a more egalitarian and dynamic economy.

Elder Mediation In Theory And Practice: Study Results From A National Caregiver Mediation Demonstration Project, Alexandra Crampton

Mediation is a process through which a third party facilitates discussion among disputing parties to help them identify interests and ideally reach an amicable solution. Elder mediation is a growing subspecialty to address conflicts involving older adults, primarily involving caregiving or finances. Mediation is theorized to empower participants but critics argue that it can exacerbate power imbalances among parties and coerce consensus. These contested claims are examined through study of a national caregiver mediation demonstration project. Study implications underscore the importance of gerontological social work expertise to ensure the empowerment of vulnerable older adults in mediation sessions.

Despite the continuing belief by a majority of Americans that the death penalty is morally permissible, the death penalty has few academic defenders. This lack of academic defenders is puzzling because of the strong philosophical justification the death penalty finds in traditional theories of punishment. The three major theories of punishment (the deterrent, the retributive, and the rehabilitative), far from showing that the death penalty is not justified, tend to provide good reasons to favor the death penalty. Indeed, every attempt to show that the major theories of punishment rule out the death penalty either involves smuggling in other assumptions …

States should have much broader authority to decline jurisdiction over federal claims. The normative considerations supporting this doctrine of “reverse abstention” have been developed in previous work. But what of the Constitution? The traditional reading, reflected in existing precedent, asserts that the Supremacy Clause, Article III, and perhaps Article I operate together to create an inflexible obligation for state courts to hear federal claims. This reading is misguided. The Supremacy Clause contains no jurisdictional obligation of its own force, but only gives supreme effect to other validly enacted federal laws. And no other clause provides the authority to impose such …

In the days after the 2012 presidential election, the pictures became drearily familiar: long lines at polling places from Election Day; people waiting four, five, even six hours in order to vote.1 The causes? Not enough polling booths. Not enough election workers. Voting machines that did not work, or were too old. Early voting days that were off, then on, then off again. The results? Confusion. In the language of cyberspace, introducing elements of fun or game-playing into everyday tasks or through simulations is known as the process of “gamification.” The idea that people could be working while they play a video game – in some instances without even knowing that they are working – is becoming part of our reality. Gamification is an important element of what in previous writing I have termed “virtual work,” that is, work that is taking place wholly online, in crowdsourcing arrangements, or in virtual worlds. What Brady V. N.F.L. Teaches About The Devolution Of Labor Law, Michael C. Duff

In this essay I argue that the Eight Circuit got things very wrong when it found, in Brady v. National Football League, that a district court’s injunctions issued against the NFL in connection with player-filed antitrust suits were barred by the Norris LaGuardia Act of 1932 (NLGA). I argue that the Court’s misreading of the NLGA strikes at the “statutory music” of labor law so dramatically as to represent a judicial unmooring from it. I chronicle other recent important, but relatively minor, judicial departures from the music. I also discuss a major but less recent departure – the employer lockout. …
