This Article examines the modern utility of the Second Amendment's guarantee of "the right to keep and bear arms" in light of the phenomenon of modern crime, particularly black-on-black violence in urban America. Although many advocates of gun control have argued that crime in modern cities is a reason for modifying or severely truncating the right to have arms, the Authors argue that the right to have arms and the Second Amendment's notion of a universal militia can be the basis of a new partnership between police and citizens in urban America. Antitrust law has been adopted by 120 jurisdictions worldwide. In more than half of these jurisdictions, the agency charged with enforcing antitrust law also has other responsibilities. The assignment of multiple regulatory tasks can affect the performance of a competition agency in complex and subtle ways. We present a framework for analyzing the consequences of creating public bodies with complex policy portfolios. Using examples from across the administrative state, we analyze the forces that shape the content of an agency’s policy duties, and how the portfolio of assigned duties affects the way an agency approaches its assigned tasks, and its …

The essay concerns one aspect of Justice Kennedy’s jurisprudence, namely, his use of some of the principal sources of the original meaning of the Constitution in his written opinions. By the term “sources of the original meaning of the Constitution,” I refer to the records from the Federal Constitutional Convention of 1787, the records of the state ratifying conventions, the Federalist Papers, dictionaries showing usage of language during the Founding period, and the acts of the First Congress. The article discusses the history of federal inroads into marriage by examining federal interventions during the nineteenth and early twentieth century, argues that, in some cases but not all, marriages' federal benefits are indeed intended to support natural procreation, argues that DOMA's underlying statutes are key to ascertaining the purposes of federal marriage benefits and burdens, distinguishes sexual orientation discrimination from race discrimination and offers a proposal for dealing with equal protection challenges to denials of marriage rights to same sex couples. Introduction: We quantified sub-maximal torque regulation during low to moderate intensity isometric hip flexion contractions in individuals with stroke and the associations with leg function. Methods: 10 participants with chronic stroke and 10 controls performed isometric hip flexion contractions at 5%, 10%, 15%, 20%, and 40% of maximal voluntary contraction (MVC) in paretic, non-paretic, and control legs. Results: Participants with stroke had larger torque fluctuations (coefficient of variation, CV), for both the paretic and non-paretic legs, than controls (Pr2 =0.45) and Berg Balance Score (r2=0.38). A current and major unanswered question is why the highly sensitive central CO2/H+ chemoreceptors do not prevent hypoventilation-induced hypercapnia following carotid body denervation (CBD). Because perturbations involving the carotid bodies affect central neuromodulator and/or neurotransmitter levels within the respiratory network, we tested the hypothesis that after CBD there is an increase in inhibitory and/or a decrease in excitatory neurochemicals within the ventrolateral medullary column (VMC) in awake goats. Microtubules for chronic use were implanted bilaterally in the VMC within or near the pre-Bötzinger Complex (preBötC) through which mock cerebrospinal fluid (mCSF) was dialyzed. It is my great pleasure to introduce the sixth volume of the College of Liberal Arts and Social Sciences’ “Creating Knowledge,” our undergraduate student scholarship and research journal. First published in 2008, the journal is the outcome of an initiative to enhance and enrich the academic quality of the student experience within the college. Through this publication, the college seeks to encourage students to become actively engaged in creating scholarship and research and gives them a venue for the publication of their essays.

Ventilator associated pneumonia is a common problem with the mechanically ventilated population. Mortality, hospital stay, and cost increase with ventilator associated pneumonia. The importance of tackling this problem has spurred an effort within the medical community to prevent the onset of VAP. Upon years of study, a basic bundle of care has been recommended by the IHI for implementation in the hospital so that the incidence of VAP would decrease. Literature has long suggested a correlation between family history and alcohol dependence; heredity plays a role in risk for alcohol dependence. To investigate the influence of the personality trait neuroticism as a moderating factor of the relationship between family history of alcohol dependence, and an individual’s alcohol consumption, analyses were conducted in the Fall 2011 Spit for Science cohort. Survey questions examined the binary variable of whether participants reported a family history of drinking problems, as well as the continuous variable measuring the number of alcoholic drinks participants had consumed in the past 30 days. Facebook is used by approximately 1.06 billion(Craig,2013) to keep in touch with family and friends. However, the question remains whether Facebook is helpful or harmful to people’s well being. According to a research study conducted by Gonzales and Hancock (2010), Facebook use enhances self-esteem by providing multiple opportunities for selective self-presentation through photos and personal details. Another research study by Twenge, Freeman and Campbell (2012) found that participants who spent time on social network sites endorsed more positive self-views. This essay focuses on this second set of issues arising out of the current discussion about the meaning and status of the term “original text.” Following a brief introduction to recent discussion, the essay will sketch usage of the term “original text” in the late nineteenth and twentieth centuries, assess proposals for de ning or indicating what it is that NT textual criticism is (or ought to be) attempting to recover, discuss some collateral issues associated with those proposals, and note the larger ideological context of the discussion.

In 2004, the Government of Western Australia introduced an inspection-type formal school registration process for Non-Government (Independent) Schools, fulfilling the legislative requirement of a new School Education Act of 1999 (Part 4, Sec.159). This formal school registration process featured twelve criteria that are used to evaluate the quality of education. The government claimed that it would ensure a good education for all students in Western Australian, including those students enrolled in Independent Schools. "This paper is concerned with the character of Darl Bundren and the repeated motif of madness in William Faulkner's As I Lay Dying. Possible psychiatric explanations for Darl's madness, including linguistic evidence for his psychotic breakdown, are explored. The paper does not agree with the critical use of words such as "insane" or "crazy" as the book itself questions the verity of such labels. Critical analyses concerning Darl tend to be sympathetic but use derogatory language when defending the character. The N-methyl-D-aspartate (NMDA) receptor has been shown to be one of the most important target sites of alcohol in the central nervous system. We and others have identified positions in the third and fourth membrane-associated (M) domains of both GluN1 and GluN2A subunits that influence alcohol sensitivity. In the structural model of the NMDA receptor based upon the related GluA2 receptor, the outward face of the M3 domain of one subunit type is oriented toward the M4 domain of the other subunit type. The oncogenic epithelial–mesenchymal transition (EMT) contributes to tumor progression in various context-dependent ways, including increased metastatic potential, expansion of cancer stem cell subpopulations, chemo-resistance and disease recurrence. One of the hallmarks of EMT is resistance of tumor cells to anoikis. This resistance contributes to metastasis and is a defining property not only of EMT but also of cancer stem cells. Here, we review the mechanistic coupling between EMT and resistance to anoikis. The discussion focuses on several key aspects. First, we provide an update on new pathways that lead from the loss of E-cadherin to anoikis resistance. We then discuss …

This study investigated carbon (C) storage and biomass in grasslands of West Virginia reclaimed surface minesites. Mine-related disturbance and subsequent reclamation may be an important component of C cycling. Biomass and C storage generally increased for the first five years after reclamation, but then declined, suggesting a nonlinear pattern to vegetation recovery. Plasmonic metal nanostructures offer a promising route to improve the solar energy conversion efficiency of semiconductors. Here we show that incorporation of a hematite nanorod array into a plasmonic gold nanohole array pattern significantly improves the photoelectrochemical water splitting performance, leading to an approximately tenfold increase in the photocurrent at a bias of 0.23 V versus Ag|AgCl under simulated solar radiation. Plasmon-induced resonant energy transfer is responsible for enhancement at the energies below the band edge, whereas above the absorption band edge of hematite, the surface plasmon polariton launches a guided wave mode inside the nanorods, with the nanorods acting …

Radio Continuum Observations Of Local Star-Forming Galaxies Using The Caltech Continuum Backend On The Green Bank Telescope, Katie Rabidoux, D. J. Pisano, Amanda A. Kepley, Kelsey E. Johnson, Dana S. Balser

We observed radio continuum emission in 27 local (D < 70 Mpc) star-forming galaxies with the Robert C. Byrd Green Bank Telescope between 26 GHz and 40 GHz using the Caltech Continuum Backend. We obtained detections for 22 of these galaxies at all four sub-bands and four more marginal detections by taking the average flux across the entire bandwidth. This is the first detection (full or marginal) at these frequencies for 22 of these galaxies. We fit spectral energy distributions (SEDs) for all of the four sub-band detections. For 14 of the galaxies, SEDs were best fit by a combination of thermal free-free and nonthermal synchrotron components. Eight galaxies with four sub-band detections had steep spectra that were only fit by a single nonthermal component. Using these fits, we calculated supernova rates, total number of equivalent O stars, and star formation rates within each ~23'' beam. For unresolved galaxies, these physical properties characterize the galaxies' recent star formation on a global scale. We confirm that the radio-far-infrared correlation holds for the unresolved galaxies' total 33 GHz flux regardless of their thermal fractions, though the scatter on this correlation is larger than that at 1.4 GHz. In addition, we found that for the unresolved galaxies, there is an inverse relationship between the ratio of 33 GHz flux to total far-infrared flux and the steepness of the galaxy's spectral index between 1.4 GHz and 33 GHz. This relationship could be an indicator of the timescale of the observed episode of star formation.

A range of factors has been identified that affect the temperature sensitivity (Q10 values) of the soil-to-atmosphere CO2 flux. However, the factors influencing the spatial distribution of Q10values within warm temperate forests are poorly understood. In this study, we examined the spatial variation of Q10 values and its controlling factors in both a naturally regenerated oak forest (OF) and a pine plantation (PP). Q10 values were determined based on monthly soil respiration (RS) measurements at 35 subplots for each stand from Oct. 2008 to Oct. 2009. Community detection in social networks plays an important role in cluster analysis. Many traditional techniques for one-dimensional problems have been proven inadequate for high-dimensional or mixed type datasets due to the data sparseness and attribute redundancy. In this paper we propose a graph-based clustering method for multidimensional datasets. This novel method has two distinguished features: nonbinary hierarchical tree and the multi-membership clusters. The nonbinary hierarchical tree clearly highlights meaningful clusters, while the multimembership feature may provide more useful service strategies. Experimental results on the customer relationship management confirm the effectiveness of the new method.
