Conde, Kelly, M.A., Spring 2013 Journalism The Damage Done Chairperson: Dennis Swibold The water that ran from Helen Ricker’s faucet stank of rotten eggs and of chemicals. It ran orange and greasy. It stained her clothes and clung to her skin. Ricker lives on the Fort Peck Indian Reservation, three miles north of Poplar, Mont. From Ricker’s home, the oil wells from the East Poplar oilfields can be seen in the distance. Her water started to change in the early 1970’s, twenty years after the first oil well was drilled. Geomorphological mapping is the attempt to depict the physical setting of the surface of the earth by mapping the landforms present and the processes responsible for their appearance, and is method that is practiced worldwide. Currently, there is no universally accepted legend for mapping the geomorphological features of all environments, though there have been several attempts made to develop such a legend. Instead, many different European nations have developed their own geomorphologic mapping legends for mapping the landscapes that exist within their national boundaries. In addition, certain countries have even developed highly specific geomorphologic mapping legends for specific geomorphologic environments. …

This thesis explores the potential for archaeological investigations of culturally modified trees (CMTs) in the northern Rocky Mountain region of Western Montana. Culturally modified trees are considered to be living artifacts, representations of traditional culture, and a lasting physical manifestation of long term use by inhabitants. The goal of this thesis is to offer an archaeological perspective for investigation of cultural modifications of the cedar basket tree (Thuja plicata), and to contribute to the development of a method for inquiry and analysis. The Ethnography Of On-Site Interpretation And Commemoration Practices: Place-Based Cultural Heritages At The Bear Paw, Big Hole, Little Bighorn, And Rosebud Battlefields, Helen Alexandra Keremedjiev

Using a memory archaeology paradigm, this dissertation explored from 2010 to 2012 the ways people used place-based narratives to create and maintain the sacredness of four historic battlefields in Montana: Little Bighorn Battlefield National Monument; Nez Perce National Historical Park- Bear Paw Battlefield; Nez Perce National Historical Park- Big Hole National Battlefield; and Rosebud Battlefield State Park. This research implemented a mixed-methods approach of four data sources: historical research about on-site interpretation and land management of the battlefields; participant observations conducted during height of tourism season for each battlefield; 1,056 questionnaires administered to park visitors; and 32 semi-structured interviews with …

Reconceiving Romantic Agency: A Question Concerning Its Extent, Richard Edward Swatek

This professional paper investigates and questions the extent to which romantic love is a matter of agency. Toward this end, I draw a distinction between two contrasting conceptions of romantic love—the “agent-external” conception and the “agent-centered” conception. In this paper I make the assumption that the agent-external conception is pervasive and commonplace in contemporary culture, and that it conceives of romantic love as being involuntary and without agency. My investigation then questions the accuracy of this agent-external conception by juxtaposing it with what I consider to be an agent-centered conception of romantic love. Responses To Climate Change In National Park Service Wilderness: What Is Happening In The Field?, Katherine E. Nelson

As scholars debate whether climate change warrants more or less active management in wilderness, this baseline study identifies what is happening on the ground. This study focuses attention on National Park Service units that administer designated wilderness. Representatives who had been identified by the superintendents from each of these units responded to an online survey (with a 94% response rate). Respondents reported on their concerns, monitoring, and management projects driven by climate change happening in their wilderness. Respondents also discussed whether and how these activities affected wilderness character. This is the first study to characterize the response to climate change …

Wild salmon and steelhead are as fundamental to the Pacific Northwest as evergreen trees and rain. For thousands of years ecosystems and economies have relied on the bountiful marine nutrients annually running inland from the Pacific Ocean in the form of large, silver fish. Even today, the chance to tangle with one of these wild gems is one of the greatest gifts the Northwest has to offer. Early settlers of the West Coast witnessed seemingly infinite salmon abundance. In the American judiciary system, it is imperative that judges act free of bias. Although this seems to be an easy-enough-to-understand theory, its practical application is not always so simple. As a result, there have been wide-ranging, unpredictable, and sometimes undesirable results. Others have noted the need for clearer recusal rules and guidelines. There have been various suggestions for how to improve or reform recusal rules, all of which note that there is a lack of standardized and predictable rules for when judges are required to recuse themselves. What happens when valid constitutional precedent, including precedent from our country’s highest court, is called into question in both fact and law? Such has been an increasingly familiar phenomenon in Canadian Charter jurisprudence. This is not necessarily surprising considering that the Charter is now over 30 years old and previous Charter issues once thought to be settled are starting to be relitigated in light of new social and legislative facts. It is amongst this backdrop that this paper considers, and makes attempts to disentangle, some of the thorny doctrinal issues associated with stare decisis and precedent in such situations. The …

Cost Of Admission: One Rubber Stamp - Evaluating The Significance Of Investigative Necessity In Wiretap Authorizations After R V Araujo, Jim Cruess

Dalhousie Journal of Legal Studies

The current application (or lack thereof in some cases) and review of investigative necessity in wiretap case law suggests that the Supreme Court of Canada's decision in R. v. Araujo is not being applied in spirit or in substance. Wiretaps represent a serious risk to the privacy of targets and their associates; they are indiscriminate in their acquisition of information. Recognizing the risk wiretaps pose to privacy, the Supreme Court of Canada directed in R. v. Araujo that the wiretap authorizing judge "should not view himself or herself as a mere rubber stamp"; rather he or she should closely examine …
