Close Encounters Of The Best Kind, Shannon Butler Jan 2013

Close Encounters Of The Best Kind, Shannon Butler

The Utah English Journal

Usually I slip into a student teacher’s class and pull my forms of checklist behaviors from my bag unnoticed. If I am introduced, students give an indifferent glance, then turn their attention back where it belongs. But this morning was different.

The Power Of Using Standards-Based Grading To Assess Student Writing, Whitney Weaver, Angela Hartley Jan 2013

The Power Of Using Standards-Based Grading To Assess Student Writing, Whitney Weaver, Angela Hartley

The Utah English Journal

Each year, like many language arts teachers across the state of Utah, we set out to effectively teach our students how to be good writers. Each time we discover exciting and engaging ways to teach writing in our classrooms. However, we have also found that even the best writing practices fall short in the absence of effective writing assessment. Standards-based grading has been, for us, the most successful tool for such assessments.

Standards-based grading is when a teacher creates specific and measurable learning goals to guide the curriculum, conducts frequent formative assessments of the students’ proficiency on these goals, and …

When Hypotheses Collide: Responding To Lyon And Minson’S “When Pages Collide”, Brant A. Gardner Jan 2013

When Hypotheses Collide: Responding To Lyon And Minson’S “When Pages Collide”, Brant A. Gardner

Interpreter: A Journal of Latter-day Saint Faith and Scholarship

At the end of 2012, Jack M. Lyon and Kent R. Minson published “When Pages Collide: Dissecting the Words of Mormon.” They suggest that there is textual evidence that supports the idea that Words of Mormon 12-18 is the translation of the end of the previous chapter of Mosiah. The rest of the chapter was lost with the 116 pages, but this text remained because it was physically on the next page, which Joseph had kept with him. In this paper, the textual information is examined to determine if it supports that hypothesis. The conclusion is that while the hypothesis …

Toward A Mormon Jurisprudence, John W. Welch Jan 2013

Toward A Mormon Jurisprudence, John W. Welch

Interpreter: A Journal of Latter-day Saint Faith and Scholarship

The following article was published in the Regent University Law Review in the first number of its 2008-2009 volume, pages 79-103. The article is reprinted here by permission without any substantive modifications. Because law reviews are not easily available on the Web or elsewhere to most readers, I am pleased to give wider exposure to this first foray into the idea of a Mormon jurisprudence. Regent University is an Evangelical Christian institution.

Book Review, Robert Boylan Jan 2013

Book Review, Robert Boylan

Interpreter: A Journal of Latter-day Saint Faith and Scholarship

Bart Ehrman’s works have long been known to Latter-day Saint scholars, including his studies that reveal presumably theologically driven corruptions to various biblical passages; 1 his analysis of writings that some early Christian communities privileged as authoritative, though they never became part of the biblical canon; as well as the diverse nature of early Christianity itself.2 Forgery and Counterforgery may well be another volume by Dr. Ehrman that will be referenced by both LDS and non-LDS interested in the question of alleged pseudepigraphic texts in the New Testament and early Christian literature.

Classifying Early Modern Sexuality: Christopher Marlowe, Edward Ii, And The Politics Of Sexuality, Michael John Lee Jan 2013

Classifying Early Modern Sexuality: Christopher Marlowe, Edward Ii, And The Politics Of Sexuality, Michael John Lee

Quidditas

This paper argues that Christopher Marlowe’s Edward II (1594) questions gender expectations and sexuality. The analysis finds that the same-sex attraction and affective relationship that develops between King Edward and Gaveston can be seen as neither simply sodomy nor exclusively as male friendship. Instead, the emotional bonds and marriage-like relationship between the king and his minion suggest that their identities are, in part, formed by their same-sex attraction.

The Anonymous Internet, Bryan H. Choi Jan 2013

The Anonymous Internet, Bryan H. Choi

Publications

This Article argues in favor of regulating online anonymity, not from the standpoint that doing so will prevent harmful abuses or improve security, but instead that refusing to do so will ultimately harm other liberty interests. One principle that has emerged from cyberlaw scholarship is that we should safeguard the Internet’s "generativity"— a key attribute representing the latitude and plasticity with which a technology (like the Internet) can be adapted to perform new, unanticipated uses—because generativity is the root source of the Internet’s unique vitality. Yet, if we want regulators to leave generativity alone, we must offer them another point …

Water Conservation In San Antonio, Tx: The Economics Of Water Pricing And The Effectiveness Of The Watersaver Landscape Rebate, Mark Wilkinson, Mitch Hagney, Yemi Idowu, Megan Miller Jan 2013

Water Conservation In San Antonio, Tx: The Economics Of Water Pricing And The Effectiveness Of The Watersaver Landscape Rebate, Mark Wilkinson, Mitch Hagney, Yemi Idowu, Megan Miller

Earth and Environmental Geosciences Student Works

We address the effort to decrease residential water use in San Antonio, Texas, because recent droughts have made water conservation a high priority there. Since the city’s water utility—the San Antonio Water System (SAWS)—maintains water prices below economically efficient levels, demand is outstripping supply. To address this problem, we apply microeconomic analysis to the utility’s residential water pricing structure and the drought restrictions it imposes. We make recommendations for incentivizing water conservation in high-volume consumers by increasing the progressivity of SAWS pricing policies. SAWS also offers water conservation rebates, such as the WaterSaver Landscape Rebate, whose effectiveness we analyze herein. …

Exploring The Future Of Friesenhahn Cave, Dylana Watford, Katherine Banick, Graham Bates, Tori Carey Jan 2013

Exploring The Future Of Friesenhahn Cave, Dylana Watford, Katherine Banick, Graham Bates, Tori Carey

Earth and Environmental Geosciences Student Works

Friesenhahn Cave in San Antonio, Texas, offers a wealth of paleontological artifacts. The cave is owned by Concordia University and is primarily managed by Dr. Laurence Meissner, professor of biology at Concordia. Since its discovery in the early twentieth century, researchers have discovered numerous Pleistocene fossils; aside from the La Brea Tar Pits in California, Friesenhahn Cave is the most Pleistocene fossil-rich site in the United States. Recently, little research has been conducted in the cave, though it is believed that many fossils remain to be discovered. We propose the establishment of the Friesenhahn Cave Foundation, a non-profit organization whose …

From Space-Off To Represented Space, Lolita Buckner Inniss

In Reimagining Equality: Stories of Gender, Race, and Finding Home, author Anita Hill explores some of the literal and figurative meanings of "home," focusing specifically on African-American women in their quest for home. Hill layers discussions of law, literature, and culture with stories of individual women, both historic and contemporary. In Reimagining Equality, Hill takes on a topic clearly distinct from the Clarence Thomas Senate confirmation hearings, the episode for which she is best known. Her work here is, nonetheless, evocative of her struggle in those hearings, because the book addresses the interrelation between gender, race, place, space, …

Value Conflicts In Psychotherapy, Aaron P. Jackson, Jamie Hansen, Juliann M. Cook-Ly Jan 2013

Value Conflicts In Psychotherapy, Aaron P. Jackson, Jamie Hansen, Juliann M. Cook-Ly

Issues in Religion and Psychotherapy

Psychotherapy has historically been viewed as value neutral; however, over the last half-century, developments have led many scholars to conclude that we can no longer dismiss the role of values in therapy. Our position is that therapists and clients will inevitably encounter value conflicts during the course of psychotherapy. This article postulates how such conflicts can be addressed so as to preserve and promote the integrity and well-being of both client and clinician. We review challenges to value neutrality and summarize ethical considerations. We discuss strategies to manage values in psychotherapy and conclude by recommending areas for consideration in professional …

Unintended Consequences: Lucas, The Public Trust Doctrine, And The Erosion Of Private Property Rights Under The Takings Clause, Timothy M. Bagshaw Jan 2013

Unintended Consequences: Lucas, The Public Trust Doctrine, And The Erosion Of Private Property Rights Under The Takings Clause, Timothy M. Bagshaw

Utah Law Review

This Note considers the relationship between the public trust doctrine and private property rights under the Takings Clause. Traditionally, the public trust doctrine vests authority in state governments to protect navigable waterways and related lands. But in recent years, state governments and state courts have begun to use the doctrine to achieve broader environmental ends. While increased environmental protection at the state level serves vital public interests, it is not an unambiguous good. Under current takings analysis, the public trust doctrine constitutes one of several affirmative defenses to just compensation liability; where state governments invoke the public trust doctrine, they …

Impact Of Climate Change On Occupational Health And Safety, Ariane Adam-Poupart, France Labrèche, Audrey Smargiassi, Patrice Duguay, Marc-Antoine Busque, Charles Gagné, Joseph Zayed Jan 2013

Impact Of Climate Change On Occupational Health And Safety, Ariane Adam-Poupart, France Labrèche, Audrey Smargiassi, Patrice Duguay, Marc-Antoine Busque, Charles Gagné, Joseph Zayed

In The U.S.: The Failure Of The Danish-American Folk High Schools Vs. The Success Of Highlander Folk, Zizanie Bodene-Yost

The Bridge

The folk high schools remain an important part of Danish culture over one hundred and fifty years after their birth. Although Denmark, and the world, is very different now than it was in the nineteenth century, this unique form of education is still an effective model. On the one hand, it would be a mistake to suppose that the folk high school cannot be relevant outside of the culture in which it originated. However, it would be equally wrong to suppose that the folk high school has not changed or evolved over time, or that it can be transplanted to …

Язык Текущего Момента: Понятие Нормы, Виталий Костомаров Jan 2013

Язык Текущего Момента: Понятие Нормы, Виталий Костомаров

Russian Language Journal

Hits And Misses In Teaching Russian In The Us: The Perspectives Of Instructors, Students, And Enrollment, Ludmila Isurin Jan 2013

Hits And Misses In Teaching Russian In The Us: The Perspectives Of Instructors, Students, And Enrollment, Ludmila Isurin

Russian Language Journal

In U.S. universities, interest in learning Russian as a foreign language has been relatively steady over the last 50 years. The so-called “Sputnik effect”―a surge of interest in the Russian language due to the launch of the first Soviet sputnik in 1957 and, as a result, the shocking revelation that the USSR might become a serious rival―is considered the beginning of a new era, during which Russian language programs were established at major American universities. The interest in learning Russian did not subside during Gorbachev’s Perestroika in the mid-1980s; neither did it weaken right after the collapse of the USSR …

Traditions And Transitions: Russian Language Teaching In The United States. In Celebration Of The Career Of Dr. Victorina Lefebvre, Jason Merrill, Lora Mjolsness

Russian Language Journal

In May 2012, the University of California, Irvine’s Humanities Language Learning Program hosted a symposium entitled Traditions and Transitions: Russian Language Teaching in the United States. The primary impetus for the meeting was to celebrate the distinguished career of our colleague, Dr. Victorina Lefebvre, who taught Russian language courses at University of California, Irvine since 1984. Her retirement in June 2012 meant the symposium was an opportunity to recognize and thank her for her unflagging decades of hard work for UC Irvine’s students. Victorina Lefebvre, who trained in the USSR in mathematics and physics education (M.A.) and in psychology (Ph.D.), …

Toward A Theory Of Interdisciplinarity: An Example Of Conceptual Integration/Blending In Teaching And Learning In Russian And East European Language-Based Area Studies, Anna Pleshakova, Kathleen M. Quinlan

Russian Language Journal

Most of problems in everyday and professional life are interdisciplinary, though most of our academic scholarship is contained within disciplines. To understand and solve such interdisciplinary problems, we must cross disciplinary boundaries. Yet, “the need to identify a method or/and logic of interdisciplinarity has, however, proven to be much easier to proclaim than to meet.”
