There Can Be No End Save Learning: Using Seminal U.S. Documents To Teach Fundamental Reading Skills, Michael Handy Jan 2013

There Can Be No End Save Learning: Using Seminal U.S. Documents To Teach Fundamental Reading Skills, Michael Handy

The Utah English Journal

The skill-based Common Core, as well as its Utah adaptation, raises the level of rigor required of students. The core focuses on skills that apply to literature and nonfiction of all kinds. A few standards name specific authors (Shakespeare’s name appears several times, for example), but the standards in general impose no prescribed list of works on teachers.

Yet Standard 9 of the Reading Standards for Informational Text curiously lists not only authors worthy of study, but specific works: “Analyze seminal U.S. documents of historical and literary significance (e.g., Washington’s Farewell Address, the Gettysburg Address, Roosevelt’s Four Freedoms speech, King’s …

Disclosure & Offer At Twenty-Five: Time To Adopt Policies To Promote Fairly Negotiated Compensation, Gabriel H. Teninbaum, Steve Kraman Jan 2013

Disclosure & Offer At Twenty-Five: Time To Adopt Policies To Promote Fairly Negotiated Compensation, Gabriel H. Teninbaum, Steve Kraman

Suffolk University Law School Faculty Works

In 1987, this article’s co-author (Dr. Kraman), with other hospital staff at the Lexington, Kentucky VA Medical Center, created the risk management method now known as "disclosure & offer." The Lexington VA's guiding principal was that patients injured by medical errors should be made whole without the need for litigation. Their process included advising patients to seek counsel and then negotiating fair compensation with the attorneys/patients. After 10 years, the Lexington VA group published a study revealing the success of their program in fairly compensating patients while reducing litigation costs. Today, disclosure & offer programs are a national phenomenon. Most …

A Tale Of Two Lawsuits, Gabriel H. Teninbaum, Benjamin R. Zimmermann Jan 2013

A Tale Of Two Lawsuits, Gabriel H. Teninbaum, Benjamin R. Zimmermann

Suffolk University Law School Faculty Works

Imagine two patients, Mal and Gary, are admitted to neighboring rooms in a Boston teaching hospital. While hospitalized, they both suffer serious injuries, but the mechanisms are different: Mal’s are caused by a drug interaction that her medical team knew, or should have known, would cause her injury when they delivered it to her. Gary’s injuries, by contrast, were caused by a contract maintenance worker who dropped a fixture on him while attempting to make a repair in the patient’s room.

Both patients have a right to bring claims for the negligence that injured them. Only Mal’s, however, will be …

State Wars - The Empire Strikes Back: The Federal/State Constitutional Power Confrontation, Steven Ferrey Jan 2013

State Wars - The Empire Strikes Back: The Federal/State Constitutional Power Confrontation, Steven Ferrey

Suffolk University Law School Faculty Works

A significant pending case will carve the contours of United States constitutional governance for the nation regarding our most important technology and its implementation and "will probably be determined by the U.S. Supreme Court.... 'These are the kind of issues that the Supreme Court likes. It's a federal preemption case; it's a landmark case.' " The attorney general concurs that he would "be surprised" if the case if not destined for the Supreme Court. This matter defines Constitutional federalism and the application of two important clauses of the United States Constitution: - The Constitution's Supremacy Clause, with specific application of …

Las Voces De America: Reflecting On Mari Matsuda's Voice, Stories, And Analysis, Margaret E. Montoya Jan 2013

Las Voces De America: Reflecting On Mari Matsuda's Voice, Stories, And Analysis, Margaret E. Montoya

Faculty Scholarship

Professor Matsuda's exhortation to listen to people of color was certainly heard and seized by people of color. It spoke to me personally and inspired me as I was writing my first article, Mascaras, Trenzas y Grerias. Once the multiracial group of scholars that took the name "LatCrit" organized ourselves, we deliberately and intentionally centered our annual conferences around listening to the voices at the bottom, including the local activists in the cities in which we met. We listened to such voices as both method and substance.

Scattered And Dissonant: The Clean Air Act, Greenhouse Gases, And Implications For The Oil And Gas Industry, Alex Ritchie

Faculty Scholarship

In the midst of a domestic oil and gas production revolution, the Environmental Protection Agency (EPA) has constructed a web of findings and regulations to control greenhouse gas (GHG) emissions from stationary sources under the auspices of the Clean Air Act. This Article explores the theoretical and practical implications for the oil and gas industry of EPA’s Clean Air Act GHG regulatory regime that, in light of congressional paralysis, will continue to expand beyond major new and modified oil and gas facilities such as refineries and natural gas processing plants. Future rulemakings directly aimed at the oil and gas industry …

Centre of Excellence in Women and Child Health

Introduction: Almost one-fifth of the world\'s population constitutes women of reproductive age who are repeatedly exposed to pregnancy and childbearing. Many are often at high risk of illness and mortality during pregnancy and require maternal healthcare services for early detection of complications. More than 0.5 million women die every year worldwide due to pregnancy-related complications. Almost 0.03 million of them are in Pakistan. Maternal healthcare in Pakistan is poor and results in high rates of morbidity and mortality. This paper evaluates the accessibility of antenatal care (ANC) services in primary healthcare settings in the Punjab province of Pakistan during the …

Turkish Journal of Zoology

Dichelyne minutus (Rudolphi, 1819) is a typical and widespread parasite of Gobiidae. In this research, histopathological changes in the intestinal wall of Neogobius bathybius (Kessler) (Actinopterygii: Gobiidae) due to infection caused by D. minutus were studied. The most heavily parasitized regions were excised for microscopic studies. Cross sections revealed different aspects of tissue defensive reactions due to the free movement of nematodes among the gut contents. Mucosal erosion, increased number of goblet cells, hyperplastic changes in the epithelial cells, and remarkable hyperplasia that formed nodule-like structures with hyperemia were observed in the submucosa. Focal necrosis and a thickened muscle layer …

Chromosomal Evolution Of The Genus Nannospalax (Palmer 1903) (Rodentia, Muridae) From Western Turkey, Ferhat Matur, Faruk Çolak, Tuğçe Ceylan, Murat Sevi̇ndi̇k, Mustafa Sözen

Turkish Journal of Zoology

We used 33 blind mole rats belonging to 10 different chromosomal races from 10 localities in western Turkey. We applied G- and C-banding techniques to compare chromosomal races as well as clarifying relationships between them. We discussed cytogenetic similarities and differences between chromosomal races. We concluded that 2n = 60C is the ancestor of the other chromosomal races. However, as a result of ongoing evolution processes 2n = 38 and 2n = 60K have become ancestors to chromosomal races on their peripherals. We discovered which rearrangements contribute to the evolution of such a complex chromosomal race system in a genus. …

First, Do No Harm: On Addressing The Problem Of Implicit Bias In Juror Decision Making, Jennifer K. Elek, Paula Hannaford-Agor

Faculty Publications

Courts have extremely limited opportunities to educate jurors about the pernicious effects of complex psychological phenomena like implicit bias and how these implicit forms of bias may distort jurors' interpretation of trial evidence. This article focuses on several of these interventions and the factors that may increase or undermine their effectiveness. Most Americans are aware of the existence of explicit bias and its effects on decision making generally, but implicit bias is still a relatively new concept about which many people in the justice system are unaware. The first section of this article discusses the difference between explicit bias and …

A Novel Multirobot Map Fusion Strategy For Occupancy Grid Maps, Sebahatti̇n Topal, İsmet Erkmen, Aydan Müşerref Erkmen Jan 2013

A Novel Multirobot Map Fusion Strategy For Occupancy Grid Maps, Sebahatti̇n Topal, İsmet Erkmen, Aydan Müşerref Erkmen

Turkish Journal of Electrical Engineering and Computer Sciences

In this paper, we consider the problem of merging partial occupancy grid environment maps, which are extracted independently by individual robot units during search and rescue (SAR) operations in icomplex disaster environments. Moreover, these maps are combined using intensity-based and area-based features without knowing the initial position and orientation of the robots. Our proposed approach handles the limitation of existing studies in the literature; for example, the limited overlapped area between partial maps of robots is enough for good merging performance and unstructured and complex partial environment maps can be merged efficiently. These abilities allow multirobot teams to efficiently generate …

A Bacterial Foraging Optimization Approach For Tuning Type-2 Fuzzy Logic Controller, Mohammad Kiani, Seyed Mohammad Ali Mohammadi, Ali Akbar Gharaveisi Jan 2013

A Bacterial Foraging Optimization Approach For Tuning Type-2 Fuzzy Logic Controller, Mohammad Kiani, Seyed Mohammad Ali Mohammadi, Ali Akbar Gharaveisi

Turkish Journal of Electrical Engineering and Computer Sciences

The type-1 fuzzy sets theory was proposed to handle uncertainty in control systems, but some cases showed some liabilities of type-1 fuzzy sets when faced with unpredictable disturbance and uncertainties. Therefore, type-2 fuzzy sets were introduced and extended while providing more degrees of freedom in designing criteria. The most important specification of type-2 fuzzy sets is the interval between a superior membership function and an inferior membership function, which is called the footprint of uncertainty. This paper presents a bacterial foraging optimization approach for optimizing the parameterized membership function. The above criterion is applied to an automatic voltage regulator system …

A Temporal Xml Data Model In Anaesthesia Information Systems, Oya Ünlü Duygulu, Taflan İmre Gündem

Turkish Journal of Electrical Engineering and Computer Sciences

Time information is an important aspect of a health information system. Health information cannot be represented and queried correctly without time in medical research, auditing, and medicolegal cases. Extensible Markup Language (XML) is being used in health information systems and has been formerly proposed as a data model for anaesthesia information systems. In this paper, we propose incorporating time into an XML model for anaesthesia information systems. A new storage structure and a temporal index structure are proposed in order to store temporal XML data and process time queries efficiently. In our proposed model, time has 4 dimensions: valid time, …
