Legal Positivism And Russell's Paradox, David G. Carlson Jan 2013

Legal Positivism And Russell's Paradox, David G. Carlson

Articles

In this Article, I argue that legal positivism is subject to the same paradox as was engendered by Frege's set theory-a paradox that has come to be known as Russell's Paradox. Basically, Frege tried to define what a set is. Russell showed that, because of self-reference, any attempt to define the word "set" led to formal condition. I argue that Russell's analysis can be applied to legal positivism, if "legal positivism" is defined to mean that a complete and closed rule of recognition for law is a logical possibility. I also argue that, to the extent legal positivism claims that …

Articles

What follows are my top four suggestions for judicial action and advocacy that can result in urgently needed and readily achievable reforms. Ass the American Judicature Society and its members consider their agenda and mission for the coming years, each of these issues deserves their support.

Evolving: Using Science Fiction To Engage Students In Evolutionary Theory, Chad Rohrbacher Jan 2013

Evolving: Using Science Fiction To Engage Students In Evolutionary Theory, Chad Rohrbacher

Publications

Evolutionary biology is not well-understood by a majority of the population. Many misperceptions and misconceptions exist as well as outright resistance to the theory. Various teaching and learning strategies have been tried in an attempt to involve students in exploring the theory, with mixed results. The use of science fiction to engage students in this area has been sparse, and virtually no quantitative assessment of learning with the method has been done. Using Origins, an anthology based on evolution, we created an interdisciplinary teacher’s resource manual that will be offered free to teachers. This paper examines some of the difficulties …

Academic And Social Barriers To Black And Latino Male Collegians' Success In Engineering And Related Stem Fields, Terrell Lamont Strayhorn, Leroy L. Long Iii, Joseph Allen Kitchen, Michael Steven Williams, Meg E. Stenz Jan 2013

Academic And Social Barriers To Black And Latino Male Collegians' Success In Engineering And Related Stem Fields, Terrell Lamont Strayhorn, Leroy L. Long Iii, Joseph Allen Kitchen, Michael Steven Williams, Meg E. Stenz

Publications

Historically underrepresented racial/ethnic minorities (i.e. African Americans, Latinos, and Native Americans) have experienced barriers to their success in engineering and related STEM fields. These student populations have had lower degree attainment rates, switch to non-STEM majors more frequently, and experience unique social challenges when compared to White and Asian Pacific Islander counterparts. To examine these findings, nearly 50 interviews were conducted and analyzed in the present study to better understand the academic and social experiences of African American and Latino American men in these fields. Interviews revealed that these students tend to (1) feel alone and invisible, (2) lack same …

Evaluation Of Ethical Issues In The Knowledge Age: An Exploratory Study, Leila Halawi, Richard V. Mccarthy Jan 2013

Evaluation Of Ethical Issues In The Knowledge Age: An Exploratory Study, Leila Halawi, Richard V. Mccarthy

Publications

Unethical information technology (IT) conduct is estimated to cost billions of dollars in deficits for enterprises. Included in this unethical behavior are issues associated with the knowledge age. Many IT ethics concerns do not have guidelines that are well recognized or broadly accepted. This study will explore the ethical perception of a diverse group of knowledge workers. It will also examine the effects of deterrents, individual factors and external variables to determine if there are noted differences in ethical perceptions that can be explained by these variables.

Students' Perceptions Of Student Evaluation Of Teaching (Set) Process, Ale J. Hejase, Rana S. Al Kaakour, Leila A. Halawi, Hussin J. Hejase

Publications

Researchers have mixed views about Student Evaluation of Teaching (SET) as means to evaluate teaching where some agreed and others viewed SET as being biased. This study aims to measure students’ perceptions of the effectiveness and appropriateness of the evaluation process in Lebanon. A survey questionnaire was administered to students from five Lebanese universities. Findings revealed that students were positive and perceived the evaluation process as effective and appropriate to evaluate teaching. Students identified students’ perceptions, instructors’ behavior, and course characteristics as variables that may impact the process. Results and implications were discussed for future research.

How Affordances Associated With A Distractor Object Affect Compatibility Effects: A Study With The Computational Model Tropicals., Daniele Caligiore, Anna M. Borghi, Domenico Parisi, Rob Ellis, Angelo Cangelosi, Gianluca Baldassarre Jan 2013

How Affordances Associated With A Distractor Object Affect Compatibility Effects: A Study With The Computational Model Tropicals., Daniele Caligiore, Anna M. Borghi, Domenico Parisi, Rob Ellis, Angelo Cangelosi, Gianluca Baldassarre

School of Psychology

Seeing an object activates both visual and action codes in the brain. Crucial evidence supporting this view is the observation of object to response compatibility effects: perception of an object can facilitate or interfere with the execution of an action (e.g., grasping) even when the viewer has no intention of interacting with the object. TRoPICALS is a computational model that proposes some general principles about the brain mechanisms underlying compatibility effects, in particular the idea that top-down bias from prefrontal cortex, and whether it conflicts or not with the actions afforded by an object, plays a key role in such …

Humour Styles, Personality And Psychological Well-Being: What’S Humour Got To Do With It?, W Ruch, S Heintz Jan 2013

Humour Styles, Personality And Psychological Well-Being: What’S Humour Got To Do With It?, W Ruch, S Heintz

School of Psychology

The Humor Styles Questionnaire (HSQ) by Martin et al. (2003) measures four humour styles, namely affiliative, self-enhancing, aggressive and self-defeating. In contrast to former humour instruments, the HSQ has strong relations to various measures of psychological well-being. However, its incremental validity in relation to basic personality traits has not been sufficiently studied. Two studies analysed how much unique variance the HSQ contributed to predicting psychological well-being over and above personality. While the affiliative, self-enhancing and self-defeating humour style were potent predictors of well-being in Study 1, the results also indicated that these humour styles had small effects when personality was …

Interactive Concept Acquisition For Embodied Artificial Agents, Joachim De Greeff Jan 2013

Interactive Concept Acquisition For Embodied Artificial Agents, Joachim De Greeff

School of Engineering, Computing and Mathematics Theses

An important capacity that is still lacking in intelligent systems such as robots, is the ability to use concepts in a human-like manner. Indeed, the use of concepts has been recognised as being fundamental to a wide range of cognitive skills, including classification, reasoning and memory. Intricately intertwined with language, concepts are at the core of human cognition; but despite a large body or research, their functioning is as of yet not well understood. Nevertheless it remains clear that if intelligent systems are to achieve a level of cognition comparable to humans, they will have to posses the ability to …

Self Organisation And Hierarchical Concept Representation In Networks Of Spiking Neurons, Timothy Rumbell Jan 2013

Self Organisation And Hierarchical Concept Representation In Networks Of Spiking Neurons, Timothy Rumbell

School of Engineering, Computing and Mathematics Theses

The aim of this work is to introduce modular processing mechanisms for cortical functions implemented in networks of spiking neurons. Neural maps are a feature of cortical processing found to be generic throughout sensory cortical areas, and self-organisation to the fundamental properties of input spike trains has been shown to be an important property of cortical organisation. Additionally, oscillatory behaviour, temporal coding of information, and learning through spike timing dependent plasticity are all frequently observed in the cortex. The traditional self-organising map (SOM) algorithm attempts to capture the computational properties of this cortical self-organisation in a neural network. As such, …

Marriage Equality, Gender Equality, And The Women's Convention, Barbara Stark Jan 2013

Marriage Equality, Gender Equality, And The Women's Convention, Barbara Stark

Hofstra Law Faculty Scholarship

"Marriage equality" remains an elusive goal in this country. About ten years ago I wrote an article suggesting that private ordering would be a good alternative to the rather haphazard and arbitrary state law governing marriage. Instead, I urged couples to draft their own "marriage proposals." As an example, I attached a "Gender Equity Marriage Proposal." The idea was that "gender equity" might be of some interest to some couples, just as others might be more concerned with a child-centered (or wealth- or environment-centered) model.

I meant well. But my premise was deeply flawed for at least two reasons. First, …

Hedonic Trademarks, Irina D. Manta Jan 2013

Hedonic Trademarks, Irina D. Manta

Hofstra Law Faculty Scholarship

A number of scholars have recently critiqued the traditional search-costs model of trademark infringement doctrine and have proposed alternatives driven by consumer decision-making theories and contractarian understandings of trademarks. While I agree that the search-costs model is problematic in parts, some of the other suggested frameworks suffer from difficulties of their own. For one, these alternative approaches draw up a dichotomy between “pure” experiences of trademarked goods as opposed to “altered” experiences, with the latter representing the mindsets of consumers after trademark owners have influenced them via advertising and other devices in an effort to build up goodwill. This Article …

Slaves To Contradictions: 13 Myths That Sustained Slavery, Wilson Huhn Jan 2013

Slaves To Contradictions: 13 Myths That Sustained Slavery, Wilson Huhn

Akron Law Faculty Publications

People have a fundamental need to think of themselves as “good people.” To achieve this we tell each other stories – we create myths – about ourselves and our society. These myths may be true or they may be false. The more discordant a myth is with reality, the more difficult it is to convince people to embrace it. In such cases to sustain the illusion of truth it may be necessary to develop an entire mythology – an integrated web of mutually supporting stories. This paper explores the system of myths that sustained the institution of slavery in the …

Til Recession Do Us Part: Booms, Busts, And Divorce In The United States, Abdur Chowdhury

Economics Faculty Research and Publications

A general hypothesis regarding the impact of permanent income levels and business cycle fluctuations on divorce rate at the state level in the United States is analysed in this article. Based on the data for 45 states over the sample period of 1978–2009, it is shown that the higher the level of transitory income, the higher the incidence of divorce. In other words, divorce is pro-cyclical.

Second Language Learnerhood Among Cross-Cultural Field Workers, Thor Andrew Sawin Jan 2013

Second Language Learnerhood Among Cross-Cultural Field Workers, Thor Andrew Sawin

Theses and Dissertations

This dissertation studies second language learnerhood (ideologies about why and how to acquire a target language) among American field workers of a multinational, faith-based development organization, "Love the World". This organizational ethnography is longitudinal, tracking how learnerhood changes across the first years of field service. It is also multi-sited, tracing learnerhood across an assemblage of interconnected nodes. Field workers' learnerhoods are shaped by two larger ideologies of language learning which interact across the nodes of and individual trajectories through Love the World. One ideology, rooted in academic tradition, developmental second language acquisition and modernist missiological theory, valorizes the individual learner …

Prevention Of Skin Breakdown In The Pediatric Intensive Care Unit, Lydia H. Palmer Jan 2013

Prevention Of Skin Breakdown In The Pediatric Intensive Care Unit, Lydia H. Palmer

Theses and Dissertations

Skin breakdown occurs when one or more layers of the skin have been disrupted (McLane et al., 2004; National Pressure Ulcer Advisory Panel, 2007). While some literature uses the terms skin breakdown and pressure ulcer interchangeably, these are actually two distinct conditions and pressure ulcers are encompassed in the definition of skin breakdown (Kuller, 2001; Lund, 1999; Suddaby et al., 2006). The consequences of skin breakdown in the pediatric population can include increased cost of treatment, infection, increased morbidity and mortality as well as psychological consequences from resulting alopecia or scarring (Schindler, 2010; Willock & Maylor, 2004). Development of skin …

The Role Of The Trickster Figure And Four Afro-Caribbean Meta-Tropes In The Realization Of Agency By Three Slave Protagonists, David Sebastian Cross Jan 2013

The Role Of The Trickster Figure And Four Afro-Caribbean Meta-Tropes In The Realization Of Agency By Three Slave Protagonists, David Sebastian Cross

Theses and Dissertations

In this dissertation, I aim to demonstrate that the figure of the trickster is a key trope for the achievement of agency by the narrators of the three slave narratives Autobiografia de un esclavo, "Routes in North Africa by Abu Bekr es siddik" [sic], and Biografia de un cimarron. I also intend to show how both the realization of the trickster's role and the achievement of agency to which such a role is oriented are dependent on the use of the four Afro-Caribbean meta-tropes ndoki, nkisi, nganga, and simbi. To demonstrate this, I plan to analyze these four meta-tropes; their …

The purpose of this study is to test Gordon Allport's theory of Contact Hypothesis about cultural attitude change in college students. Participants were college First year students participating in First year seminar classes in a small southeastern liberal arts university. The treatment group of randomly selected First year seminar classes was exposed to a one-week seminar designed to address the issue of cultural diversity. A non-treatment group received the standard instruction on this issue. The content of the seminar included exposure to multicultural issues that include Allport's most important tenants for changing prejudicial attitudes. For this study components of Allport's …

School Counselors' Perceptions Of Their Role In Assisting Students With College Preparedness, Tabatha Mcallister Jan 2013

School Counselors' Perceptions Of Their Role In Assisting Students With College Preparedness, Tabatha Mcallister

Theses and Dissertations

Access to quality precollege counseling is a crucial component of students' post-secondary educational planning. High school counselors provide educational planning and guidance to students which make them a valuable commodity to obtain information for students contemplating their postsecondary options (Hoyt, 2001). School counselors are situated as the focal point for students and their parents to obtain the information needed for academic and financial college preparedness. The research problem was ascertaining a descriptive definition of the elements that comprise the roles of the school counselor in student post-secondary preparedness. As well as determining if there are factors that enhance or inhibit …

An Examination Of Middle School Counselors' Comfort With Technology, Patricia Christina Roddy

Theses and Dissertations

The purpose of the current study was to investigate the differences in comfort with technology in middle school counselors in South Carolina. The researcher’s goal was to determine the effects of years of experience, technology training, gender, and age on middle school counselors’ comfort with technology.

After a review of literature, it was determined that this study was warranted to determine middle school counselors’ comfort with technology. As technology progresses, it is critical that school counselors are appropriately trained to utilize technology in their work. Their comfort levels with technology should be as strong as their ability to use a …

Professional Conversations About Race, Culture And Language In Early Childhood Literacy Education: An Administrator's Journey, Sabina Maria Mosso-Taylor Jan 2013

Professional Conversations About Race, Culture And Language In Early Childhood Literacy Education: An Administrator's Journey, Sabina Maria Mosso-Taylor

Theses and Dissertations

Year after year, children of Color, speakers of languages other than English, and children of poverty are served less well in public schools then their White, middle-class peers. The lives of children from White, middle-class homes are regularly normalized as they are described by teachers, administrators, policy makers, and educational programs as those with the most worth and knowledge. In all too many settings, cultures and languages outside this narrowly-defined norm are perceived from deficit perspectives. This hierarchy perpetuates a status quo that privileges and therefore supports the success of some, while devaluing and contributing to the failure of others. …
