Reflections On Contracts In The Real World: History, Currency, Context, And Other Values, Lawrence A. Cunningham Dec 2013

Reflections On Contracts In The Real World: History, Currency, Context, And Other Values, Lawrence A. Cunningham

Washington Law Review

It is gratifying to read that this symposium issue of the Washington Law Review was stimulated by Contracts in the Real World. Thanks to the editors for the opportunity to ruminate on the place of the book’s approach—stressing context through stories—in the tradition of contracts pedagogy. To that end, Part I first pinpoints relevant historical milestones in the field of contracts casebooks. Building on that historical grounding, Part II then highlights the values of currency and context that the stories approach epitomizes. Turning more speculative, Part III considers the value of this approach from the perspective of the purpose …

Evidence, John E. Hall Jr., W. Scott Henwood, Alex Battey

Mercer Law Review

This year's Survey of evidence finds us in a unique position. The overhaul of the Georgia Evidence Code (Evidence Code) went into effect on January 1, 2013. Therefore, appellate cases continue to emerge that interpret and apply the former rules, providing insight and raising questions about how the new rules have changed the face of evidence in Georgia. This Survey highlights cases decided by the Georgia Court of Appeals and the Georgia Supreme Court between June 1, 2012 and May 31, 2013, that illustrate this tension between the old and new rules of evidence. These cases are presented alongside other …

On The Biophysics And Kinetics Of Toehold-Mediated Dna Strand Displacement, Bernard Yurke Dec 2013

On The Biophysics And Kinetics Of Toehold-Mediated Dna Strand Displacement, Bernard Yurke

Electrical and Computer Engineering Faculty Publications and Presentations

Dynamic DNA nanotechnology often uses toehold-mediated strand displacement for controlling reaction kinetics. Although the dependence of strand displacement kinetics on toehold length has been experimentally characterized and phenomenologically modeled, detailed biophysical understanding has remained elusive. Here, we study strand displacement at multiple levels of detail, using an intuitive model of a random walk on a 1D energy landscape, a secondary structure kinetics model with single base-pair steps and a coarse-grained molecular model that incorporates 3D geometric and steric effects. Further, we experimentally investigate the thermodynamics of three-way branch migration. Two factors explain the dependence of strand displacement kinetics on toehold …

Short-Term Inflation Forecasting Models For Nigeria, Sani I. Doguwa, Sarah O. Alade Dec 2013

Short-Term Inflation Forecasting Models For Nigeria, Sani I. Doguwa, Sarah O. Alade

CBN Journal of Applied Statistics (JAS)

Short-term inflation forecasting is an essential component of the monetary policy projections at the Central Bank of Nigeria. This paper proposes four short-term headline inflation forecasting models using the SARIMA and SARIMAX processes and compares their performance using the pseudo-out-of-sample forecasting procedure over July 2011 to September 2013. According to the results the best forecasting performance is demonstrated by the model based on the all items CPI estimated using the SARIMAX model. This model is, therefore, recommended for use in short-term forecasting of headline inflation in Nigeria. The forecasting performance up to eight months ahead, of the models based on …

How Global Is Globalization?, Jac C. Heckelman, Andrew T. Young Dec 2013

How Global Is Globalization?, Jac C. Heckelman, Andrew T. Young

Economics Faculty Working Papers Series

We examine a balanced panel of globalization indices for 129 countries over the years 1991- 2010. We report evidence of cross-country sigma convergence in the overall globalization index. Sigma convergence also holds for each of the economic, political, and social globalization indices, as well as each sub-index within these indices. However, the evidence for stochastic convergence, based on panel unit root tests, is only strong for the political globalization index. Regarding the economic and social dimensions of globalization, respectively, we find evidence for stochastic convergence only in the flows and cultural proximity sub-indices. For the OECD subsample, evidence supports stochastic …

The True Value Of A Law Degree, Or, Why Did Thurgood Marshall Go To Law School?, R. Lawrence Dessem, Gregory M. Stein Dec 2013

The True Value Of A Law Degree, Or, Why Did Thurgood Marshall Go To Law School?, R. Lawrence Dessem, Gregory M. Stein

Faculty Publications

There has been vigorous debate in recent months over whether a law degree is a worthwhile investment. Much of this discussion has focused on whether the economic costs of obtaining a degree pay off over a lawyer’s career. This conversation has largely overlooked the many non-economic benefits of a law degree. In this essay, we seek to re-introduce several non-economic factors back into this important dialogue. We suggest that prospective law school applicants would be wise to consider these non-economic factors in addition to economic ones.

Coastal And Marine Spatial Planning (Cmsp): An Ecosystem Based Approach To Conservation And Management In Long Island Sound, Christine Ann O'Connell Dec 2013

Coastal And Marine Spatial Planning (Cmsp): An Ecosystem Based Approach To Conservation And Management In Long Island Sound, Christine Ann O'Connell

Stony Brook Theses and Dissertations Collection, 2006-2020 (closed to submissions)

Past approaches to ocean management in the United States are no longer sustainable because they were largely reactionary and applied in a piecemeal fashion. A more comprehensive ecosystem-based approach is needed. Ocean policy and management practices should be defined by ecological boundaries, not political ones, and should incorporate all elements and processes in the system, including human uses. Thus, a regional, multi-objective plan, such as coastal and marine spatial planning (CMSP), that addresses the cumulative impacts of current and future environmental stressors, is essential. Coastal and marine spatial plans separate conflicting uses in marine environments based upon an established community …

Prey Plasticity Responses To A Native And Nonnative Predator, Alexandra Hooks Dec 2013

Prey Plasticity Responses To A Native And Nonnative Predator, Alexandra Hooks

Stony Brook Theses and Dissertations Collection, 2006-2020 (closed to submissions)

Phenotypic plasticity in response to environmental stimuli is exceedingly common across systems and taxa. For instance, predation risk in many gastropods can induce a variety of defenses including growing thicker shells, growing shells of different shapes, and developing apertural teeth. However, the role of coevolution between species that produce these defense responses and their consumers is not well known. This thesis examines the responses of an ovoviviparous gastropod (Littorina saxatilis) with low dispersal from three different habitats (marsh habitat, rocky habitat, and cobble stone habitat) to the presence of chemical cues from a native (Dyspanopeus sayi) and nonnative (Hemigrapsus sanguineus) …

The Population Ecology Of The Spiny Dogfish In The Northeast (Us) Shelf Large Marine Ecosystem: Implications For The Status Of The Stock, Skyler Rose Sagarese Dec 2013

The Population Ecology Of The Spiny Dogfish In The Northeast (Us) Shelf Large Marine Ecosystem: Implications For The Status Of The Stock, Skyler Rose Sagarese

Stony Brook Theses and Dissertations Collection, 2006-2020 (closed to submissions)

In this dissertation, statistical and modeling approaches were undertaken to increase the knowledge of spiny dogfish distribution, habitat, and population dynamics including: (1), environmental preference (2), habitat modeling (3), assessing diel variation in survey catchability of spiny dogfish and key prey species and (4), elucidating how spiny dogfish distributional shifts influenced their availability to commercial fisheries. For objective (1), I estimated habitat preference for neonate (total length, TL <= 26 cm), immature (male: 26 cm < TL < 60 cm; female: 26 cm < TL < 80 cm), and mature (male: TL >= 60 cm; female: TL >= 80 cm) spiny dogfish using Northeast Fisheries Science Center (NEFSC) annual bottom trawl survey data from 1963 through 2009. Preferences were compared between dogfish stages to …

Nanoindentation Of Piezoelectric Materials, Guang Cheng Dec 2013

Nanoindentation Of Piezoelectric Materials, Guang Cheng

Stony Brook Theses and Dissertations Collection, 2006-2020 (closed to submissions)

Piezoelectric materials, with their unique electromechanical coupling characteristics, have found widespread use in many applications as sensors and actuators. With a continuing demand for macroscale piezoelectric devices with better performance characteristics, numerous efforts have been made to synthesize " bulk" monolithic and composite piezoelectric materials with better properties. More recently, within the context of microscale devices such as smart MEMS, self-powered sensors, microbatteries, and energy harvesting devices, there is a growing interest in developing " thin-film" piezoelectric materials. While, advances in microfabrication technology have greatly helped the synthesis and fabrication of piezoelectric thin films and structures, there is a continuing …

Study On Improvement Of Plasma Etch Resistance Of Photo Resists And E-Beam Resists By Sequential Infiltration Synthesis, Xianghai Meng Dec 2013

Study On Improvement Of Plasma Etch Resistance Of Photo Resists And E-Beam Resists By Sequential Infiltration Synthesis, Xianghai Meng

Stony Brook Theses and Dissertations Collection, 2006-2020 (closed to submissions)

Deep etch is always a challenge in semiconductor industry due to the requirement of high selectivity and fidelity for the process. Atomic layer deposition (ALD) is a new thin film deposition technique which is self-limiting and provides excellent conformality and reproducibility. Other than the application of deposition, ALD also provides an approach which operates at semi-static mode to modify the characteristic of the bulk of resist, which will render a high resistance to plasma etch as well as sidewall protection. In this research, etching resistance of two types of e-beam resists and two types of photoresists is treated by sequential …

Thermal Homeostasis In Buildings (Thib): Radiant Conditioning Of Hydronically Activated Buildings With Large Fenestration And Adequate Thermal Mass Using Natural Energy For Thermal Comfort, Peizheng Ma

Stony Brook Theses and Dissertations Collection, 2006-2020 (closed to submissions)

" Living" buildings, like living bodies, seek to maintain stable internal environments while the external surroundings keep on changing. In biology, the " stable internal environment" is called homeostasis. This dissertation focuses on thermal homeostasis in buildings. In a homeostatic building, adequate thermal mass is applied to keep indoor temperature varying within a small range; natural energy is harnessed to maintain indoor temperature at a comfortable level using lower-power equipment (lowPE); hydronic radiant conditioning system is employed to distribute heat or coolness effectively to avoid over-heating or over-cooling; and large fenestration is designed for aesthetics, natural lighting and solar gain. …

Structural Characterization Of Individual Domains Of An Energy Dependent Mitochondrial Protease, Faiza Sheikh Dec 2013

Structural Characterization Of Individual Domains Of An Energy Dependent Mitochondrial Protease, Faiza Sheikh

Stony Brook Theses and Dissertations Collection, 2006-2020 (closed to submissions)

The ATP- dependent i-AAA protease pulls in and unwinds improperly folded and short-lived membrane proteins in order to maintain the integrity of the mitochondrial inner membrane. The i-AAA protease consists of an N-terminal domain, a single trans-membrane domain, a AAA ATPase domain and a metalloprotease domain. The role of the AAA domain is to unfold and translocate targeted proteins to protease domain where they are degraded. To further our understanding of the mechanism of this important enzyme, I sought to isolate and gain structural information on the individual domains of the i-AAA protease from the thermophilic eukaryote Myceliophthoya thermophile. I …

Synthesis And Preliminary Biological Screening Of Bis-Aroyl Methanes And Chemically-Modified Curcumins As Matrix Metalloproteinse Inhibitors, Yijun Chen Dec 2013

Synthesis And Preliminary Biological Screening Of Bis-Aroyl Methanes And Chemically-Modified Curcumins As Matrix Metalloproteinse Inhibitors, Yijun Chen

Stony Brook Theses and Dissertations Collection, 2006-2020 (closed to submissions)

Matrix Metalloproteinases (MMPs) are a family of more than 25 structurally-related enzymes that can degrade a variety of substances including collagen. Basal levels of these enzymes play an important role in tissue turnover under normal physiological conditions, while excessive levels of these enzymes may cause or exacerbate many diseases related to tissue loss, including arthritis, cancer, cardiovascular disease, coma, periodontal disease, stroke etc. For decades, research teams from both industrial companies and academic institutions have been trying to develop an effective matrix metalloproteinase inhibitor as a drug to treat MMP-involved diseases. Our group have been working on MMP inhibitor development …

Systematic Modeling And Characterization Of Analog Circuits Using Symbolic And Data Mining Techniques, Cristian Ferent Dec 2013

Systematic Modeling And Characterization Of Analog Circuits Using Symbolic And Data Mining Techniques, Cristian Ferent

Stony Brook Theses and Dissertations Collection, 2006-2020 (closed to submissions)

Analog circuit design activities mainly depend on designers' expertise and their ability to produce new designs by combining basic devices, sub-circuits, and ideas from similar solutions as the source for innovation. There are very few systematic methods that can characterize similarities and differences between analog circuits while maintaining the correlation between design variables, performance, and trade-offs. Moreover, many computer-aided design tools are focused only on routine tasks, like transistor sizing and layout design. This dissertation presents novel techniques to automatically characterize the analog design space based on feature uniqueness and variety and to perform systematic circuit comparisons using symbolic models. …

The Significance Of Famously Queer Writers In The Book Of Salt And The Hours, Caitlin Nelson Dec 2013

The Significance Of Famously Queer Writers In The Book Of Salt And The Hours, Caitlin Nelson

Stony Brook Theses and Dissertations Collection, 2006-2020 (closed to submissions)

Monique Truong's The Book of Salt and Michael Cunningham's The Hours include fictional portrayals of famous writers who interact with similarly queer protagonists. These writers, Gertrude Stein, Alice B. Toklas and Virginia Woolf, are significant because of their reputations as iconic queer figures. Stein and Toklas are remembered as a progressive lesbian couple; Woolf is celebrated as an influential feminist writer. While initially it would seem that the protagonists and the writers could unite based on a shared queer identity, the novels imply that the hierarchies that are prevalent in these queer communities prevent the characters from becoming allies. Such …
