Law As Shield, Law As Sword: The Icc’S Lubanga Decision, Child Soldiers And The Perverse Mutualism Of Participation, Chris Jenks Oct 2013

Law As Shield, Law As Sword: The Icc’S Lubanga Decision, Child Soldiers And The Perverse Mutualism Of Participation, Chris Jenks

University of Miami National Security & Armed Conflict Law Review

The International Criminal Court’s Lubanga decision has been hailed as a landmark ruling heralding an end to impunity for those who recruit and employ children in armed conflict and a pivotal victory for the protection of children. Overlooked amidst this self-‐congratulation is that the ICC incorrectly applied the law governing civilian participation in hostilities which perversely places child soldiers at greater risk of being attacked. The Court created a false distinction between active and direct participation in hostilities. Expanding the kinds and types of behaviors that constitute children actively participating in hostilities expanded Lubanga¹s liability. But under the law of …

Citizen Engagement In The Shrinking City: Toward Development Justice In An Era Of Growing Inequality, Barbara L. Bezdek Oct 2013

Citizen Engagement In The Shrinking City: Toward Development Justice In An Era Of Growing Inequality, Barbara L. Bezdek

Faculty Scholarship

What are the aims of the revitalization conducted by local officials: for which social goods? Good for whom? By what means can the city’s people understand and influence the tradeoffs made by their government in the redevelopment of city blocks already occupied by residents. This is more than a matter of development finance or physical redevelopment. It is a question of social justice, of whose reality counts in the legal process utilized to reach development decisions and approve significant public subsidy for the projects that are remaking American cities.

Sherry Arnstein, writing in 1969 about citizen involvement in planning processes …

Breaking The Cycle Of Maltreatment: The Role Of Safe, Stable, And Nurturing Relationships, Terence P. Thornberry, Kimberly L. Henry, Carolyn A. Smith, Timothy O. Ireland, Sarah J. Greenman, Rosalyn D. Lee

College of Liberal Arts All Faculty Scholarship

Purpose

We examine two research questions. First, does a history of child maltreatment victimization significantly increase the likelihood of maltreatment perpetration during adulthood? Second, do safe, stable, and nurturing relationships (SSNRs) during early adulthood serve as direct protective factors, buffering protective factors, or both to interrupt intergenerational continuity in maltreating behaviors?

Methods

Data come from the Rochester Youth Development Study that followed a community sample from age 14 to 31 with 14 assessments. Maltreatment victimization records covering birth through age 17 were collected from Child Protective Services records as were maltreatment perpetration records from age 21 to 30. Data on …

Pseudo Newsgathering: Analyzing Journalists’ Use Of Pseudo-Events On 'The Wire', Patrick Ferrucci, Chad Painter Oct 2013

Pseudo Newsgathering: Analyzing Journalists’ Use Of Pseudo-Events On 'The Wire', Patrick Ferrucci, Chad Painter

Communication Faculty Publications

This textual analysis examines the role of pseudo-events in the newsgathering process depicted on season five of The Wire. The researchers found that the press and sources construct “reality”; sources present “masks” to conceal “reality”' and journalists acknowledge the absurdity of pseudo-events but cover staged events as genuine news. The overriding conclusion is that journalists fail citizens by constructing a false reality through a negotiation with powerful sources who are media- savvy enough to control depictions. These findings are then interpreted through the lens of cultivation theory.

The Exploitation And Trafficking Of African Youth Soccer Players In Their Pursuit For Soccer Stardom, Christopher Guido Oct 2013

The Exploitation And Trafficking Of African Youth Soccer Players In Their Pursuit For Soccer Stardom, Christopher Guido

Sport Management Undergraduate

My topic will look at the issue of unlicensed soccer academies in Africa and how they exploit the families of kids with dreams of traveling to Europe and playing for major soccer clubs like Manchester United and Real Madrid. Before looking at this specific issue, the larger picture of human trafficking must be looked at as to why it happens in the first place. Looking at current laws and looking at their effectiveness of decreasing trafficking. Human trafficking awareness is the underlying goal because if people don’t know about the issue, no one will do anything about it.

Update On Geospatial Patterns Of Antecedent Behavior Among Perpetrators In The American Terrorism Study (Ats), Brent L. Smith, Paxton Roberts, Kelly Damphousse

Research Projects

As part of the Terrorism and Extremist Violence in the United States (TEVUS) database integration effort, researchers at the Terrorism Research Center in Fulbright College at the University of Arkansas and the University of Oklahoma have been adding: 1) federal terrorism court cases and associated data and 2) incident and antecedent geospatial data from these court cases to the American Terrorism Study (ATS). The goal of the project is to examine geospatial patterns in perpetrator behavior and determine if the patterns identified in earlier studies have changed significantly. The ATS allows examination of a number of different units of analysis. …

The Indefinite Quarantine: A Public Health Review Of Chronic Inconsistencies In Sexually Violent Predator Statutes, Isaac ("Zack") D. Buck Oct 2013

The Indefinite Quarantine: A Public Health Review Of Chronic Inconsistencies In Sexually Violent Predator Statutes, Isaac ("Zack") D. Buck

Scholarly Works

Fifteen years after the Supreme Court’s decision in Kansas v. Hendricks upheld their constitutionality, sexually violent predator (SVP) statutes exist in 20 states and the federal code. Committing sex offenders indefinitely in an effort to protect the public, SVP statutes have survived academic criticism and mushrooming expense, targeting society’s most unpopular subjects and unpalatable crimes. In upholding the statutes against constitutional attack in Hendricks, the Court relied upon the state’s demonstrable power to preventively detain individuals during public health emergencies – analogous to the civil detention model of quarantine – to establish the state’s unquestioned right to involuntarily commit sex …
