Remaining Silent After Salinas, Brandon L. Garrett
Remaining Silent After Salinas, Brandon L. Garrett
Faculty Scholarship
In its ruling last Term in Salinas v Texas, the Supreme Court further eroded what little remains of the Fifth Amendment jurisprudence protecting against coercive police questioning of suspects. In this short piece for the University of Chicago Law Review's online Dialogue, I explore the Salinas decision and its implications. I argue that the result encourages precisely the types of informal, undocumented questioning that can cause false confessions and wrongful convictions.
The Regulation And Control Of Bail Recovery Agents: An Exploratory Study, Brian R. Johnson, Ruth S. Stevens
The Regulation And Control Of Bail Recovery Agents: An Exploratory Study, Brian R. Johnson, Ruth S. Stevens
Peer Reviewed Publications
This article explores the current status of the licensing and regulation of bail recovery agents in the United States. By reviewing state legislative and administrative codes in all the 50 states, this study found that 24 states control bail recovery agents through licensure or the imposition of other occupational regulations. These state controls include age, criminal history, and pretraining and educational requirements; some states also require continuing education and training for licensure and/or regulation. In contrast, 18 states have no licensing or other occupational requirements for bail recovery agents. These findings raise questions about the actual utility and function of …
An Examination Of The Interactions Of Race And Gender On Sentencing Decisions Using A Trichotomous Dependent Variable, Tina L. Freiburger, Carly M. Hilinski-Rosick
An Examination Of The Interactions Of Race And Gender On Sentencing Decisions Using A Trichotomous Dependent Variable, Tina L. Freiburger, Carly M. Hilinski-Rosick
Peer Reviewed Publications
This study examined how race, gender, and age interact to affect defendants’ sentences using a trichotomized dependent variable. The findings indicate that the racial and gender disparity found in sentencing decisions was largely due to Black men’s increased likelihood of receiving jail as opposed to probation. The results also show that being young resulted in increased odds of receiving probation over jail for White men and for women but resulted in decreased odds for Black men. Separate analysis of incarceration terms to jail and prison further reveal that legal factors had a greater impact on prison than on jail sentence …

Narrative, Truth, And Trial, Lisa Kern Griffin
Narrative, Truth, And Trial, Lisa Kern Griffin
Faculty Scholarship
This Article critically evaluates the relationship between constructing narratives and achieving factual accuracy at trials. The story model of adjudication— according to which jurors process testimony by organizing it into competing narratives—has gained wide acceptance in the descriptive work of social scientists and currency in the courtroom, but it has received little close attention from legal theorists. The Article begins with a discussion of the meaning of narrative and its function at trial. It argues that the story model is incomplete, and that “legal truth” emerges from a hybrid of narrative and other means of inquiry. As a result, trials …
State-Corporate Crime In The Democratic Republic Of Congo, Veronica Jane Winters
State-Corporate Crime In The Democratic Republic Of Congo, Veronica Jane Winters
USF Tampa Graduate Theses and Dissertations
This study addresses the need for a parsimonious theoretical model to explain state-corporate crime. The Integrated Theoretical Model of State-Corporate Crime will be compared to the Integrated Theory of International Criminal Law Violation to determine which model provides the most accurate theoretical depiction of state- corporate crime, while retaining parsimony. For this comparison, the models will be applied to Democratic Republic of Congo case study. Using a secondary analysis of qualitative data and preexisting literature, it was found that the Integrated Theoretical Model of State-Corporate Crime displays a representative depiction of all state-corporate crime actors and their catalysts for action …

An Empirical Assessment Of Corporate Environmental Crime-Control Strategies, Sally S. Simpson, Carole Gibbs, Melissa Rorie, Lee Ann Slocum, Mark A. Cohen, Michael Vandenbergh
Journal of Criminal Law and Criminology
Corporate illegality is often attributed to greed by corporate managers and insufficient legal safeguards. Underlying this argument is an explicit critique of corporate crime regulatory systems. Yet there is little systematic investigation of the relative merits of different types or components of crime-control strategies; research comparing more punitive command-and-control strategies with self-regulatory approaches is particularly lacking. In this Article, we assess these crime prevention-and-control mechanisms in the context of individual and situational risk factors that may increase the likelihood of illegal behavior in the environmental arena. We use data drawn from two groups of business managers who participated in a …

The Innocent Defendant's Dilemma: An Innovative Empirical Study Of Plea Bargaining's Innocence Problem, Lucian E. Dervan, Vanessa A. Edkins Ph.D.
Journal of Criminal Law and Criminology
In this Article, Professors Dervan and Edkins discuss a recent psychological study they completed regarding plea bargaining and innocence. The study, involving dozens of college students and taking place over several months, revealed that more than half of the innocent participants were willing to falsely admit guilt in return for a benefit. These research findings bring significant new insights to the long-standing debate regarding the extent of plea bargaining’s innocence problem. The Article also discusses the history of bargained justice and examines the constitutional implications of the study’s results on plea bargaining, an institution the Supreme Court reluctantly approved of …

A Reporter's Privilege In Florida: Has The Conflict Between The First Amendment And Sixth Amendment Been Reconciled?, Jay B. Rosman
Barry Law Review
This article examines the reporter's privilege in Florida and the inherent conflict between the First Amendment and Sixth Amendment as it exists between the freedom of the press and the right to a fair trial. The salient question addressed is whether the conflict between the First Amendment and the Sixth Amendment has been reconciled on the issue of a reporter's privilege by Florida courts and the Florida Legislature. The author provides both an analytic and empirical study. Analytically, the article looks to the two amendments to define a reporter's privilege and considers the history of the privilege. The article discusses …
Individual Characteristics, Protective Factors And Processes Significant In Helping Low-Income African American Students Achieve Academic Success And Projected Upward Mobility, Barbara Still
PCOM Psychology Dissertations
Research and other studies have documented the educational plight and academic difficulties of many poor, urban African American students. A number of studies have explored and identified many reasons for the low level of academic success among these students. Nonetheless, some poor, urban African American students have completed high school and college; and they have successfully transitioned to higher socioeconomic groups. The purpose of this study was to identify individual characteristics, protective factors and school processes that are significant in helping current urban, poor African American students to achieve high levels of academic success and to begin movement towards eventual …
The Death Of Punishment: Searching For Justice Among The Worst Of The Worst, Robert I. Blecker
The Death Of Punishment: Searching For Justice Among The Worst Of The Worst, Robert I. Blecker
Books
For twelve years Robert Blecker, a criminal law professor at New York Law School, wandered freely inside Lorton Central Prison, armed only with cigarettes and a tape recorder. The Death of Punishment tests legal philosophy against the reality and wisdom of street criminals and their guards. Some killers' poignant circumstances should lead us to mercy; others show clearly why they should die. After thousands of hours over twenty-five years inside maximum security prisons and on death rows in seven states, Professor Blecker exposes the perversity of justice: Inside prison, ironically, it's nobody's job to punish. Thus the worst criminals often …
Underclaiming And Overclaiming, Peter Siegelman, Sachin Pandya
Underclaiming And Overclaiming, Peter Siegelman, Sachin Pandya
Faculty Articles and Papers
Arguments that we have too much litigation (overclaiming) or too little (underclaiming) cannot be valid without estimating how many of the undecided claims that are brought (actual claims) or not brought (potential claims) have or lack legal merit. We identify the basic conceptual structure of such underclaiming and overclaiming arguments, which entails inferences about the distribution of actual or potential claims by their probability of success on the merits within a claims-processing institution. We then survey the available methods for estimating claim merit.

Nevada Institute for Children's Research and Policy Reports
The purpose of this Legislative Briefing Book is to provide a quick snapshot of some of the most pressing issues facing Nevada’s children in order to provide advocates and policymakers with a stepping stone in creating positive changes to improve the lives of Nevada’s children. While this book will not cover every issue facing our children, it is intended to highlight some of those where state policy may have an impact, covering issues in education, health, safety and security, and the juvenile justice system. Diligent efforts need to be made during the 2013 Legislative Session to improve policies, procedures and …
Staying Current After Graduation: A Survey Of Social Work Alumni, Linda Hacker
Staying Current After Graduation: A Survey Of Social Work Alumni, Linda Hacker
Collaborative Librarianship
How do our alumni stay current once they graduate and are away from academic information resources? Very few studies have addressed how alumni stay current in their field after graduation. This research surveyed the graduate and undergraduate Social Work alumni of The College at Brockport in asking key questions. Are you able to stay current with research, especially without access to article databases? Do you receive support from your employer to stay current? Does this include money/time off for participating in Continuing Education Programs (CEP), conferences or accessing article databases? This paper looks at the methods for, and importance of, …
