The Inmate Code: The Stories Lived And The Stories Told Of Men Behind Bars, Pauline Matthey Jan 2013

The Inmate Code: The Stories Lived And The Stories Told Of Men Behind Bars, Pauline Matthey

Masters Theses

Using Coordinated Management of Meaning, this study links socialization and identification with the intricate levels of the inmate code that male prisoners live by, or live with anyway, while being incarcerated. In doing so, the research showed that the more highly identified to the inmate code a prisoner is, the less likely he is to have a desire to coordinate the meaning of his stories lived with the stories told of others. Furthermore, this project uncovered a characteristic of metamorphosis, the TRAP, or Temporary Relapse Alluding to the Past. TRAP takes place when prisoners who have developed the ability to …

Personality And Substance Abuse, Juliana Gonzalez Jan 2013

Personality And Substance Abuse, Juliana Gonzalez

Masters Theses

The Big Five have shown to be distinct personality traits that do not overlap and have universal applicability, so this study examined whether there are specific personality trait differences in users of Marijuana, Pain Medication, Sedative/Hypnotics, and Stimulants.

Study was placed in the 50 most visited Craigslist pages in the United States. Anonymous web users (N = 547) were recruited through Craigslist. High Neuroticism was associated with Marijuana and Stimulant use. Low Conscientiousness was associated with Marijuana and Stimulant use. High Extraversion was associated with Pain Medication use only. Implications, limitations, and suggestions for future research were discussed.

International Perspectives On Correcting Wrongful Convictions: The Scottish Criminal Cases Review Commission, Lissa Griffin Jan 2013

International Perspectives On Correcting Wrongful Convictions: The Scottish Criminal Cases Review Commission, Lissa Griffin

Elisabeth Haub School of Law Faculty Publications

Part I of this Article traces the history of the Scottish Criminal Cases Review Commission (SCCRC) and outlines the procedures employed by the SCCRC after an application is received, with particular attention to its extensive investigatory procedures. It also describes and analyzes the standards for referral of an application to the Scottish court. Part II briefly sets forth the statistics concerning applications, referrals, and judicial decisions. Part III includes an analysis of the SCCRC’s work by looking at the cases that have been referred and decided by the court. Those cases are divided into several categories: fresh evidence referrals, referrals …

Blanket Retroactive Amelioration: A Remedy For Disproportionate Punishments, S. David Mitchell Jan 2013

Blanket Retroactive Amelioration: A Remedy For Disproportionate Punishments, S. David Mitchell

Faculty Publications

While statutes determine the conditions under which an individual is to be held accountable for their actions and identifies the punishment that shall attach to that conduct, they are not engraved in stone. Laws can and are changed. Legislatures will revisit whether a penalty is too harsh (or too lenient), and amend an existing statute to reflect the legislature’s evaluation of what is contemporaneously appropriate. This re-evaluation of a statutory punishment is ongoing assessment to determine whether the punishment is proportional to the conduct. Blanket retroactive amelioration allows society to correct overly harsh, overreactions and to restore the balance between …

Like Father, Like Son? Reflections On Black Cultural Capital And Generational Conceptions Of Work, Quaylan Allen, Travis D. Boyce Jan 2013

Like Father, Like Son? Reflections On Black Cultural Capital And Generational Conceptions Of Work, Quaylan Allen, Travis D. Boyce

Education Faculty Articles and Research

This article extends our understanding of Black middle-class social mobility by examining successful cases of social reproduction. Specifically, using autoethnographic methods, two Black junior faculty reflect upon their fathers’ uses of cultural capital and the generational differences in conceptions of appropriate work. For the first generation middle-class Black fathers, material realities and the technocratic nature of their work influenced their interpretations of appropriate employment. In contrast, the second-generation’s access to particular cultural and economic capital influenced the sons’ conceptions of work, demonstrating generational differences in Black middle-class occupational ideology. Responding to deficit views on Black mobility, this article highlights the …

Targeting And The Concept Of Intent, Jens David Ohlin Jan 2013

Targeting And The Concept Of Intent, Jens David Ohlin

Michigan Journal of International Law

International law generally prohibits military forces from intentionally targeting civilians; this is the principle of distinction. In contrast, unintended collateral damage is permissible unless the anticipated civilian deaths outweigh the expected military advantage of the strike; this is the principle of proportionality. These cardinal targeting rules of international humanitarian law are generally assumed by military lawyers to be relatively well-settled. However, recent international tribunals applying this law in a string of little-noticed decisions have completely upended this understanding. Armed with criminal law principles from their own domestic systems — often civil law jurisdictions — prosecutors, judges and even scholars have …

Liability Of Child Soldiers Under International Criminal Law, Fanny Leveau Jan 2013

Liability Of Child Soldiers Under International Criminal Law, Fanny Leveau

Osgoode Hall Review of Law and Policy

The phenomenon of child soldiers has gained increased attention since the condemnation, last year, of Thomas Lubanga for recruiting and using child soldiers. However, not much has been said about the crimes perpetrated by those children. This article looks at child soldiers as perpetrators of crimes and examines their potential criminal accountability under international criminal law. Interpretation of international instruments suggests that child soldiers could be prosecuted by international criminal tribunals. However, those prosecutions would have to respect specific standards.

The Emerging Reality Of Social Media: Erosion Of Individual Privacy Through Cyber-Vetting And Law’S Inability To Catch Up, 12 J. Marshall Rev. Intell. Prop. L. 551 (2013), Saby Ghoshray Jan 2013

The Emerging Reality Of Social Media: Erosion Of Individual Privacy Through Cyber-Vetting And Law’S Inability To Catch Up, 12 J. Marshall Rev. Intell. Prop. L. 551 (2013), Saby Ghoshray

UIC Review of Intellectual Property Law

The rise of social media means that data about a large number of people is available in public and quasi-public digital locations. Employers, keen on taking advantage of this additional data to decrease the risk associated with an offer of employment, are engaging in “cyber-vetting”—non-consenting social media searches conducted by third parties or the employers themselves. To the extent that current law applies to this practice, the regulation it provides is weak and attacks only part of the problem. Left unchecked, cyber-vetting has the potential to fundamentally alter the scope of prospective employees’ rights. This article surveys the legal and …

The Rule Of Three: Federal Courts And Prison Farms In The Post-Segregation South, Gregory Louis Richard Jan 2013

The Rule Of Three: Federal Courts And Prison Farms In The Post-Segregation South, Gregory Louis Richard

Electronic Theses and Dissertations

The following dissertation discusses the United States Federal Court judicial reform of prison farms in Arkansas, Mississippi, and Louisiana. More specifically, it examines the judicial and legislative history of the historic reform that includes the role of the individual judges that presided over the years of legislation necessary to bring Constitutional reforms to the state prison systems of the South. The judges and states in this study include J. Henley Smith of Arkansas, William C. Keady of Mississippi, and E. Gordon West of Louisiana. The research outlines an important aspect of the court system and the struggle between states and …

Effective Plea Bargaining Counsel, Jenny M. Roberts Jan 2013

Effective Plea Bargaining Counsel, Jenny M. Roberts

Scholarly Articles in Law Reviews & Journals

Fifty years ago, Clarence Earl Gideon needed an effective trial attorney. The Supreme Court agreed with Gideon that the Sixth Amendment guaranteed him the right to counsel at trial. Recently, Galin Frye and Anthony Cooper also needed effective representation. These two men, unlike Gideon, wanted to plead guilty and thus needed effective plea bargaining counsel. However, their attorneys failed to represent them effectively, and the Supreme Court - recognizing the reality that ninety-five percent of all convictions follow guilty pleas and not trials - ruled in favor of Frye and Cooper.

If negotiation is a critical stage in a system …

Death Eligibility In Colorado: Many Are Called, Few Are Chosen, Justin Marceau, Sam Kamin, Wanda Foglia Jan 2013

Death Eligibility In Colorado: Many Are Called, Few Are Chosen, Justin Marceau, Sam Kamin, Wanda Foglia

University of Colorado Law Review

This Article reports the conclusions of an empirical study of every murder conviction in Colorado between January 1, 1999 and December 31, 2010. Our goal was to determine: (1) what percentage of first-degree murderers in Colorado were eligible for the death penalty; and (2) how often the death penalty was sought against these killers. More importantly, our broader purpose was to determine whether Colorado's statutory aggravating factors meaningfully narrow the class of death-eligible offenders as required by the Constitution. We discovered that while the death penalty was an option in over 90% of all first-degree murders, it was sought by …

Community Loss: A New Social Indicator, Jochen Albrecht, Mimi Abramovitz Jan 2013

Community Loss: A New Social Indicator, Jochen Albrecht, Mimi Abramovitz

Publications and Research

The Community Loss Index ðCLIÞ, a new social indicator, focuses on the understudied role of place as a source of stress and an aggregator of individual experiences. Building on the relationship between loss and stress, the index attempts to capture collective loss, defined as the chronic exposure by neighborhood residents to multiple resource losses at the same time. Using maps, the article analyzes the spatial distribution of six types of loss in New York City and the characteristics of people who live in high- and low-loss neighborhoods. Regionalization reveals a neighborhood-based concentration of loss, patterns of loss that are both …

The Case To Accredit Homeland Security Programs: Why Outcomes-Based Accreditation Makes Sense, James D. Ramsay Jan 2013

The Case To Accredit Homeland Security Programs: Why Outcomes-Based Accreditation Makes Sense, James D. Ramsay

Security Studies & International Affairs - Daytona Beach

The following essay lays out an argument for program level accreditation in academic homeland security (HS) programs. Admittedly, neither the practice nor the educational components of the HS discipline are standardized. Indeed, a recent analysis by the Congressional Research Service indicates that there remain several operational definitions of HS in practice. Regardless, this paper provides rationale which argues that after roughly eight years, academic HS has developed enough to be able to identify and support a distinct set of student learning outcomes— knowledge, skills and attitudes—that can both characterize and define the discipline.

Generally, program level academic accreditation requires a …

The Challenge Of Studying Pedophilia, Ryuhei Kawamoto Jan 2013

The Challenge Of Studying Pedophilia, Ryuhei Kawamoto

Calvert Undergraduate Research Awards

Increased media exposure of convicted sexual offenders with child victims has increased the public concern of pedophilia. A pedophile is no longer seen as “a dirty old man” in a church or a local theater; instead, people started recognizing someone more familiar such as friends and neighbors as potential pedophiles. However, despite this increased public concern, research on pedophilia has been facing an impediment due to limited available samples for researchers. The problem of research samples has been preventing the further understanding of pedophilia, and consequently, the solution for child sexual exploitation. After addressing why people should keep in mind …
