The Level Of Maturity That Constitutes Adulthood, Peter Stoller Apr 2013

The Level Of Maturity That Constitutes Adulthood, Peter Stoller

The Review: A Journal of Undergraduate Student Research

In lieu of an abstract, below is the article's first paragraph.

The United States of America provides its citizens with many freedoms and privileges unique to other nations worldwide. At 15, you may start working with the proper legal working papers. The same freedom that allows you the right to earn that living also allows the government to take taxes out of your paycheck as a thank you for the privilege. This very same government acknowledges the fact that you are old enough a U.S. citizen for the government to remove taxes, federal and/or state, from your paycheck. yet you're …

Meaningful Change For Family Justice: Beyond Wise Words: Final Report Of The Family Justice Working Group, Action Committee On Access To Justice In Civil And Family Matters

Canadian Forum on Civil Justice

Canadians do not have adequate access to family justice. For many years now reports have been telling us that cost, delay, complexity and other barriers are making it impossible for many Canadians to exercise their legal rights. More recently, a growing body of research has begun to quantify the extent of unmet legal need in our communities and to describe the disquieting individual and social consequences of failing to respond adequately to family legal problems.

An Examination Of Data-Sharing Procedures Of Former Juvenile Offenders Re-Enrolling Into Mainstream Public Schools, Thomas Richardson, Thomas Dipaola, Robert K. Gable

K-12 Education

This study examined school re-enrollment procedures employed by two school systems for N=578 former juvenile offenders re-enrolling from secured supervised settings to urban mainstream secondary public schools and alternative schools and programs in New England. Quantitative data regarding student demographics and qualitative data from interviews with 19 support personnel and selected documents were used to evaluate which program elements enhanced or disengaged former offenders from secondary urban schools. The characteristics of former juvenile offenders’ lack of school involvement with respect to truancy, school suspension and expulsion, learning, behavior, and emotional disabilities, as well as family, economic, and social disadvantages …

Standards Of Proof In Civil Litigation: An Experiment From Patent Law, David L. Schwartz, Christopher B. Seaman Apr 2013

Standards Of Proof In Civil Litigation: An Experiment From Patent Law, David L. Schwartz, Christopher B. Seaman

Scholarly Articles

Standards of proof are widely assumed to matter in litigation. They operate to allocate the risk of error between litigants, as well as to indicate the relative importance attached to the ultimate decision. But despite their perceived importance, there have been relatively few empirical studies testing jurors’ comprehension and application of standards of proof, particularly in civil litigation. Patent law recently presented an opportunity to assess the potential impact of varying the standard of proof in civil cases. In Microsoft Corp. v. i4i Limited Partnership, the Supreme Court held that a patent’s presumption of validity can only be overcome by …

A Unique Approach Against Child Sex Offenders: Jefferson County "Cheezo" Unit The Model For Success?, Sonia R. Chavez

Regis University Student Publications (comprehensive collection)

Online crimes against children are a daunting problem facing law enforcement today. The Internet Crimes Against Children (ICAC) Task Force reported 76,961 complaints in 2010-2011. The purpose of this study was to describe the unique approach of the Jefferson County Child Sex Offender Internet Investigations (CSOII, nicknamed "Cheezo") Unit, analyze the arrest data of Cheezo, and determine if Cheezo could be used as a best methods approach against this problem. A demographic study was conducted on the Cheezo arrest data, as well as comparison analysis of arrest totals, prosecution rates, and educational presentations provided to the community. Comparisons were conducted …

Sentence Appeals In England: Promoting Consistent Sentencing Through Robust Appellate Review, Briana Lynn Rosenbaum Apr 2013

Sentence Appeals In England: Promoting Consistent Sentencing Through Robust Appellate Review, Briana Lynn Rosenbaum

Scholarly Works

Unlike in most areas of the law, federal courts of appeals in the United States defer to trial courts on many issues of sentencing law and policy. As a result, the power to decide sentencing law and policy is often at the discretion of individual district court judges. Law reform scholars have long decried the disparity, lack of transparency, and legitimization concerns that this practice raises. These concerns are heightened in the post-Booker sentencing regime, where the advisory nature of the Federal Sentencing Guidelines undermines those Guidelines’ ability to further sentencing consistency. The deferential approach to federal sentence appeals is …

Mental Health And Gun Control Briefing Report, Harris Rollinger Apr 2013

Mental Health And Gun Control Briefing Report, Harris Rollinger

Mosakowski Institute for Public Enterprise

The issue of gun control has once again become a highly contested issue in the United States after the most recent mass shootings at a movie theatre in Aurora, CO, a Sikh temple in Wisconsin, a mall in Portland, OR, and involving Representative Gabby Giffords in Arizona. However, it was not until the horrific tragedy in Newtown, CT, where 20 children and 6 adult staff members were fatally shot at Sandy Hook Elementary School, that the gun control debate reached its peak.

Foreign Affairs Federalism: A Revisionist Approach, Daniel Abebe, Aziz Z. Huq Apr 2013

Foreign Affairs Federalism: A Revisionist Approach, Daniel Abebe, Aziz Z. Huq

Vanderbilt Law Review

In April 2010, the Arizona legislature enacted the Support Our Law Enforcement and Safe Neighborhoods Act. Commonly known as SB 1070, the law created a slate of new criminal offenses and arrest powers covering aliens within Arizona's borders. SB 1070 proved divisive. It inspired copycat legislation in several states, provoked sharp criticism from the legal academy, and-most relevant here- catalyzed a lawsuit by the U.S. Department of Justice seeking a preliminary injunction against the state law on the ground that it was preempted by federal law. Initially, the federal government's litigation prospects seemed dim. One term before SB 1070 reached …
