Should Interpreters Be Trained And Tested In Telephone And Video-Link Interpreting? Responses From Practitioners And Examiners, Jim Hlavac May 2013

Should Interpreters Be Trained And Tested In Telephone And Video-Link Interpreting? Responses From Practitioners And Examiners, Jim Hlavac

International Journal of Interpreter Education

This article focuses on the use of telephone and video-link technology in interpreting, presenting data from current research as well as from surveys conducted with practicing interpreters and examiners. The surveys asked interpreters to report on their own experiences using such technologies and asked examiners for their impressions of the technologies’ suitability as components of training and testing for certification. Technological advances in the means of audio and audiovisual communication are now being trialed in interpreted interactions, but most research reveals that increased use of technology accompanies rather than forms a part of the interlingual transfer. Responses from two groups …

What Men?: The Essentialist Error Of The End Of Men, Nancy E. Dowd May 2013

What Men?: The Essentialist Error Of The End Of Men, Nancy E. Dowd

UF Law Faculty Publications

Many aspects of The End of Men are debatable. Among them is the critical issue of essentialism: do Rosin's claims about women withstand scrutiny when we ask, “Is this representative of all women?” While women as a group may have progressed in some domains, they have remained the same or worse in others, and some women have not progressed at all.

An even more significant shortcoming of The End of Men, however, is its essentialism about men. Rosin assumes a beginning, namely, men's prior place of power and privilege in the domains she addresses. To assume that is true of …

Subverting Brady V. Maryland And Denying A Fair Trial: Studying The Schuelke Report, Bennett L. Gershman May 2013

Subverting Brady V. Maryland And Denying A Fair Trial: Studying The Schuelke Report, Bennett L. Gershman

Mercer Law Review

The Schuelke Report about the ill-fated federal prosecution of the late-Senator Ted Stevens is an extraordinary contribution to criminal procedure. No other official documentation or investigative study of a criminal prosecution, to my knowledge, has dissected and analyzed as carefully and thoroughly the sordid and clandestine actions of a team of prosecutors who zealously wanted to win a criminal conviction at all costs. In examining this Report, one gets the feeling that as the investigation and prosecution of Senator Stevens unfolded and the prosecution's theory of guilt unraveled, the prosecutors became indifferent to the defendant's guilt or innocence. They just …

Prosecutorial Disclosure Violations: Punishment Vs. Treatment, Kevin C. Mcmunigal May 2013

Prosecutorial Disclosure Violations: Punishment Vs. Treatment, Kevin C. Mcmunigal

Mercer Law Review

Recent scholarship on prosecutorial disclosure violations proposes preventing violations through understanding and remedying the causes of violations, such as cognitive error. Scholars who adopt this view-what I call here the "treatment perspective"-often call for greater transparency and cooperation from prosecutors. A frequently unacknowledged tension exists between such a treatment perspective and a more traditional perspective-what I call here the "punishment perspective"-that seeks to deter disclosure violations through greater use of sanctions such as professional discipline.

The tension arises because increasing the certainty and severity of sanctions, as the punishment perspective urges, creates a powerful disincentive for individual prosecutors and prosecutor …

Pacifism In A Dog-Eat-Dog World: Potential Solutions To School Bullying, Farley Anderson May 2013

Pacifism In A Dog-Eat-Dog World: Potential Solutions To School Bullying, Farley Anderson

Mercer Law Review

Based on these three real-life stories, there are different ways to solve the profound problem of bullying: criminal prosecution; national, state, and local legislation; and awareness and protests. Many school districts use a combination of all three methods to eliminate bullying, and at this point in time, most states have some form of anti-bullying legislation. Whether it was a personal experience in elementary school, victimization in high school, or a story heard on the nightly news, everyone is aware that bullying is a serious problem in schools. Similarly, extensive media coverage of bullying has raised public awareness of this very …

The Territorialization Of The 'Republican Law': Judicial Presence In Seine-Saint-Denis, France, Joaquin Villanueva May 2013

The Territorialization Of The 'Republican Law': Judicial Presence In Seine-Saint-Denis, France, Joaquin Villanueva

Geography and the Environment - Dissertations

This dissertation investigates the presence of the courts in the spaces of everyday life in social housing estates located in Seine-Saint-Denis (northeast of Paris). Since the 1990s the judiciary has actively sponsored the territorialization of the courts (la territorialisation de la Justice) as the most adept measure to respond to a series of problems often understood as essentially "local": crime, revolts, "incivilities," and insecurity. The dissertation examines the proliferation of new judicial structures in crime-prone areas, and the increasing involvement of judges in local partnerships to more efficiently fight crime and prevent collective violence among youths from immigrant origins. Human Trafficking And Human Rights: The Movement Of Women From Nigeria To Europe, Chinenye Monde-Anumihe

Renée Crown University Honors Thesis Projects - All

The phenomenon of human trafficking, especially the trafficking of young women and girls into exploitative and commercial sex labor, has recently attracted considerable local, national and international attention. This sex trafficking phenomenon exists against the backdrop of poverty, unemployment, and social instability, signaling a correlation between these elements. This research paper will define the concept of human trafficking in comparison to human smuggling and migration and will discuss the complexity in applying the definition. The magnitude and scope of the problem of human trafficking will be examined as well as its causes.

Human trafficking will be analyzed by international standards …

Estimate The Effect Of Police On Crime Using Electoral Data And Updated Data, Yaqi Wang May 2013

Estimate The Effect Of Police On Crime Using Electoral Data And Updated Data, Yaqi Wang

All Theses

It is surprisingly difficult to isolate causal effects of police on crime empirically due to the simultaneous determination of crime and police presence. Instruments are used to address the simultaneity concerns in the previous crime literature. The 2SLS results provide evidence indicating that additional police reduce crime. However, we might suspect whether the same instruments can generate consistent results with previous studies by using datasets of more recent years instead of thirty years ago and considering the change of policies, crime situation, and other factors. This paper use electoral cycles as instrumental variable and updated data of the 1985-2010 period …

Detecting Student Dropouts Using Fuzzy Inferencing, Shahriar Husainy May 2013

Detecting Student Dropouts Using Fuzzy Inferencing, Shahriar Husainy

Theses and Dissertations

Fuzzy logic provides a methodology for reasoning using imprecise rules and assertions. Fuzzy inference is the process of formulating the mapping from a given input to an output using fuzzy logic. The mapping then provides a basis from which decisions can be made, or patterns discerned. This study concerns the development of a Fuzzy Inference System (FIS) for identifying likely student dropouts at Columbus State University (CSU). The fuzzy inference based model uses a hybrid knowledge extraction process to predict how likely each freshman student will be to drop their program of study at the end of their first semester. …

Holy Experiments And Unholy Acts: Sex, Law, And Religion In Colonial Massachusetts, Rhode Island, And Pennsylvania, Anna L. Todd May 2013

Holy Experiments And Unholy Acts: Sex, Law, And Religion In Colonial Massachusetts, Rhode Island, And Pennsylvania, Anna L. Todd

Honors Theses

This thesis uses the law codes and court cases of sexual misconduct from the colonies of Massachusetts, Rhode Island, and Pennsylvania to determine the degree to which the colonies’ stated understandings of the relationship between church and state were practically applied to the governing of their societies as well as how that understanding affected the daily lives of colonial women. Thus, this analysis uses the lens of female sexual deviance to determine the degree to which church and state were integrated or separated within the three colonies.

Chapter 1 discuses the law as it was written. It examines the sexual …

Theoretical Underpinnings Of Jury Decision Making In Excuse Defense Cases, Christopher Sean Peters May 2013

Theoretical Underpinnings Of Jury Decision Making In Excuse Defense Cases, Christopher Sean Peters

Graduate Theses and Dissertations

In the typical criminal trial, a defendant is trying to prove he/she is not guilty because they were not the individual that committed the crime. However, another type of defense exists in which the defendant admits they were the culprit, but provides an excuse in an attempt to avoid criminal punishment. These so called "excuse defenses" include insanity, involuntary intoxication, age, and entrapment. In all cases, juries are required to determine whether the defendant had sufficient mental capacity to form the intent to commit the crime. Although jury decision making is a popular research area in psychology, relatively little has …

Narrative Framing Of U.S. Military Females In Combat: Inclusion Versus Resistance, James Scott Herford May 2013

Narrative Framing Of U.S. Military Females In Combat: Inclusion Versus Resistance, James Scott Herford

Graduate Theses and Dissertations

This study utilizes discursive data to examine how the strategic use of narratives inform policies that shape women's participation in military service overall and more specific, the current controversy over exclusion of women from participation in combat roles within the U.S. military. Specifically, I examine popular military newspapers, blogs and the Department of Defense 2012 Report regarding policies and regulations of female service members. In this study, I provide a sociological analysis of current military-cultural narratives and the institutional narrative discussing women's participation in combat roles in order to provide evidence of the current threat to the military form of …

A Mixed-Method Examination Of Homicides Targeting Lgbt Individuals In The United States, Kristin Kaye Kelley May 2013

A Mixed-Method Examination Of Homicides Targeting Lgbt Individuals In The United States, Kristin Kaye Kelley

Graduate Theses and Dissertations

The purpose of the current study is to understand the dynamic processes of fatal attacks against lesbian, gay, bisexual, and transgender (LGBT) individuals across different situational circumstances. Recent scholarship has begun to identify the heterogeneous nature of anti-LGBT homicides, including possible differences in how victims are targeted by offenders. However, several limitations of prior research have stunted the systematic examination of these circumstances. Few studies, for instance, have disaggregated by crime type and bias type, thus masking unique patterns and causal processes associated with varying types of anti-LGBT homicide events. Others have relied on official data sources whose validity and …

Resources And Relationships: Food Insecurity And Social Capital Among Middle School Students, Don Edward Willis May 2013

Resources And Relationships: Food Insecurity And Social Capital Among Middle School Students, Don Edward Willis

Graduate Theses and Dissertations

This study examines the relationship between food insecurity and Social capital among 5th-7th graders attending an intermediate school in Northwest Arkansas where nearly 70 percent of students participate in the free or reduced lunch program. The central research questions are: Does Social capital have a direct impact on children's food insecurity? And, does Social capital mediate the influence of negative circumstances on children's food insecurity? This study finds that Social capital does have a significant association with food insecurity, even when controlling for multiple demographic and circumstantial factors. However, there appears to be no mediation of circumstance by Social capital. …

The Plight Of Foreign National Women In The United Kingdom: Coercion And Trafficking As Factors Of Imprisonment, Sarah Lokey May 2013

The Plight Of Foreign National Women In The United Kingdom: Coercion And Trafficking As Factors Of Imprisonment, Sarah Lokey

HIM 1990-2015

Within the United Kingdom (UK) prisons exists Foreign National women (FNW), a unique demographic of women who are non-UK citizens who have committed crimes within the UK. It is important to delve deeper into the issue before judgment is made, however, it seems as though in most circumstances, most citizens are not willing or perhaps even unknowledgeable that such a population within prison exists. Therefore, it is important to educate others about the issues that FNW in prison face. This research focuses on the issues such as lack of special services for the women such as translation and family contacts, …

Mental Illness In The Prison System: Exploring The Issues And Possible Solutions, Melinda Pacecca May 2013

Mental Illness In The Prison System: Exploring The Issues And Possible Solutions, Melinda Pacecca

HIM 1990-2015

The purpose of this research was to explore the issue of mental health in the prison system. A large portion of the prison population is mentally ill. The prison environment poses special challenges to these individuals. Treating mental illness in a prison environment can be difficult as there are many factors that must be considered in deciding the best way to handle mentally ill offenders. Mental health courts show promise in dealing with these issues, but methods vary quite significantly from region to region. A literature review was conducted to provide an overview of the types of mental illnesses seen …

Demographic Effects On Attitudes Toward Dating Violence And The Need For Legal Protections., Kellianne K. Doan May 2013

Demographic Effects On Attitudes Toward Dating Violence And The Need For Legal Protections., Kellianne K. Doan

College of Arts & Sciences Senior Theses

Dating violence among college students, whether physical, sexual, or psychological is a serious problem with limited legal resources available for victims. Studies have shown that one in four undergraduate students is in an abusive dating relationship. In Kentucky, individuals in a dating relationship are not eligible to receive civil protective orders, leaving them without legal protection from abusive partners. A fifty‐question survey was administered to 200 students enrolled in Justice Administration courses at the University of Louisville to determine what demographic factors might be related to attitudes toward abuse in dating relationships and whether or not dating partners should have …

Enhancing Student Academic Performance And Overall Health Through Standards-Based Physical Education, Haley Elizabeth Marcoux May 2013

Enhancing Student Academic Performance And Overall Health Through Standards-Based Physical Education, Haley Elizabeth Marcoux

Dissertations, Masters Theses, Capstones, and Culminating Projects

Standards-based physical education may have an impact on students’ academic performance. Many studies support this notion. In many schools, physical education curricula are being greatly reduced. They may be removed or replaced with other programs. It is a common perception that physical education is an extra curricular activity and can be characterized as “free time” or recess. The purpose of this study is to analyze quality indicators of standards-based physical education programs in a select setting in an urban middle school. The research literature yields studies with mixed results. However in a meta analysis of the research in this area, …
