Private Memorials On Public Space: Roadside Crosses At The Intersection Of The Free Speech Clause And The Establishment Clause, Amanda Reid Jan 2013

Private Memorials On Public Space: Roadside Crosses At The Intersection Of The Free Speech Clause And The Establishment Clause, Amanda Reid

Nebraska Law Review

Private roadside memorials are part of a growing trend among the bereaved who seek to “make sense of senseless deaths” along the public roadways.2 These memorials, which often feature a Latin cross, are part of deeply meaningful bereavement practices that support the grieving process. As such, these memorials are created to satisfy a human need during a time of crisis and are, therefore, largely constructed without regard to the legality of erecting such markers.3 Courts have yet to provide clear guidance on the constitutionality of erecting and maintaining these private memorials on public spaces. This Article considers the constitutional guideposts …

The Impact Of Service-Learning On Academics Related To Neurogenic Communication Disorders, Ricki A. Konnerup Jan 2013

The Impact Of Service-Learning On Academics Related To Neurogenic Communication Disorders, Ricki A. Konnerup

EWU Masters Thesis Collection

"Service-Learning (SL) is a pedagogical approach used to assist students in higher education in learning academic material by providing them an experience with a community partner. SL involves academic course objectives that are linked to a community need and includes student reflection on the experience (Goldberg, McCormick Richburg, & Wood, 2006). SL research is limited, but has been an increasing interest for medical, sociology, education, and communication disorders fields. This study describes the effect that SL has on academic learning related to neurogenic communication disorders, attitudes towards SL, and community benefits. One section of a senior level undergraduate course in …

Death Penalty Politics And Symbolic Law In Russia, Olga B. Semukhina, John F. Galliher Jan 2013

Death Penalty Politics And Symbolic Law In Russia, Olga B. Semukhina, John F. Galliher

Social and Cultural Sciences Faculty Research and Publications

In contemporary Russia there is widespread support for the death penalty. Recent Russian presidents have endorsed the nation’s entry into the European Community (EC). The dilemma is that the price of membership into the EC is total abolition of capital punishment. The Russian Duma is much less popular than the president, even though it sides with public opinion in supporting capital punishment. Since 1997, these conflicting political positions have been temporarily neutralized by leaving capital punishment legislation in place but allowing the Russian president to offer clemency to all sentenced to death. In 1999, the Constitutional Court of Russia placed …

Strange Traffic: Sex, Slavery & The Freedom Principle, Anders Walker Jan 2013

Strange Traffic: Sex, Slavery & The Freedom Principle, Anders Walker

All Faculty Scholarship

This article uses the recent prosecution of a sex trafficking case in rural Missouri to argue three points. One, the federal law of trafficking is currently being used in unanticipated ways, including the apprehension of individuals who pay for sex. Two, trafficking invites creative use precisely because it provides prosecutors with a more salient justification for punishment than either legal moralism or harm; a rhetorical plea to anti-slavery that enjoys a longstanding but under-theorized role in criminal law rhetoric. Three, anti-slavery’s recurrence in criminal law rhetoric underscores a larger doctrinal point, namely that H.L.A. Hart’s version of the harm principle …

Selling 'Fracking': Legitimation Of High Speed Oil And Gas Extraction In The Marcellus Shale Region, Jacob R. Matz Jan 2013

Selling 'Fracking': Legitimation Of High Speed Oil And Gas Extraction In The Marcellus Shale Region, Jacob R. Matz

Graduate Theses, Dissertations, and Problem Reports (ETD)

The advent of horizontal hydraulic fracture drilling, or 'fracking,' a technology used to access oil and natural gas deposits, has allowed for the extraction of deep, unconventional shale gas and oil deposits in various shale seams throughout the United States and world. One such shale seam, the Marcellus shale, extends from New York State, across Pennsylvania, and throughout West Virginia, where shale gas development has significantly increased within the last decade. This boom has created a massive amount of economic activity surrounding the energy industry, creating jobs for workers, income from leases and royalties for landowners, and profits for energy …

Using Narrative As A Tool To Locate And Challenge Pre Service Teacher Bodies In Health And Physical Education, Jennifer A. Mcmahon, Dawn Penney Jan 2013

Using Narrative As A Tool To Locate And Challenge Pre Service Teacher Bodies In Health And Physical Education, Jennifer A. Mcmahon, Dawn Penney

Australian Journal of Teacher Education

This paper reports on research that has explored the use of narrative as a pedagogical tool in pre service teacher education. Specifically, we pursue the use of narrative to engage with pre service teachers’ embodied experiences [their lived body] and the ways in which these experiences are in turn currently influencing their ‘living bodies’ in regard to what Health and Physical Education (HPE) is and how it should be taught. Data in the form of an assemblage of pre service teachers’ narratives are presented to show how both the lived and living body contributes to thoughts and ideas about HPE. …

On The Design Of It-Enabled Self-Care Systems: A Socio-Technical Perspective, Omar F. El-Gayar, Surendra Sarnikar, Abdullah Hamdi Saleh Wahbeh

Research & Publications

Advances in information technology (IT) have resulted in a proliferation of IT-based solution to support the self-care and management for healthy individuals as well as patients with chronic conditions. Despite these advances, the adoption and diffusion of these solutions into practice is limited. The objective of this paper is to enhance adoption and diffusion by providing actionable recommendations for the design of IT systems for self-care. The recommendations are grounded in socio-technical design theory and in an extensive review of self-care literature. The findings indicate that despite the diversity of disease conditions, users, technologies, and implementation environments, IT-solutions for self-care …

The Trials And Tribulations Of Japan’S Legal Education Reforms, Daniel H. Foote Jan 2013

The Trials And Tribulations Of Japan’S Legal Education Reforms, Daniel H. Foote

Articles

A sense of momentum accompanied the start of Japan's new legal education system in the spring of 2004. Less than three years had passed since the Justice System Reform Council (the Reform Council) issued its final report in June 2001, proposing a major restructuring of Japan's legal training system centered on a new tier of graduate level law schools. And less than a year and a half had elapsed since the details of the law school system were decided and enabling legislation passed. Despite the tight timetable, sixty-eight law schools were ready to commence operations in 2004, having arranged facilities, …

Utilization And Value Of Public Sector Information For Knowledge Development: The Case Of South Africa, Raed M. Sharif Jan 2013

Utilization And Value Of Public Sector Information For Knowledge Development: The Case Of South Africa, Raed M. Sharif

School of Information Studies - Dissertations

Although there appears to be a broad recognition of the key role that Public Sector Information (PSI) can play in the development of societies, there are still significant gaps in our understanding of how PSI is actually being utilized and of its wider societal value, especially in developing countries. The overarching goal of this dissertation was to analyze the PSI utilization process within the knowledge creation context and the factors and conditions that affect its value and usability from the user perspective. More specifically, the thesis investigates the PSI-related factors and conditions that facilitate or hinder the utilization process, as …

Institutional And Individual Influences On Scientists' Data Sharing Behaviors, Youngseek Kim Jan 2013

Institutional And Individual Influences On Scientists' Data Sharing Behaviors, Youngseek Kim

School of Information Studies - Dissertations

In modern research activities, scientific data sharing is essential, especially in terms of data-intensive science and scholarly communication. Scientific communities are making ongoing endeavors to promote scientific data sharing. Currently, however, data sharing is not always well-deployed throughout diverse science and engineering disciplines. Disciplinary traditions, organizational barriers, lack of technological infrastructure, and individual perceptions often contribute to limit scientists from sharing their data. Since scientists' data sharing practices are embedded in their respective disciplinary contexts, it is necessary to examine institutional influences as well as individual motivations on scientists' data sharing behaviors. The objective of this research is to investigate …

Defining, Tracking, And Displaying Regional Equity Conditions: Two Approaches From The Portland-Vancouver Metropolitan Region, Meg Merrick

Institute of Metropolitan Studies Publications

This report explores the strengths and weaknesses of two significant regional indicator projects for the Portland‐Vancouver metropolitan area. Specifically, this paper focuses on the measurement of equity conditions at a regional scale. In 2003, the Coalition for a Livable Future (CLF), in partnership with Portland State University (PSU), launched the nation's first regional equity atlas endeavor that pushed the notion of equity to the forefront of regional discourse. Defined primarily in terms of access to opportunities, especially in spatial terms, the atlas took advantage of the analytical capabilities and graphic power of mapping and maps to convey its findings. Family Factors And Perceived Coworker Support And Supervisor Support, Sara Narveson Jan 2013

Family Factors And Perceived Coworker Support And Supervisor Support, Sara Narveson

Theses and Dissertations

This study examines how aspects of family formation relate to coworker support and supervisor support. Studying both coworker support and supervisor support is valuable because they can give us a glimpse of how different people feel about the workplace. Using the theoretical perspective of homophily, which focuses on how people prefer to interact with others who are similar to themselves, it was hypothesized that people who are married or who have children will perceive more coworker support and supervisor support than others. The data set of the 2002 National Study of the Changing Workforce was used. It contained 3,368 cases …

An Investigation Of The Relationships Among Instructional Congruence, Burnout And Attrition In Undergraduate Music Theory Students, Whitney Blaire Berry Jan 2013

An Investigation Of The Relationships Among Instructional Congruence, Burnout And Attrition In Undergraduate Music Theory Students, Whitney Blaire Berry

Theses and Dissertations

Music theory is a core course in all undergraduate music degree programs. Students enter this course with varying degrees of prior subject matter knowledge, which presents a challenge to music theory teaching and learning. An incongruence between the student's prior knowledge and the level of instruction can negatively affect learning, mental health and persistence in the course sequence.

The purpose of this study was to determine what relationships exist among instructional congruence, burnout and attrition in undergraduate music theory students. A survey was developed and administered to music theory students at four universities in the upper Midwest (95.5% response rate, …

Is There A Disconnect? Comparing North Dakota And National Geography Standards, Lori Jean Young

Theses and Dissertations

In 1994, Geography for Life was published. From this publication the national geography and state geography standards were developed. These national standards were the basis of the state standards.

North Dakota Studies is a Grade 9-12 course offered in North Dakota high schools. This course is offered under mandate in North Dakota high schools, so a broad range of data could be obtained by contacting those teachers.

Prior research has shown that students exposed to 3-D geographic technologies have better spatial abilities than students without a technologic background. A recent study showed that adults wanted to know more about geography …

Promoting The Case For Using A Research Journal To Document And Reflect On The Research Experience, David Lamb Jan 2013

Promoting The Case For Using A Research Journal To Document And Reflect On The Research Experience, David Lamb

Research outputs 2013

This paper draws upon a personal research journey and makes the case for recording this experience using a research journal. tol The context for this paper is based on a study of family life and leisure, which collected data using more traditional qualitative methods, namely focus groups and interviews with pre-birth and post birth couples and leisure managers in New Zealand. The research design for this study was based on phenomenology, where the experience of the subjects being studied was significant and involved developing an understanding of the lived experiences of pre-birth and post-birth couples, where the way they acted …

Patterns Of Physical And Psychological Development In Future Teenage Mothers, Daniel Nettle, Thomas E. Dickins, David A. Coall, Paul De Monrnay Davis

Research outputs 2013

Background and objectives: Teenage childbearing may have childhood origins and can be viewed as the outcome of a coherent reproductive strategy associated with early environmental conditions. Life-history theory would predict that where futures are uncertain fitness can be maximized through diverting effort from somatic development into reproduction. Even before the childbearing years, future teenage mothers differ from their peers both physically and psychologically, indicating early calibration to key ecological factors. Cohort data have not been deliberately collected to test life-history hypotheses within Western populations. Nonetheless, existing data sets can be used to pursue relevant patterns using socioeconomic variables as indices …

Contextual Support For Innovation In An Australian Financial Services Firm, Agung N. Fahrudi, Denise E. Gengatharen, Yuliani Suseno, Craig Standing

Research outputs 2013

Organizational learning can facilitate innovation and it is affected by internal and external contexts. Leaders can provide internal contextual support for learning to occur in the organization in order to respond to changes in external contexts. However, there are limited studies about how leaders affect innovation in financial services firms. This paper applies Crossan et al.’s (1999) 4I framework to examine the impact of internal and external factors on an organization’s learning process and the extent of its innovation. An on-going case study of a large Australian financial services firm is used to gain insights about contextual support for innovation. …

The Road To Damascus Leads To One Infinite Loop: An Introspective Adventure Into Apple Computer Customer Evangelism, Nathalie S. Collins Jan 2013

The Road To Damascus Leads To One Infinite Loop: An Introspective Adventure Into Apple Computer Customer Evangelism, Nathalie S. Collins

Research outputs 2013

This paper draws on a literature review, conceptual development and an introspective narrative to explore “quintessence” and Customer Evangelism (CE). Quintessence, a mystical connection between the customer and a product, elevates a profane product experience to the sacred. This paper argues that the quintessential moment, the root of the Customer Evangelism conversion experience, awakens or redirects a propensity toward evangelistic behaviour. As the moment of conversion, quintessence is as pivotal as it is mystical. Tourism entities can attempt to nurture a seemingly religious experience, and for some entities quintessence is an unexpected by-product. An introspective narrative, through one of the …

Risk Blindness Among Temporary Migrant Workers In Australia, Susanne T. Bahn Jan 2013

Risk Blindness Among Temporary Migrant Workers In Australia, Susanne T. Bahn

Research outputs 2013

Workers can suffer from risk blindness in that they fail to recognise workplace hazards or their severity, thereby jeopardising their health and safety and their organisation’s performance. This problem is exacerbated in organisations who employ temporary migrant workers because not only do ‘home country’ cultural factors influence the way they understand and see risks; more critically the temporary nature of their work contract can reduce their commitment, and perceived responsibility, to acknowledge risk. The result of which could expose temporary migrant and domestic workers to increased incidents of work-related injury, disease and fatalities. This paper presents this problem through the …

The Unmet Promise Of Occupational Health And Safety Harmonisation: Continued Complexity For Small, Multi-Jurisdictional Firms, Susanne T. Bahn, Susan Mayson, Rowena Barrett, Llandis G. Barratt-Pugh Jan 2013

The Unmet Promise Of Occupational Health And Safety Harmonisation: Continued Complexity For Small, Multi-Jurisdictional Firms, Susanne T. Bahn, Susan Mayson, Rowena Barrett, Llandis G. Barratt-Pugh

Research outputs 2013

Harmonisation of state-based occupational health and safety (OHS) regimes is a Council of Australian Governments (COAG) initiative designed to ‘cut red tape’ for Australian firms. However Western Australia’s, South Australia’s and Victoria’s lack of harmonisation makes it problematic for firms that conduct business in multiple jurisdictions. In this paper we investigate what impacts harmonisation has on firms generally and specifically smaller, multi-jurisdictional firms. First, we look at the requirements of the model WHS Act and what it said about managerial responsibilities for OHS. We focus on the due diligence clause which places personal liability on company directors or persons conducting …

Using Sensemaking As A Diagnostic Tool In The Analysis Of Qualitative Data, Megan Paull, Ian Boudville, Helen Sitlington Jan 2013

Using Sensemaking As A Diagnostic Tool In The Analysis Of Qualitative Data, Megan Paull, Ian Boudville, Helen Sitlington

Research outputs 2013

Analysis of qualitative data is a process which novice researchers must learn as they progress, and which experienced researchers must negotiate and adapt to suit the study they are undertaking and the data they are collected. The purpose of this paper is to demonstrate how researchers can use sensemaking to diagnose and explain phenomena in ordinary situations, and how it can be added as an analysis and interpretation tool in their toolkit. This paper describes the use of sensemaking employed as a tool for diagnosis of the processes which take place when a manager encounters perceived declining performance in an …
