Path Dependence In Tax Subsidies For Home Sales, Lily Kahng
Path Dependence In Tax Subsidies For Home Sales, Lily Kahng
Faculty Articles
At a time of looming fiscal crisis and virtual unanimity that tax expenditures must be curtailed, tax subsidies for homeownership stand out as among the most costly and unfair of these expenditures. As a result of tax subsidies for homeownership, the government foregoes billions of dollars in revenue each year, most of which benefits wealthy taxpayers. Moreover, subsidies for homeownership encourage overinvestment in housing and underinvestment in other business sectors, which impedes economic productivity, jobs creation and the ability of U.S. businesses to compete in the global marketplace.
Scholars and commentators have analyzed extensively the tax subsidy for home mortgage …
Usage-Based Collection Evaluation With A Curricular Focus, Karen C. Kohn
Usage-Based Collection Evaluation With A Curricular Focus, Karen C. Kohn
Library Faculty Scholarship
Systematic evaluation of a library’s collection can be a useful tool for collection development. After reviewing three evaluation methods and their usefulness for our small academic library, I undertook a usage-based evaluation, focusing on narrow segments of our collection that served specific undergraduate courses. For each section, I collected data on the number of books owned, number of checkouts in the past four years, and number of unique books used. Using examples from the data, I discuss possible ways to interpret and act on the data. I also note how the knowledge gained from this evaluation fits into the larger …
The Beauty Standard Trade-Off: How Ebony, Essence, And Jet Magazine Represent African American/Black Female Beauty In Advertising In 1968, 1988, And 2008, Jerrika M. Anderson Edwards
The Beauty Standard Trade-Off: How Ebony, Essence, And Jet Magazine Represent African American/Black Female Beauty In Advertising In 1968, 1988, And 2008, Jerrika M. Anderson Edwards
Scripps Senior Theses
How do magazines that target the Black community represent Black/African American female beauty within a society that pushes a Eurocentric beauty ideal? Are these publications affected by the dominant ideal, do they resist the ideal with their own Afrocentric beauty standards, or do they find some type of compromise between the two? In this thesis, I propose that these publications present a compromise between Eurocentric and Afrocentric ideals but to the detriment of Black/African American women. To investigate my research questions, I conducted a content analysis of the advertisements in three periods of time, 1968, 1988, and 2008, in three …
Mocking Equality: Reproduction Of Gender Hierarchy In Collegiate Mock Trial, Lily M. Foss
Mocking Equality: Reproduction Of Gender Hierarchy In Collegiate Mock Trial, Lily M. Foss
Scripps Senior Theses
During the information sessions that the Scripps Mock Trial Team hosts at the beginning of the school year for those interested in mock trial, it's customary for all the returning team members to talk about why we decided to join mock trial in college. We had no team at my high school, but at the end of my senior year, my AP American Government teacher decided that having a mock trial in class would give us valuable insight into the American legal system. I was chosen to give the closing statement for the defense, and I found my calling. My …
Desde Una Identidad Transnacional A La Hibridez: La Formación De La Nueva Identidad Nikkei En La Población Japonesa En El Perú, Nina Pincus
Scripps Senior Theses
Over the past century, the Japanese community in Peru has grown to be the second largest in South America. Their arrival and subsequent success in small businesses posed a threat to the Peruvian attempt to “whiten” their population. Because of this, racial conflicts arose between the Japanese and Peruvians, leading to the widespread “Yellow Peril” epidemic. Anti-Japanese sentiments caused immigration reduction laws and in the years leading up to WWII, tensions grew. During this time, the Japanese community remained ethnically close, maintaining transnational ties with Japan. This changed after the war, when their sojourner mentality changed to the permanence of …
How Modern Family And Parenthood Represent Equal Parenting: A Feminist Discourse, Samantha B. Coffin
How Modern Family And Parenthood Represent Equal Parenting: A Feminist Discourse, Samantha B. Coffin
All Graduate Theses, Dissertations, and Other Capstone Projects
Within recent discourses about parenting, the concept of equal parenting and fathering is a prominent theme. I have chosen two popular television shows that portray families to see if they represent ideas about equal parenting. I have identified three prominent themes that researchers agree comprise equal parenting: parents' equal power in decision-making, fathers challenging masculine gender expectations by actively nurturing children, and fathers sharing household duties. The findings of this thesis conclude that the television shows Parenthood and Modern Family are contradictory in their representations of equal parenting themes. Parenthood has strong examples of equal parenting, but remains more conservative …

All Graduate Theses, Dissertations, and Other Capstone Projects
The purpose of this capstone project was to provide training materials to social workers that is relatable and practical regarding researched best practices for engaging families during the Family Group Conference process. In Olmsted County, Family Group Conferences have been utilized since 1996 becoming an engrained practice model and a cornerstone of permanency planning for children. The capstone project focused on developing a training manual to enhance current practice in Olmsted County and implement newer best practice strategies throughout the Family Group Conference process--from prior to a referral to a post-conference follow up meetings--to ensure better outcomes for the children …
Evaluation Guide: Mower County Health And Human Services Child Welfare Preventative Programs, Tina Meyer
Evaluation Guide: Mower County Health And Human Services Child Welfare Preventative Programs, Tina Meyer
All Graduate Theses, Dissertations, and Other Capstone Projects
The Child Abuse Prevention and Treatment Act (CAPTA) of 2010 identifies that State child protection systems should include interventions to prevent the occurrence and reoccurrence of child maltreatment. The Juvenile Protection Provisions of the Juvenile Court Act, describes the requirement of county social service agencies to provide reasonable efforts to prevent placement prior to the removal of any child from the home. Family poverty is cited as a central risk factor for child maltreatment. Vulnerability has an exponential relationship to risk exposure, and risk should not be considered as linear. Thus, families with multiple risk factors are at increased likelihood …

The Association Between Sexual Orientation And Labor Market Outcomes, Justine A. Bulgar-Medina
The Association Between Sexual Orientation And Labor Market Outcomes, Justine A. Bulgar-Medina
Master's Theses and Capstones
The purpose of this research is to begin to describe various aspects of interactions with the labor market (e.g. employment status, individual income, household income) based on sexual orientation, using nationally representative data from the General Social Survey. Much of the previous research suggests that any observed differences can be attributed to employee choice of occupation or other voluntary aspects of employment. Furthermore, previous research has found wage premiums for gay women and penalties for gay men, with sexual orientation, not gender, as the lead cause. Based on this current data, I assert that any observed difference is an artifact …

The Face Of Fakes: U.S. Consumers And Counterfeit Fashion Products, Karen Edwards J.D., Jason Carpenter
The Face Of Fakes: U.S. Consumers And Counterfeit Fashion Products, Karen Edwards J.D., Jason Carpenter
Faculty Publications
Counterfeit products pose a serious threat to fashion product brand owners and to the world economy. While research on the demand side of counterfeiting has grown over the past two decades, few extant studies have been conducted among non-student consumers outside Asia and Europe and few studies have focused on product categories other than consumer electronic-related items. Using a sample of U.S. consumers (N=305), the current research investigates consumer attitudes in the context of fashion products. Findings suggest that gender and education are the two variables most frequently related to purchase intention for counterfeits, beliefs about counterfeit products, and ethicality. …

Offices Of Goodness: Influence Without Authority In Federal Agencies, Margo Schlanger
Offices Of Goodness: Influence Without Authority In Federal Agencies, Margo Schlanger
Law & Economics Working Papers
Inducing governmental organizations to do the right thing is the central problem of public administration. If Congress or another principal wants a federal executive agency to pay attention to a value that constrains or conflicts with the agency’s overall mission — that additional value is here labeled, generically, "Goodness" — the principal often creates a subsidiary agency office — an "Office of Goodness." Both policymakers and scholars should care about how and when Offices of Goodness work. Yet while Offices of Goodness are frequently established in federal agencies, they are nearly invisible in scholarship. And the resulting knowledge gap is …
Formalism And Employer Liability Under Title Vii, Samuel R. Bagenstos
Formalism And Employer Liability Under Title Vii, Samuel R. Bagenstos
Law & Economics Working Papers
Most lawyers, law professors, and judges are familiar with two standard critiques of formalism in legal reasoning. One is the unacknowledged-policymaking critique — that formalist reasoning purports to be above judicial policymaking but instead simply hides the policy decisions offstage. The other is the false-determinacy critique — that formalist reasoning purports to reduce decision costs in the run of cases by sorting cases into defined categories, but that instead of going away the difficult questions of application migrate to the choice of the category in which to place a particular case. Last Term’s decision in Vance v. Ball State University …
Not Peace But The Sword: Violence In Contemporary American Catholic Literature, Michael O'Connell
Not Peace But The Sword: Violence In Contemporary American Catholic Literature, Michael O'Connell
Dissertations
In this dissertation, I argue that violence is a consistent theme in contemporary (post-1945) fiction written by American Catholics, and that these authors employ violence as an aesthetic strategy that is best, and perhaps only, understood when approached through the philosophical and imaginative discourses of their Catholic faith. While the violence in contemporary fictions can be viewed as a product of the power dynamics at work in the modern age, I contend that these power dynamics are not a central concern for Catholic authors. Rather, in Catholic fiction, violence functions as a catalyst that leads characters toward a moment of …
Risk Perception In Cardiovascular Disease, Michelle Ellen Block
Risk Perception In Cardiovascular Disease, Michelle Ellen Block
Dissertations
Cardiovascular disease (CVD) remains among the leading causes of death in the United States despite widespread knowledge about risk factors as well as effective primary prevention strategies. Risk perception is a complex phenomenon that plays an important role in how persons view disease and ultimately how they make health behavior choices. This study is supported by the knowledge that few studies have examined how persons perceive cardiovascular risk or the variables thought to contribute to the formation of risk perception.
Purpose: The purpose of this study was to examine how accurately persons perceive personal risk for cardiovascular disease and identify …
Taboo Lexeme Conditioning And Obscenities In American English, Alexander Werny
Taboo Lexeme Conditioning And Obscenities In American English, Alexander Werny
Master's Theses and Doctoral Dissertations
Taboo Lexeme Conditioning refers to the neurological, psychological, and sociological conditioning required during lexical acquisition for a native speaker to treat or experience certain lexemes as highly taboo. Taboo words differentiate both neurologically from non-emotional or non-taboo lexemes, and lexically person to person, in at least 4 ways: 1) they exhibit high activity in the emotional and moral processing structures of the limbic system, and can activate, or be uttered, independently of cortical structures involved in propositional language processing; 2) they generally receive a high amount of negative emotional response during lexical acquisition and subsequent usage, which affects how they …
Truth Commission Impact: A Participation-Based Implementation Agenda, Tara J. Melish
Truth Commission Impact: A Participation-Based Implementation Agenda, Tara J. Melish
Journal Articles
With a focus on truth commissions, this Essay argues for a new approach to assessing the impact or effectiveness of transitional justice mechanisms. It recognizes at least four discernible approaches to impact assessment in the current literature. I term these “Quantifiable Truth,” “Victim Perception,” “Formal Political Rights,” and “Redistributive Development.” While each has added important and complementary insights to the field, each has also exhibited important weaknesses in its ability to speak persuasively to the question of meaningful long-term impact on the societal dynamics and institutions that lead to violence in the first place. To help fill this gap, I …

"The Rise And Fall Of Welfare Health Legislation In 20th Century Chile: A Case Study In Political Economy Of Law", Jaime Llambias-Wolff
PhD Dissertations
This dissertation analyzes the economic and political dynamics of health legislation in Chile throughout the 20th century. Law is understood as a process, in which legislation is the consequence of the political interaction between different stakeholders within a specific socio-economic and political reality. Law thus performs as a function of its political dynamics. This case study discusses lawmaking in its multifaceted character fulfilling different roles, understanding health legislation in Chile as the expression of how society articulates and represents different interests and how health reforms are determined by the influence and capabilities of interest groups. The legal framework is situated …
Animal Mobilegalities: The Regulation Of Animal Movement In The American City, Irus Braverman
Animal Mobilegalities: The Regulation Of Animal Movement In The American City, Irus Braverman
Journal Articles
The initial focus of “animobility” scholarship has been on the dynamic physical geographies of animals. This article extends the meaning of animobility to explore the ways in which animals are affected — and, in fact, constituted — by law, as well as the ways in which they affect and constitute law, which I call “mobilegalities.” Specifically, I ask how animobility in contemporary American cities translates into the animals’ legal mobility, and how laws can adapt to animobility and the ensuing mobilegality by setting “traps” that then immobilize the animals. This article demonstrates, finally, that law is not a static narrative …
Three Facets Of Pau Casals' Musical Legacy, Silvia Maria Lazo
Three Facets Of Pau Casals' Musical Legacy, Silvia Maria Lazo
Graduate Student Theses, Dissertations, & Professional Papers
Pau Casals (1876-1973, better known to American audiences as Pablo Casals) was a notable Catalan cellist, conductor and composer, also widely known as a humanitarian. He was raised in El Vendrell, a small village in Catalonia (Spain). He went into exile in Prades, France in 1939, towards the end of the Spanish Civil War, subsequently relocating to Puerto Rico in 1957. In October 1945, following the end of World War II, the lack of Allied intervention in Spain ignited Casals' international artistic boycott, wherein Casals vowed not to perform in any country recognizing General Francisco Franco's regime. To date, a …
Perception And Decision At The Threshold Of Tort Law: Explaining The Infrequency Of Claims, David M. Engel
Perception And Decision At The Threshold Of Tort Law: Explaining The Infrequency Of Claims, David M. Engel
Journal Articles
Although numerous studies have confirmed that tort victims rarely litigate and that most simply "lump" their losses, we lack an understanding of why this should be so. Why do the vast majority of injured persons choose inaction over action? Explanations relying on rational actor theories on the one hand or cultural determinism on the other have been sharply challenged by recent studies of mind, culture, and cognition, particularly with respect to individual responses to physical trauma and disablement. This article, drawing on a broad interdisciplinary literature dealing with injury victims, proposes a new model of perception and decision by persons …
Multidimensionality Is To Masculinities What Intersectionality Is To Feminism, Athena D. Mutua
Multidimensionality Is To Masculinities What Intersectionality Is To Feminism, Athena D. Mutua
Journal Articles
Committed to intersectionality theory in her feminist work, the scholar Juliet Williams expressed the sentiment that “multidimensionality is to masculinities theory, what intersectionality is to feminism.” She did so in the context of a debate about whether intersectionality theory might capture the complexity of men’s lives, particularly men of color’s lives, as well as does multidimensionality theory, given that the latter is based in large part on the former. This paper, briefly explores the intellectual history of multidimensionality theory, concedes that intersectionality, a powerful analytical tool that has matured and gone global, could easily be used and is in part …
Authority To Proscribe And Punish International Crimes, Guyora Binder
Authority To Proscribe And Punish International Crimes, Guyora Binder
Journal Articles
Although criminal jurisdiction is usually exercised by governments, offenses can also be proscribed by international law, and punishment can be imposed by international tribunals. This article critically examines the legitimacy of such exercises of international criminal jurisdiction. It reasons that criminal law can plausibly be justified as a cooperative institution that achieves the public good of a rule of law, with its attendant benefits of social peace and equal dignity of persons. It then argues that such a beneficial rule of law requires a punishing authority with the executive capacity to protect those it claims to regulate. It would follow …
Bright Lines, Black Bodies: The Florence Strip Search Case And Its Dire Repercussions, Teresa A. Miller
Bright Lines, Black Bodies: The Florence Strip Search Case And Its Dire Repercussions, Teresa A. Miller
Journal Articles
Part I is a brief history of Search and Seizure law, focusing on seismic doctrinal shifts that occurred from the 1950s to the present. As a framework for the important cases, the Founders’ concerns about abuse of governmental authority are discussed, as well as the rights protected by the Fourth Amendment. Various governmental programs will also be presented, such as the War on Drugs and its call for a large-scale federal anti-drug policy, first initiated by President Richard Nixon in 1969. Part II is a description of the central reasoning presented in Florence v. Board of Chosen Freeholders, including the …

The Dao That Can Be Spoken Is Not The Eternal Dao: National Role Conceptions And The Effects On Chinese Foreign Policy Behavior, Adam Stephan Jankowski
Senior Independent Study Theses
Chinese foreign policy is an extremely dynamic factor in today's world. One way of trying to describe Chinese foreign policy is by determining national role conceptions of Chinese leaders. The national role conception that Chinese leaders have plays an essential part in the development and implementation of Chinese foreign policy. The different conceptions of China's role in the international system, as determined by Chinese leaders, gives an important contribution to understanding the rise of China as a leading world power. It is obvious that different leaders have had different views regarding what China's position should be in the global community. …

Eat Until You're Full: The Pursuit Of Autonomy And Health Through The Adoption Of Organic Agriculture In Mae Ta, Thailand, Erin Jean Plews-Ogan
Senior Independent Study Theses
This research explores the role that farmers' concerns about health and community autonomy play in the emergence of an organic agriculture movement in the village of Mae Ta in northern Thailand. In the midst of the push for export-oriented and urban-centered development, many rural people have migrated to urban areas for work or adopted contract farming of chemical-intensive cash crops. Yet farmers in Mae Ta chose a unique alternative: sufficiency-based organic polyculture. Why take on such a risk without solid policy and market support for organic agriculture in Thailand? I investigated these questions through six weeks of participant observation and …

Background: Pedestrian crashes are a deterrent to physical activity, especially walking. The purpose of this study was to analyze pedestrian crash characteristics in Clark County, NV and to determine if there was a significant relationship between pedestrian crashes and socio-economic variables.
Methods: Police reported pedestrian crash data collected between January 2009 and December 2011 were analyzed. Frequencies and rates for pedestrian crashes, injuries and deaths were calculated for environmental and human characteristics. Chi square tests were utilized to determine if there were significant differences in environmental and human characteristics for pedestrian injuries and deaths. Zero-inflated negative binomial (ZINB) regression analysis …
