The Traits, Characteristics, And Qualities Of International Christian School Teachers Valued By Third Culture Kids, Dale B. Linton Jan 2013

The Traits, Characteristics, And Qualities Of International Christian School Teachers Valued By Third Culture Kids, Dale B. Linton

Dissertations

The Problem. In this qualitative study, 24 participants, ages 18-30, who had previously attended international Christian schools for at least 2 years at the secondary level, or a combination of 4 years at the primary and middle school levels, were interviewed to determine the traits, characteristics, and qualities they valued in their teachers.

Methodology. Incorporating principles of Grounded Theory, a series of rigorous steps associated with the validity process of Grounded Theory construction was employed. These steps included the simultaneous involvement of the researcher in the data collection and analysis process. Twenty-four participants were interviewed, and written notes were taken …

How Strong Is The Pull Of The Past? Measuring Personal Nostalgia Evoked By Advertising, Altaf Merchant, Kathryn Latour, John B. Ford Jan 2013

How Strong Is The Pull Of The Past? Measuring Personal Nostalgia Evoked By Advertising, Altaf Merchant, Kathryn Latour, John B. Ford

Marketing Faculty Publications

Marketers frequently evoke personal nostalgia in their advertising. To date, scales have been developed to measure the propensity to get nostalgic but not the actual dimensions of personal nostalgia. Results from four studies show that advertising-evoked personal nostalgia comprises four correlated but distinct dimensions: past imagery, positive emotions, negative emotions, and physiological reactions. This multidimensional scale showed a high level of validity and reliability. Moreover, due to careful choice of sampling frames, the study demonstrates a high level of external generalizability. Evaluating nostalgia-based advertising using the study's multidimensional scale may provide marketers with strategic insights for developing and fine-tuning advertising …

United States V. Windsor And The Role Of State Law In Defining Rights Claims, Ernest A. Young Jan 2013

United States V. Windsor And The Role Of State Law In Defining Rights Claims, Ernest A. Young

Faculty Scholarship

The Supreme Court’s recent decision in United States v. Windsor is best understood from a Legal Process perspective. Windsor struck down Section 3 of the federal Defense of Marriage Act (“DOMA”), which defined marriage as exclusively between a man and a woman for purposes of federal law. Much early commentary, including Professor Neomi Rao’s essay in these pages, has found Justice Kennedy’s opinion for the Court to be “muddled” and unclear as to its actual rationale. But the trouble with Windsor is not that the opinion is muddled or vague; the rationale is actually quite evident on the face of …

Transparency In International Investment Law: The Good, The Bad, And The Murky, Julie A. Maupin Jan 2013

Transparency In International Investment Law: The Good, The Bad, And The Murky, Julie A. Maupin

Faculty Scholarship

How transparent is the international investment law regime, and how transparent should it be? Most studies approach these questions from one of two competing premises. One camp maintains that the existing regime is opaque and should be made completely transparent; the other finds the regime sufficiently transparent and worries that any further transparency reforms would undermine the regime’s essential functioning. This paper explores the tenability of these two positions by plumbing the precise contours of transparency as an overarching norm within international investment law. After defining transparency in a manner befitting the decentralized nature of the regime, the paper identifies …

Federalism, Liberty, And Equality In United States V. Windsor, Ernest A. Young, Erin C. Blondel Jan 2013

Federalism, Liberty, And Equality In United States V. Windsor, Ernest A. Young, Erin C. Blondel

Faculty Scholarship

This essay argues that federalism played a profoundly important role in the Supreme Court's decision in United States v. Windsor, which struck down the federal Defense of Marriage Act. Arguments to the contrary have failed to appreciate how Justice Kennedy's opinion employed federalism not as a freestanding argument but as an essential component of his rights analysis. Far from being a "muddle," as many have claimed, Justice Kennedy's analysis offered one of the most sophisticated examples to date of the interconnections between federalism, liberty, and equality.

Dreaming Denationalized Law: Scholarship On Autonomous International Arbitration As Utopian Literature, Ralf Michaels Jan 2013

Dreaming Denationalized Law: Scholarship On Autonomous International Arbitration As Utopian Literature, Ralf Michaels

Faculty Scholarship

A completely denationalised law is of course a utopia. But it is a utopia not just in the broad sense of being unrealistic, at least for the present, and perhaps also for the future. No, it is a utopia in the very literal sense of the word. Recall what utopia means in Greek: no place. Delocalised arbitration, non-state law, is, quite literally, no-place law. It thus makes up a utopia in the central meaning of the term.

International Commercial Arbitration should be just about money. But its scholarship is full of invocations of dreams, visions, faith, utopia. These are not …

Governing The Post-Socialist Transitional Commons: A Case From Rural China, Shitong Qiao Jan 2013

Governing The Post-Socialist Transitional Commons: A Case From Rural China, Shitong Qiao

Faculty Scholarship

When the collective declines, who manages the collective-owned land? When the socialist state fails, who possesses the state-owned river? This Article concerns the governance of land and natural resources that are still owned by collectives or the state in rural China. No effective community governance has evolved in rural China to fill the authority vacuum left by the dissolution of the people’s commune system. As a result, such land and natural resources have become real commons. In describing these I use the term “transitional commons” to indicate both the crucial influence of the transitional political legal environment in their emergence …

The Critical Theory Of Religion: From Having To Being, Rudolf J. Siebert, Michael R. Ott, Dustin J. Byrd Jan 2013

The Critical Theory Of Religion: From Having To Being, Rudolf J. Siebert, Michael R. Ott, Dustin J. Byrd

Peer Reviewed Articles

In our essay we trace the evolution of the critical theory of religion, or comparative dialectical religiology, out of the critical theory of society of the Institute for Social Research or the Frankfurt School. For us, the history of religions reflects the history of humanity’s intellectual and spiritual evolution. As we developed our critical theory of religion, we have tried to supersede concretely the great accomplishments of three generations of critical theorists, particularly in the field of religion. One main theme of our critical theory of religion is the dialectic of two modes of existence: having and being; egoism and …

Anchor Institutions On The Michigan Street Corridor: An Economic Case Study, Alex Kontras Jan 2013

Anchor Institutions On The Michigan Street Corridor: An Economic Case Study, Alex Kontras

SPNHA Review

As large employers, landholders, and purchasers, anchor institutions hold great potential for benefiting the local economy. This study examines the current literature on anchor institutions and how such potential can be unleashed. Drawing on two established economic development strategies, locality development and local import substitution, this paper describes how successful co-optation of anchors by local economic developers can produce mutually beneficial results. A cluster of anchor institutions in downtown Grand Rapids, Michigan, where three distinct projects are developing from an intentional anchor institution economic development strategy, serves as an illustrative case study.

The Regulation And Control Of Bail Recovery Agents: An Exploratory Study, Brian R. Johnson, Ruth S. Stevens Jan 2013

The Regulation And Control Of Bail Recovery Agents: An Exploratory Study, Brian R. Johnson, Ruth S. Stevens

Peer Reviewed Publications

This article explores the current status of the licensing and regulation of bail recovery agents in the United States. By reviewing state legislative and administrative codes in all the 50 states, this study found that 24 states control bail recovery agents through licensure or the imposition of other occupational regulations. These state controls include age, criminal history, and pretraining and educational requirements; some states also require continuing education and training for licensure and/or regulation. In contrast, 18 states have no licensing or other occupational requirements for bail recovery agents. These findings raise questions about the actual utility and function of …

Flexibility In International Agreements, Laurence R. Helfer Jan 2013

Flexibility In International Agreements, Laurence R. Helfer

Faculty Scholarship

The form and substance of international agreements are intimately linked. This insight, recently articulated by scholars working at the intersection of international law (IL) and international relations (IR) (Guzman 2005; Hathaway 2005; Raustiala 2005), has important implications for the study of legalized interstate cooperation. The relationship between form and substance affects issues central to the international legal system, including treaty design, the choice between hard and soft law, delegation of authority to international organizations and tribunals, and treaty compliance. The form and substance equation is, in turn, shaped by the many uncertainties that pervade international affairs, including insufficient information about …

Framing News In 140 Characters: How Social Media Editors Frame The News And Interact With Audiences Via Twitter, Ben S. Wasike

Communication Faculty Publications

The social media editor, the newsroom liaison to the digital world, is the newest position in journalism. This study used content analysis to examine how these editors interacted with audiences on Twitter; which frames occurred within the news articles they posted via Twitter and if these two points of foci varied according to the media format the SMEs represent—print vs. TV news. TV SMEs were more personal in their interaction with their Twitter followers. They also posted more articles that carried the technology frame while print SMEs emphasized the human interest, conflict and economic impact frames the most. Overall, all …

Resilience Governance Through Serious Energy Gaming, Adrian V. Gheorghe, Dan V. Vamanu

Engineering Management & Systems Engineering Faculty Publications

Physical analogies emphasizing cooperative behavior in systems are explored and integrated into so called 'serious energy games', to contribute in a better understanding, monitoring and good governance of some of the complex security issues confronting the evolvement of contemporary energy systems. It is believed that such exercises might be supportive in the necessary attempt, by the many stakeholders and actors / agents involved, to bring balance to prevailing policies of which seems to be “Go change yourself - in a resilient fashion!” An extrapolation of several findings to other than energy systems tempted to implement drastic changes based on substantial …

Election System Of Bosnia And Herzegovina: Catalyst Of Unsuccesful Democratization, Adis Arapovic, Bedrudin Brljavac Jan 2013

Election System Of Bosnia And Herzegovina: Catalyst Of Unsuccesful Democratization, Adis Arapovic, Bedrudin Brljavac

Khazar Journal of Humanities and Social Sciences

Bosnia and Herzegovina has faced serious democratic obstacles in the post-war period due to huge shortcomings in its Election Law, among other things. That is, implementation of human rights, and in this way right to vote, is obtruded by current Constitution and Election Law of BiH as it provides serious basis for discrimination. In fact, present election system in the country is not completely grounded in general, equal and secret right to vote and direct election for all citizens of BiH who have a voting right. Still, election system has to contain basic principles of democratic election law: principle of …

An Empirical Assessment Of Corporate Environmental Crime-Control Strategies, Sally S. Simpson, Carole Gibbs, Melissa Rorie, Lee Ann Slocum, Mark A. Cohen, Michael Vandenbergh

Journal of Criminal Law and Criminology

Corporate illegality is often attributed to greed by corporate managers and insufficient legal safeguards. Underlying this argument is an explicit critique of corporate crime regulatory systems. Yet there is little systematic investigation of the relative merits of different types or components of crime-control strategies; research comparing more punitive command-and-control strategies with self-regulatory approaches is particularly lacking. In this Article, we assess these crime prevention-and-control mechanisms in the context of individual and situational risk factors that may increase the likelihood of illegal behavior in the environmental arena. We use data drawn from two groups of business managers who participated in a …

This article covers three years of Transnational Legal Practice developments outside of the US. (It is the companion piece to 47 Int'l Law. 499 (2013) which discusses US developments.) This article discusses the approval of an Alternative Business Structure licensing system by the UK Solicitors Regulation Authority and its subsequent issuance of ABS licenses. The second section reviews the emergence of the “Troika” as a new regulatory influence in Europe, citing as an example the joint ABA-CCBE letter to the IMF. (The Troika refers to the International Monetary Fund, the European Central Bank, and the European Commission.) The third section …

Ethnic Identity On Display: West Indian Youth And The Creation Of Ethnic Boundaries In High School, Bedelia N. Richards Jan 2013

Ethnic Identity On Display: West Indian Youth And The Creation Of Ethnic Boundaries In High School, Bedelia N. Richards

Sociology and Anthropology Faculty Publications

The black immigrant population in New York City has grown exponentially since 1990, such that West Indians now compose the majority of the black population in several neighbourhoods. This article examines how this ethnic density manifests among youth in high school, and how it has influenced ethnic identity formation among second-generation West Indians. My findings are based on twenty-four interviews and eight months of participant observation in two Brooklyn high schools from 2003 to 2004. The results show that in both schools, Caribbean island identities have become a ‘cool’ commodity within peer groups. Further, although it was important to express …

Free Agents: Should Crowdsourcing Lead To Agency Liability For Firms?, Erin R. Frankrone Jan 2013

Free Agents: Should Crowdsourcing Lead To Agency Liability For Firms?, Erin R. Frankrone

Vanderbilt Journal of Entertainment & Technology Law

Crowdsourcing has emerged as a new production paradigm through which firms outsource traditional employee tasks to an undefined and generally large network of people, the "crowd," in the form of an open call. The relationships between the crowd and the firm vary across different crowdsourcing models and do not represent, either in fact or in theory, the employment or contractor relationships with which the law is familiar. Therefore, the law and the courts are ill-equipped to answer the questions of whether and how liability should attach to firms for the crowd's harmful conduct toward third parties. Agency law is the …

Furious Activity Vs. Understanding: How Much Expertise Is Needed To Evaluate Creative Work?, Learning Research Institute, John Baer, David H. Cropley, Roni Reiter-Palmon

Psychology Faculty Publications

What is the role of expertise in evaluating creative products? Novices and experts do not assess creativity similarly, indicating domain-specific knowledge’s role in judging creativity. We describe two studies that examined how quasi-experts (people who have more experience in a domain than novices but also lack recognized standing as experts) compared to novices and experts in rating creative work. In Study One, we compared different types of quasi-experts with novices and experts in rating short stories. In Study Two, we compared experts, quasi-experts, and novices in evaluating an engineering product (a mousetrap design). Quasi-experts (regardless of type) seemed to be …

The News We Use: A Mixed Methods Analysis Of Cable News Media Polarization, Stephen Lott Jan 2013

The News We Use: A Mixed Methods Analysis Of Cable News Media Polarization, Stephen Lott

Sociology & Anthropology Theses - Archive

The 2012 election is done and the dust has settled, but one cannot overlook the fact that the ever-widening gap between our two main political parties' ideologies and platforms has made it substantially harder for independents and moderates to find their place in the field of politics. The cable news media are complicit in this polarization process by reducing coherent and productive discourse on the issues to ignorant shouting matches between "conservative" republicans and "liberal" democrats, leaving no room for informed discussion or compromise. The 2012 election coverage is a near perfect example of this process, as it was a …

Social Work, Yoga, And Gratitude: Partnership In A Homeless Shelter, Jennifer Davis-Berman, Jean Farkas

Sociology, Anthropology, and Social Work Faculty Publications

This narrative explores the personal lessons learned about life and practice from YogaHome, a yoga program for homeless adults. The yoga program, taught in partnership by a social worker/professor of social work (Jenny) and a yoga teacher (Jean) with 17 years of experience, exemplifies the merging of social work and yogic practices , but also illustrates the evolution of these two professionals in their chosen fields as many of their traditional views, values, intentions, and expectations unraveled and led to a re-revaluation of their professional practices, transforming their personal perspectives on life. This reflection is based on the YogaHome program, …

Managing A Sport Organization: The Impact Of Recruiting, Selecting, And Retaining Elite Level Coaches In Sport, Jonathon Edwards, Marvin Washington

Journal of Applied Sport Management

Hockey clubs in Edmonton, Alberta, Canada are a fascinating setting to study as they merge issues related to youth sport participation and volunteerism with elite level sport development. We examine the management of elite level hockey clubs, through interviews, to understand how the organizations develop and implement processes that enable them to obtain and maintain a positive reputation through the development of elite level hockey players. The results of our analyses show that hockey clubs view the coach as a vital part of creating and maintaining a successful organizational reputation. This study makes two contributions to the sport management literature; …

Embedded, Participatory Research: Creating A Grounded Theory With Teenagers, Shannon Crawford Barniskis

Communication Faculty Publications

Objective – This project, based on a study of the impact of art programs in public libraries on the teenaged participants, sought to show how library practitioners can perform embedded, participatory research by adding participants to their research team. Embedded participatory techniques, when paired with grounded theory methods, build testable theories from the ground up, based on the real experiences of those involved, including the librarian. This method offers practical solutions for other librarians while furthering a theoretical research agenda. Methods – This example of embedded, participatory techniques used grounded theory methods based on the experiences of teens who participated …
