Climbing The Ladder To Leadership And Other (Un) Told Stories Of Black Women Administrators In Higher Education, Marian Muldrow

Journal of the International Association for the Study of the Global Achievement Gap (Archived)

This narrative reflection presented vacillates between an exploration of the historical journey of the Black women and a modern day Black women who is “persisting in the journey toward self-definition…” (Collins, 2000, p. 121). This history eludes to the underrepresentation of Black women that originates in colleges and universities, which results in the underrepresentation in higher education administration. This narrative and interpretative review considers race and highlights factors and barriers that perpetuate the glass ceiling in higher education for Black women.

Dismantling Glass Ceilings: Ethical Challenges To Impasse In The Academy, Debora Y. Fonteneau Jan 2013

Dismantling Glass Ceilings: Ethical Challenges To Impasse In The Academy, Debora Y. Fonteneau

Journal of the International Association for the Study of the Global Achievement Gap (Archived)

This article uses numeric and qualitative data to interrogate the impact of affirmative action policies on shattering glass ceilings and resolving impasse in the academic lives of African Americans. This work takes its trajectory from previous research on glass ceilings (Marina and Fonteneau, 2012). Two brief case studies from both PWIs and HBCUs are mentioned to ponder complex attitudes toward race, gender and power. In extracting meaning from the policies, practices, and cases, it became clear that attitudes toward power and authority are influenced by context, but even more, by an individual’s sense of right and wrong. This work is …

Women Faculty Of Color: Success Stories From The Margins, Bridget Turner Kelly, Kristin Mccann

Journal of the International Association for the Study of the Global Achievement Gap (Archived)

Based on data from a larger, longitudinal study of 22 women faculty on the tenure track, this qualitative study examines the socialization experiences of four women faculty of color (WFOC) who earned tenure at two public, research extensive, predominantly White institutions (PWIs) in the U.S. This study gives voice to WFOC who broke through the glass ceiling of tenure and were promoted to associate professor. Although these women earned tenure, their adjustment as newcomers to the academy was fraught with marginalization for being both women and persons of color. Specifically, the WFOC experienced challenges to their role clarity, self-efficacy and …

Ruth Bader Ginsburg's Equal Protection Clause: 1970-80, Wendy Webster Williams

Georgetown Law Faculty Publications and Other Works

Professor Ruth Bader Ginsburg of Columbia Law School was the leading Supreme Court litigator for gender equality in the crucial decade, 1970-80. In addition to teaching her classes, producing academic articles, and co-authoring the first casebook on sex discrimination and the law, she worked on some sixty cases (depending on how one counts), including over two dozen cases in the Supreme Court. Rumor has it she did not sleep for ten years; her prodigious output gives the rumor some credence. Her impact on the law during that critical decade earned her the title "the Thurgood Marshall of the women's movement" …

“[This] I Know From My Grandfather”: The Battle For Admissibility Of Indigenous Oral History As Proof Of Tribal Land Claims, Hope M. Babcock Jan 2013

“[This] I Know From My Grandfather”: The Battle For Admissibility Of Indigenous Oral History As Proof Of Tribal Land Claims, Hope M. Babcock

Georgetown Law Faculty Publications and Other Works

A major obstacle indigenous land claimants must face is the application of federal evidentiary rules, like the hearsay doctrine, which block the use of oral history to establish legal claims. It is often oral history and stories that tribes rely upon as evidence to support their claims, reducing substantially the likelihood of a tribe prevailing. Indigenous oral history presents unique challenges to judges when faced with its admissibility. Canadian courts have largely overcome these challenges by interpreting evidentiary rules liberally, in favor of the aborigines. As such, Canadian aborigines have enjoyed greater land claim success than indigenous claimants in the …

Civil Rights For The Twenty-First Century: Lessons From Justice Thurgood Marshall's Race-Transcending Jurisprudence, Sheryll Cashin Jan 2013

Civil Rights For The Twenty-First Century: Lessons From Justice Thurgood Marshall's Race-Transcending Jurisprudence, Sheryll Cashin

Georgetown Law Faculty Publications and Other Works

This Essay pays tribute to justice Thurgood Marshall's race-transcending vision of universal human dignity, and explores the importance of building cross-racial alliances to modern civil rights advocacy. justice Marshall's role as a "Race Man" is evident in much of his jurisprudence, where he fought for years to promote equal opportunity and equal justice. As an advocate for all marginalized people, justice Marshall viewed equal justice as transcending race, and this Essay suggests that the multi-racial coalition that supported President Obama aligns with Marshall's vision. The Essay evaluates the civil rights movement through the lens of Justice Marshall's equality analysis, and …

Improper Deportation Of Legal Permanent Residents: The U.S. Government’S Mischaracterization Of The Supreme Court’S Decision In Nijhawan V. Holder, Michael R. Devitt

San Diego International Law Journal

The purpose of this Article is to draw attention to the government’s misinterpretation of the central holding in Nijhawan v. Holder and how it has led to the improper dilution of evidentiary standards in removal proceedings when determining the $10,000 threshold loss requirement under section 101(a)(43)(M)(i) of the INA [hereinafter “M(i)”]. Section II of this article provides a brief doctrinal overview and summary of my proposed procedural methodology; sections III and IV provide essential background information regarding the Supreme Court’s important pre-Nijhawan opinions and the inconsistent methods circuit courts have applied when calculating the monetary threshold under the fraud or …

A High Seas Requirement For Inciters And Intentional Facilitators Of Piracy Jure Gentium And Its (Lack Of) Implications For Impunity, Jonathan Bellish

San Diego International Law Journal

Around 2005, maritime piracy made a troubling resurgence three quarters of a century after a consensus had been reached that the age of piracy had permanently ended. Yet piracy returned in a slightly different form, with pirates relying more on land-based facilitators than their historical counterparts. Maritime piracy’s reappearance made ripe for consideration the question of whether a facilitator of maritime piracy must be physically present on the high seas while facilitating in order to be subject to universal jurisdiction. This Article undertakes an analysis of the text, statutory context, history, and policy impetus behind UNCLOS art. 101 as it …

Naked Dishonesty: Misuse Of A Social Security Number For An Otherwise Legal Purpose May Not Be A Crime Involving Moral Turpitude After All, Nathanael C. Crowley Jan 2013

Naked Dishonesty: Misuse Of A Social Security Number For An Otherwise Legal Purpose May Not Be A Crime Involving Moral Turpitude After All, Nathanael C. Crowley

San Diego International Law Journal

This Comment questions whether the misuse of a Social Security number for an otherwise legal purpose is a crime involving moral turpitude. It begins with a history of moral turpitude and its initial connection to immigration law in the United States. Through a close analysis of misuse of a Social Security number for an otherwise legal purpose as a crime involving moral turpitude in modern cases, this Comment will examine the role of fraud and dishonesty in the question. The analysis reveals a critical distinction between crimes involving dishonesty and crimes involving fraud. This distinction shows that crimes involving naked …

The Moral Significance Of Economic Life, Andrzej Rapaczynski Jan 2013

The Moral Significance Of Economic Life, Andrzej Rapaczynski

Faculty Scholarship

Much of the modern perception of the role of economic production in human life – whether on the Left or on the Right of the political spectrum – views it as an inferior, instrumental activity oriented toward self-preservation, self-interest, or profit, and thus as essentially distinct from the truly human action concerned with moral values, justice, and various forms of self-fulfillment. This widely shared worldview is rooted, on the one hand, in the Aristotelian tradition that sees labor as a badge of slavery, and freedom as lying in the domain of politics and pure (not technical) knowledge, and, on the …

Agriculture Under Threat - A Crisis Of Confidence? The Solution: Redefine Adventitious Presence Maximum Levels From Zero To Zero++, Mark Perry, Ramesh Karky

Canadian Journal of Law and Technology

The issue of Adventitious Presence (AP) of genes, those that are not “naturally” present in food and crops but rather have been placed there using recombinant deoxyribonucleic acid (DNA) technology, has become a hot issue for producers and consumers. It can also be a major problem for exporters. Part of this problem is the reality that zero presence is now impossible to guarantee in some crops and products. Pressure has arisen to establish a Low Level Presence (LLP) threshold, one that is above zero, to be determined at an international level. This would allow crops to be imported and exported …

C-11 Et L'Information Sur Le Régime Des Droits: Regard Rétrospectif Et Prospectif, Antoine Guilman

Canadian Journal of Law and Technology

Corporate Cyber-Censorship: The Problems With Freedom Of Expression Online, Max Rothschild

Canadian Journal of Law and Technology

This article will explore the problem of the applicability of human rights law to the corporate entities that own and enable the operation of the Internet. The focus will be the status of the right to freedom of expression online, and the different possibilities that have been suggested in order to ensure that users have and are able to exercise this right. As the Internet is a communicative tool that allows for an unprecedented global discourse, freedom of expression is naturally of primary importance in the online context.

Automatic Detection Of Polypoid Skin Lesions: The Squash Sign, Saurabh G. Karnik Jan 2013

Automatic Detection Of Polypoid Skin Lesions: The Squash Sign, Saurabh G. Karnik

Masters Theses

“Earlier detection of malignant melanoma can save lives. Automatic in-vivo methods of melanoma detection including smart-phone applications are now available, but specificity is low, i.e. too many benign lesions are detected as possible melanomas. Polypoids, elevated and rounded lesions are one class of benign lesions. These raised lesions with piecewise circular borders, predominantly intradermal nevi and cutaneous polyps (IDNs), are always benign. Variegated coloring present in polypoid lesions can lead physicians to perform an unneeded biopsy. Contact dermatoscope plates with gel squash these lesions, leaving a “squash sign” marker of benignancy which can be automatically detected. We present a method …

"Children Are Different": Constitutional Values And Justice Policy, Elizabeth S. Scott Jan 2013

"Children Are Different": Constitutional Values And Justice Policy, Elizabeth S. Scott

Faculty Scholarship

This essay explores the importance for Eighth Amendment jurisprudence and for juvenile crime regulation of Miller v. Alabama (2012) and two earlier Supreme Court opinions rejecting harsh sentences for juveniles. It argues that the Court has broken new ground in defining juveniles as a category of offenders who are subject to special Eighth Amendment protections. In Miller and in Graham v. Florida (2010) particularly, the Court has applied to juveniles' non-capital sentences the rigorous proportionality review that, for adults, has been reserved for death sentences. The essay then turns to the implications of the opinions for juvenile crime policy, arguing …

Fabry-Perot Interferometer Based Co₂ Sensor Using Ionic-Liquid, Mujahid Abdul Jan 2013

Fabry-Perot Interferometer Based Co₂ Sensor Using Ionic-Liquid, Mujahid Abdul

Masters Theses

"Anthropogenic greenhouse gas emission has become an eminent problem today especially CO₂ gas emission is of major importance. Statistics show that CO₂ concentration is consistently increasing in atmosphere every year. Having cognizance of this problem, better CO₂ absorbents, ionic liquids, has been suggested through this thesis. To prove Ionic liquid's efficiency, a unique sensor was developed by a sophisticated fabrication using Femto-second (fs) laser. Sensor is built to work as an extrinsic Fabry-Perot Interferometer (EFPI) to sense CO₂. EFPI sensor consists of a glass tube fused between two single mode fibers, and a miniature hole is fabricated in the tube …
