Disaster, Resilience And Security In Global Cities, Tim Prior, Florian Roth
Disaster, Resilience And Security In Global Cities, Tim Prior, Florian Roth
Journal of Strategic Security
Today the majority of the globe’s inhabitants live in urban areas, and according to all prognoses, cities will continue to grow in the coming decades. Global cities are also becoming increasingly connected as a result of economic, political, cultural and demographic globalization. In the context of urban security management, the growing complexity these connections bring may present a double-edged sword: global cities can be both the most secure and the most dangerous places to be when disaster strikes. Developing appropriate mechanisms to prepare for and cope with complex crises in cities will, in the future, be a key aspect of …
Lessons From Japan: Resilience After Tokyo And Fukushima, Michelle L. Spencer
Lessons From Japan: Resilience After Tokyo And Fukushima, Michelle L. Spencer
Journal of Strategic Security
In the spring of 1995 Japan experienced the world’s first major terrorist attack using chemical weapons by a little-known religious cult called Aum Shinrikyo. The attack on the Tokyo subway, which killed 13 people, was the first lethal case of a non-state actor using a chemical agent against a civilian population. In March 2011, following a 9.0 magnitude earthquake in Japan, the Fukushima Daiichi nuclear reactor experienced a full meltdown releasing radiation into the surrounding area. The seemingly unhurried government reaction provided conflicting information to Japanese citizens, slowing evacuation and protective actions. Government failure is cited as a significant factor …

Don't Give Your Kid That Shot!: The Public Health Threat Posed By Anti-Vaccine Speech And Why Such Speech Is Not Guaranteed Full Protection Under The First Amendment, Amanda C. Naprawa
Don't Give Your Kid That Shot!: The Public Health Threat Posed By Anti-Vaccine Speech And Why Such Speech Is Not Guaranteed Full Protection Under The First Amendment, Amanda C. Naprawa
Cardozo Public Law, Policy & Ethics Journal
The article argues that antivaccination speech poses a significant threat to public health, and the law should be utilized to regulate such speech to prevent the spread of preventable diseases and protect vulnerable populations through herd immunity. While the First Amendment protects free speech, legal measures such as the FTC regulating false advertising and potential vaccine disparagement statutes can be effective tools in curbing harmful misinformation. The article emphasizes the need for a balanced approach that respects individual rights while safeguarding community health, supported by scientific consensus on vaccine safety and legal precedents like Jacobson v. Massachusetts.

Failing To Protect Participants' Fundamental Rights In Drug Treatment Court, Michel Panaretos Fullerton
Failing To Protect Participants' Fundamental Rights In Drug Treatment Court, Michel Panaretos Fullerton
Montana Law Review
This comment begins with the story of Karlyle Plouffe, a young adult participant in the Mineral County DUI/Drug Treatment Court. Next, the paper details the Sixth Amendment fundamental rights afforded to all criminal offenders and the manner in which those rights apply to defendants upon entry into drug treatment court. The paper then details the Fifth Amendment privilege against self-incrimination and presents the sole exception to the rule—namely, that one must affirmatively waive that privilege. The paper outlines the history of drug treatment courts, as well as the Bureau of Justice Assistance’s best practices for drug treatment courts. Next, those …

Fighting Cyber-Crime After United States V. Jones, David Gray, Danielle K. Citron, Liz Clark Rinehart
Fighting Cyber-Crime After United States V. Jones, David Gray, Danielle K. Citron, Liz Clark Rinehart

In a landmark non-decision last term, five Justices of the United States Supreme Court would have held that citizens possess a Fourth Amendment right to expect that certain quantities of information about them will remain private, even if they have no such expectations with respect to any of the information or data constituting that whole. This quantitative approach to evaluating and protecting Fourth Amendment rights is certainly novel and raises serious conceptual, doctrinal, and practical challenges. In other works, we have met these challenges by engaging in a careful analysis of this “mosaic theory” and by proposing that courts focus …
Affective Disorders Of The State: A Spinozan Diagnosis And Cure, Ericka L. Tucker
Affective Disorders Of The State: A Spinozan Diagnosis And Cure, Ericka L. Tucker
Philosophy Faculty Research and Publications
The problems of contemporary states are in large part “affective disorders”; they are failures of states to properly understand and coordinate the emotions of the individuals within and in some instances outside the state. By excluding, imprisoning, and marginalizing members of their societies, states create internal enemies who ultimately enervate their own power and the possibility of peace and freedom within the state. Spinoza’s political theory, based on the notion that the best forms of state are those that coordinate the power and emotions of those within a state, offers us both a diagnosis of and a cure for these …
Measuring The Performance Of Livability Programs, Mti Report 12-06, Peter J. Haas, Lisa Fabish
Measuring The Performance Of Livability Programs, Mti Report 12-06, Peter J. Haas, Lisa Fabish
Mineta Transportation Institute
This report analyzes the performance measurement processes adopted by five large “livability” programs throughout the United States. It compares and contrasts these programs by examining existing research in performance measurement methods. The “best practices” of the examined performance measurement methods for each program are explored and analyzed with respect to their key characteristics. The report entails an appropriately comprehensive literature review of the current research on performance measurement methods from the perspective of various stakeholders including the public and government agencies. Additionally, the results of this literature review are used to examine the actual performance measures of the target programs …

Research Is A Partner In Forward Focused Time, Mary Kathleen Gorman, Rita I. Herron

"The complexities of modern society and the dynamic forces of progress necessitate that professionals in every discipline be forward-focused, which is believed to come from gaining higher education. This is becoming standard within the fire and emergency services professions and is commonly a factor regarding upward mobility. With that in mind, the U.S. Fire Administration/National Fire Academy (NFA) developed the Fire and Emergency Services Higher Education (FESHE) recognition certificate…"
