Collective Representation And Employee Voice In The U.S. Public Sector Workplace: Looking North For Solutions?, Martin H. Malin Oct 2013

Collective Representation And Employee Voice In The U.S. Public Sector Workplace: Looking North For Solutions?, Martin H. Malin

All Faculty Scholarship

Legislation enacted in many states following the 2010 elections in the United States strengthened unilateral public employer control and weakened employee voice. This rebalancing of power occurred in the context of state public employee labour relations acts modeled on the National Labor Relations Act (NLRA), but with a narrower scope of bargaining than in the private sector. This narrow scope channels unions’ voice away from the quality of public services and towards protecting members from the effects of decisions unilaterally imposed by management. The Supreme Court of Canada has held that the freedom of association guaranteed by the Charter of …

Citizen Engagement In The Shrinking City: Toward Development Justice In An Era Of Growing Inequality, Barbara L. Bezdek Oct 2013

Citizen Engagement In The Shrinking City: Toward Development Justice In An Era Of Growing Inequality, Barbara L. Bezdek

Faculty Scholarship

What are the aims of the revitalization conducted by local officials: for which social goods? Good for whom? By what means can the city’s people understand and influence the tradeoffs made by their government in the redevelopment of city blocks already occupied by residents. This is more than a matter of development finance or physical redevelopment. It is a question of social justice, of whose reality counts in the legal process utilized to reach development decisions and approve significant public subsidy for the projects that are remaking American cities.

Sherry Arnstein, writing in 1969 about citizen involvement in planning processes …

Pseudo Newsgathering: Analyzing Journalists’ Use Of Pseudo-Events On 'The Wire', Patrick Ferrucci, Chad Painter Oct 2013

Pseudo Newsgathering: Analyzing Journalists’ Use Of Pseudo-Events On 'The Wire', Patrick Ferrucci, Chad Painter

Communication Faculty Publications

This textual analysis examines the role of pseudo-events in the newsgathering process depicted on season five of The Wire. The researchers found that the press and sources construct “reality”; sources present “masks” to conceal “reality”' and journalists acknowledge the absurdity of pseudo-events but cover staged events as genuine news. The overriding conclusion is that journalists fail citizens by constructing a false reality through a negotiation with powerful sources who are media- savvy enough to control depictions. These findings are then interpreted through the lens of cultivation theory.

Methods: The web-based survey administered in June, 2012 to 165 local Medical Reserve Corps (MRC) volunteers and 72 public health workers was part of a larger study designed to assess functional needs flow processes in general shelters. The Indefinite Quarantine: A Public Health Review Of Chronic Inconsistencies In Sexually Violent Predator Statutes, Isaac ("Zack") D. Buck Oct 2013

The Indefinite Quarantine: A Public Health Review Of Chronic Inconsistencies In Sexually Violent Predator Statutes, Isaac ("Zack") D. Buck

Scholarly Works

Fifteen years after the Supreme Court’s decision in Kansas v. Hendricks upheld their constitutionality, sexually violent predator (SVP) statutes exist in 20 states and the federal code. Committing sex offenders indefinitely in an effort to protect the public, SVP statutes have survived academic criticism and mushrooming expense, targeting society’s most unpopular subjects and unpalatable crimes. In upholding the statutes against constitutional attack in Hendricks, the Court relied upon the state’s demonstrable power to preventively detain individuals during public health emergencies – analogous to the civil detention model of quarantine – to establish the state’s unquestioned right to involuntarily commit sex …

Profile (1996-)

Summer brings many visitors to the University of Minnesota, Morris campus. In June, some three hundred individuals attended the second Rural Arts and Culture Summit, co-sponsored by Morris’s Center for Small Towns and Springboard for the Arts. The summit brought together people who share an interest in the arts and the particular values and quality of life that are uniquely found in small towns. The people gathered for this two-day summit came to explore how these two things—the arts and small-town values—can converge to create vibrant, model communities.

Talking With Mormons: An Invitation To Evangelicals, David Dominguez, Richard J. Mouw Oct 2013

Talking With Mormons: An Invitation To Evangelicals, David Dominguez, Richard J. Mouw

BYU Studies

As an Evangelical who has resided in Utah County since 1989 and as a law professor at BYU for the past twenty-four years, I read with great interest Richard J. Mouw's latest book, Talking with Mormons: An Invitation to Evangelicals. I was pleased that the author, president of Fuller Theological Seminary, helped me sort out my thoughts on countless conversations with LDS colleagues, students, and neighbors concerning differences in our religious traditions and, even more importantly, provided a structure for more fruitful dialogue. I encourage anyone who cares about building bridges between and among Evangelicals and Mormons to take time …

Risk Factors For External Human Trafficking In Nigerian And Indonesian Hotspots, Mark Ryan Oct 2013

Risk Factors For External Human Trafficking In Nigerian And Indonesian Hotspots, Mark Ryan

Annual Interdisciplinary Conference on Human Trafficking: 5th (2013)

This study ultimately attempted to determine how useful quantitatively analysing secondary data is when studying human trafficking in individual countries. Two countries were chosen to analyse: Nigeria and Indonesia. Secondarily, the researcher tried to determine whether or not current human trafficking theory, which is based on international studies, can be applied when studying a nation individually. This study used content analysis to identify ‘hotspot’ areas of Nigeria and Indonesia. The researcher then used quantitative analyses of various secondary state-level data to search for risk factors that may be facilitating trafficking in these hotspot areas. In Nigeria, hotspot states were generally …

Skin Flicks Without The Skin: Why Government Mandated Condom Use In Adult Films Is A Violation Of The First Amendment, Elizabeth Sbardellati Oct 2013

Skin Flicks Without The Skin: Why Government Mandated Condom Use In Adult Films Is A Violation Of The First Amendment, Elizabeth Sbardellati

Northwestern Journal of Law & Social Policy

The filming of sexual acts for publication is legal in California, which has led to the development of a robust adult film industry in Southern California, particularly in the Los Angeles area. Recently, regulations have been proposed that would require actors in pornographic films to wear condoms. This comment examines legal objections to “The County of Los Angeles Safer Sex in the Adult Film Industry Act” and CalOSHA’s assertion that California law requires the use of prophylactics in adult films. It argues that sexual expression in these adult films is protected under the First Amendment, although it may still be …
