Hardline Ideology Stymies Real Results: Texas Lawmakers' Battle Over Family Planning Leaves Texas Women Unprotected., Mariel Puryear
The Scholar: St. Mary's Law Review on Race and Social Justice
Family planning has opened economic and social doors for women. Contraception, specifically, allows women to choose when they have children, how far apart their children are born, or if they have children at all. This freedom empowers women to pursue higher education and careers which might not have been attainable otherwise. The increase in education effectively levels the playing field between genders, bringing more women into traditionally male-dominated professions. Family planning and contraceptive measures also dramatically impact low-income families. The role of family planning clinics is extremely important in a state like Texas, where many do not have insurance, and …

Gun Control Is Not Enough: The Need To Address Mental Illness To Prevent Incidences Of Mass Public Violence., Morgan Stanley
The Scholar: St. Mary's Law Review on Race and Social Justice
Throughout the year 2012, senseless violence and tragedy plagued the United States. Numerous mass shootings occurred, leaving innocent victims dead and leaving their survivors to grieve. No single law can prevent a mass shooting from occurring, but access to firearms is one of many potential reasons such tragedies happen. There are many reasons why a gunman is motivated to commit such heinous acts. Failure to take notice of warning signs, bullying, drug use, and serious mental illness are a few examples. One in seventeen Americans live with a serious diagnosable mental illness. Most mentally ill persons are the victims of …

Evaluation Of Microbiological Quality And Safety In Kuala Sepetang Estuaries (Perak, Malaysia) Using Cultivation-Dependent Method / Aziz Ghaderpour, Aziz Ghaderpour
Student Works (2010-2019)
Estuaries are crucial coastal and marine habitats of various aquaculture organisms. However, uncontrolled development has caused contamination in many coastal areas all over the world that will eventually bring negative effects to aquaculture industry and public health. Bacteriological study based on culturing methods is appropriate not only for routine monitoring in laboratories, but also for making inferences on the physiological and metabolic properties of the organisms. Therefore the applicability of CHROMagarTM Orientation agar was evaluated in microbiological survey of estuarine waters and sediments as well as to detect and isolate human-associated bacterial pathogens in the surface waters and sediments along …

Hazards Identification For Safety And Risk Evaluation Of Hydroelectric Dam Power Generation Plant / Ali Mohammad Saedi, Ali Mohammad Saedi
Student Works (2010-2019)
There are many formal techniques for the systematic analysis of occupational safety and health in general as well as specific areas. Currently there is increased interest in the evaluation of environmental safety and health. In the light of this a project was initiated for the evaluation of environmental safety and health at the Sultan Yusuf Hydro Electric Power generation Plant (JOR Power Station) at Cameron Highlands in Pahang. It was with a view to creating a conceptual framework for hazard identification and risk assessment at the power generating station of the plant and to recommend control measures with respect to …
From Coolidge To Christie: Historical Antecedents Of Current Government Officials Dealing With Public Sector Labor Unions, Bryan J. Soukup
From Coolidge To Christie: Historical Antecedents Of Current Government Officials Dealing With Public Sector Labor Unions, Bryan J. Soukup
Law Student Publications
One might ask: what do Calvin Coolidge, Ronald Reagan, Scott Walker and Chris Christie have in common? The most obvious answer is that they all are (or were) Republican Governors, but these four men have something much deeper in common. All four have faced-off against powerful public sector labor unions and won. This paper will address and examine the similarities between the anti-union actions taken by these men— Coolidge and the Boston Police Strike of 1919, Reagan and the Professional Air Traffic Controllers (“PATCO”) Strike of 1981, and Walker and Christie’s recent dealings with public employee unions. In the end, …

American Gangsters: Rico, Criminal Syndicates, And Conspiracy Law As Market Control, Benjamin Levin
Publications
In an effort to reexamine legal and political decisions about criminalization and the role of the criminal law in shaping American markets and social institutions, this Article explores the ways in which criminal conspiracy laws in the United States have historically been used to subdue nonstate actors and informal markets that threatened the hegemony of the state and formal market. To this end, the Article focuses primarily on the Racketeer Influenced and Corrupt Organizations Act (RICO) as illustrative of broader trends in twentieth-century criminal policy. Enacted in 1970, RICO provides criminal sanctions for individuals engaged in unacceptable organized activities and …

Five Answers And Three Questions After United States V. Jones (2012), The Fourth Amendment Gps Case, Benjamin Priester
Journal Publications
Each year, the United States Supreme Court's docket includes a range of "high profile" cases that attract attention not merely from law professors and others with an acquired fascination with the Court, but also from a general audience of law students, lawyers, scholars and commentators on American politics and society, as well as, occasionally, the public at large. During the 2011 Term, one of those cases was "the GPS case," formally known as United States v. Jones.' Media coverage of the case spread far beyond the legal blogosphere to a wide variety of mainstream and popular sources, both in print …

Theorizing Forms For Social Enterprise, Dana Brakman Reiser
Theorizing Forms For Social Enterprise, Dana Brakman Reiser
Emory Law Journal
Jurisdictions across the country and around the globe are enacting legislation enabling founders of social enterprises to adopt specialized forms to house their entities. These forms blend elements traditionally found in nonprofit organizational forms, such as commitment to a social mission, with elements from for-profit business structures, such as the ability to attract investors.

West Chester University Climate Action Plan: Carbon Neutral By 2025, Tim Lutz, Executive Director Of Facilities Management, Climate Action Planning Team
WCU Campus Sustainability Initiatives
WEST CHESTER UNIVERSITY PRESIDENT GREG WEISENSTEIN signed the American College and University Presidents’ Climate Commitment (ACUPCC) in October 2010, pledging the University to a series of actions that will ultimately reduce net greenhouse gas emissions to zero. In doing so we joined more than 600 institutions in expressing our deep concern about global warming. More importantly, we accepted the challenge to provide leadership in our own community by “modeling ways to minimize global warming emissions, and by providing the knowledge and the educated graduates to achieve climate neutrality.” Since 2010 we have completed an inventory of greenhouse gas emissions (GHG), …

Overall, the issue analyzes the difficulty that occurs when these laws meet practical realities.

The Federal Reserve’S Use Of International Swap Lines, Colleen M. Baker
The Federal Reserve’S Use Of International Swap Lines, Colleen M. Baker
Journal Articles
This Article focuses on the U.S. Federal Reserve's controversial practice of loaning U.S. dollars to foreign central banks, which the foreign central banks then turn around and loan to institutions in their jurisdictions. The Federal Reserve does not know the identity of these recipient institutions. Nevertheless, these loans-termed "swap lines"-provide foreign financial institutions the type of financial stability that the U.S. Federal Reserve was created to provide for U.S. banks during times of crises. During the financial crisis, the U.S. Federal Reserve arranged swap lines with 14 foreign central banks for a total amount of $583 billion, making it the …

Confronting Criminal Law’S Violence: The Possibilities Of Unfinished Alternatives, Allegra M. Mcleod
Georgetown Law Faculty Publications and Other Works
Confronting criminal law’s violence calls for an openness to unfinished alternatives — a willingness to engage in partial, in process, incomplete reformist efforts that seek to displace conventional criminal law administration as a primary mechanism for social order maintenance. But despite all indications that the status quo in U.S. criminal law administration is profoundly dysfunctional — an institutional manifestation of the deepest pathologies in our society — contemporary criminal law reform efforts and scholarship focus almost exclusively on relatively limited modifications to the status quo. These modifications may well render criminal law administration more humane, but fail to substitute alternative …

Liberal Responsibilities, Robin West
Georgetown Law Faculty Publications and Other Works
This essay is a review of When the State Speaks, What Should it Say?: How Democracies can Protect Expression and Promote Equality by Corey Brettschneider (2012) and Ordered Liberty: Rights, Responsibilities, and Virtues by James E. Fleming & Linda C. McClain (2013).
In a parallel fashion, Fleming and McClain articulate and then defend a general conception of “constitutional liberalism” and its core individual rights against various critics, including communitarians such as Mary Ann Glendon and Michael Sandel, and “minimalists” such as Cass Sunstein and Jeremy Waldron, who argue that for various reasons those individual rights have undermined either civic society …

Shattered Dreams: An Analysis Of The Georgia Board Of Regents' Admissions Ban From A Constitutional And International Human Rights Perspective, Azadeh Shahshahani, Chaka Washington
UC Law Journal of Race and Economic Justice
Access to higher education for undocumented immigrants is a highly debated issue across the country. While some states have been more inclusive of undocumented students, other states have implemented laws which make higher education unattainable for this group. In 2008, South Carolina enacted House Bill 4400 which bars undocumented immigrants from attending public colleges and universities. The University System of Georgia is, so far, the only other public university system to enact a policy which outright bans undocumented students from certain colleges.
This article begins by discussing the Georgia Board of Regents' ban from a constitutional perspective, applying an equal …

A Local Official's Guide To Language Access Laws, David Jung, Noemi Gallardo, Ryan Harris
UC Law Journal of Race and Economic Justice
Sharp growth in immigration has introduced California to a large number of persons who do not speak and understand English well enough to make use of basic social services. These individuals may not know what public services are available, may not be able to communicate with local officials, and may not receive information that local agencies release to the public. Local agencies throughout California should ensure that all their services are accessible to persons for whom English is a barrier to understanding.
This article first explains why the California and federal constitutions forbid laws requiring that services be provided in …
