Socio-Legal Review
This stuy is about hierarchj within the legalprofession - how itpresents itself, how it is retained, and how it is combated. The soio legal literature on this subject is rich, with many roots tracing back to Professor Marc Galanter famous early 1970s article on the Haves' and Have-Nots.' Galanter'spiece and the work of those influenced by him rghty suggest that resources - institutional, financial, and demogr'phic - contribute to whether lawyers are, and remain as, part of the Haves.' Yet, while resources of course greaty matter, as this studj will argue other forces are sgn fcant as well. One set, …

On March 16, 2013, the United States implemented the Leahy-Smith America Invents Act (AIA). Enactment of the AIA substantially enhances the value of U.S. provisional and non-provisional patent applications (PPAs and NPAs) to foreign applicants. Here, the authors endeavor to outline the procedural and strategic considerations facing foreign applicants for PPAs by offering a brief survey of protective foreign patent application law, followed by an analysis of the modern benefits of PPA filing in the post-AIA world. The analysis here suggests that the traditional benefits to foreign filers of PPAs encompassing term extension, cost-efficiency and secrecy have been amplified by …

Faculty Articles
This article recommends developing assignments for first-year legal writing courses through collaborations with legal services organizations. The article stems from and describes such ongoing projects at Seattle University School of Law, where several hundred first-year law students have worked on such projects so far. We have partnered with lawyers at organizations like the National Employment Law Project, the ACLU of Washington, and Northwest Justice Project to come up with live issues that they would like to have researched, and they received the best student work product from each class. The partner organizations have used the students’ work in several ways, …

Adding By Subtracting: How Limited Scope Agreements For Dispute Resolution Representation Can Increase Access To Attorney Services, Kristen M. Blankley
Adding By Subtracting: How Limited Scope Agreements For Dispute Resolution Representation Can Increase Access To Attorney Services, Kristen M. Blankley
Nebraska College of Law: Faculty Publications
Limited scope attorneys specializing in alternative dispute resolution ("ADR") procedures could help clients like these achieve their goals and resolve their disputes in a timely manner. If more attorneys would consider providing these types of limited services, additional clients (i.e. people considered "nobody's clients" now) could be served in the way that matters most to them. This Article suggests a new model for attorney representation based on the combined use of limited scope representation and ADR processes to give otherwise unrepresented parties greater access to justice. Although none of these three concepts (i.e., access to justice, unbundled services, and ADR) …

Do Procedural Claims Drive Out Merits Claims In Plea Bargaining?: A Comment On The Work Of The Late Professor William Stuntz, Gabriel J. Chin
Duquesne Law Review
In his now classic body of work on plea bargaining, the late William Stuntz answered one the of the most disturbing challenges to the institution of plea bargaining: That it promotes conviction of the innocent by putting them to the torturous choice of pleading guilty to a crime they did not commit, or going to trial and facing the possibility of conviction, and thus even more time. Stuntz, like other scholars, persuasively contended that denying innocent defendants the opportunity for a plea bargain could only make them worse off because they would be forced to go to trial where they …
