Nothing About Us Without Us! The Failure Of The Modern Juvenile Justice System And A Call For Community-Based Justice, Charisa Smith Esq. Mar 2013

Nothing About Us Without Us! The Failure Of The Modern Juvenile Justice System And A Call For Community-Based Justice, Charisa Smith Esq.

Journal of Applied Research on Children: Informing Policy for Children at Risk

The modern juvenile justice system is failing our society. A literature review reveals resounding criticism of the system at all points—arrest, court processing, and incarceration. The current system does not effectively reduce recidivism, is wrought with racial disparities, operates with a minimal degree of cultural competence, violates human rights norms, and fails to empower and reform individuals who are directly affected. The current system shatters social bonds and does not hold governmental agencies accountable for wrongdoing or ineffectiveness. Community-based approaches more effectively reduce crime, cost less, are more empowering and culturally competent, help ameliorative civic fragmentation, and are more socially …

Dismantling Large Bank Holding Companies For Their Own Good And For The Good Of The Country, Tamar Frankel Mar 2013

Dismantling Large Bank Holding Companies For Their Own Good And For The Good Of The Country, Tamar Frankel

Faculty Scholarship

This paper suggests that bank holding companies are in fact “financial malls.” I demonstrates the problems that they pose for the financial system, not only by size but by inefficient and inappropriate concentration. The article suggests restructuring of bank holding companies by introducing more market discipline to the various “shops” in the mall as well as concentrating services for the purpose of efficiency. The Article concludes with suggestion that rather than imposing a restructure by law it may perhaps be possible to entice managements that look to the long-term future to follow a restructure voluntarily.

Devolution: The Retreat Of Government, Judith Kurland Mar 2013

Devolution: The Retreat Of Government, Judith Kurland

New England Journal of Public Policy

Devolution as practiced in much of the world is decentralization of program authority and responsibility to achieve greater administrative efficiency or program standards. Devolution as practiced by the Bush administration and the Republican Congress is not that, nor is it a diminution of federal power and the strengthening of states’ rights. Rather, it is a radical restructuring of government to prevent the expenditure of funds for traditional Democratic programs of the New Deal and the Great Society, and to prohibit states from being either more generous in social programs or more stringent in regulating industry than this administration desires.

Murky Immigration Law And The Challenges Facing Immigration Removal And Benefits Adjudication, Jill E. Family Mar 2013

Murky Immigration Law And The Challenges Facing Immigration Removal And Benefits Adjudication, Jill E. Family

Journal of the National Association of Administrative Law Judiciary

Immigration adjudication is more diverse than it may seem. Scholars tend to focus on one aspect of administrative immigration adjudication, the decision-making process established to determine whether an individual may be removed (deported) from the United States. But there is a whole other function of administrative immigration adjudication that relatively is ignored in the legal literature. Immigration adjudicators are also tasked with determining whether to grant immigration benefits, such as whether to grant lawful permanent resident (green card) status. Both types of administrative immigration adjudication, removal and benefits, are in crisis. This article explores the challenges facing each and argues …

Reverse Advisory Opinions, Neal Devins, Saikrishna B. Prakash Mar 2013

Reverse Advisory Opinions, Neal Devins, Saikrishna B. Prakash

University of Chicago Law Review

Federal courts have increasingly issued demands and requests for legal advice from the executive branch and other parties. Without offering any justification, federal judges simply assume that they may seek legal advice from virtually anyone. These practices warrant further scrutiny. First, we believe that the federal courts lack the power to compel judicial advice, from parties to a case or otherwise. To begin with, the federal courts cannot demand opinions of Congress or the president, for Article III never grants any such power. Indeed, such a power would be inconsistent with the independence and equality that each branch enjoys. Nor …
