Meaningful Change For Family Justice: Beyond Wise Words: Final Report Of The Family Justice Working Group, Action Committee On Access To Justice In Civil And Family Matters

Canadian Forum on Civil Justice

Canadians do not have adequate access to family justice. For many years now reports have been telling us that cost, delay, complexity and other barriers are making it impossible for many Canadians to exercise their legal rights. More recently, a growing body of research has begun to quantify the extent of unmet legal need in our communities and to describe the disquieting individual and social consequences of failing to respond adequately to family legal problems.

Residential Square In The 21st Century: Applying A Typology To Create A New Urban Morphology, Elizabeth Whittington Apr 2013

Residential Square In The 21st Century: Applying A Typology To Create A New Urban Morphology, Elizabeth Whittington

Architecture Senior Theses

The transposition of the residential square will be part of a large-scale strategic plan for the re-development of low-rise low-density neighborhoods on the fringe of the central business district in the post-industrial city. A community garden will be defined by a public housing project. Thus, the neighborhood’s identity will be presented through the physical landscape, building volumes and façade. The project will become part of the system of communal spaces within the city. American individualism will express the civic realm, while creating a secure and connected environment. The new housing block provides a proto-type for an urban morphology that decreases …

Movement Of Engineers And Architects Between India And The Eu, Tanu M Goyal, Arpita Mukherjee Apr 2013

Movement Of Engineers And Architects Between India And The Eu, Tanu M Goyal, Arpita Mukherjee

Working Papers

This paper examines the current and future prospects for the movement of architects and engineers between India and the EU, based on secondary information and a primary survey. Due to ageing population and a shrinking workforce, the EU Member States are facing shortage of skilled professionals, including architects and engineers. While some studies show that India has a large pool of architects and engineers, others point out that India's own demand for these skills will rise and the country will face skill shortages. None of the studies contradict the fact that India's young population, if provided the right education and …

Regulatory Framework For Legal Services Sector In Selected Eu Member States: Implications For Indian Legal Professionals, Pralok Gupta Apr 2013

Regulatory Framework For Legal Services Sector In Selected Eu Member States: Implications For Indian Legal Professionals, Pralok Gupta

Working Papers

Legal services are amongst the most protected services across the globe. The protection comes mainly from regulatory barriers related to qualification recognition, residency conditions, area of practice etc. The European Union (EU) also has various regulations affecting the supply and availability of legal services in its Member States. Some of these regulations are common across the Member States whereas some are unique to particular Member States. An examination of the regulatory framework for legal services in the selected EU Member countries, namely, Germany, Ireland, Netherlands, Sweden and the UK, reveals that these countries have varying degrees of restrictiveness for foreign …

“Harmonizing Current Threats: Using The Outcry For Legal Education Reforms To Take Another Look At Civil Gideon And What It Means To Be An American Lawyer”, Cathryn A. Miller-Wilson Apr 2013

“Harmonizing Current Threats: Using The Outcry For Legal Education Reforms To Take Another Look At Civil Gideon And What It Means To Be An American Lawyer”, Cathryn A. Miller-Wilson

Working Paper Series

Drawing from the broad and varied literature on legal ethics, the paper demonstrates that legal education and access to justice concerns can and should be addressed simultaneously in our current political and economic climate. Current threats to legal education, and to lawyering in general, present an opportunity for legal education transformation. Applying legal ethics theory to an analysis of these threats provides support for the creation of teaching law firms, similar in size and scope to teaching hospitals, that will employ clinical teaching methodology, substantially enhance ethics teaching and significantly address the issue of access to justice.

Control-Alt-Incomplete? Using Technology To Assess "Digital Natives", Samantha A. Moppett Apr 2013

Control-Alt-Incomplete? Using Technology To Assess "Digital Natives", Samantha A. Moppett

Chicago-Kent Journal of Intellectual Property

Law students matriculating today were “born digital.” As digital natives, they have never known a world without digital technology, and therefore, they think and process information differently than previous generations. Although law school student bodies have changed, law school assessment methods have remained static, with students nearly universally being evaluated entirely by one exam at the end of the course. Best Practices, the Carnegie Report, and more recently the ABA, have acknowledged that this system of evaluation is contrary to learning theory and that periodic assessment of student learning is crucial to improving the performance of both students and teachers. …

After Dothard: Female Correctional Workers And The Challenge To Employment Law, Brenda V. Smith, Melissa C. Loomis

Scholarly Articles in Law Reviews & Journals

This article examines a profession where women have made great strides - corrections. Using an equality framework, corrections and other non-traditional professions were the first target of the feminist movement in the 1970s. By and large, feminists were successful in creating greater porosity for women in law enforcement, emergency services, corrections, and the military. While women have entered these traditionally masculine spaces, they still suffer from an achievement gap. They are still underrepresented in leadership positions and marginalized in these settings; are still the targets of discrimination based on race, gender, and perceived sexual orientation; and are less likely than …

Ready For The Real World, Mary Jean Babic

Law Quadrangle (formerly Law Quad Notes)

For many alumni who practice law in public-interest fields, the real-world experience they gained in law school was critical to their paths. Whether opening their eyes to opportunities they hadn't considered previously, or reaffirming the passions that drove them to law school in the first place, the clinics, externships, and fellowships they participated in link directly to the careers they enjoy today.

“Owner Finance! No Banks Needed!” Consumer Protection Analysis Of Seller-Financed Home Sales: A Texas Case Study, Genevieve Hebert Fajardo Apr 2013

“Owner Finance! No Banks Needed!” Consumer Protection Analysis Of Seller-Financed Home Sales: A Texas Case Study, Genevieve Hebert Fajardo

Faculty Articles

Seller-financing of residential property is booming in the credit crisis. Due in part to tightened lending standards for traditional mortgages, low-income home buyers are being shut out of the mortgage market, and are turning to contract-for-deed or lease-to-own agreements to finance their home purchases. In Texas, the state legislature tried to curb abuses in the seller-financed housing market by enacting a mix of typical consumer protection laws: required disclosures, penalties for unfair practices, and a process for converting contracts for deed into mortgages. So why do so many abuses remain in seller-financed transactions, when the legislation checked all the consumer-friendly …
