Patent Applications And The Performance Of The U.S. Patent And Trademark Office, Christopher A. Cotropia

Law Faculty Publications

This Article reports data and analyses to facilitate answering these questions. The reported data was obtained from two sources. The first is the Workload Tables from the USPTO annual reports, called the "USPTO Performance and Accountability Reports," provided to the President, Congress, and public.' The second is data received from the USPTO in response to Freedom of Information Act ("FOIA") requests.3 From these two data sources, information such as the number of applications filed per year, the type of applications being filed and prosecuted, the pendency of these applications, and their disposition, including the number of them issued as patents, …

Discovering E-Discovery: A Resources Guide, Timothy L. Coggins Jan 2013

Discovering E-Discovery: A Resources Guide, Timothy L. Coggins

Law Faculty Publications

E-discovery refers to discovery in civil litigation that focuses on the exchange of information in electronic form. Lainie Crouch Kaiser, a litigation attorney with McDermott Will & Emery, writes that “e-Discovery can be used as an umbrella term for both the legal and operational considerations related to how electronically stored information (ESI) is used in the modern day practice of law.”There are many types of ESI, including e-mail and office documents, voicemail, photos, video, and databases. Attorneys and others who write about e-discovery also include “raw data” as discoverable information. Ronald J. Hedges of Nixon Peabody writes that “[t]echnically, documents …

Taxing Privacy, Hayes R. Holderness Jan 2013

Taxing Privacy, Hayes R. Holderness

Law Faculty Publications

In the United States, many low-income citizens are being held to a harsher standard than wealthier citizens — these low-income citizens are being asked to relinquish their privacy in order to obtain the public assistance they need, whereas wealthier individuals are not subjected to similar levels of public scrutiny for government benefits that they claim. Giving up privacy can have devastating effects on individuals’ lives — they may suffer various dignitary harms, may experience repressed abilities to express themselves, and may even be coerced into important life decisions by the government. This situation presents a unique problem to the neediest …

And to add to your stress, you have a research project for your legal writing class due in less than two days, and you have not even started. Your professor told …

Reducing Cognitive Load Using Adaptive Uncertainty Visualization, Gregory Block Jan 2013

Reducing Cognitive Load Using Adaptive Uncertainty Visualization, Gregory Block

CCAC Theses and Dissertations

Uncertainty is inherent in many real-world settings; for example, in a combat situation, darkness may prevent a soldier from classifying approaching troops as friendly or hostile. In an environment plagued with uncertainty, decision-support systems, such as sensor-based networks, may make faulty assumptions about field conditions, especially when information is incomplete, or sensor operations are disrupted. Displaying the factors that contribute to uncertainty informs the decision-making process for a human operator, but at the expense of limited cognitive resources, such as attention, memory, and workload.

This research applied principles of perceptual cognition to human-computer interface design to introduce uncertainty visualizations in …

Time Resolved Gain And Excess Noise Properties Of Ingaas/Inalas Avalanche Photodiodes With Cascaded Discrete Gain Layer Multiplication Regions, Georges M. Williams, David A. Ramirez, Majeed M. Hayat, Andrew S. Huntington Jan 2013

Time Resolved Gain And Excess Noise Properties Of Ingaas/Inalas Avalanche Photodiodes With Cascaded Discrete Gain Layer Multiplication Regions, Georges M. Williams, David A. Ramirez, Majeed M. Hayat, Andrew S. Huntington

Electrical and Computer Engineering Faculty Research and Publications

To predict pulse detection performance when implemented in high speed photoreceivers, temporally resolved measurements of a 10-stage InAlAs/InGaAs single carrier multiplication (SCM) avalanche photodiode (APD)'s avalanche response to short multi-photon laser pulses were explained using instantaneous (time resolved) pulse height statistics of the device's impulse response. Numeric models of the junction carrier populations as a function of the time following injection of a primary photo-electron were used to create the probability density functions (pdfs) of the instances of the avalanche buildup process. The numeric pdfs were used to generate low frequency gain and excess noise models, which were in good …

Erie's Starting Points: The Potential Role Of Default Rules In Structuring Choice Of Law Analysis, Allan Erbsen Jan 2013

Erie's Starting Points: The Potential Role Of Default Rules In Structuring Choice Of Law Analysis, Allan Erbsen

Articles

This contribution to a symposium marking the seventy-fifth anniversary of Erie Railroad Company v. Tompkins is part of a larger project in which I seek to demystify a decision that has enchanted, entangled, and enervated commentators for decades. In prior work I contended that the “Erie doctrine” is a misleading label encompassing four distinct inquiries that address the creation, interpretation, and prioritization of federal law and the adoption of state law when federal law is inapplicable. This article builds from that premise to argue that courts pursuing Erie’s four inquiries would benefit from default rules that establish initial assumptions and …

Immunological And Clinical Response Of Coyotes (Canis Latrans) To Experimental Inoculation With Yersinia Pestis, Laurie A. Baeten, Ryan Pappert, John Young, Martin E. Schriefer, Thomas Gidlewski, Dennis Kohler, Richard A. Bowen Jan 2013

Immunological And Clinical Response Of Coyotes (Canis Latrans) To Experimental Inoculation With Yersinia Pestis, Laurie A. Baeten, Ryan Pappert, John Young, Martin E. Schriefer, Thomas Gidlewski, Dennis Kohler, Richard A. Bowen

United States Department of Agriculture Wildlife Services: Staff Publications

Multiple publications have reported the use of coyotes (Canis latrans) in animalbased surveillance efforts for the detection of Yersinia pestis. Coyotes are likely exposed via flea bite or oral routes and are presumed to be resistant to the development of clinical disease. These historic data have only been useful for the evaluation of the geographic distribution of Y. pestis in the landscape. Because the canid immunologic response to Y. pestis has not been thoroughly characterized, we conducted experimental inoculation of captive-reared, juvenile coyotes (n58) with Y. pestis CO92 via oral or intradermal routes. We measured the humoral response …

Spatial Ecology Of Urban Raccoons In Northeastern Ohio: Implications For Oral Rabies Vaccination, Are R. Berentsen, Mike R. Dunbar, Chadd E. Fitzpatrick, W. David Walter

United States Department of Agriculture Wildlife Services: Staff Publications

In 1977, rabies was detected in a raccoon (Procyon lotor) in West Virginia, and since the mid-1980s raccoon variant rabies has spread throughout the eastern United States and moved west as far as the eastern edge of Cleveland, Ohio. The primary tool to combat this spread is the distribution of oral rabies vaccine (ORV) baits. A thorough knowledge of raccoon space use is critical in determining bait placement, particularly in urban areas. We monitored nine raccoons in urban areas of Cleveland, Ohio, calculated home range sizes, monitored raccoon movement with respect to potential movement barriers, and used resource …

The Two-Phase Arterial Blood Flow With Or Without A Catheter And In The Presence Of A Single Or Multi Stenosis, Ani E. Garcia, Daniel N. Riahi Jan 2013

The Two-Phase Arterial Blood Flow With Or Without A Catheter And In The Presence Of A Single Or Multi Stenosis, Ani E. Garcia, Daniel N. Riahi

School of Mathematical & Statistical Sciences Faculty Publications

We consider the problem of blood flow in an artery with or without a catheter and in the presence of single or multi stenosis whose shape is based on the available experimental data for the stenosis in a human’s artery. The presence of stenosis in the artery, which locally narrows portion of the artery, can be a result of fatty materials such as cholesterol in the blood. The use of catheter is important as a standard tool for diagnosis and treatment in patience whose blood flow passage in the artery is affected adversely by the presence of the stenosis within …

Rethinking Critical Mass In The Federal Appellate Courts., Laura Moyer Jan 2013

Rethinking Critical Mass In The Federal Appellate Courts., Laura Moyer

Faculty and Staff Scholarship

This article draws from critical mass studies of gender in other political institutions to inform an application to the US Courts of Appeals. The results demonstrate the utility of considering court-level aspects of diversity. As mixed-sex panels become more common within a circuit, both male and female judges increasingly support plaintiffs in civil rights claims, though the magnitude of the effect is larger for women. The presence of a female chief judge is also positively associated with pro-plaintiff decisions by men and women in sex discrimination cases.

Study Of Dynamic Features Of Highly Energetic Reactions By Dsc And High-Speed Temperature Scanner (Hsts), Mkhitar Hobosyan, Kh. G. Kirakosyan, S. L. Kharatyan, Karen S. Martirosyan Jan 2013

Study Of Dynamic Features Of Highly Energetic Reactions By Dsc And High-Speed Temperature Scanner (Hsts), Mkhitar Hobosyan, Kh. G. Kirakosyan, S. L. Kharatyan, Karen S. Martirosyan

Physics & Astronomy Faculty Publications

The dynamic features of Al2O3 - polytetrafluoroethylene (PTFE) and Al - PTFE reactions in non-isothermal conditions are presented. The Differential Scanning Calorimetry (DSC) and High-Speed Temperature Scanner (HSTS) were used to characterize the Al2O3/Al – PTFE reactions at different heating rates. The study shows that the HSTS instrument can give more information about the reaction mechanism and kinetics than the conventional DSC measurements. In this work we show that high heating rates may reveal exothermic reaction between Al2O3 and PTFE that were previously unidentified. The PTFE can potentially remove the oxide layer from aluminum in the initial period of the …

Carbon Monoxide Adsorption On Platinum-Osmium And Platinum-Ruthenium-Osmium Mixed Nanoparticles, Nicholas Dimakis, Nestor E. Navarro, Eugene S. Smotkin Jan 2013

Carbon Monoxide Adsorption On Platinum-Osmium And Platinum-Ruthenium-Osmium Mixed Nanoparticles, Nicholas Dimakis, Nestor E. Navarro, Eugene S. Smotkin

Physics & Astronomy Faculty Publications

Density functional calculations (DFT) on carbon monoxide (CO) adsorbed on platinum, platinum-osmium, and platinum-ruthenium-osmium nanoclusters are used to elucidate changes on the adsorbate internal bond and the carbon-metal bond, as platinum is alloyed with osmium and ruthenium atoms. The relative strengths of the adsorbate internal bond and the carbon-metal bond upon alloying, which are related to the DFT calculated C–O and C–Pt stretching frequencies, respectively, cannot be explained by the traditional 5σ-donation/2π*-back-donation theoretical model. Using a modified π-attraction σ-repulsion mechanism, we ascribe the strength of the CO adsorbate internal bond to changes in the polarization of the adsorbate-substrate hybrid orbitals …

Material Internal Control Weaknesses And Earnings Management In The Post-Sox Environment, Benjamin P. Foster, Trimbak Shastri Jan 2013

Material Internal Control Weaknesses And Earnings Management In The Post-Sox Environment, Benjamin P. Foster, Trimbak Shastri

Faculty and Staff Scholarship

Prior studies found that companies with internal control deficiencies incorporate abnormal accounting accruals into their financial statements. However, these studies did not consider the materiality of abnormal accruals. Abnormal accruals should be within materiality when financial statements receive clean audit opinions. When material internal control weaknesses (MICW) exist, to compensate for additional risk, auditors should apply more audit effort to gain the quantity and quality of evidence necessary to obtain a reasonable degree of assurance to support their audit reports. We find evidence of this because audit fees are significantly higher for MICW companies than those for effective internal controls …

Proteomic Identification Of Dengue Virus Binding Proteins In Aedes Aegypti Mosquitoes And Aedes Albopictus Cells, Maria De Lourdes Muñoz, Gustavo Limón-Camacho, Rosalinda Tovar, Alvaro Diaz-Badillo, Guillermo Mendoza-Hernández, William C. Black Jan 2013

Proteomic Identification Of Dengue Virus Binding Proteins In Aedes Aegypti Mosquitoes And Aedes Albopictus Cells, Maria De Lourdes Muñoz, Gustavo Limón-Camacho, Rosalinda Tovar, Alvaro Diaz-Badillo, Guillermo Mendoza-Hernández, William C. Black

School of Medicine Publications

The main vector of dengue in America is the mosquito Aedes aegypti, which is infected by dengue virus (DENV) through receptors of midgut epithelial cells. The envelope protein (E) of dengue virus binds to receptors present on the host cells through its domain III that has been primarily recognized to bind cell receptors. In order to identify potential receptors, proteins from mosquito midgut tissue and C6/36 cells were purified by affinity using columns with the recombinant E protein domain III (rE-DIII) or DENV particles bound covalently to Sepharose 4B to compare and evaluate their performance to bind proteins including …

An Analytical Framework For Quantifying And Testing Patterns Of Temporal Dynamics In Social Networks, Elizabeth A. Hobson, Michael L. Avery, Timothy F. Wright Jan 2013

An Analytical Framework For Quantifying And Testing Patterns Of Temporal Dynamics In Social Networks, Elizabeth A. Hobson, Michael L. Avery, Timothy F. Wright

United States Department of Agriculture Wildlife Services: Staff Publications

Change is fundamental to all social systems. Temporal dynamics are critical in understanding how relationships form and change over time but rarely are studied explicitly in animal groups. Social network approaches are useful in describing association patterns and provide promising tools for investigating the dynamics of change in social structure but have rarely been used to quantify how animal associations change over time. In this study, we describe and test a framework for temporal analysis of social structure. We propose an analytical framework of methods that integrates across social scales and comparatively analyses change in social structure across multiple types …

Comparison Of Two Models For Estimating Mortality From Baitings With Compound Drc-1339 Concentrate Avicide, Jeffrey H. Homan, Randal S. Stahl, George M. Linz Jan 2013

Comparison Of Two Models For Estimating Mortality From Baitings With Compound Drc-1339 Concentrate Avicide, Jeffrey H. Homan, Randal S. Stahl, George M. Linz

United States Department of Agriculture Wildlife Services: Staff Publications

In the U.S., DRC-1339 baitings for blackbirds (Icteridae) are generally done under the pesticide label, Compound DRC-1339 Concentrate e Staging Areas. DRC-1339 is a slow-acting avicide and gives the birds enough time to leave the baiting sites. Carcass searches and other forms of onsite counts are ineffective. Instead, linear models (LM) are used. The LM are based on esophageal analyses of several blackbird species collected while feeding at staging area bait sites. Biases and large variances can occur with this type of sampling. As an alternative to the LM, we developed a semi-mechanistic model (SM) that combined mechanistic modeling of …

Sullivan, Erin Mutrie, Sidney A. Gauthreaux Jr., Michael L. Avery, Robert L. Crawford, Albert M. Manville Ii, Emilie R. Travis, David Drake

United States Department of Agriculture Wildlife Services: Staff Publications

Birds migrating to and from breeding grounds in the United States and Canada are killed by the millions in collisions with lighted towers and their guy wires. Avian mortality at towers is highly variable across species, and the importance to each population depends on its size and trajectory. Building on our previous estimate of avian mortality at communication towers, we calculated mortality by species and by regions. To do this, we constructed a database of mortality by species at towers from available records and calculated the mean proportion of each species killed at towers within aggregated Bird Conservation Regions. These …

The Use Of Diazacon™ To Limit Fertility By Reducing Serum Cholesterol In Female Grey Squirrels, Sciurus Carolinensis, Brenda A. Mayle, Mark Ferryman, Andrew Peace, Christi A. Yoder, Lowell A. Miller, David Cowan Jan 2013

The Use Of Diazacon™ To Limit Fertility By Reducing Serum Cholesterol In Female Grey Squirrels, Sciurus Carolinensis, Brenda A. Mayle, Mark Ferryman, Andrew Peace, Christi A. Yoder, Lowell A. Miller, David Cowan

United States Department of Agriculture Wildlife Services: Staff Publications

BACKGROUND: The grey squirrel, Sciurus carolinensis Gmelin, is an invasive alien species introduced into Great Britain in the late nineteenth century and into Northern Italy during the early twentieth century. Grey squirrels have displaced the native European red squirrel, Sciurus vulgaris L., throughout much of Great Britain and have a significant impact on trees and woodlands through bark-stripping activity. In Britain, eradication is no longer an option at a regional scale, but fertility control offers a non-lethal approach to reducing negative impacts. The cholesterol mimic DiazaCon™ has been successfully used to inhibit reproduction in some species. These studies aimed to …

Patterns Of Human–Coyote Conflicts In The Denver Metropolitan Area, Sharon A. Poessel, Stewart W. Breck, Tara L. Teel, Stephanie A. Shwiff, Kevin R. Crooks, Lisa Angeloni

United States Department of Agriculture Wildlife Services: Staff Publications

In many cities throughout North America, human–coyote conflicts are an emerging problem. Little research has described temporal and spatial patterns of human–coyote conflicts, although such information can be an important step in developing and optimizing management efforts. We used reports from 22 entities within the Denver Metropolitan Area (DMA) in Colorado that provided information on coyote observations (signs, sightings, and encounters) and conflicts (incidents, pet-attacks, and human attacks). Our objectives were to 1) define, quantify, and map categories of coyote observations and conflicts, and 2) investigate temporal and spatial patterns of conflicts, particularly related to land cover types and housing …

Use Of Stormwater Impoundments Near Airports By Birds Recognizedas Hazardous To Aviation Safety, Brian J. Fox, Wesley B. Holland, Frank L. Boyd, Bradley F. Blackwell, James B. Armstrong

United States Department of Agriculture Wildlife Services: Staff Publications

Design of privately-owned stormwater impoundments within or near airport siting criteria has received little attention with regard to potential hazards posed to aviation safety. In particular, minimizing use of these impoundments by bird species recognized as hazardous to aviation poses an important challenge. Emergent vegetation, shoreline irregularity, and proximity of other water resources are linked to avian richness and diversity within wetlands, as well as bird use of stormwater impoundments on airports. We predicted also that impoundments with bank slope >20% and those functioning as detention facilities, where water is periodically drawn down, would negatively influence use by birds; and …

Use Of Dairies By Postreproductive Flocks Of European Starlings, H. Jeffrey Homan, Jeffrey T. Lejeune, D. L. Pearl, T. W. Seamans, Thomas W. Seamans, A.A. Slowik, Mark R. Morasch, George M. Linz Jan 2013

Use Of Dairies By Postreproductive Flocks Of European Starlings, H. Jeffrey Homan, Jeffrey T. Lejeune, D. L. Pearl, T. W. Seamans, Thomas W. Seamans, A.A. Slowik, Mark R. Morasch, George M. Linz

United States Department of Agriculture Wildlife Services: Staff Publications

Knowledge of the behavior and movement patterns of European starlings (Sturnus vulgaris L.) is important to wildlife managers that seek to resolve conflicts at livestock facilities. We captured and radio tagged 10 starlings at each of 5 dairies in northeastern Ohio. From September 19 to October 31, 2007, we obtained sufficient data from 40 birds to study their behavior and movements. The birds visited the dairies where they were initially captured (home sites) on 85% of the days, spending 58% of each day at the dairies. Onsite arrival and departure times were 2.5 h after sunrise and 3.1 h …

Comparisons Between Blackbird Damage To Corn And Sunflower In North Dakota, Megan E. Klosterman, George M. Linz, Anthony Slowik, H. Jeffrey Homan

United States Department of Agriculture Wildlife Services: Staff Publications

For sunflower producers in North Dakota, blackbird (Icterinae) damage is a chronic problem costing millions of dollars annually. Sunflower damage surveys were last completed in the state in 1979-1980. Since the last surveys, corn plantings have increased 6-fold to 1500 X 103 ha, whereas sunflower hectarage has declined by >75% to 310 × 103 ha. Blackbirds forage on both crops, and this rapid change in North Dakota’s agricultural landscape was a sound inducement for reassessing crop damage. Field surveys are an important step in damage methods development because they are used for measuring efficacy, as well as assessing …

Use Of A Gnrh Vaccine, Gonacontm, For Prevention And Treatment Ofadrenocortical Disease (Acd) In Domestic Ferrets, Lowell A. Miller, Kathleen A. Fagerstone, Robert A. Wagner, Mark Finkler

United States Department of Agriculture Wildlife Services: Staff Publications

Adrenocortical disease (ACD) is a common problem in surgically sterilized, middle-aged to old ferrets (Mustela putorius furo). The adrenal tissues of these ferrets develop hyperplasia, adenomas, or adenocarcinomas, which produce steroid hormones including estradiol, 17-hydroxyprogesterone, and androstenedione. Major clinical signs attributable to overproduction of these hormones are alopecia (hair loss) in both sexes and a swollen vulva in females. Pruritus, muscle atrophy, hind limb weakness, and sexual activity or aggression are also observed in both sexes. Males can develop prostatic cysts, prostatitis, and urethral obstruction. ACD is thought to be linked to continuous and increased LH secretion, due …
