What does “liberty of conscience” mean? Religious liberty? Freedom of strong conviction? Freedom of thought? Since the Founding Era, Americans have used liberty of conscience to paper over disputes about the proper scope of religious, moral, and philosophical liberty. This Article explores the relationship between conscience and religion in history, political theory, and theology, and proposes a conception of conscience that supports a liberty of conscience distinct from religious liberty. In doing so, it offers a theoretical basis for distinguishing between conscience and religion in First Amendment scholarship and related fields. Plunging Into Endless Difficulties: Medicaid And Coercion In National Federation Of Independent Business V. Sebelius, Elizabeth Weeks Leonard, Nicole Huberfield, Kevin Outterson

Of the four discrete questions before the Court in National Federation of Independent Business v. Sebelius, the Medicaid expansion held the greatest potential for destabilization from both a statutory and a constitutional perspective. As authors of an amicus brief supporting the Medicaid expansion, and scholars with expertise in health law who have been cited by the Court, we show in this article why NFIB is likely to fulfill that promise.

Correlates Of Life Satisfaction And Acculturation Among University Students, Carrie D. Morrison, Susan E. Mason

Modern Psychological Studies

The present study compared correlations between life satisfaction, acculturation, socioeconomic status, and social support for students born in the United States and for students not born in the United States. Acculturation scores differed significantly between American-born and foreign born participants, while life satisfaction scores did not, indicating that living in a new country is not necessarily a negative experience for college-age students. Furthermore, acculturation to the host culture, that is, American culture, was found to correlate with life satisfaction among American-born students, and socioeconomic status correlated with acculturation for both groups. In this literature review, research on single parenting is examined. Current research heavily correlates single parenting with internalized and externalized behavioral problems in children. After broader investigation it appears traumatizing events (e.g. divorce, separation) display a confounding variable which is not given adequate significance in research on single parenting. Reviewed research in which early childhood differences in children raised by dual-, or single parents were controlled for has not found behavioral differences between these two groups. This study examines the relationship between specific childhood experiences and the use of guns in crime in a sample of incarcerated males in American prisons. Two specific childhood experiences are examined: exposure to violence in the home and exposure to guns in the home. Utilizing social learning theory, I argue that adult male felons who used guns in the commission of crimes will have had greater levels of exposure to violence and exposure to guns in their childhood home. This thesis offers a rhetorical criticism of two speeches delivered from a 1972 panel at the American Psychiatric Association (APA): Franklin Kameny’s “Gay, Proud and Healthy” and John Fryer’s “I am a Homosexual.” Both speeches seek to challenge heteronormative constructions of homosexuality through the construction of a positive homosexual identity. Kameny’s speech uses an extensive set of metaphors to deconstruct the sickness theory of homosexual, challenge the role psychiatrists should play in society, re-conceptualize sexuality, and empower homosexual identity. As a consequence of recent decisions from the ICJ and the ICTR, it is clear that genocide can be pursued through the international courts both in terms of criminal liability and also rights/responsibility legal paradigms. This article suggests that this duality in possible contexts and processes of judicial determination, while being procedurally problematic, is in keeping with the human rights direction of international criminal justice. This chapter identifies some of the potential legal and policy issues involved in the future regulation of over-the-counter (OTC) derivatives. First, regulators must be cautious in the regulation and solvency of some mammoth clearing- houses. Second, Singapore and Hong Kong both face challenges in the areas of global regulatory cooperation and extra-territorial regulatory effects. Moving on from the authors’ seminal 2009 critique of the overuse of role-plays in negotiation teaching, "Death of the Role-Play" (chapter 13 in Rethinking Negotiation Teaching), Alexander and LeBaron have taken the rapidly increasing enthusiasm for experiential learning in a new direction: multiple intelligences. Their particular interest is in a use of experiential learning that focuses on kinesthetic intelligence, employing actual physical movement, particularly dance, to unlock creativity in other mental domains, as well as to encourage authentic participation by people whose skills are not primarily verbal or mathematical. Background: Multicellular organisms consist of cells of many different types that are established during development. Each type of cell is characterized by the unique combination of expressed gene products as a result of spatiotemporal gene regulation. Currently, a fundamental challenge in regulatory biology is to elucidate the gene expression controls that generate the complex body plans during development. Cryo-electron microscopy is an experimental technique that is able to produce 3D gray-scale images of protein molecules. In contrast to other experimental techniques, cryo-electron microscopy is capable of visualizing large molecular complexes such as viruses and ribosomes. At medium resolution, the positions of the atoms are not visible and the process cannot proceed. The medium-resolution images produced by cryo-electron microscopy are used to derive the atomic structure of the proteins in de novo modeling. Objective — Pediatric psychologists are often interested in finding patterns in heterogeneous cross-sectional data. Latent variable mixture modeling is an emerging person-centered statistical approach that models heterogeneity by classifying individuals into unobserved groupings (latent classes) with similar (more homogenous) patterns. The purpose of this article is to offer a nontechnical introduction to cross-sectional mixture modeling.

Method — An overview of latent variable mixture modeling is provided and 2 cross-sectional examples are reviewed and distinguished.

Results — Step-by-step pediatric psychology examples of latent class and latent profile analyses are provided using the Early Childhood Longitudinal Study–Kindergarten Class of 1998–1999 data file. …

Research Findings: The objective of this study was to understand how instructional book-reading style and emotional quality of reading interact and relate to cognitive skills in a sample of at-risk infants and toddlers. Participants were 81 parents and their children participating in Early Head Start programs in the rural Midwest. Correlation and multiple regression analyses were used to test the hypothesis that parental book-reading instructional style and emotional quality interact and relate to changes in children’s cognitive scores for culturally and linguistically diverse families. The purposes of this research were to: develop a reliable measure of children’s affinity for nature or “biophilia”; determine whether young children’s biophilia was related to the “green-ness” of the outdoor play area of the preschool they attend; examine whether demographic variables are associated with children’s biophilia; and determine whether demographic variables predict children’s enrollment in nature-oriented programs. We recruited children from ten early childhood education programs—six that had outdoor play spaces with many natural elements and four that had few or none of these elements. This research examined preservice early childhood educators’ perceptions of outdoor settings and their intentions to use outdoor settings in their teaching practice. Students enrolled in an early childhood education program (n = 110) at a university in the Great Lakes region completed surveys that assessed perceptions of natural settings, intentions to use natural settings in future teaching, knowledge of the benefits of nature for children, and personal nature relatedness. Participants reported relatively high intentions to use natural settings in future teaching, as well as knowledge of the benefits of nature for children, but moderate levels of personal nature relatedness. Questions have arisen recently about the role of spiritual well-being in strengthening resilience of youth. To explore this association, this case study focused on the relationships and connectedness of young people who attend one religious organization as a means of enhancing their spiritual well-being. In line with the purposes of an instrumental case study, different sources of data (quantitative and qualitative) were collected on the phenomenon of interest—spiritual well-being. "Psychological professionals recommend following a number of steps to examine a client's claim of malingering, including the use of standardized measures (Binder, 2002). Psychometric testing is available to assist with the evaluation for malingering. The Portland Digit Recognition Test (PORT; Binder & Willis, 1991) has been found to be a valid measure of a client's motivation to perform inadequately on memory evaluations and thus, detects clients attempting to memory malinger. The PORT takes approximately 45 minutes to administer. Background The aim of this study was to review the available literature and define clinical practice guidelines for the use of laser and other light therapies for the prevention and treatment of oral mucositis.

Methods A systematic review was conducted by the Mucositis Study Group of the Multinational Association of Supportive Care in Cancer/International Society of Oral Oncology. The body of evidence for each intervention, in each cancer treatment setting, was assigned an evidence level. Based onthe evidence level, one of the following three guideline determinations was possible: recommendation, suggestion, and no guideline possible.

Tackling the issue of getting healthier food options into the hands of children presents multiple barriers. For example, with almost one out of three items on the supermarket shelf coming from a genetically modified organism, with school lunches decreasing in nutrition, and with the U.S. Environmental protection agency allowing nearly 1,400 pesticides to be spread throughout our nation, 40 of which have been classified as carcinogens (Epstein, M.D., and Leibson 28-33), this task is becoming progressively more difficult.
