The Regressing Progress Clause: Rethinking Constitutional Indifference To Harmful Content In Copyright, Ned Snow Nov 2013

The Regressing Progress Clause: Rethinking Constitutional Indifference To Harmful Content In Copyright, Ned Snow

Faculty Publications

The Constitution's Progress Clause purports to restrict Congress's copyright power to works that "promote the Progress of Science and useful Arts." For most of the past two centuries, this Clause has set a minimal content-based standard for copyright eligibility. It denied protection for a work whose content did not rise to the level of useful knowledge, in that the work either lacked compositional value or portrayed an immoral or unlawful subject matter. As evidenced by judicial and scholarly writings, this construction of the Progress Clause was consistent with the 1903 decision in Bleistein v. Donaldson Lithographing Co., where the Court …

International Journal of Aquatic Research and Education

Current healthcare provision demands evidence of clinical effectiveness. Since 2007, The Measure Yourself Medical Outcome Profile (MYMOP2) questionnaire has been used in the Aquatic Physiotherapy (AP) Department at the Brighton and Sussex Universitiy Hospitals NHS trust since 2007. This service evaluation presents a snapshot of pre- and post- MYMOP2 scores for a 3-month period. All patients (n = 125) attending for AP between January and March 2012 completed a MYMOP2 before and after treatment. AP was given as per Aquatic Therapy Association of Chartered Physiotherapists Guidance on Good practice in Hydrotherapy. The MYMOP2 Profile score was calculated from the mean …

Checklist For Assessing Graduate Student Competencies In Voice Disorders, Amy F. Teten, Shari L. Deveney, Mary J. Friehe

Special Education and Communication Disorders Faculty Publications

Low-incidence clinical disorders such as voice, nasal resonance, and fluency present challenging areas for graduate-level speech-language pathology training programs to help students acquire necessary knowledge and skills. A checklist of competencies for fluency disorders exists in the literature. The authors are presently collecting pretest/posttest data on the fluency disorders checklist over several cohorts of graduate students to determine student level of proficiency and confidence regarding these competencies. Preliminary data analysis suggests significant student perception of growth as a result of completing course requirements. These data have been useful to the second author, who teaches a course in fluency disorders and …

Information Systems and Quantitative Analysis Faculty Publications

Loss of postnatal mammalian auditory hair cells (HCs) is irreversible. Earlier studies have highlighted the importance of the Retinoblastoma family of proteins (pRBs) (i.e., Rb1, Rbl1/p107, and Rbl2/p130) in the auditory cells’ proliferation and emphasized our lack of information on their specific roles in the auditory system. We have previously demonstrated that lack of Rbl2/p130 moderately affects HCs’ and supporting cells’ (SCs) proliferation. Here, we present evidence supporting multiple roles for Rbl1/p107 in the developing and mature mouse organ of Corti (OC). Like other pRBs, Rbl1/p107 is expressed in the OC, particularly in the Hensen’s and Deiters’ cells. Moreover, Rbl1/p107 …

Construction Workers' Crystalline Silica Exposure: Statistical Analysis Of A Literature-Based Database, Jean-François Sauvé, Charles Beaudry, Denis Bégin, Chantal Dion, Michel Gérin, Jérôme Lavoué

The Uneven Representation Of Women In Asian Parliaments: Explaining Variation Across The Region, Devin K. Joshi, Kara Kingma Nov 2013

The Uneven Representation Of Women In Asian Parliaments: Explaining Variation Across The Region, Devin K. Joshi, Kara Kingma

Research Collection School of Social Sciences

Although home to the majority of the world's women, Asia is the continent with the smallest proportion of women in Parliament. Rarely studied from a comparative perspective, this article examines the uneven representation of women in the lower houses of contemporary Asian parliaments. While socio-economic modernization and industrialization are generally expected to increase the proportion of women in positions of political influence, we find that differences in electoral and party systems across Asia play a greater role than levels of female literacy, urbanization, or per capita income. In particular, Asian parliaments with strict quotas and a higher number of (three …

Probation As A Non-Custodial Measure In Nigeria: Making A Case For Adult Probation Service, Abubakri O. Yekini, Mashkur Salisu Nov 2013

Probation As A Non-Custodial Measure In Nigeria: Making A Case For Adult Probation Service, Abubakri O. Yekini, Mashkur Salisu

African Journal of Criminology and Justice Studies

Imprisonment as a disposition method has created a lot of problems not only in Nigeria criminal justice system but also, in most countries. It is now believed that imprisonment no longer serves the purpose for which it was meant to serve- deterrence. The offenders wrong the state and yet the state is responsible for their welfare while in prison. In 2012, over N50 billion (about $312,500,000) (Appropriation Act 2012) was budgeted for prison and yet the prison sub-culture makes inmate come out more hardened. This paper seeks to appraise the law and practice of probation as a non-custodial disposition method …

Assessing Current Programs And Reentry Needs In Trinidad And Tobago: Insights From Offenders – An Exploratory Study, Melvina Sumter, Elizabeth Monk-Turner, John Rougier

African Journal of Criminology and Justice Studies

Much literature in the United States explores how offenders’ perceive current programs and reentry challenges. However, little is known about such needs in the Trinidad and Tobago Prison System (TTPS). This research was designed to determine what are the perceived reentry needs of the sampled offenders? As such, fifty offenders in the TTPS were asked about how they perceive current services provided by TTPS, what programs they believe are necessary for success on release, and their anxiety level about (release) returning to the community in order to gauge their perceptions about anticipated reentry needs. Over all, respondents’ identified employment, life …

Reexamining Cultural Orientation Provided To Newly Arrived Refugees, Sara E. Matchulat Nov 2013

Reexamining Cultural Orientation Provided To Newly Arrived Refugees, Sara E. Matchulat

Capstone Collection

The provision of cultural orientation is one of many services required by the contract between resettlement agencies and the federal agencies overseeing refugee resettlement, the Cooperative Agreement. This paper explores World Relief in Moline, Illinois as a case study for how small resettlement agencies can provide meaningful and memorable cultural orientations. In order to accomplish this goal, this research utilizes the Empowerment Theory to explore how recently resettled refugees’ perceptions can be taken into consideration as orientation materials are examined. Research sought to compare Cooperative Agreement requirements to current orientation materials, interviewed service providers and recently resettled refugees, and utilized …

Cytochrome P450 Family 1 Inhibitors And Structure-Activity Relationships, Jiawang Liu, Jayalakshmi Sridhar, Maryam Foroozesh

Faculty and Staff Publications

With the widespread use of O-alkoxyresorufin dealkylation assays since the 1990s, thousands of inhibitors of cytochrome P450 family 1 enzymes (P450s 1A1, 1A2, and 1B1) have been identified and studied. Generally, planar polycyclic molecules such as polycyclic aromatic hydrocarbons, stilbenoids, and flavonoids are considered to potentially be effective inhibitors of these enzymes, however, the details of the structure-activity relationships and selectivity of these inhibitors are still ambiguous. In this review, we thoroughly discuss the selectivity of many representative P450 family 1 inhibitors reported in the past 20 years through a meta-analysis.

Distancing The Past: New Forms Of Discomfort With Aids In The U.S, John C. Hawley

English

In his Introduction to this collection, Gustavo Subero makes reference to the AIDS Quilt, a reference made especially significant since the year 2012 marked its 25th anniversary. The whole quilt had been last displayed in 1996; in the summer of 2012, 8.000 panels were rotated each day in the National Mall in Washington, DC. The quilt, composed of thousands of 3’ x 6’ panels (intentionally the size of a human grave), currently consists of over 48.000 panels honoring more than 94.000 individuals who have died of AIDS. In the early days of the quilt, in the 1980s and 1990s, the …

Addressing Climate Change: Have The Political Winds Shifted In Favor Of A Carbon Tax?, Jesse Reiblich Nov 2013

Addressing Climate Change: Have The Political Winds Shifted In Favor Of A Carbon Tax?, Jesse Reiblich

LSU Journal of Energy Law and Resources

Policymaking to combat climate change has been almost nonexistent despite the scientific community’s consensus that the time to act is now. Regardless, climate change remains a volatile political issue that divides our nation and its legislators. Advocates of reducing carbon emissions have traditionally endorsed several tools available to policymakers and administrative agencies in order to curb climate change: rulemaking under the Clean Air Act, capand-trade, and carbon taxes. Carbon tax legislation has gained traction after endorsements from both sides of the political aisle, and because it could be used to raise funds to reduce the United States’ deficit. Even policymakers …

Comparison Of Electrogustometrically Determined Taste Threshold And Phenylthiocarbamide Sensitivity Between Non-Diabetic Subjects With First Degree Relatives With Type 2 Diabetes And Non-Diabetic Subjects Without Type 2 Diabetic First Degree Relatives, Matthew E. Joseph Do Nov 2013

Joseph Do

PCOM Biomedical Studies Student Scholarship

Diabetes is a systemic degenerative disease, having adverse effects on many different organ systems. Nerve conduction specifically related to taste is one of the affected functions and can lead to altered taste perceptions and taste thresholds. Electrogustometry was used in this study to evaluate taste thresholds, and taste sensitivity was tested using phenylthiocarbamide-impregnated testing strips. Healthy non-diabetic subjects were divided into two experimental groups: One with a first degree relative with Type 2 diabetes and the other matched controls having no family history of Type 2 diabetes. The hypotheses: 1). There is a significant difference in taste threshold values and …

Slope Of Change Through D-Cycloserine Facilitation Of Exposure Therapy In A Social Anxiety Population, Christina M. Sheerin Nov 2013

Slope Of Change Through D-Cycloserine Facilitation Of Exposure Therapy In A Social Anxiety Population, Christina M. Sheerin

Dissertations

The present study sought to add to a growing base of research investigating approaches that facilitate the therapeutic effects of exposure-based therapy for social anxiety disorders. In particular, the approach involves the use of medication adjuvants that work in conjunction with therapeutic learning. This work translates findings from preclinical work to further our understanding of the neurobiological mechanisms that impact extinction learning. Among others, a promising method has been found with the use of D-cycloserine (DCS), a partial NMDA receptor agonist. Evidence of its positive impact in preclinical work has led to its application to clinical populations who suffer from …
