Reanalyzing Cost-Benefit Analysis: Toward A Framework Of Function(S) And Form(S), Robert B. Ahdieh

The analysis herein arises from the collision course between the sweeping reforms mandated by the Dodd-Frank Wall Street Reform and Consumer Protection Act of 2010 and a single sentence of the U.S. Code, adopted nearly fifteen years earlier and largely forgotten ever since. Few were likely thinking of Section 106 of the National Securities Market Improvement Act when the Dodd-Frank Act was enacted on July 21, 2010. As applied by the D.C. Circuit less than a year later in Business Roundtable v. SEC, however, that provision’s peculiar requirement of cost-benefit analysis could prove the new legislation’s undoing.

Although there are many important intellectual property and public health developments in the United States, the domestic debate remains surprisingly disconnected from the international debate. To help bridge this disconnect, this Article discusses the interrelationship between intellectual property and public health in the context of communicable diseases. This type of disease is intentionally picked to highlight how developments abroad could easily affect what happens at home, and vice versa.

Liriodendron tulipifera L., commonly known as yellow-poplar, is a fast-growing hardwood tree species with great ecological and economic value and is native to eastern North America. Liriodendron occupies an important phylogenetic position as a basal angiosperm and has been used in studies of the evolution of flowering plants. Genomic resources, such as Expressed Sequence Taq (EST) databases and Bacterial Artificial Chromosome (BAC) libraries, have been developed for this species. However, no genetic map is available for Liriodendron, and very few molecular markers have been developed. Phytophthora foliage blight of garden phlox (Phlox paniculata ) - caused by Phytophthora nicotianae - is a devastating disease that has been seen consistently in nursery production facilities in South Carolina. However, this disease has not been characterized previously. Recent complaints have been received on the failure of milk to foam to expectations of the coffee house (Randolph & Associates 2013). Four methods for estimating lake evaporation are presented and compared. Three are mass transfer methods that incorporated high resolution satellite imagery obtained from the MODIS sensor on the Terra and Aqua satellites. The fourth is the traditional pan method, which used monthly derived pan coefficients and pan evaporation measurements from a Class A evaporation pan located in Clemson, SC.

The four evaporation methods were used to estimate lake evaporation from the five major lakes in the Savannah River Basin for a period of more than one decade. Analysis of the evaporation rates clearly illustrated the uncertainty in daily, monthly, and …

Serious infections due to antibiotic-resistant bacteria are pervasive, and of particular concern within hospital units due to frequent interaction among health-care workers and patients. Such nosocomial infections are difficult to eliminate because of inconsistent disinfection procedures and frequent interactions among infected persons, and because ill-chosen antibiotic treatment strategies can lead to a growth of resistant bacterial strains. Clinical studies to address these concerns have several issues, but chief among them are the effects on the patients involved. Realistic simulation models offer an attractive alternative. Can we ever justly critique the norms and practices of another culture? When activists or policy-makers decide that one culture’s traditional practice is harmful and needs to be eradicated, does it matter whether they are members of that culture? Given the history of imperialism, many argue that any critique of another culture’s practices must be internal. Others argue that we can appeal to a universal standard of human well-being to determine whether or not a particular practice is legitimate or whether it should be eradicated. Consistent daily rhythms are important to healthy aging according to studies linking disrupted circadian rhythms with negative health impacts. We studied the effects of age and exercise on baseline circadian rhythms and on the circadian system's ability to respond to the perturbation induced by an 8 h advance of the light:dark (LD) cycle as a test of the system's robustness. Mice (male, mPer2luc/C57BL/6) were studied at one of two ages: 3.5 months (n=39) and >18 months (n=72). The cytochromes P450 (CYPs) are heme proteins responsible for the oxidation of xenobiotics and pharmaceuticals and the biosynthesis of essential steroid products. In all cases, substrate binding initiates the enzymatic cycle, converting ferric low-spin to high-spin state, with the efficiency of the conversion varying widely for different substrates, so documentation of this conversion for a given substrate is an important objective. Resonance Raman (rR) spectroscopy can effectively yield distinctive frequencies for the ν3 ‘spin state marker’ bands. Background/aims: The quaternary benzo-phenanthridine alkaloid (QBA) chelerythrine (CET) is a pro-apoptotic drug and Na(+)/K(+) pump (NKP) inhibitor in human lens epithelial cells (HLECs). In order to obtain further insight into the mechanism of NKP inhibition by CET, its sub-cellular distribution was quantified in cytosolic and membrane fractions of HLEC cultures by surface-enhanced Raman spectroscopy (SERS). Methods: Silver nanoparticles (AgNPs) prepared by the Creighton method were concentrated, and size-selected using a one-step tangential flow filtration approach. In 2012 burns hospitalized 40,000 people and over 17,000 people received organ transplants. Sadly, the number of organ donors greatly lags the number of people on the transplant waiting list and the gap has widened over the decades. Social status and hierarchies of social status are ubiquitous. Because of this, they have been addressed in a great number of philosophical, theoretical, and empirical discussions across a variety of fields of studies. A primary focus of attention has been on the role of human agency, most notably trait theory (i.e., personality theory). Despite a number of studies in this topic, there have been two notable limitations in extant studies. This project examined the link between race and self-efficacy. Self-efficacy pertains to an individual’s confidence in ability to complete or engage in a particular task or activity (Bandura, 1986). Prior research shows that self-efficacy has a great influence on exercise initiation and adherence (Bandura, 1986; Dishman, 1982; Rodgers and Sullivan, 2001). Research also supports that Caucasians are more likely to participate in exercise than African Americans (Centers for Disease Control and Prevention, 2000).

Participants included 51 females, 31 Caucasians and 20 African Americans, between the ages of 18 and 50 years old. The women were recruited from local fitness gyms, …

Cancer is a hyperplastic cellular malignancy that affected 1,436,000 people (newly diagnosed cases) in the United States last year. The top three most frequent forms of cancer were lung, prostate, and breast. Oncogenesis is associated with both genetic predisposition and environmental onslaught, with a mixture of the two being required for the malignancy to progress. Tumor markers, circulating serum factors, are used in the diagnosis of cancer. Prostate cancer is one of the most prevalent forms of this malignancy, affecting 230,110 men in 2004 alone. This study explored how different social interaction formats (face-to-face versus virtual) influence individuals’ belongingness need satisfaction and interaction enjoyment. Furthermore, it also explored how personality variables related to social anxiety (i.e., Interaction Anxiousness, Fear of Negative Evaluation) interact with social interaction format to influence belongingness needs satisfaction and enjoyment. Participants engaged in a conventional face-to-face interaction or a virtual interaction (via Instant Messenger) with a same-sex confederate on a between-subjects basis. Participants then indicated the extent to which the interaction satisfied fundamental social needs (e.g., self-esteem, belonging), their positive and negative mood, as well as how much they enjoyed the …

The Separate And Combined Effects Of Heredity And Environment Predicting Alcohol Use Disorder Symptoms And Antisocial Personality Disorder Symptoms, Jaylee R. Gill

The current study examined genetic and environmental influences in relation to alcohol use pathology. The 756 participants (378 adoptive, 378 non-adoptive) came from the 2001-2002 NESARC conducted by the NIAAA. A factorial ANOVA was used to measure the effects that the three grouping variables had on each dependent variable for a total of seven datasets. Results showed that biological parents’ drinking did pose a risk in participants for Loss of Control (p = .000) and Dangerous Behavior (p = .00). Adoption status was correlated with Conduct Disorder (p = .007) and Antisocial Personality Disorder (p = .014). This suggests that …

End-to-end models were constructed to examine and compare the trophic structure and energy flow in coastal shelf ecosystems of four US Global Ocean Ecosystem Dynamics (GLOBEC) study regions: the Northern California Current, the Central Gulf of Alaska, Georges Bank, and the Southwestern Antarctic Peninsula. High-quality data collected on system components and processes over the life of the program were used as input to the models. No Promo Hetero: Children's Right To Be Queer, Clifford J. Rosky

This Article argues that the state has no legitimate interest in promoting heterosexuality or gender conformity during childhood. Although opponents of LGBT rights have longed cited this goal as one of the primary justifications for discrimination against LGBT people, it has no constitutional foundation upon which to stand.

Building upon a schema familiar to legal scholarship on LGBT rights, this Article challenges the state's interest in promoting heterosexuality in childhood by articulating a tripartite defense of children's homosexual speech, status, and conduct. It argues that these three aspects of children's homosexuality are connected to and protected by the Constitution's free …
