Urban Growth Patterns And Effectiveness Of The Metropolitan Urban Service Areas In Woodbury, Minnesota, Danielle Thomas
Urban Growth Patterns And Effectiveness Of The Metropolitan Urban Service Areas In Woodbury, Minnesota, Danielle Thomas
All Graduate Theses, Dissertations, and Other Capstone Projects
This study evaluates the effectiveness of a specific urban sprawl containment strategy called the Metropolitan Urban Service Areas (MUSA). MUSA was developed for Minneapolis/St. Paul in order to ensure organized and practical development in areas that already had pre-built roads and sewer system infrastructures. Currently, MUSA is not an urban boundary; its specific goal is to, "synchronize urban growth with the provision of infrastructure needed to accommodate growth" (Council, August 2006). To evaluate the rigidity of the MUSA boundaries, the sample years of 1990, 2000, 2010 and the projected 2020 boundaries were subjected to spatial analysis utilizing three different software …
Health Status And Care Access Of The Uninsured In Kentucky, Douglas Keith Branham
Health Status And Care Access Of The Uninsured In Kentucky, Douglas Keith Branham
Theses and Dissertations--Public Health (M.P.H. & Dr.P.H.)
ABSTRACT/EXECUTIVE SUMMARY
With the individual mandate of the Patient Protection and Affordable Care Act (ACA) set to go into effect in 2014, as well as the Medicaid expansion in some states, the federal and state governments have a difficult road ahead planning how to respond to the anticipated increase in health services use. Kentucky is an undecided state regarding the Medicaid expansion and as one of the more impoverished states in the U.S. potentially has much to gain from the new law.
Many studies have focused on the U.S. as a whole in describing the health status of the uninsured. …
Ecology And Management Of Moose In Northern New England, Haley A. Andreozzi
Ecology And Management Of Moose In Northern New England, Haley A. Andreozzi
Master's Theses and Capstones
This study examined three facets of moose ecology in northern New England: impact of moose browsing on forest regeneration, physical characteristics of harvested bull moose, and winter habitat use. Forest regeneration was not considered a major problem in northern Vermont based on stocking levels of commercial tree species. Increasing dominance of softwood species coupled with suppressed growth of hardwoods suggests possible local shifts in composition. Bull moose in Maine had stable body weight and antler spread, and selective harvest of trophy bulls was not apparent over 30 years. Winter locations from aerial surveys indicated that moose preferentially used deciduous/mixed forest …
Strangers In Their Own Native Land: Joseph Smith, Mormons, And The Orientalizating Of An American People, Mahala Ruddell
Strangers In Their Own Native Land: Joseph Smith, Mormons, And The Orientalizating Of An American People, Mahala Ruddell
Master's Theses and Capstones
Emerging stronger than ever in the wake of the Napoleonic Wars, "orientalism" was more than just pictures of Turkish girls in a sultan's harem; it was a process of information sharing through art, literature, military campaigns, and politics. Joseph Smith founded the Church of Jesus Christ of Latter-day Saints, colloquially known as Mormonism, in the midst of this information exchange. A product of his era, he used orientalist rhetoric and imagery to connect the ideas he preached to ancient Judaism, thereby legitimizing the new religion within the context of a much older and more respected holy past. But he was …
Why Judges Should Not Make Refugee Law: Australia's Malaysia Solution And The Refugee Convention, Anthony Pastore
Why Judges Should Not Make Refugee Law: Australia's Malaysia Solution And The Refugee Convention, Anthony Pastore
Chicago Journal of International Law
In a 2011 decision, the High Court of Australia effectively incorporated an international treaty into a domestic statute. The case involved a refugee swap deal, called the "Malaysia Solution," between Australia and Malaysia, which the Australian government hoped would deter asylum seekers from making the dangerous overseas voyage to Australia. However, some of these asylum seekers argued that the Malaysia Solution violated the Migration Act, an Australian immigration statute. The plaintiff proposed an interpretation of the immigration statute that incorporated elements of the Convention Relating to the Status of Refugees, most notably the principle of "non-refoulement." A majority of the …

We Are Always Already Imprisoned: Hyper-Incarceration And Black Male Identity Performance, Frank Rudy Cooper
We Are Always Already Imprisoned: Hyper-Incarceration And Black Male Identity Performance, Frank Rudy Cooper
Scholarly Works
In this Essay, Professor Frank Rudy Cooper recenters the experiences of men of color, particularly those of black men, in light of Reagan's War on Drugs and recent scholarship illustrating the over-representation of men of color in prison for petty drug use. The mainstream's depiction of black men as always already imprisoned disciplines us into the never-finished quest to prove we are a "Good Black Man," rather than a "Bad Black Man." In order to propose greater empathy for black men's imprisonment, this article proceeds in the following manner. In Part I, Professor Cooper sets the stage for considering the …
Ballot Design As Fail-Safe: An Ounce Of Rotation Is Worth A Pound Of Litigation, Mary Beth Beazley
Ballot Design As Fail-Safe: An Ounce Of Rotation Is Worth A Pound Of Litigation, Mary Beth Beazley
Scholarly Works
For generations, some candidates have argued that first-listed candidates gain ‘‘extra’’ votes due to primacy effect, recommending ballot rotation to solve the problem. These votes, however, are generally intentional votes, accurately cast, and rotation is controversial. This article argues that rotation is appropriate because it mitigates the electoral impact of not only primacy effect, but also of two categories of miscast votes. First, rotation mitigates the impact of proximity-mistake votes, which can occur even on well-designed ballots when voters mis-vote for a candidate in proximity to their chosen candidate. Second, rotation mitigates the impact of mis-votes caused by flawed ballot …

Limited Effectiveness Of Hiv Prevention For Young People In Sub-Saharan Africa: Studying The Role Of Intervention And Evaluation, Kristien Michielsen, Marleen Temmerman, Van Rossem
Obstetrics and Gynaecology, East Africa
On average, 2,500 young people (15-24 years) get -infected with HIV every day; 80% of which live in sub-Saharan Africa. Since no cure or vaccine is available, reducing sexual risk behaviour in this group is crucial in tackling the epidemic. The general objective of this doctoral study was to improve the effectiveness of HIV prevention interventions for young people in sub-Saharan Africa. First, we assessed the overall effectiveness of such interventions (systematic literature review, meta-analysis). Secondly, we evaluated a school-based peer-led HIV prevention interventions in Rwanda (longitudinal, non-randomized controlled trial), to get insight into how interventions are developed, implemented and …
Religious/Spiritual Beliefs And Practices Of Asian/Asian American Mental Health Professionals & Students And The Impact On Treatment, Georgia Yu
Theses and Dissertations
Religion and spirituality is often an overlooked feature of culture and diversity. Robust research suggests that that religion and spiritual beliefs and practices of clinicians and clients can influence the treatment process and provide benefits to overall mental health and psychological well-being. This dissertation study provides an overview of the religious and spiritual beliefs, practices, and affiliations of psychologists compared to the general population. A specific focus is placed on that of mental health professionals and students of Asian and Asian-American descent, particularly given the religious and spiritual diversity among this ethnic group. Despite nearly 3 decades of research among …
Debt And Discipline: Neoliberal Political Economy And The Working Classes, Tayyab Mahmud
Debt And Discipline: Neoliberal Political Economy And The Working Classes, Tayyab Mahmud
Faculty Articles
Over the last three decades, neoliberal restructuring of the economy created a symbiosis of debt and discipline. New legal regimes and strategic use of monetary policy displaced Keynesian welfare, facilitated financialization of the economy, broke the power of organized labor, and expanded debt to sustain aggregate demand. Public laws and policies created a field of possibility within which financial markets extended their reach and brought ever-increasing sections of the working classes and the marginalized within the ambit of the credit economy. Reordered public policies and new norms of personal responsibility demarcated the horizon within which the economically vulnerable pursued strategies …
Tourism On A Scenic Byway: Destination Image And Economic Impacts Of The Beartooth Highway, Jacob Daniel Jorgenson
Tourism On A Scenic Byway: Destination Image And Economic Impacts Of The Beartooth Highway, Jacob Daniel Jorgenson
Graduate Student Theses, Dissertations, & Professional Papers
Many tourism destination managers know who their visitors are and how they are perceived by them. However, when new destinations begin to take shape, understanding these perceptions and meeting the expectations of visitors can be a difficult task. Destination image provides the ability to explore the perceptions of visitors at a tourism place. One such place the Beartooth Highway in south-central Montana and north-central Wyoming is a scenic byway that reaches nearly 11,000 feet in elevation. Previously, little to no research has been conducted regarding travelers that frequent this region. The purpose of this study was to understand the destination …
Forecasting Groundwater Responses To Dam Removal, Antony Ray Berthelote
Forecasting Groundwater Responses To Dam Removal, Antony Ray Berthelote
Graduate Student Theses, Dissertations, & Professional Papers
This dissertation contains three papers describing groundwater system responses to dam removals and presents current and new methodologies that managers can use to proactively forecast and mitigate those impacts. The three papers bring together literature, data gathering, data analysis, testing, and modeling techniques that apply groundwater science to forecasting the response of groundwater systems to dam removal actions. Conceptual and numerical models developed as part of this work provide scientists, environmental consultants, regulators and managers with tools to assess the consequences of the removal of stream reservoirs on the adjacent and underlying groundwater system The first chapter/paper, Responses of Groundwater …

Toward A Jurisprudence Of Law, Peace, Justice, And A Tilt Toward Non-Violent And Empathic Means Of Human Problem Solving, Carrie Menkel-Meadow
Georgetown Law Faculty Publications and Other Works
In this essay the author sets out some questions about whether law can be made a site of encouraging more positive, peace seeking, non-violent, and pro-social behaviors. These questions derive from my own family history, as well as from my experience as a social and political activist, and also as a practicing lawyer and legal scholar. She begins in the introduction by setting out these questions in light of current conditions of domestic and international violence and some past considerations of categories of law. In the second section of this essay the author explains where her questions come from—her personal …
A Comprehensive Research Framework For Geographic Parthenogenesis In Whiptail Lizards (Genus Aspidoscelis), Adam Leland
A Comprehensive Research Framework For Geographic Parthenogenesis In Whiptail Lizards (Genus Aspidoscelis), Adam Leland
UNLV Theses, Dissertations, Professional Papers, and Capstones
One of the most compelling topics in biology has been the ubiquity of sexual reproduction in living organisms. Because the ecological and evolutionary advantages of sex are well founded, those organisms that reproduce asexually remain enigmatic. Parthenogenesis, the clonal reproduction of an all-female species without the need for males, is a relatively common form of asexual reproduction in vertebrates, and has been subject of numerous academic investigations. Many parthenogenic organisms also share aspects of their geographic distributions, such as inhabiting higher latitudes, higher altitudes, islands or island-like habitats, xeric environments, and marginal, disturbed or ecotonal habitats relative to their sexual …
Comparison Of Wild-Domestic Sheep Interaction Policies In Bighorn Disease Outbreak Locations In The Continental U.S., 1990-2010, Tristan Howard
Comparison Of Wild-Domestic Sheep Interaction Policies In Bighorn Disease Outbreak Locations In The Continental U.S., 1990-2010, Tristan Howard
Graduate Student Theses, Dissertations, & Professional Papers
For over 100 years, disease has significantly limited bighorn sheep (Ovis canadensis) in the western U.S. Interaction with domestic sheep (Ovis aries) has been a primary cause of fatal bighorn disease (typically pneumonia), which has severely reduced or eliminated entire populations. Various wild-domestic sheep interaction policies exist to address the disease problem. In this analysis, six case study locations are compared and analyzed in an effort to evaluate policy efficacy. Locations examined and their bighorn die-off dates include: the Tobin Range, NV (1991); Aldrich Mountain, OR (1991); the Highland/Pioneer Mountains, MT (1994-1995); the Tarryall/Kenosha Mountains, CO (1997-2000); the Hays Canyon …

An Ice-Core Pollen Record Showing Vegetation Response To Late-Glacial And Holocene Climate Changes At Nevado Sajama, Bolivia, C. A. Reese, K. B. Liu, L. G. Thompson
Faculty Publications
We present the results of pollen analysis performed on an ice core recovered from Nevado Sajama, Bolivia, dated to 25 ka BP. Low pollen concentrations from 25 to 15 ka BP are consistent with the scenario of an expanded ice cap surrounded by sparse vegetation and cold conditions on the Altiplano during the Last Glacial Maximum. After 15 ka BP, more pollen is present and percentages show vegetation response to climate fluctuations during the late Pleistocene. Initially, high concentrations of Poaceae pollen are replaced by Asteraceae pollen, suggesting the occurrence of dry conditions towards the end of the Bolling-Allerod/Guantiva interstadial. …
Landscape Fairness: Removing Discrimination From The Built Environment, Stephen Clowney
Landscape Fairness: Removing Discrimination From The Built Environment, Stephen Clowney
Utah Law Review
At its core, this Article argues that the everyday landscape is one of the most overlooked instruments of modern race-making. Drawing on evidence from geography and sociology, the paper begins by demonstrating that the built environment inscribes selective and misleading versions of the past in solid, material forms. These narratives — told through street renamings, parks, monuments, and buildings — ultimately marginalize African-American communities and transmit ideas about racial power across generations.
After demonstrating that the landscape remains the agar upon which racial hierarchies replicate themselves, the Article then pivots and examines current efforts to rid the built environment of …
Mapping, Modeling, And The Fragmentation Of Environmental Law, Dave Owen
Mapping, Modeling, And The Fragmentation Of Environmental Law, Dave Owen
Utah Law Review
In the past forty years, environmental researchers have achieved major advances in electronic mapping and spatially explicit, computerbased simulation modeling. Those advances have turned quantitative spatial analysis—that is, quantitative analysis of data coded to specific geographic locations—into one of the primary modes of environmental research. Researchers now routinely use spatial analysis to explore environmental trends, diagnose problems, discover causal relationships, predict possible futures, and test policy options. At a more fundamental level, these technologies and an associated field of theory are transforming how researchers conceptualize environmental systems.
Advances in spatial analysis have had modest impacts upon the practice of environmental …
Transracial Adoption In The United States: The Reflection And Reinforcement Of Racial Hierarchy, David Ray Papke
Transracial Adoption In The United States: The Reflection And Reinforcement Of Racial Hierarchy, David Ray Papke
Utah Law Review
Individual whites who adopt children of another race admittedly have a range of motivations, and many manage to transcend racism in their adoptions and their subsequent family lives. However, transracial adoption as a socio-legal phenomenon remains racialized. Participants have preferences and standing related to their races, and transracial adoption reflects and reinforces the nation’s dominant racial hierarchy. In the area of transracial adoption and in the society as a whole, a “post-racial” era has not dawned, even with the election of a President who was in part raised abroad and understands himself as a man of color. In the contemporary …
The Humanitarian Problem With Drones, Frédéric Mégret
The Humanitarian Problem With Drones, Frédéric Mégret
Utah Law Review
One of the difficulties with the debate on drones is that it has become a sort of lightning rod for all kinds of anxieties about the use of force in today’s world. Drones are, often problematically, the emblematic weapon for a range of other phenomena, and unsurprisingly, attract much polemic. The challenge, therefore, is to find the specific problem with drones as a technology in armed conflict that could not be dealt with better by invoking a larger genus of problems. To do this, this Article outlines ways in which drones have been seen as problematic, which this Article argues …
The Public Trust In Wildlife, Michael C. Blumm
The Public Trust In Wildlife, Michael C. Blumm
Utah Law Review
The public trust doctrine, derived from ancient property principles, is thought to mostly apply to navigable waters and related land resources. The doctrine supplies a mediating force to claims of both private ownership and unfettered government discretion over these resources, vesting the state with trust responsibility to ensure that the use of these resources promotes long-term sustainability. A related doctrine—sovereign ownership of wildlife—is also an ancient public property doctrine inherited from England. State ownership of wildlife has long defeated private ownership claims and enabled states to enact and implement wildlife conservation regulations. This Article claims that these two doctrines should …
Interstate Groundwater Law In The Snake Valley: Equitable Apportionment And A New Model For Transboundary Aquifer Management, Noah D. Hall, Benjamin L. Cavataro
Interstate Groundwater Law In The Snake Valley: Equitable Apportionment And A New Model For Transboundary Aquifer Management, Noah D. Hall, Benjamin L. Cavataro
Utah Law Review
This Article examines how the equitable apportionment doctrine can be applied to an interstate groundwater dispute, using the Snake Valley Aquifer shared by Nevada and Utah as a case study. Equitable apportionment is a viable doctrine for resolving interstate groundwater disputes, but it is not ideal. Instead, interstate compacts provide a constitutional mechanism for cooperation by which states may protect and utilize a shared natural resource. There are over twenty interstate compacts currently in effect, covering major interstate waters such as the Colorado River and the Great Lakes. Some of these compacts address connected groundwater, but none to date are …
Tragulidae (Artiodactyla, Ruminantia) From The Middle Miocene Chinji Formation Of Pakistan, Muhammad Akbar Khan, Muhammad Akhtar
Tragulidae (Artiodactyla, Ruminantia) From The Middle Miocene Chinji Formation Of Pakistan, Muhammad Akbar Khan, Muhammad Akhtar
Turkish Journal of Earth Sciences
The fossil record of the Siwalik tragulids remains poorly documented. The study of the tragulid material from the Chinji Formation allows the identification of 3 species: Dorcatherium minus, Dorcatherium majus and Dorcabune anthracotherioides. The tragulid assemblage is quite rich and Dorcatherium is the predominant taxon in the Chinji Formation of Pakistan. The fossils from the Chinji Formation of the Chakwal district, northern Pakistan, may document the first appearance of the 3 tragulid species in the Lower Siwaliks. The selenodonty and palaeoecology of the Siwalik tragulids are also discussed.

Multi-Proxy Evidences Of Mid-Pleistocene Dry Climates Observed On Calcretes In Central Turkey, Ceren Küçükuysal, Asuman Günal Türkmenoğlu, Seli̇m Kapur
Turkish Journal of Earth Sciences
Palaeosols are very important in reconstructing palaeoclimate studies, since they are accepted as useful climate markers and as potential providers of proxy data. The study of the palaeosols of the Plio-Pleistocene rock sequences around Ankara revealed evidence for a reconstruction of the Quaternary palaeoclimate of the region. The study area is located in Bala, south-east of Ankara, which contains Middle Pleistocene red palaeosols with powdery to nodular calcrete developments, alternating with channel deposits. During this warm and arid period in the Pleistocene, the limited water available in the soil led to the accumulation of low magnesian carbonates, forming calcretes. The …

Vocabulary Acquisition In Kindergarten For English Language Learners: Ventriglia's Rule Of 3, Or Marzano's Six Steps To Effective Vocabulary Instruction?, Danielle Marie Rose
Graduate Research Papers
Teaching kindergarten is my passion. I love the excitement five and six year old children bring to the classroom. Their sense of wonder, their smiles and their laughter bring constant joy to my life. A group of children that I especially love teaching is the English language learners in my classroom. These children are always so curious to learn, but many times lack the adequate vocabulary to understand conversations between peers or comprehend the meaning of books. This lack of vocabulary knowledge decreases their success in the classroom. Throughout my teaching career, it has been my constant desire to implement …
On Human Biological Diversity : Variation In Sexual Dimorphism Of The Skull Between African-Americans And European-Americans, Amanda Grace Kittoe
On Human Biological Diversity : Variation In Sexual Dimorphism Of The Skull Between African-Americans And European-Americans, Amanda Grace Kittoe
LSU Master's Theses
This study assesses sexual dimorphism of the skull in samples of African-Americans (AA) and European-Americans (EA). Morphology of the cranium is classically referenced as an indicator of sexual dimorphism in the fields of bioarchaeology and forensic anthropology. Variation in size and shape of cranial elements has been found to differ significantly between ancestral populations. Abundant research suggests that patterns of sexual dimorphism also vary between ancestries. This study uses a sample of 55 AA females, 50 AA males, 49 EA females, and 49 EA males from the Hamann-Todd Collection at the Cleveland Museum of Natural History and the WM Bass …
