Existential Phenomenology's Role In Understanding Minority Cynicism In The American Legal System, Layla Garcia-Brown Jan 2013

Existential Phenomenology's Role In Understanding Minority Cynicism In The American Legal System, Layla Garcia-Brown

Senior Honors Theses and Projects

This paper will discuss the cynicism many people of color have toward the American legal system by using the intersections between existential philosophy, Africana philosophy, black existentialism and phenomenology. This paper will explore the cynicism and lack of trust held by many American minorities toward the American legal and judicial systems primarily through the lenses of philosophy, but additionally, the disciplines of: psychology, political science, criminology and sociology will also be discussed as they are vital and unavoidable disciplines to the discussion. Therefore, the methodology of this paper is intersectionality, meaning that all of the above systems as well as …

Development Of 15 Psi Safe Haven Polycarbonate Walls For Use In Underground Coal Mines, Rex Allen Meyr Jr. Jan 2013

Development Of 15 Psi Safe Haven Polycarbonate Walls For Use In Underground Coal Mines, Rex Allen Meyr Jr.

Theses and Dissertations--Mining Engineering

Following three major mining accidents in 2006, the MINER Act of 2006 was enacted by MSHA and required every underground coal mine to install refuge alternatives to help prevent future fatalities of trapped miners in the event of a disaster. The following research was performed in response to NIOSH’s call for the investigation into new refuge alternatives. A 15 psi safe haven polycarbonate wall for use in underground coal mines was designed and modeled using finite element modeling in ANSYS Explicit Dynamics. The successful design was tested multiple times in both half-scale and small scale using a high explosive shock …

The Collective Origins Of Toxic Air Pollution: Implications For Greenhouse Gas Trading And Toxic Hotspots, David E. Adelman Jan 2013

The Collective Origins Of Toxic Air Pollution: Implications For Greenhouse Gas Trading And Toxic Hotspots, David E. Adelman

Indiana Law Journal

This Article presents the first synthesis of geospatial data on toxic air pollution in the United States. Contrary to conventional views, the data show that vehicles and small stationary sources emit a majority of the air toxics nationally. Industrial sources, by contrast, rarely account for more than ten percent of cumulative cancer risks from all outdoor sources of air toxics. This pattern spans multiple spatial scales, ranging from census tracts to the nation as a whole. However, it is most pronounced in metropolitan areas, which have the lowest air quality and are home to eighty percent of the U.S. population. …

Investment Impact Of Water Reliability—Recent Dow Experience, Paul Bork

Texas A&M Journal of Property Law

Rather than repeat the work of others in this area, this paper merely cites with approval the recent paper of Michael Booth3 for its presentation of the background and current status of the law, including TCEQ’s regulations and the ongoing case4 challenging the existing TCEQ water call regulations and their application. The Author ex- presses no view regarding the paper’s presentation of Mr. Booth’s views with respect to the legality or appropriateness of these regula- tions or his views on this case. The Author notes in passing that the second sentence in Section D of this paper should read in …

Conceptualizing Age-Friendly Community Characteristics In A Sample Of Urban Elders: An Exploratory Factor Analysis, Richard J. Smith, Amanda J. Lehning, Ruth E. Dunkle

Social Work Faculty Publications

Accurate conceptualization and measurement of age-friendly community characteristics would help to reduce barriers to documenting the effects on elders of interventions to create such communities. This article contributes to the measurement of age-friendly communities through an exploratory factor analysis of items reflecting an existing U.S. Environmental Protection Agency policy framework. From a sample of urban elders (n =1,376), we identified six factors associated with demographic and health characteristics: Access to Business and Leisure, Social Interaction, Access to Health Care, Neighborhood Problems, Social Support, and Community Engagement. Future research should explore the effects of …

Origins Of The Privileges And Immunities Of State Citizenship Under Article Iv, Stewart Jay Jan 2013

Origins Of The Privileges And Immunities Of State Citizenship Under Article Iv, Stewart Jay

Loyola University Chicago Law Journal

The Privileges and Immunities Clause of Article IV provides: “The Citizens of each State shall be entitled to all Privileges and Immunities of Citizens in the several States.” According to Alexander Hamilton, the clause was “the basis of the union,” which may seem odd given its minor significance in modern constitutional law. Part of the reason for its relative unimportance today is the development of constitutional doctrines unforeseeable in the eighteenth century: the invention of the Dormant Commerce Clause and the enactment of the Fourteenth Amendment, which prohibit much of the interstate discrimination that Article IV’s clause was intended to …

Editorial: Preoccupy/Maximum Occupancy, Kryssi Staikidis Jan 2013

Editorial: Preoccupy/Maximum Occupancy, Kryssi Staikidis

Journal of Social Theory in Art Education

When the Editor and Associate Editor conceived of this call for papers for PreOccupy/Maximum Occupancy, it was based on the Caucus members’ input during the annual meetings of the Caucus on Social Theory and Art Education (CSTAE) at the National Art Education Association conference, NAEA 2012, New York. We listened to our colleagues speak about the year’s events, and we discussed how we as art educators could respond to the needs of the Caucus and of our field for Volume 33 of the Journal of Social Theory in Art Education (JSTAE).

Poetic Occupations: Artists As Narrator-Protagonists, Jack Richardson Jan 2013

Poetic Occupations: Artists As Narrator-Protagonists, Jack Richardson

Journal of Social Theory in Art Education

What does it mean to “occupy” space? Referencing the Occupy Wall Street (OWS) protests of 2011, this paper articulates a type of public art practice that can be understood as poetic occupation. The paper further suggests that shifting one’s understanding of public art practice provokes a reconsideration of the role of the artist. To this end, Miwon Kwon’s (2002) term “narrator-protagonist” is useful for expressing this alternative role. The paper proceeds with an exploration of the work of the artist collective Lone Twin, supported by Michel de Certeau’s (1984) theories associating walking with speaking, and illustrated with an analysis of …

(Pre)Determined Occupations: The Post-Colonial Hybridizing Of Identity And Art Forms In Third World Spaces, Amanda Alexander, Manisha Sharma Jan 2013

(Pre)Determined Occupations: The Post-Colonial Hybridizing Of Identity And Art Forms In Third World Spaces, Amanda Alexander, Manisha Sharma

Journal of Social Theory in Art Education

In this article, we present the effects of globalization on art forms in Peru and on teacher identity in India while exploring hybridization as an ongoing global paradigm in both contexts (Bhabha, 1994; Said, 1979). Peruvian art forms are continuously shifting as global cultures meld and become more technologically connected, which ultimately brings about questions of authenticity. The identities of Indian art educators are evolving, and shifting indicating an assemblage or structure containing many parts working together to perform a particular function. In realizing its function, the structure can be named or its form made visible (Deleuze & Guattari, 1987). …

Altering The Urban Frontier: Gentrification And Public Parks In New York City, Sarah E. Evers Jan 2013

Altering The Urban Frontier: Gentrification And Public Parks In New York City, Sarah E. Evers

Pitzer Senior Theses

After decades of cuts to federal funding, cities were left with few resources for public services, particularly parks and open spaces. Current trends of massive gentrification in New York City are changing the housing market and other components of the private sector. In addition to altering socio-spatial dynamics in the housing and consumer markets, gentrification can alter public spaces as well. By comparing three New York City neighborhoods at different stages of gentrification, I analyzed socio-spatial dynamics, public and private funding, event programming, and ethnographically observed changes in the physical and social landscape of the park, and neighborhood, over time.

The Tree Of Life: From Eden To Eternity, Liza Olsen, John W. Welch, Donald W. Parry Jan 2013

The Tree Of Life: From Eden To Eternity, Liza Olsen, John W. Welch, Donald W. Parry

BYU Studies

One of humankind's most sacred and abiding symbols is the tree of life. From earliest recorded religious belief, that singular image encompassed the sense of our humanity, rooted deeply in this earthly life with branches stretching outward, heavenward, in hope of the divine. From the Garden of Eden to Lehi's dream, tree of life imagery is particularly evocative within Mormonism, and many contributors to this book are Latter-day Saints writing from scholarly and religious points of view. The tree likewise takes a central place in the development of various human belief systems. Scholars whose works appear in this collection explore …

"Hope, Danger's Comforter": Thucydides, Hope, Politics, Joel Alden Schlosser Jan 2013

"Hope, Danger's Comforter": Thucydides, Hope, Politics, Joel Alden Schlosser

Political Science Faculty Research and Scholarship

With its ascendancy in American political discourse during the past few years, hope has become a watchword of politics, yet the rhetoric has failed to inquire into the actual function of hope in political life. This essay examines elpis, the Greek word for ‘‘hope,’’ in Thucydides’ History and offers a theoretical account of this concept and its connection to successful political action. I suggest that a complex understanding of hope structures Thucydides’ narrative: Hope counts as among the most dangerous political delusions, yet it also offers the only possible response to despair. Thucydides’ text educates the judgment of his …

Political Violence, Collective Functioning And Health: A Review Of The Literature, Cindy A. Sousa Jan 2013

Political Violence, Collective Functioning And Health: A Review Of The Literature, Cindy A. Sousa

Graduate School of Social Work and Social Research Faculty Research and Scholarship

Political violence is implicated in a range of mental health outcomes, including PTSD, depression, and anxiety. The social and political contexts of people’s lives, however, offer considerable protection from the mental health effects of political violence. In spite of the importance of people’s social and political environments for health, there is limited scholarship on how political violence compromises necessary social and political systems and inhibits individuals from participating in social and political life. Drawing on literature from multiple disciplines, including public health, anthropology, and psychology, this narrative review uses a multi-level, social ecological framework to enhance current knowledge about the …

World Knowledge And Global Citizenship: Factual And Perceived World Knowledge As Predictors Of Global Citizenship Identification, Stephen Reysen, Iva Katzarska-Miller, Shonda A. Gibson, Braken Hobson Jan 2013

World Knowledge And Global Citizenship: Factual And Perceived World Knowledge As Predictors Of Global Citizenship Identification, Stephen Reysen, Iva Katzarska-Miller, Shonda A. Gibson, Braken Hobson

Faculty Publications

We examine the influence of factual and perceived world knowledge on global citizenship identification. Perceived world knowledge directly predicted global citizenship identification, while factual world knowledge did not (Study 1). Students’ factual (Study 1) and perceived (Study 2) world knowledge predicted students’ normative environment (degree that valued others prescribe being a global citizen) and global awareness (perceived knowledge of the world and one’s connection to the world), which then predicted global citizenship identification, and identification with global citizens predicted endorsement of pro-social values and behaviours (e.g., intergroup empathy, valuing diversity). Overall, the results highlight the indirect influence of factual and …

Reflections On A Decade Of Global Rankings: What We've Learned And Outstanding Issues, Ellen Hazelkorn Jan 2013

Reflections On A Decade Of Global Rankings: What We've Learned And Outstanding Issues, Ellen Hazelkorn

Articles

Ten years after the first global rankings appeared, it is clear that they have had an extraordinary impact on higher education. While there are fundamental questions about whether rankings measure either quality or what’s meaningful, they have succeeded in exposing higher education to international comparison. Moreso, because of the important role higher education plays as a driver of economic development, rankings have exposed both an information deficit and national competitiveness. Accordingly, both nations and institutions have sought to maximise their position vis-á-vis global rankings with positive and perverse effects. Their legacy is evident in the way rankings have become an …

Risks And Safety On The Internet: Comparing Brazilian And European Children, Alexander Barbosa, Brian O'Neill, Cristina Ponte, Simões Simões, Tatiana Jereissati Jan 2013

Risks And Safety On The Internet: Comparing Brazilian And European Children, Alexander Barbosa, Brian O'Neill, Cristina Ponte, Simões Simões, Tatiana Jereissati

Articles

A child’s home and school are the most frequently reported locations of internet use in Brazil: 60% of Brazilian children aged 9 to 16 who used the internet claimed to access it from home, and 42% from school, whereas in Europe this proportion is 87% for home access and 63% for schools.

However, when it comes to accessing the network from publicly sponsored internet access centres such as Local Area Network (LAN) Houses or cybercafés, the value in Brazil is considerably higher when compared to Europe, 35% against 12% respectively. Access from public libraries is far more popular in Europe …

How Tax Increment Financing (Tif) Districts Correlate With Taxable Properties, Randall K. Johnson Jan 2013

How Tax Increment Financing (Tif) Districts Correlate With Taxable Properties, Randall K. Johnson

Faculty Works

This article deals with Tax Increment Financing (TIF), which is a popular economic development tool. TIF borrows against future tax revenues to subsidize current development projects. In Illinois, this economic development tool is justified by its promise to expand the local tax base: by increasing tax revenues, increasing the number of tax payers or increasing the number of taxable properties in the area. However, it is not clear that TIF delivers on its promise. A new dataset, which is introduced in this article, helps to clarify the issue. It does so by providing information about the number of TIF Districts …

Amazonian Maize: Diversity, Spatial Distribution And Historical-Cultural Diffusion, Fábio O. Freitas, Patricia G. Bustamante Jan 2013

Amazonian Maize: Diversity, Spatial Distribution And Historical-Cultural Diffusion, Fábio O. Freitas, Patricia G. Bustamante

Tipití: Journal of the Society for the Anthropology of Lowland South America

Subsistence is one of the factors that determined the presence or migration of prehistoric human populations. At the same time, humans were largely responsible for the dissemination of important crop plants such as maize (Zea mays). Maize is the major domesticated species in the New World, with thousands of landraces that were shaped by environment and human culture. Genetic analyses of archaeological and indigenous maize samples were used to verify the occurrence in South America of at least two major introductory waves of distinct races of maize from its center of origin in Mexico. The first occurred around 5000 years …

Managing Inner And Outer Conflict: Selves, Subpersonalities, And Internal Family Systems, Leonard L. Riskin Jan 2013

Managing Inner And Outer Conflict: Selves, Subpersonalities, And Internal Family Systems, Leonard L. Riskin

UF Law Faculty Publications

This article describes potential benefits of considering certain processes within an individual that take place in connection with external conflict as if they might be negotiations or other processes that are routinely used to address external disputes, such as mediation or adjudication. In order to think about internal processes in this way, it is necessary to employ a model of the mind that includes entities capable of engaging in such processes. The Internal Family Systems (IFS) model, developed by Richard C. Schwartz, works well for this purpose. The IFS model is grounded on the construct that the mind is composed …
