A Political Economy Approach To Reforming The Foreign Corrupt Practices Act, Matthew C. Turk Jan 2013

A Political Economy Approach To Reforming The Foreign Corrupt Practices Act, Matthew C. Turk

Northwestern Journal of International Law & Business

Prohibitions against transnational bribery suffer from a paradoxical problem of simultaneous over- and under-enforcement. On the “supply-side,” U.S. enforcement against bribery through the Foreign Corrupt Practices Act (FCPA) is increasingly over-aggressive, while enforcement by other developed economies is nearly non-existent. On the “demand-side,” governments of developing economies where bribes take place often have neither an interest in nor the capacity to rein in their corrupt officials. In light of these shortcomings, this Article proposes reforming the FCPA as follows. First, the SEC should cease paying profits disgorged by corporate defendants into the U.S. Treasury. Second, disgorgements should instead be transferred …

Punishing The Pen With The Sword?: Colombia's New, Extreme, And Ineffective Punishment For Plagiarism, David Cromwell Jan 2013

Punishing The Pen With The Sword?: Colombia's New, Extreme, And Ineffective Punishment For Plagiarism, David Cromwell

Washington International Law Journal

The Colombian Supreme Court of Justice recently sentenced a professor to two years in prison for plagiarizing a student’s thesis, an extreme punishment by both comparative and Colombian standards. Despite its severity and global ramifications, the decision has received little attention within the English-speaking legal community. This comment provides an overdue analysis of the case and clarifies the current state of Colombian copyright law, both on the books and on the ground. The comment argues that while the case has clarified that plagiarism is a crime in Colombia, addressing academic plagiarism through criminal punishment will likely do little to deter …

Climate Hope: Implementing The Exit Strategy, Henry Shue Jan 2013

Climate Hope: Implementing The Exit Strategy, Henry Shue

Chicago Journal of International Law

While Eric A. Posner and David Weisbach advocate that climate change and poverty be tackled separately, the realiZaion that only a single cumulative carbon emissions budget is available to accommodate all nations through all centuries of the current millennium shows why efforts to confront these two challenges are inextricably linked Once carbon dioxide from fossil fuels reaches the atmosphere, most molecules remain for several centuries. Therefore, most additions of carbon dioxide to the atmosphere are effectively net additions to a rapidly swelling total accumulation. Total cumulative atmospheric carbon correlates strongly with maximum surface temperature. It is, consequently, urgent to cease …

Redefining "Atheism" In America: What The United States Could Learn From Europe's Protection Of Atheists, Alan Payne Jan 2013

Redefining "Atheism" In America: What The United States Could Learn From Europe's Protection Of Atheists, Alan Payne

Emory International Law Review

There continues to be a pervasive and persistent stigma against atheists in the United States. The current legal protection of atheists is largely defined by the use of the Establishment Clause to strike down laws that reinforce this stigma or that attempt to deprive atheists of their rights. However, the growing atheist population, a religious pushback against secularism, and a neo-Federalist approach to the religion clauses in the Supreme Court could lead to the rights of atheists being restricted.

Securities Arbitration In China: A Better Alternative To Retail Shareholder Protection, Gu Weixia Jan 2013

Securities Arbitration In China: A Better Alternative To Retail Shareholder Protection, Gu Weixia

Northwestern Journal of International Law & Business

There is a large body of law and finance literature suggesting that strong legal protection for investors is the key to a nation’s healthy stock market development and economic growth. Despite remarkable progress in setting up its securities market, China has often been criticized for its underdeveloped regulatory regime. The wide securities fraud scandals that contrast with the paucity of conviction rates are indicative of China’s inadequate public securities law enforcement. Private enforcement efforts, such as securities litigation, help address the disconnect between the securities regulatory regime and investor compensation. Nevertheless, given the immaturity of China’s current legal and institutional …

The Debate On Discounting: Reconciling Positivists And Ethicists, Christian Gollier Jan 2013

The Debate On Discounting: Reconciling Positivists And Ethicists, Christian Gollier

Chicago Journal of International Law

Using a simple arbitrage argument, positivists claim that the interest rate provides the right basis to fix the discount rate to evaluate green investment projects. The real interest rate observed in the US during the twentieth century was around 1 percent. On the other band, ethicists estimate the discount rate using the marginal rate of substitution between current and future consumption. From classical estimations of intertemporal inequality aversion and prudence, assuming a 2 percent growth rate of consumption, they recommend a discount rate of around 3.5 percent. Ethicists are therefore less prone to investing for the future than positivists. I …

Climate Change: Why Theories Of Justice Matter, Martha C. Nussbaum Jan 2013

Climate Change: Why Theories Of Justice Matter, Martha C. Nussbaum

Chicago Journal of International Law

Climate Change Justice is impressive, and one of its merits is its serious treatment of philosophical issues. Developing its philosophical aspects further will strengthen the argument, in three areas: (1) the relationship between entitlements and duties; (2) the moral status of the nation; and (3) the question of plural ends.

Who Should Pay For Climate Change? "Not Me", Paul Baer Jan 2013

Who Should Pay For Climate Change? "Not Me", Paul Baer

Chicago Journal of International Law

In Climate Change Justice, Eric A. Posner and David Weisbach argue not only that a climate treaty with significant North-to-South redistribution of wealth is infeasible, but also that to support such a treaty is counterproductive. They ague instead that all countries should support an "optimal" climate treaty, balancing marginal costs and benefits, and that side payments should go to ensure that no countries-even wealthy, high-polluting countries that are externalizing huge costs and risks-are worse off than the status quo. They justify this seeming contradiction to their welfarist moral theory by arguing that North-South redistribution is better handled in a separate …

Living With A Changing Climate: Holocene Climate Variability And Socio-Evolutionary Trajectories, Central Turkey, Samantha Lee Allcock Jan 2013

Living With A Changing Climate: Holocene Climate Variability And Socio-Evolutionary Trajectories, Central Turkey, Samantha Lee Allcock

School of Geography, Earth and Environmental Sciences Theses

Collaborative studies between Quaternary scientists and archaeologists increasingly provide new and informative discussions about the nature and timing of cultural change and links with variation in the natural world (particularly climate). In the Eastern Mediterranean region, connecting the human past with palaeoclimate is an important research theme but the complex interactions between them are still poorly understood and past climate records have often been collected from regions distant from the human record. The thesis aims to derive a record of past climatic and environmental changes from lake sediment cores and synthesise this with archaeological data in order to reconstruct human-climate …

Revenge Of The Steamroller: Abcp As A Window On Risk Choices, Carlos Arteta, Mark Carey, Ricardo Correa, Jason Kotter Jan 2013

Revenge Of The Steamroller: Abcp As A Window On Risk Choices, Carlos Arteta, Mark Carey, Ricardo Correa, Jason Kotter

Faculty Publications

We empirically examine financial institutions’ motivations to take systematic bad-tail risk in the form of sponsorship of credit-arbitrage asset-backed commercial paper vehicles. A run on debt issued by such vehicles played a key role in causing and propagating the liquidity crisis that began in the summer of 2007. We find evidence consistent with important roles for both ownermanager agency problems and government-induced distortions, especially government control or ownership of banks.

Perils And Profits: A Reexamination Of The Link Between Profitability And Safety In U.S. Aviation, Peter M. Madsen Jan 2013

Perils And Profits: A Reexamination Of The Link Between Profitability And Safety In U.S. Aviation, Peter M. Madsen

Faculty Publications

In many industries, for-profit business organizations make decisions that critically impact the safety of their employees and the public. Managers in such organizations often argue that there is no trade-off between profitability and safety because “safety is good business.” However, prior studies examining the profitability–safety relationship report inconsistent and conflicting results. In the present study, the author reexamines this issue, building on insights into managerial risk taking from the behavioral theory of the firm and hypothesizing that the slope of the profitability–safety relationship reaches an inflection point at the organizational profitability aspiration. Using data from the U.S. airline industry, the …

Community Health Sciences

Background: Body weight and its perception play an important role in the physical and mental well-being of a person. Weight perception is found to be a better predictor of weight management behaviour as compared to actual weight. In Pakistan, studies have been done on the prevalence of weight status but weight perception is still unexplored. The study was done to examine relationships between body weight perception, actual weight status, and weight control behaviour among the female university students of Karachi.
Methods: A cross sectional study was carried out during Sep-Nov 2009 on female students in four universities of Karachi, Pakistan. …
