A Jurisdictional Perspective On New York Times V. Sullivan, Howard M. Wasserman Jan 2013

A Jurisdictional Perspective On New York Times V. Sullivan, Howard M. Wasserman

Faculty Publications

New York Times v. Sullivan, arguably the Supreme Court's most significant First Amendment decision, marks its fiftieth anniversary next year. Often overlooked in discussions of the case's impact on the freedom of speech and freedom of the press is that it arose from a complex puzzle of constitutional, statutory, and judge-made jurisdictional and procedural rules. These kept the case in hostile Alabama state courts for four years and a half-million-dollar judgment before the Times and its civil rights leader co-defendants finally could avail themselves of the structural protections of federal court and Article III judges. The case's outcome and …

If women outnumber men in graduate schools and are entering professional and other workplaces in unprecedented numbers, and if Title VII has aimed to eradicate workplace discrimination for almost fifty years, why are women still so woefully underrepresented at the highest levels of power, leadership, wealth, and prestige in the contemporary workplace? This Article is about abusive speech in the workplace. It explores how the expression of bias in the workplace has evolved and been shaped by anti-discrimination legislation and jurisprudence. It identifies a category of biased speech that eludes prosecution under Title VII. Moreover, this Article seeks to provide …

Reexamining The Relationship Between Financial Development And Economic Growth: The Case Of South Africa., Erick Kitenge Jan 2013

Reexamining The Relationship Between Financial Development And Economic Growth: The Case Of South Africa., Erick Kitenge

Research Papers

This paper aims to analyze the causality relationship between financial development and economic development. The pairwise Granger causality test was applied to data of South Africa, from 1966 to 2008, under Vector Error Correction Mechanism. Empirical analysis reveals two major facts. Firstly, the economic growth Granger causes the financial development. Secondly, there exist long-run and short-run causality relationships from economic growth to bank assets. A boom of economic activities seems to be the driving force behind the improvement of financial sectors. Consequently, policies aiming to foster the financial sector in South Africa should include the nature of increased economic activities.

Pre-Constitutional Law And Constitutions: Spanish Colonial Law And The Constitution Of Cádiz, M C. Mirow Jan 2013

Pre-Constitutional Law And Constitutions: Spanish Colonial Law And The Constitution Of Cádiz, M C. Mirow

Faculty Publications

This article contributes to the intellectual and legal history of this constitutional document. It also provides a close study of how pre-constitutional laws are employed in writing constitutions. It examines the way Spanish colonial law, known as "derecho indiano" in Spanish, was used in the process of drafting the Constitution and particularly the way these constitutional activities and provisions related to the Americas. The article asserts that this pre-constitutional law was used in three distinct ways: as general knowledge related to the Americas and their institutions; as a source for providing a particular answer to a specific legal question; and …

Teaching The Post-Sex Generation, Kerri Lynn Stone Jan 2013

Teaching The Post-Sex Generation, Kerri Lynn Stone

Faculty Publications

There is a trend that I have observed in the course of leading my classes in discussions about the kinds of behavior that may constitute unlawful discrimination: the emergence of an attitude among students that society is simply “post-sex,” or no longer in need of most or all anti-sex discrimination jurisprudence. This Article details my own approach to teaching and to raising and conducting discussions about how anti-discrimination legislation and jurisprudence works in theory, in practice, and how it would/could work in an ideal world. I enjoy teaching students with a diversity of viewpoints. However, when I began to encounter …

Prosecuting Those Bearing 'Greatest Responsibility': The Lessons Of The Special Court For Sierra Leone, Charles Chernor Jalloh Jan 2013

Prosecuting Those Bearing 'Greatest Responsibility': The Lessons Of The Special Court For Sierra Leone, Charles Chernor Jalloh

Faculty Publications

This Article examines the controversial article 1(1) of the Statute of the Special Court for Sierra Leone (SCSL) giving that tribunal the competence “to prosecute those who bear the greatest responsibility” for serious international and domestic crimes committed during the latter part of the notoriously brutal Sierra Leonean conflict. The debate that arose during the SCSL trials was whether this bare statement constituted a jurisdictional requirement that the prosecution must prove beyond a reasonable doubt or merely a type of guideline for the exercise of prosecutorial discretion. The judges of the court split on the issue. This paper is the …

Change And Discomfort In Academia: How Far Should We Stretch In Our Readiness For Change?, Laurie A. Branch Jan 2013

Change And Discomfort In Academia: How Far Should We Stretch In Our Readiness For Change?, Laurie A. Branch

Student Scholarship

Employee attitudes and their effect on successful implementation of organizational changes continue to engross researchers and practitioners alike. In this study, we investigated the significance and nature of discomfort as it affects readiness for change in business school settings. This choice of context is deliberate. There is a strong push for change in business schools to align with market needs and there are high levels of individual and collective efficacy. Our findings indicate discomfort as a mediator explains significantly more variation in readiness than is explained by perceived collective efficacy. Surprisingly, we found that some forms of discomfort such as …

Institutional Factors Influencing The Effectiveness Of Scientist-Physician Partnerships In Biomedical Research, Yunmei Wang Jan 2013

Institutional Factors Influencing The Effectiveness Of Scientist-Physician Partnerships In Biomedical Research, Yunmei Wang

Student Scholarship

Substantial resources invested in biomedical research have generated revolutionary discoveries in medical science. However, it takes on average 17 years to turn about 14% of research findings into changes that benefit patients. Lack of scientist-physician partnership (SPP) is one main reason for the extremely slow translation of science into medical practice. Our previous study identified several institutional and socio-cultural barriers that hinder SPP and slow down knowledge transfer in medicine. However, the relationships among the identified factors, as well as the prevalence of their impacts on scientist-physician partnership and transfer of knowledge are not clear. This study focuses on the …

Managerial And Organizational Factors That Influence A Firm's Safety And Environmental Performance: An Examination Of The Fortune 500 Companies, David Klossner Jan 2013

Managerial And Organizational Factors That Influence A Firm's Safety And Environmental Performance: An Examination Of The Fortune 500 Companies, David Klossner

Student Scholarship

This research seeks to illuminate which managerial and organizational factors lead large corporations to operate in an environmentally conscious manner. We used a blended quantitative approach to test the effects of managerial and organizational factors on a corporation's environmental performance. We used three data sets: (a) firm's actual environmental performance, (b) firm's actual safety performance, and (c) survey from top executives of the Fortune 500 companies. Our data shows that profit seeking positively affects environmental performance; in contrast, a manager's intrinsic values have little effect; and surprisingly a corporation's environmental performance is inversely related to coercive external pressure and risk …

Enhancing Firm Profitability By Improving Director Dynamics, Solange Charas Jan 2013

Enhancing Firm Profitability By Improving Director Dynamics, Solange Charas

Student Scholarship

Board performance research focused on individual director's economically-motivated behaviors and outcomes has generated inconsistent and disappointing results. Most research does not consider the board as a team, despite recent calls for a focus on collective board processes and behaviors. As 90% of directors rate their individual performance at very effective but only 30% rate overall board performance at an equivalent level, it is obvious that this gap needs to be addressed. The discrepancy between individual and team performance effectiveness was the focus of this research, based on original data from 182 directors and their assessment of their board's dynamic, team …

Characterization Of Silver Nanoparticle-Infused Tissue Adhesive For Ophthalmic Use, William Yee Jan 2013

Characterization Of Silver Nanoparticle-Infused Tissue Adhesive For Ophthalmic Use, William Yee

Master's Theses

This research examined if the infusion of silver nanoparticles into a 2-octyl cyanoacrylate tissue adhesive alters the antibacterial effectiveness and mechanical properties of the adhesive. Silver nanoparticle size and concentration combinations were varied to determine the effects of these factors. Uniform distribution of the silver nanoparticles was achieved before proceeding to testing. Antibacterial effectiveness of the composite adhesive was determined via the Kirby-Bauer disk diffusion susceptibility test and by CFU counting. Doping the adhesive with silver nanoparticles resulted in an order of magnitude reduction in bacterial growth. The greatest antibacterial effect came from imbuing 10 μg/mL of 4 nm silver …

Do Liars Believe? Beliefs And Other-Regarding Preferences In Sender-Receiver Games, Roman M. Sheremeta, Timothy W. Shields Jan 2013

Do Liars Believe? Beliefs And Other-Regarding Preferences In Sender-Receiver Games, Roman M. Sheremeta, Timothy W. Shields

ESI Publications

We examine subjects’ behavior in sender–receiver games where there are gains from trade and alignment of interests in one of the two states. We elicit subjects’ beliefs, risk and other-regarding preferences. Our design also allows us to examine the behavior of subjects in both roles, to determine whether the behavior in one role is the best response to the subject's own behavior in the other role. The results of the experiment indicate that, when acting as senders, the majority of subjects adopt deceptive strategies by sending favorable message when the true state of the nature is unfavorable. When acting as …

Towards A Neo-Darwinian Synthesis Of Neoclassical And Behavioral Economics, Terence C. Burnham Jan 2013

Towards A Neo-Darwinian Synthesis Of Neoclassical And Behavioral Economics, Terence C. Burnham

ESI Publications

There is a schism within economics between the neoclassical and behavioral schools. A primary cause of the behavioral ascent is the experimental evidence of deviations between actual behavior and the neoclassical prediction of behavior. While behavioral scholars have documented these “anomalies,” they have made little progress explaining the origin of such behavior. This paper proposes a biological and evolutionary foundation for the anomalies of behavioral economics by separating proximate and ultimate causation. Such a foundation may allow for a re-uniting of economics; a neo-Darwinian synthesis of neoclassical and behavioral economics.

Transparency, Efficiency And The Distribution Of Economic Welfare In Pass-Through Investment Trust Games, Thomas A. Rietz, Roman M. Sheremeta, Timothy W. Shields, Vernon L. Smith Jan 2013

Transparency, Efficiency And The Distribution Of Economic Welfare In Pass-Through Investment Trust Games, Thomas A. Rietz, Roman M. Sheremeta, Timothy W. Shields, Vernon L. Smith

ESI Publications

We design an experiment to examine behavior and welfare in a multi-level trust game representing a pass through investment in an intermediated market. In a repeated game, an investor invests via an intermediary who lends to a borrower. A pre-experiment one-shot version of the game serves as a baseline and to type each subject. We alter the transparency of exchanges between non-adjacent parties. We find transparency of the exchanges between the investor and intermediary does not significantly affect welfare. However, transparency regarding exchanges between the intermediary and borrower promotes trust on the part of the investor, increasing welfare. Further, this …

Rethinking The Principal-Agent Theory Of Judging, Rafael I. Pardo, Jonathan Remy Nash Jan 2013

Rethinking The Principal-Agent Theory Of Judging, Rafael I. Pardo, Jonathan Remy Nash

Scholarship@WashULaw

This Essay offers new insights into understanding the relationship between higher and lower courts and responds to the extant literature that has characterized the relationship as one involving a principal and an agent. We challenge the underpinnings of the principal-agent understanding of judicial hierarchies and identify problems with the theory’s applicability in this context. While principals ordinarily select their agents, higher court judges usually do not select lower court judges. Moreover, while lower court judges may cast votes with an eye to the possibility of elevation to a higher court, the higher court judges who review the lower court’s decisions …

Using The Instructional Coaching Model To Implement Positive Behavior Supports In Early Childhood Special Education Programs, Heather Donoho Jan 2013

Using The Instructional Coaching Model To Implement Positive Behavior Supports In Early Childhood Special Education Programs, Heather Donoho

Graduate Research Papers

Challenging behaviors in early childhood programs are of increasing concern to teachers in preschool programs. The use of Positive Behavior Supports, or PBS, has been on the rise in a variety of preschool programs as a way to increase acceptable behaviors while using tiered interventions to identify children in need of specific skills training in hopes of decreasing the chances of negative behaviors. While most teachers are in favor of the PBS initiative, many teachers report not having enough time or expertise to implement the program to the best of their ability. Another new initiative in preschool programs is that …

Two Essays On Politics And Finance, Incheol Kim Jan 2013

Two Essays On Politics And Finance, Incheol Kim

USF Tampa Graduate Theses and Dissertations

I examined how politics affects corporate policies and value in two dissertation essays. In my first essay, we investigate whether diversity in points of view within corporate boards, as captured by the diversity in political ideology of board members, can affect a firm's performance. We employ personal political contributions' data to measure political ideology distance among groups of inside, outside directors and the CEO. Our empirical evidence strongly supports the notion that outside directors' monitoring effectiveness is more likely to be enhanced when their viewpoints are distinct from those of management. We find that ideologically diverse boards are associated with …

Argumentation As A Lens To Examine Student Discourse In Peer-Led Guided Inquiry For College General Chemistry, Ushiri Kumarihamy Kulatunga Jan 2013

Argumentation As A Lens To Examine Student Discourse In Peer-Led Guided Inquiry For College General Chemistry, Ushiri Kumarihamy Kulatunga

USF Tampa Graduate Theses and Dissertations

This dissertation work entails three related studies on the investigation of Peer-Led Guided Inquiry student discourse in a General Chemistry I course through argumentation. The first study, Argumentation and participation patterns in general chemistry peer-led sessions, is focused on examining arguments and participation patterns in small student groups without peer leader intervention. The findings of this study revealed that students were mostly engaged in co-constructed arguments, that a discrepancy in the participation of the group members existed, and students were able to correct most of the incorrect claims on their own via argumentation.

The second study, Exploration of peer leader …

Design, Manufacturing, And Assembly Of A Flexible Thermoelectric Device, Christopher Anthony Martinez Jan 2013

Design, Manufacturing, And Assembly Of A Flexible Thermoelectric Device, Christopher Anthony Martinez

USF Tampa Graduate Theses and Dissertations

This thesis documents the design, manufacturing, and assembly of a flexible thermoelectric device. Such a device has immediate use in haptics, medical, and athletic applications. The governing theory behind the device is explained and a one dimensional heat transfer model is developed to estimate performance. This model and consideration for the manufacturing and assembly possibilities are the drivers behind the decisions made in design choices. Once the design was finalized, manufacturing methods for the various components were explored. The system was created by etching copper patterns on a copper/polyimide laminate and screen printing solder paste onto the circuits. Thermoelectric elements …

The Experiences Of Mothers Of Children With Autism In Jamaica: An Exploratory Study Of Their Journey, Angela R. Mann Jan 2013

The Experiences Of Mothers Of Children With Autism In Jamaica: An Exploratory Study Of Their Journey, Angela R. Mann

USF Tampa Graduate Theses and Dissertations

Autism Spectrum Disorders (ASDs), also referred to as Pervasive Developmental Disorders (PDDs), are characterized by deficits in verbal and nonverbal communication, social interaction, and repetitive or restricted interests and behaviors. To date, much of the literature on ASDs has been conducted from a western perspective, although interest in ASDs from a global perspective has dramatically increased in recent years. Over the last decade, there have been numerous conceptual papers attempting to explain how autism might be experienced in other parts of the world. However, in actuality, little research has been conducted in this area, and further exploration of the experiences …
