Carbon Emissions From Soil Respiration In The Northern Chihuahuan Desert Shrubland, Anna Cristina Ortiz Jan 2013

Carbon Emissions From Soil Respiration In The Northern Chihuahuan Desert Shrubland, Anna Cristina Ortiz

Open Access Theses & Dissertations

The United States Department of Agriculture's Jornada Experimental Range (JER), is located in the northern Chihuahuan Desert in southern New Mexico and historically functioned as an experimental rangeland for cattle grazing. Historical grazing in the US Southwest has been identified as a leading, but not the sole, factor that has led to the conversion of pristine grasslands to shrublands, such has been the case on the JER. The estimated increased variability in precipitation intensity and frequency that is predicted to occur with climate warming will likely affect ecosystem responses from ecological processes including primary productivity, microbial decomposition, and thus respiration. …

(Re)Mapping The Rhetorical Situation: Toward A Transactional Networked Ecology, Ramesh Kumar Pokharel Jan 2013

(Re)Mapping The Rhetorical Situation: Toward A Transactional Networked Ecology, Ramesh Kumar Pokharel

Open Access Theses & Dissertations

The existing theories of the rhetorical situation that focus on and around Bitzer's theory define the rhetorical situation as something "real," "genuine," "objective" based on historic reality. I believe that this modernist containment to perceive the rhetorical situation as fixed entities limit our understanding about it in a broader sense, because it cannot capture the changed meaning that naturally exists with the impact of new media and technology. With the advent of new media and technology, the notion of rhetorical situation also has changed and thus there is an exigence of a new theory of the rhetorical situations that better …

3d Printed Impedance Elements By Micro-Dispensing, Ubaldo Robles Dominguez Jan 2013

3d Printed Impedance Elements By Micro-Dispensing, Ubaldo Robles Dominguez

Open Access Theses & Dissertations

Micro-dispensing allows electric circuits to be "3D printed," which can be used to give 3D printed systems electronic and electromagnetic functionality. The focus of this thesis is using micro-dispensing to fabricate capacitors and inductors. 3D printed impedance elements are capable of being more easily embedded, can be used to create structural electronics, and will have extensive applications in antennas, metamaterials, frequency selective surfaces, and more. This is the first known effort to print and measure impedance elements by micro-dispensing which holds great potential for manufacturing multi-material devices.

Developing A Sustainable Ecotourism Foundation In Indonesian National Parks Using Cross-Cultural Adaptation And Communication Framing, Adriana Salas Jan 2013

Developing A Sustainable Ecotourism Foundation In Indonesian National Parks Using Cross-Cultural Adaptation And Communication Framing, Adriana Salas

Open Access Theses & Dissertations

Previous research on ecotourism in Southeast Asia has focused on its positive and negative effects for conservation. However, the focus in this particular study is to look at what it takes to run a successful ecotourism site in four diverse areas in Indonesia using communication elements like cross-cultural adaptation and communication framing. Communication should be used as a baseline for a successful site and should be used as the most useful tool to address issues and challenges in ecotourism project development.

A successful ecotourism site must carefully look at how their ideas and programs are framed. Ecotourism must also create …

Event Related Potential Changes In A Two-Stimulus Auditory Oddball Task In Concussed College Athletes: A Linguistic Component, Paola G. Sanchez

Open Access Theses & Dissertations

"Return to Play" decisions are done based on cognitive-communicative testing and clinical assessments; concussed athletes may benefit from electrophysiological testing for a more accurate representation of their recovery. The purpose of this study is to investigate the electrophysiological performance post-concussion analyzing the attentional differences using the traditional "oddball" paradigm with a CV linguistic component. Participants for this study were 6 male college athletes with a history of concussion and 10 participants with no history of concussion (controls). Athletes were evaluated using event-related potentials (ERPs) that were recorded during a consonant-vowel (CV) auditory oddball task. Both the P300a and P300b components …

A Convex Optimization Algorithm For Sparse Representation And Applications In Classification Problems, Reinaldo Sanchez Arias Jan 2013

A Convex Optimization Algorithm For Sparse Representation And Applications In Classification Problems, Reinaldo Sanchez Arias

Open Access Theses & Dissertations

In pattern recognition and machine learning, a classification problem refers to finding an algorithm for assigning a given input data into one of several categories. Many natural signals are sparse or compressible in the sense that they have short representations when expressed in a suitable basis. Motivated by the recent successful development of algorithms for sparse signal recovery, we apply the selective nature of sparse representation to perform classification. Any test sample is represented in an overcomplete dictionary with the training sample as base elements. A given test sample can be expressed as a linear combination of only those training …

An Approach To Power Efficiency Determination In The Solar Energy Systems Using Central Composite Design And Box-Behnken Design, Juan Venegas Mendez

Open Access Theses & Dissertations

We are living in an industrialized world that relies on fossil fuels. The ways, in which these fossil fuels have damaged the earth, in special the environment is worth of special attention and corrective actions. In our days, the climate change (global warming) it is becoming the number one topic. These changes are affecting our health, comfort and our way of living. Solar systems have been working among us since several years, but the truth is that most of us really don't understand how they work and more important, how they work in time in different conditions. Solar panels are …

Societal Power Shifts And Changing Social Identities In South Africa: Workplace Implications, Lize A. E. Booysen Jan 2013

Societal Power Shifts And Changing Social Identities In South Africa: Workplace Implications, Lize A. E. Booysen

Faculty Articles

The enormous social, economic and political transformation South Africans have experienced especially over the past 12 years, since the systematic dismantling of apartheid in the era of social and economic reconstruction, has brought about numerous societal and social identity changes. Due to these changes in social identity, societal norms and power shifts, major changes are occurring in the workplace, and societal level identity crises and conflicts are increasingly spilling over into the workplace. This article unpacks these social identity changes and power shifts on the political, social, economic and management levels, by employing social identity theory, self-categorisation theory and embedded …

The Influence Of University Personnel Upon Students' Spirituality At Selected Adventist Universities In West Africa, Isaiah Ola Abolarin Jan 2013

The Influence Of University Personnel Upon Students' Spirituality At Selected Adventist Universities In West Africa, Isaiah Ola Abolarin

Dissertations

Problem and Purpose. The Seventh-day Adventist Church has a deep concern for youth and young adults' spirituality. Hence the church established institutions of higher learning with the aim of restoring in youth and young adults the image of God in which they were created. There are programs and activities in these institutions to accomplish the aim, but there is still concern among church leaders and parents that young people will abandon their faith and exit the church. This study explored the influence of interactions between students and university personnel in selected Adventist universities in West Africa that, apart from programs …

Does Criminal Diversion Contribute To The Vanishing Civil Trial?, John B. Meixner Jr., Shari Seidman Diamond Jan 2013

Does Criminal Diversion Contribute To The Vanishing Civil Trial?, John B. Meixner Jr., Shari Seidman Diamond

Scholarly Works

Through his seminal work on the vanishing trial, Professor Marc Galanter has had a profound impact on public and scholarly discourse about the role of the trial in litigation, documenting the sharp reductions in the rate of civil cases since the mid-twentieth century. While there is little remaining doubt that the American civil trial is an increasingly scarce commodity, there is still much debate as to what has caused the decline.

In this Article, we seek to explore the extent to which the federal criminal docket may be contributing to the rapid disappearance of the civil trial by taking priority …

Error Costs & Ip Law, Joseph S. Miller Jan 2013

Error Costs & Ip Law, Joseph S. Miller

Scholarly Works

A court in doubt about an ip statute’s scope can err in two ways. It can wrongly narrow the ip right’s reach, or wrongly broaden it. The latter error, however, is worse: A wrongly broadened ip statute effectively creates new property. To correct erroneous broadening, unlike erroneous narrowing, the legislature must thus eliminate a now-established property right. And that is very hard to do. Courts cannot, of course, avoid making at least some mistakes. Courts can, however, prefer the mistakes that are easier, not harder, for the legislature to correct. This essay explores this error-cost-based approach to ip statutes, as …

Death Panels And The Rhetoric Of Rationing, Elizabeth Weeks Leonard Jan 2013

Death Panels And The Rhetoric Of Rationing, Elizabeth Weeks Leonard

Scholarly Works

This essay offers an explanation for the United States' continued resistance to universal health care as grounded in two taboos: taxation and rationing. Even we were willing to pay more in taxes to directly subsidize the cost of medical care for those in need, rather than our current system of indirect subsidization through private insurance risk-pooling and cost-shifting, we still would face the unavoidable reality of resource limitations. Attempts to limit resource consumption, however, have been strongly opposed, as evidenced by the "death panels" controversy. Governor Palin's grossly erroneous characterization of the Patient Protection and Affordable Care Act (ACA) rendered …

The Outside Investor: Citizen Shareholders & Corporate Alienation, Anne M. Tucker Jan 2013

The Outside Investor: Citizen Shareholders & Corporate Alienation, Anne M. Tucker

Scholarly Works

This Article explores the creation and conundrum of citizen shareholders-investors who enter the securities market primarily through employer- sponsored defined-contribution plans, invest in mutual or index funds, and are saving for long-term goals like retirement. Citizen shareholders are a consequence of a retirement revolution, and are the fastest growing group of investors. Citizen shareholders are distinguishable from other shareholders on the grounds of choice, exit, and the number of intermediaries inserted into the investment chain in defined-contribution plans. They are largely missing from corporate policy and scholarship debates; few discussions have incorporated the growing reality that shareholder status has changed …

Retirement Revolution: Unmitigated Risks In The Defined Contribution Society, Anne M. Tucker Jan 2013

Retirement Revolution: Unmitigated Risks In The Defined Contribution Society, Anne M. Tucker

Scholarly Works

A revolution in the retirement landscape over the last several decades shifted the predominant savings vehicle from traditional pensions (defined benefit plans) to self-directed accounts in defined contribution plans like the 401(k) and has drastically changed how people invest in the stock market and why. The prevalence of these self-directed accounts has created our defined contribution society and a new class of investors-the citizen shareholders-who enter the private securities market through self-directed retirement plans, invest for long-term savings goals, and are predominately indirect shareholders. With 90 million Americans invested in mutual funds, and nearly 75 million who do so through …

A Funhouse Mirror Of Law: The Entailment In Jane Austen's Pride And Prejudice, Peter A. Appel Jan 2013

A Funhouse Mirror Of Law: The Entailment In Jane Austen's Pride And Prejudice, Peter A. Appel

Scholarly Works

In this Essay, I will first outline the general development of different means used to hold property and keep it within a family in England. This discussion must of necessity be brief and schematic, and therefore readers should not rely on it as a completely accurate, nuanced, and detailed discussion of the historical development of English land law. I will then examine what Austen has to say about Longbourn, the principal property in Pride and Prejudice, which leads me to conclude that Austen probably conceived of Longbourn as being entailed and not secured under a strict settlement. I will also …

Disaggregating, Elizabeth Chamblee Burch Jan 2013

Disaggregating, Elizabeth Chamblee Burch

Scholarly Works

Commonality is a defining characteristic of mass-tort litigation. But mass-tort claimants typically do not share enough in common to warrant class certification. That is, commonality does not predominate. Yet, without class certification, judges cannot conclude these cases as a unit absent a private settlement.

This paradox prompts two questions. First, what level of commonality justifies aggregating mass torts, shorn of Rule 23’s procedural protections? And, second, should the federal judicial system continue to centralize claims with nominal commonality when judges typically cannot resolve them collectively absent a private settlement? This Article’s title suggests one answer: if minimal commonality continues to …

Prioritizing Abortion Access Over Abortion Safety In Pennsylvania, Randy Beck Jan 2013

Prioritizing Abortion Access Over Abortion Safety In Pennsylvania, Randy Beck

Scholarly Works

This conference was prompted by the prosecution of Dr. Kermit Gosnell, who ran an abortion clinic in Philadelphia, Pennsylvania. Dr. Gosnell was convicted in May of 2013 of charges arising from the killing of viable infants born in his clinic, the negligent death of an adult patient, and the systematic disregard of regulations governing the performance of abortions in Pennsylvania. One question proposed for our consideration is whether Dr. Gosnell is an “outlier,” a description offered by the National Abortion Federation following Gosnell’s indictment.

Presumably, one might want to know whether Gosnell was typical of abortion providers because it could …

State Action Problems, Christian Turner Jan 2013

State Action Problems, Christian Turner

Scholarly Works

The state action doctrine is a mess. Explanations for why federal courts sometimes treat the private actions of private parties as public actions subject to the Constitution, like the Supreme Court did in Shelley v. Kraemer, are either vastly overinclusive or fail to explain our law and values. A better approach is to understand the state action doctrine in institutional terms. I introduce a two-step, institutionally focused state action theory that is a natural consequence of a broader public/private theory of legal systems. In the first step, a court identifies a “state action problem,” meaning a privately made law that …

Employers United: An Empirical Analysis Of Corporate Political Speech In The Wake Of The Affordable Care Act, Elizabeth Weeks Leonard, Susan Scholz, Raquel Meyer Alexander Jan 2013

Employers United: An Empirical Analysis Of Corporate Political Speech In The Wake Of The Affordable Care Act, Elizabeth Weeks Leonard, Susan Scholz, Raquel Meyer Alexander

Scholarly Works

Is the Patient Protection and Affordable Care Act (ACA) bad for business? Did the countries' most prominent companies game the Securities and Exchange Commission (SEC) disclosure process to make negative political statements about ObamaCare? Immediately following the ACA's enactment on March 23, 2010, a number of companies drew scrutiny for issuing SEC filings writing off millions – and in AT&T's case, one billion dollars – against expected earnings for 2010 alone, based on a single, discrete tax-law change in the ACA. Congressional and Administration officials accused the firms of being "irresponsible" and using "big numbers to exaggerate the health reform's …

Is The Corporate Director's Duty Of Care A "Fiduciary' Duty? Does It Matter?, Christopher M. Bruner Jan 2013

Is The Corporate Director's Duty Of Care A "Fiduciary' Duty? Does It Matter?, Christopher M. Bruner

Scholarly Works

While reference to "fiduciary duties" (plural) is routinely employed in the United States as a convenient short-hand for a corporate director's duties of care and loyalty, other common-law countries generally treat loyalty as the sole "fiduciary duty." This contrast prompts some important questions about the doctrinal structure for duty of care analysis adopted in Delaware, the principal jurisdiction of incorporation for U.S. public companies. Specifically, has the evolution of Delaware's convoluted and problematic framework for evaluating disinterested board conduct been facilitated by styling care a "fiduciary" duty? If so, then how should Delaware lawmakers and judges respond moving forward?

Lavigne, Laura B.K. Herzing, Edwin H. Cook, Susan A. Lebailly, Karen R. Gouze, Joyce Hopkins, Fred B. Bryant

Psychology: Faculty Publications and Other Works

Genetic factors can play a role in the multiple level of analyses approach to understanding the development of child psychology. The present study examined gene-environment correlations and Gene x Environment interactions for polymorphisms of three target genes, the serotonin transporter gene, the D4 dopamine reactor gene, and the monoamine oxidase A gene in relation to symptoms of anxiety, depression, and oppositional behavior. Saliva samples were collected from 175 non-Hispanic White, 4-year-old children. Psychosocial risk factors included socioeconomic status, life stress, caretaker depression, parental support, hostility, and scaffolding skills. In comparison with the short forms (s/s, s/l) of the serotonin transporter …

Lateralization Of Simulated Sources And Echoes On The Basis Of Interaural Differences Of Level, Raymond H. Dye Jr, Jacquelyn P. Hill, Leslie M. Ryan, Alexander E. Cupler, Kevin M. Bannon

Psychology: Faculty Publications and Other Works

This experiment assessed the relative weights given to source and echo pulses lateralized on the basis of interaural differences of level (IDLs). Separate conditions were run in which the to-be-judged target was the first (source) or second (echo) pulse. Each trial consisted of two intervals; the first presented a 3000-Hz diotic pulse that marked the intracranial midline and the pitch of the target frequency. The second presented the sequence of a source followed by an echo. Target frequency was always 3000 Hz, while the non-target pulse was presented at 1500, 3000, or 5000 Hz. Delays between the source and echo …

The Aig Story (Chapter 18, Nationalization), Lawrence A. Cunningham, Maurice R. Greenberg

GW Law Faculty Publications & Other Works

This is the final chapter of The AIG Story, a book about the growth of a large international insurance company that pioneered the opening of new markets and helped forge milestone international trade agreements, followed by an account of its near-destruction, first at the hands of an overzealous state attorney general and underwhelming board of directors, and then, as detailed in this chapter, at the hands of federal government officials overwhelmed by a financial crisis they could not understand. This chapter begins in mid-2008, when AIG’s losing financial products bets presented the company with a huge liquidity problem, though it …

The Congressional War On Contractors, Jessica Tillipman Jan 2013

The Congressional War On Contractors, Jessica Tillipman

GW Law Faculty Publications & Other Works

The U.S. Suspension & Debarment regime is designed to ensure that the federal government does business only with “responsible” partners. One of the most fundamentally (and frequently) misunderstood aspects of the FAR 9.4 suspension & debarment system is that these tools are only to be used for the purpose of protecting the Government, not to punish contractors for their past misconduct. Unfortunately, recent congressional initiatives demonstrate many legislators’ desire to transform debarment into a tool of punishment by banishing contractors from the procurement system “with little consideration of whether such action is needed or fair."

Instead of focusing on the …
