Real Property, Linda S. Finley Dec 2013

Real Property, Linda S. Finley

Mercer Law Review

For the last several years, the Author has begun this Survey with a comment about the American economy and the increase in the number of foreclosures facing Georgia homeowners. Although the number of residential foreclosures appears to be decreasing, the plight of homeowners remains a critical issue. Rest assured, this Article does not limit itself to a review of consumer-related law. It also looks at broad topics pertaining to real property, because whether the topic is foreclosure, boundaries, condemnation, or title, ". . . it is just about the dirt."

Changes In Tissue-Specific Fatty Acid Composition Of The Freshwater Alewife (Alosa Pseudoharengus) In Response To Temperature, William D. Schregel Dec 2013

Changes In Tissue-Specific Fatty Acid Composition Of The Freshwater Alewife (Alosa Pseudoharengus) In Response To Temperature, William D. Schregel

Biology Theses

Ectotherms are known to alter the composition of the cell membrane in response to changes in environmental temperature. Tissue-specific fatty acid composition in the alewife (Alosa pseudoharengus) was examined in response to both warm and cold temperature challenges administered over an approximate one month period. Gill, muscle, and liver tissues were analyzed prior to the start of the temperature challenge (initial), following the temperature challenges (survivors), and on those fish that did not survive the temperature challenges (mortalities). Significant differences were found between fatty acid composition of initial fish and survivors for membrane-incorporated fatty acids (polar) and for …

Homing Behavior In Response To Displacement And Orientation Of The Northern Diamondback Terrapin (Malaclemys Terrapin Terrapin) In Barnegat Bay, New Jersey, Nicole M. Lainhart Dec 2013

Homing Behavior In Response To Displacement And Orientation Of The Northern Diamondback Terrapin (Malaclemys Terrapin Terrapin) In Barnegat Bay, New Jersey, Nicole M. Lainhart

Biology Theses

Increasing urbanization of the Barnegat Bayestuary in New Jersey has subjected northern diamondback terrapins to substantial habitat loss. Understanding whether terrapins have homing behavior, and determining the types of orientation cues they use to aid in this behavior, is important for conservation management. To test their homing behavior, nine non-gravid female terrapins were outfitted with biotelemetry tracking devices and data loggers and were displaced 4 km north and/or south. Eight of nine terrapins successfully returned home; the one terrapin that did not return home was inadvertently captured in a crab pot. Urbanization and shoreline development of the north displacement location …

Ineffective, Opaque, And Undemocratic: The Ious Of—Too Much—International Law And Why A Bit Of Skepticism Is Warranted, James Allan

San Diego Law Review

In this Article I want to give you an outsider’s view of international law, or at least this outsider’s view. And by outsider I mean someone who is usually interested in legal philosophy and constitutional law and who may well be thought to lack standing to offer the sort of views and criticisms that are to come.... The structure of this Article will be simple. I will criticize certain aspects of international law, especially rights-related international law, under the three headings you see in the title to this Article. However, I am going to take those headings and critiques in …

Ordinary Families: Queer Sexuality And Adoptive Parenthood In Central New York, Sean H. Wang Dec 2013

Ordinary Families: Queer Sexuality And Adoptive Parenthood In Central New York, Sean H. Wang

Theses - ALL

This thesis argues that geographers must consider sexuality and family together as integral parts of social life. Although sexuality already entered the lexicon of geography in the 1980s, and a burgeoning field of the geography of sexuality exists today, too often it is still considered peripheral in geographic scholarship. Similarly, family either remains consigned either as merely a place for social reproduction by studies of political economy, or is relegated entirely as an object of inquiry for only feminist geographers. Drawing from sociology, feminist and queer studies, this thesis makes an important intervention by relating sexuality and family in the …

House Broken: The Functions And Contradictions Of "Housing First", Brian Richard Hennigan Dec 2013

House Broken: The Functions And Contradictions Of "Housing First", Brian Richard Hennigan

Theses - ALL

"Housing first" is the new orthodoxy for homelessness policy in the United States, a program design expected to end homelessness once and for all. Unlike the traditional "treatment first" model, housing first places the most expensively homeless individuals immediately into an apartment (with treatment following). Although certainly different from the treatment first model due to its prioritization of housing, housing first remains a product of neoliberal poverty governance. By examining program operations in greater Phoenix, Arizona, it is clear that housing first proceeds as a stigma-reproducing rehabilitation program of socioeconomic discipline that works in tandem with anti-homeless laws and service …

Feeling In Character: Towards An Ethics Of Emotion, John Monteleone Dec 2013

Feeling In Character: Towards An Ethics Of Emotion, John Monteleone

Dissertations - ALL

This dissertation contends that emotions are subject to ethical assessment, not simply as motives or overt expressions, but in their own right. Emotions, I argue, are subject to assessment because they are aspects of a person's character. Specifically, emotions involve voluntary acts of attention, which are due to habituation. These acts show character by manifesting certain stable, deeply-held desires called 'concerns.' This view, dubbed 'Attentional Voluntarism,' is opposed to the prevalent view, dubbed 'Rationalism,' that emotions are subject to assessment because of their propositional content. Rationalism is unable to account for certain kinds of irrational emotion, where one forms an …

To Say What The Law Is: Rules, Results, And The Dangers Of Inferential Stare Decisis, Adam N. Steinman Dec 2013

To Say What The Law Is: Rules, Results, And The Dangers Of Inferential Stare Decisis, Adam N. Steinman

Faculty Scholarship

Judicial decisions do more than resolve disputes. They are also crucial sources of prospective law, because stare decisis obligates future courts to follow those decisions. Yet there remains tremendous uncertainty about how we identify a judicial decision’s lawmaking content. Does stare decisis require future courts to follow the rules stated in a precedent-setting opinion? Or must future courts merely reconcile their decisions with the ultimate result of the precedent-setting case? Although it is widely assumed that a rule-based approach puts greater constraints on future courts, two recent Supreme Court decisions—Wal-Mart Stores, Inc. v. Dukes and Ashcroft v. Iqbal—turn this conventional …

Reanalyzing Cost-Benefit Analysis: Toward A Framework Of Function(S) And Form(S), Robert B. Ahdieh Dec 2013

Reanalyzing Cost-Benefit Analysis: Toward A Framework Of Function(S) And Form(S), Robert B. Ahdieh

Faculty Scholarship

The analysis herein arises from the collision course between the sweeping reforms mandated by the Dodd-Frank Wall Street Reform and Consumer Protection Act of 2010 and a single sentence of the U.S. Code, adopted nearly fifteen years earlier and largely forgotten ever since. Few were likely thinking of Section 106 of the National Securities Market Improvement Act when the Dodd-Frank Act was enacted on July 21, 2010. As applied by the D.C. Circuit less than a year later in Business Roundtable v. SEC, however, that provision’s peculiar requirement of cost-benefit analysis could prove the new legislation’s undoing.

The Case For A Legislative Amendment Against Accessory Copyright For Grey Market Products: What Can The U.S. Learn From Singapore And Australia, Irene Calboli, Mary Lafrance Dec 2013

The Case For A Legislative Amendment Against Accessory Copyright For Grey Market Products: What Can The U.S. Learn From Singapore And Australia, Irene Calboli, Mary Lafrance

Faculty Scholarship

In this article, we suggest that the U.S. Congress could implement a legislative provision prohibiting copyright protection for incidental product features in the context of parallel imports. The U.S. would not be the first country to implement such a provision. In 1994, Singapore pioneered the adoption of a similar provision, which was introduced as an amendment to the SG 1987 Copyright Act. A few years later, in 1998, Australia incorporated a similar amendment to its Aust. Copyright Act 1968. In this article, we analyse in detail the Singapore and Australia provisions and, building upon these provisions, we suggest …

The Detection Of A Light Echo From Sn 2007af, Dina Drozdov Dec 2013

The Detection Of A Light Echo From Sn 2007af, Dina Drozdov

All Theses

Type Ia supernovae are widely studied for their uniform properties, which make them ideal candidates for cosmological surveys. Although these exploding stars are popular targets, key funda-mental questions about their nature remain, and new techniques need to be developed to investigate the progenitor system and explosion mechanisms. Light echoes are created by light scattering off dust that reaches the observer after the direct path light from the explosion arrived and have been studied for the past 100 years. Light echoes from Type Ia supernovae are rare, with only a few cases being discovered in the past decades. Because light echoes …

Analyzing Requirement Type Influence On Generated Solutions, Emily Worinkeng Dec 2013

Analyzing Requirement Type Influence On Generated Solutions, Emily Worinkeng

All Theses

Several ideation methods are available and used by engineering designers to enable the generation of alternative designs [1]. However, there has been little work done to understand the role that the design problem given to participants plays in the ideation process. The contribution of this research is found through the proposed guidelines with respect to the type of requirements to include as part of the design problem in order to achieve the desired quantity, quality, novelty, and variety of solutions during the early stages of the design process. This work is the first attempt at analyzing the effect of requirement …

A Study Of The Frothing Capacity Of Whole Milk- 1. A Market Survey Of Conventional And Organic Milks, 2. The Effect Of Clean In Place (Cip) Cleaning Solutions, Sara Stancil

All Theses

Gourmet coffee drink consumption is on the rise (NCAUSA 2013). With most of these coffee drinks including milk and/or milk foam, an emphasis on producing quality foam is of high importance. Recent complaints have been received on the failure of milk to foam to expectations of the coffee house (Randolph & Associates 2013). Identifying the source of this failure could enable the milk industry to provide higher foam quality milk to meet the growing needs of coffee houses.

A two-part study on the frothing capacity of milk was carried out to investigate potential variations in the market place and to …

Stimulated Raman Scattering In Micro Sphere Resonators, Ruoyu Zhang Dec 2013

Stimulated Raman Scattering In Micro Sphere Resonators, Ruoyu Zhang

All Theses

Micro sphere resonators that hold optical whisper gallery modes (WGMs) provide an innovative option for implementing micro optical resonators. The unique properties of the micro sphere resonator make it capable to introduce resonance for various optical phenomenon, like stimulated Raman scattering (SRS), in micron scale.

This thesis illustrates the characteristics of micro sphere resonators and demonstrates the resonance-enhanced SRS in micro sphere resonators with reduce threshold power. Both theoretical and experimental results are presented. Coupling model for WGM is derived in transfer matrix method. Simulation analyses for mode pattern of WGMs are solved based on mathematic model and finite element …

The Fabrication And Study Of Silver Nanoparticle Structures, Aubrie Pfirman Dec 2013

The Fabrication And Study Of Silver Nanoparticle Structures, Aubrie Pfirman

All Theses

Nanotechnology and the synthesis of nanoparticle systems are attractive in part because of interesting, tunable optical and electrical properties that are not observed with bulk material. Silver nanoparticles (Ag NPs) interact with visible light more efficiently than any other system due to the excitation of plasmon resonances, which are the collective oscillations of the free electron density. These collective oscillations produce an enhanced local electromagnetic (EM) field: this field is responsible for highly-utilized phenomena such as surface enhanced Raman scattering (SERS), enhanced fluorescence, surface enhanced infrared absorption (SEIRA), and many others. Many experiments have been conducted to optimize and tailor …

Rapid Riparian Buffer Width And Quality Analysis Using Lidar In South Carolina, Emre Akturk Dec 2013

Rapid Riparian Buffer Width And Quality Analysis Using Lidar In South Carolina, Emre Akturk

All Theses

The importance of protecting water quality and aquatic resources are increasing because of harmful human impacts within and around waterways. Establishing or restoring functional riparian areas protect water quality and are a good mechanism to conserve aquatic systems, plants, and wildlife. Laser-based remote sensing technology offers a high resolution approach to both characterize and document changes in riparian buffer zones (RBZs). The objectives of this study were to build a model to calculate riparian buffer width on both sides of a stream using a LiDAR-derived slope variable, to classify riparian buffers and determine their quality, and to evaluate the appropriateness …

A Hybrid Agent-Based And Differential Equations Model For Simulating Antibiotic Resistance In A Hospital Ward, Lester Caudill, Barry Lawson Dec 2013

A Hybrid Agent-Based And Differential Equations Model For Simulating Antibiotic Resistance In A Hospital Ward, Lester Caudill, Barry Lawson

Department of Math & Statistics Faculty Publications

Serious infections due to antibiotic-resistant bacteria are pervasive, and of particular concern within hospital units due to frequent interaction among health-care workers and patients. Such nosocomial infections are difficult to eliminate because of inconsistent disinfection procedures and frequent interactions among infected persons, and because ill-chosen antibiotic treatment strategies can lead to a growth of resistant bacterial strains. Clinical studies to address these concerns have several issues, but chief among them are the effects on the patients involved. Realistic simulation models offer an attractive alternative. This paper presents a hybrid simulation model of antibiotic resistant infections in a hospital ward, combining …

Light Sea Fermions In Electron-Proton And Muon-Proton Interactions, Ulrich D. Jentschura Dec 2013

Light Sea Fermions In Electron-Proton And Muon-Proton Interactions, Ulrich D. Jentschura

Physics Faculty Research & Creative Works

The proton radius conundrum [Pohl, Nature 466, 213 (2010)NATUAS0028-083610. 1038/nature09250 and Antognini, Science 339, 417 (2013)SCIEAS0036-807510.1126/ science.1230016] highlights the need to revisit any conceivable sources of electron-muon nonuniversality in lepton-proton interactions within the standard model. Superficially, a number of perturbative processes could appear to lead to such a nonuniversality. One of these is a coupling of the scattered electron into an electronic vacuum-polarization loop as opposed to a muonic one in the photon exchange of two valence quarks, which is present only for electron projectiles as opposed to muon projectiles. However, we show that this effect actually is part of …

Waveguiding Of Surface Phonon Polariton, Franklin Manene, Brian A. Lail, Edward C. Kinzel Dec 2013

Waveguiding Of Surface Phonon Polariton, Franklin Manene, Brian A. Lail, Edward C. Kinzel

Mechanical and Aerospace Engineering Faculty Research & Creative Works

Metal losses lead to unacceptably low propagation lengths in THz and LWIR waveguides. While SPP based waveguides provide relatively good confinement and attenuation in the near-IR and visible these are insufficiently bound to the surface in the THz and LWIR. We study using surface phonon polaritons for waveguiding at these frequencies. An eigenmode approach was applied to model a hybrid waveguide structure at λ=10.6 μm. The results show that phonon-coupled hybrid waveguide of silicon carbide BCB and gold exhibit enhanced propagation length and confinement at LWIR. © 2013 IEEE.

Mutant Drought Phenotype Investigation : A Look Into Effects Of Protein Prenylation On Water Utilization In Conditions Of Varying Soil Saturation And Gene Knockout., Casey Rasmussen

College of Arts & Sciences Senior Theses

Plants respond to environmental stress, such as drought, with increases in levels of Abscisic Acid (ABA). This stress response allows greater survival rates but results in the plants producing lower seed yield and biomass. Certain mutant strains of the Arabidopsis plant have been identified with mutations in coding regions involved in the formation of the α and β subunits of PFT and PGGT-I genes involved in protein prenylation. We explored the possibility of these mutant strains to better preserve seed yield and plant biomass under drought stressing conditions in comparison to the wild type (Columbia) strain, based on the mutants’ …

Pharmacology and Toxicology Faculty Publications

Background/aims: The quaternary benzo-phenanthridine alkaloid (QBA) chelerythrine (CET) is a pro-apoptotic drug and Na(+)/K(+) pump (NKP) inhibitor in human lens epithelial cells (HLECs). In order to obtain further insight into the mechanism of NKP inhibition by CET, its sub-cellular distribution was quantified in cytosolic and membrane fractions of HLEC cultures by surface-enhanced Raman spectroscopy (SERS). Methods: Silver nanoparticles (AgNPs) prepared by the Creighton method were concentrated, and size-selected using a one-step tangential flow filtration approach. HLECs cultures were exposed to 50 μM CET in 300 mOsM phosphate-buffered NaCl for 30 min. A variety of cytosolic extracts, crude and purified membranes, …

Revisiting Colorado V. Connelly: The Problem Of False Confessions In The Twenty-First Century, Daniel Harkins Dec 2013

Revisiting Colorado V. Connelly: The Problem Of False Confessions In The Twenty-First Century, Daniel Harkins

Southern Illinois University Law Journal

This Article analyzes how the current constitutional test formatted in Colorado v. Connelly no longer sufficiently excludes unreliable confessions from being admitted into evidence at trial.  In the last twenty years, a multitude of psychological studies have demonstrated that people confess to crimes they did not commit for a range of reasons wider than what is recognized by the Connelly inquiry.  This Article analyzes this phenomenon and examines potential methods (both inside and outside the constitutional standard) for preventing these confessions from reaching juries at trial.
