Hanoch Dagan is among “those who think it advantageous to get as much ethics into the law as they can,” in the phrase of Oliver Wendell Holmes, Jr. His pluralism is a perfectionism for polytheists: There are many human goods, and each has its domain, including some portion of the law of property. Depending on where we stand on the property landscape at any time, we may be community-minded sharers, devoted romantics in marriage, or coolly rational market actors, and the local property law will smooth each of these paths for us. Walking, Running, And Resting Under Time, Distance And Average Speed Constraints: Optimality Of Walk-Run-Rest Mixtures, Leroy L. Long Iii, Manoj Srinivasan

On a treadmill, humans switch from walking to running beyond a characteristic transition speed. Here, we study human choice between walking and running in a more ecological (non-treadmill) setting. We asked subjects to travel a given distance overground in a given allowed time duration. During this task, the subjects carried, and could look at, a stop-watch that counted down to zero. As expected, if the total time available were large, humans walk the whole distance. If the time available were small, humans mostly run. For an intermediate total time, humans often use a mixture of walking at a slow speed …

Historically underrepresented racial/ethnic minorities (i.e. African Americans, Latinos, and Native Americans) have experienced barriers to their success in engineering and related STEM fields. These student populations have had lower degree attainment rates, switch to non-STEM majors more frequently, and experience unique social challenges when compared to White and Asian Pacific Islander counterparts. To examine these findings, nearly 50 interviews were conducted and analyzed in the present study to better understand the academic and social experiences of African American and Latino American men in these fields. This thesis studied organizational dissent through the lens of loyalty in order to examine the nuanced motivations of employees' choices to dissent. The goal of this work was to approach loyalty as a nuanced concept that provides a foundational motivation for employees' dissent. In order to understand the contextualized experience of dissent, I conducted individual interviews with 17 employees in the radiology department of a healthcare organization. I adopted a grounded theory approach to data analysis, yielding a series of major findings. First, participants described their loyalties in the workplace as multiple and involving four distinct dimensions: organizational loyalty, coworker …

Contemporary superhero comics carry the burden of navigating historical iterations and reiterations of canonical figures—Batman, Superman, Green Lantern et al.—producing a tension unique to a genre that thrives on the reconstruction of previously established narratives. This tension results in the complication of authorial and interpretive negotiation of basic principles of narrative and structure as readers and producers must seek to construct satisfactory identities for these icons. Similarly, the post-modern experimentation of Robert Coover—in Briar Rose and Stepmother—argues that we must no longer view contemporary fairytales as separate (cohesive) entities that may exist apart from their source narratives. Beaver Valley Wetland in north-east Iowa was studied to determine its functionality in filtering incoming contaminants from the surrounding agricultural fields. The study was conducted from May through November of 2011. Altogether 78 water samples (from 13 sites), 84 soil samples (from 14 sites), and some sediment samples were collected for chemical analysis. Heavy metals in three different soil categories, such as surface, 6” deep, and sediments were found to be at or below the acceptable concentrations, indicating no immediate concern for metal toxicity in the wetland environment. W. E. B. Du Bois is one of the founding fathers of sociology. Despite his many contributions, he was not included in the sociological canon and given the recognition he deserves. Du Bois was an African-American scholar whose contributions lead to the development of the first school of sociology in the United States, although he has generally not been recognized for it. My research explores how the effects of the veil contribute to the interpretations of Du Bois. The study was done in Dry Run Creek watershed, a small sub-urban watershed in the northwestern part of Black Hawk County, Iowa. Different hydrologic units like, wetland, agricultural area, urban area, and stream channels were compared in terms of nutrient transport. Soil, surface water, and groundwater samples were collected from May, 2012 to October, 2012. Among the hydrologic units, agricultural land has the highest organic matter percentages, infiltration rate, soil nitrate, and total phosphorus. High infiltration rate and amount of nutrients in agricultural soil made those areas more vulnerable to vertical infiltration of pollutants. Agricultural and urban soils had similar …

Thomomydoecus minor is an ectoparasitic chewing louse that lives in intimate association with the pocket gopher Thomomys bottae. Chewing lice are wingless, obligate, host specific parasites that spend their entire life cycle on the fur of their host. Pocket gophers are fossorial and asocial, cut off for most of their lives even from members of their own species. Thus, the life histories of both chewing lice and pocket gophers have been predicted to limit transmission of lice from host to host, thus limiting gene flow among louse infrapopulations found on different hosts and increasing the effect of louse population …

Human capital theory (Becker 1962; Mincer 1958; Schultz 1960; 1961) posits that individuals can increase their labor market returns through investments in education and training. This concept has been studied extensively across several disciplines. An analog concept of criminal capital, while the focus of speculation and limited empirical study, remains considerably less developed theoretically and methodologically. This paper offers a formal theoretical model of criminal capital indicators and tests for greater illegal wage returns using a sample of serious adolescent offenders, many of whom participate in illegal income-generating activities. This article gives a concise introduction to the ‘tragedy of the anticommons.’ The anticommons thesis is simple: when too many people own pieces of one thing, nobody can use it. Usually, private ownership creates wealth. But too much ownership has the opposite effect – it leads to wasteful underuse. This is a free market paradox that shows up all across the global economy. If too many owners control a single resource, cooperation breaks down, wealth disappears, and everybody loses. Conceptually, underuse in an anticommons mirrors the familiar problem of overuse in a ‘tragedy of the commons.’ The field of anticommons …

This essay was the keynote address for a symposium on Miller v Alabama, the 2012 Supreme Court opinion holding unconstitutional under the Eighth Amendment a statute imposing a mandatory sentence of life without parole for juveniles convicted of homicide. The essay argues that Miller embodies a way of thinking about juvenile crime that has taken hold in the early 21st century – an approach that emphasizes the importance for legal policy of developmental differences between juveniles and adults. The limitations of large bone defect regeneration has brought the focus of Bone Tissue Engineering research on fabricating three-dimensional bone-mimetic grafts that could enhance osteogenesis and vascularization. Osteons composed of apatite-deposited aligned collagen nanofiber layers are the fundamental building blocks of cortical bone. In natural cortical bone, mineralization is mediated by extracellular matrix (ECM) proteins with amino acid sequences rich in glutamic acid. This dissertation is focused on the establishment of a novel biomimetic approach to engineer scaffolds for healing large bone defects.

Cell transplantation can be considered a regenerative therapy, an intervention which attempts to replace or restore the function of compromised tissue by harnessing innate properties of cells that cannot be replicated artificially. For such therapies to succeed, it will be necessary to understand and closely match the physiological conditions that govern cell behaviors in vivo. One important factor is low oxygen tension, termed hypoxia, which is often overlooked in vitro. Because oxygen insufficiency can lead to cell death, hypoxia has traditionally been viewed as a negative condition. However, hypoxia can also serve as a potent regulator of crucial cell behaviors …

Through new technologies in chemical production, certain high value products have oversaturated the market and have become high-volume, low value waste products. The peels of processed apples can be recovered for further food applications. Limited information on the valorisation of this type of waste is available for cooking varieties, e.g. cv Bramley’s Seedling. Extracts from fresh or dried (oven-dried or freeze-dried) peels were obtained with solvents of different polarity (aqueous acetone or ethanol) and assayed for their total phenolic content and antioxidant capacity; their antiradical power was compared to herb extracts. Extruded snacks and breadsticks were formulated with increasing levels of brewer’s spent grain (BSG). The phenolic content increased by 4 and 7 fold with BSG addition in extrudates (40g/100g) and in breadsticks (35g/100g), respectively. Consequently, antioxidant capacity (DPPH, FRAP) also increased despite a recorded loss of phenolic compounds in extruded snacks. Arabinoxylans content increased up to 20 and 25g of BSG addition /100g of formulated extruded snacks and breadsticks, respectively. Further addition of BSG did not improve the content of arabinoxylans due to the possible formation of polysaccharide-protein complexes. A clinician is entrusted with the difficult task of organizing, integrating, and formulating a vast amount of information provided by a patient in order to conduct therapy. Typically, a theoretical paradigm is employed in this endeavor. This paper constructs a theory of theoretical paradigms—a meta-theory—to understand better how clinicians organize and understand patient information. The theory of theory posits that theoretical paradigms function as complex metaphors developed within a culture. A physician's armamentarium includes the presence of the tool of touch which is used not only to diagnose and to heal, but also to reassure patients that they are safe and well cared for in the hands of the physician. This study is a preliminary investigation of the validity of using time-based measures to quantify sustained attention in children ages 6-12. Problems with sustained attention negatively affect childhood learning and development. The prevalence of disorders known to impact sustained attention performance continue to rise in the United States. Currently, commercially available, objective measures of sustained attention use normative comparisons that provide limited information about the effect such problems have on child performance in natural settings. We have recently demonstrated the emergence of dynamic feature sensitivity through exposure to formative stimuli in a real-time neuromorphic system implementing a hybrid analog/digital network of spiking neurons. This network, inspired by models of auditory processing in mammals, includes several mutually connected layers with distance-dependent transmission delays and learning in the form of spike timing dependent plasticity, which effects stimulus-driven changes in the network connectivity. Here we present results that demonstrate that the network is robust to a range of variations in the stimulus pattern, such as are found in naturalistic stimuli and neural responses.
