The Shape Of Illusion: Water Law And Policy In The Fourth Dimension, George William Sherk Jan 2013

The Shape Of Illusion: Water Law And Policy In The Fourth Dimension, George William Sherk

Texas A&M Journal of Property Law

With these words, Colonel Nathan R. Jessep, played by Jack Nicholson in the movie A Few Good Men, expressed his outrage at being caught in a lie. The lie is not relevant to our purposes today. What is relevant is the fact that the truth eventually became known.

As we look to secure water supplies for the future, it is essential that decisions regarding the allocation and management of water resources be based as much as possible on truth, not on illusions created and perpetrated in the name of political expediency. As Col. Jessep could not stand being caught in …

Habitat Conservation Plans: Embracing Landowner Pragmatism And Quieting The Complexity Of The Incidental Take Permit Process, Mark F. Maples

Texas A&M Journal of Property Law

Both sides of the debate have strong reasons for disliking section 10. After a brief discussion of HCPs and their history in Part II, this Comment will evaluate the best arguments from both landowners and preservationists in Parts III and V. Parts IV and VI will discuss case history supporting both sides. Part VII will then discuss the philosophy of eco-pragmatism and recommend that resourcists and landowners should adopt some of its principles regarding adaptive management and HCPs. Within this Section, the Author will argue that the advantages to pragmatism in constitutional law that Daniel Farber submitted in 1988 are …

To Detroiters And Outsiders: A Call To Action To Bring Back The Motor City, Leah A. Walker

Texas A&M Journal of Property Law

In order to spark progress in the form of urban farming, a basic understanding of the relevant history, benefits, and laws proves essential. Part II of this Comment introduces the history of urban agriculture in the United States. Part III narrows the historical focus to Detroit before discussing the benefits that accompany urban agriculture, which are essential to Detroit’s survival and potential revival. Finally, Part IV discusses the laws with the most widespread and immediate impact on urban farming in Detroit and reveals the significant role timing plays in starting an urban farm, as changes to the zoning ordinance loom.

Effects Of Coal Combustion By-Product–Encapsulated Ammonium Nitrate On Wheat Yield And Uptake Of Nitrogen And Metals, Eton E. Codling

Coal Combustion and Gasification Products Journal Archive

Ammonium nitrate (AN) is an essential plant nutrient for plant growth. Ammonium nitrate is also an ingredient in explosives. Research is being conducted on reducing the explosiveness of AN by encapsulating it with the use of coal by-products. The objective of this greenhouse pot study was to determine the effects of class C and F fly ash and flue gas desulfurization-gypsum-encapsulated AN on biomass, grain, and straw yield and nitrogen and metals uptake by wheat. Encapsulated AN was mixed with a low-nitrogen soil at 56 and 112 kg N ha^-1^, as well as unencapsulated AN as a control, and planted …

Theses and Dissertations--Animal and Food Sciences

The objective of this thesis was to evaluate inclusion of up to 35% by-product DDGS (with reduced Ca and P) with and without addition of a proprietary premix (enzyme and antioxidant; Alltech Inc.) on productive performance and egg quality of white and brown egg laying hens. A total of 288 white or brown hens were randomly allocated to one of the following treatments: 1) corn-soybean meal (control), 2) 25% DDGS, 3) 25% DDGS plus premix, 4) 35% DDGS, and 5) 35% DDGS plus premix. Hen body weight values were impaired with addition of 25 and 35% DDGS when compared to …

Compost Bedded Pack Barns: Management Practices And Economic Implications, Randi Alyson Black Jan 2013

Compost Bedded Pack Barns: Management Practices And Economic Implications, Randi Alyson Black

Theses and Dissertations--Animal and Food Sciences

Compost bedded pack (CBP) barn design and pack maintenance procedures vary considerably, making advising and problem-solving challenging. One objective of this research was to characterize herd performance and management practices employed by Kentucky CBP managers (42 farms and 47 CBP facilities). Producer satisfaction, changes in historical bulk-tank somatic cell count, and improvement in herd performance parameters after transitioning to a CBP barn support reported CBP barn system benefits. Daily milk production increased from before moving into the CBP barn to the second year after (29.3 ± 0.3 vs. 30.7 ± 0.3 kg, respectively; P < 0.05) for farms using the CBP barn as the primary housing facility (n = 8). Increasing stirring frequency, stirring depth, and ambient temperatures increased pack temperature. Increased drying rate decreased CBP moisture. Increased 20.3 cm depth CBP temperature and ambient temperatures improved cow hygiene. Mastitis-causing bacteria thrive in conditions similar to optimal composting bacteria conditions, making reduction of these bacteria difficult in an active composting environment. Producers must pay attention to other management areas where preventive measures can be employed. The New Dairy Housing Investment Analysis Dashboard provides users an interactive and flexible decision tool to make more informed facility investment decisions.

Offspring And Maternal Health Benefits Of Exercise During Pregnancy, Lindsay G. Carter Jan 2013

Offspring And Maternal Health Benefits Of Exercise During Pregnancy, Lindsay G. Carter

Theses and Dissertations--Nutritional Sciences

Maternal lifestyle and nutrient intake during pregnancy can have long-lasting effects on the health of offspring as well as the mother. This dissertation focuses on the impact of maternal exercise during pregnancy on offspring insulin sensitivity and glucose uptake and the maternal effects of exercise during pregnancy.

The first aim of this dissertation was to investigate if exercise prior to and during pregnancy and nursing would improve glucose uptake and insulin sensitivity in mice and rats. In both mice and rats, it was concluded that maternal exercise could enhance whole-body insulin sensitivity and increase glucose uptake into skeletal muscle and …

An Investigation Of Perinatal Polychlorinated Biphenyl Exposure On Body Composition And Glucose Homeostasis, Cetewayo S. Rashid Jan 2013

An Investigation Of Perinatal Polychlorinated Biphenyl Exposure On Body Composition And Glucose Homeostasis, Cetewayo S. Rashid

Theses and Dissertations--Nutritional Sciences

Recent advancements have uncovered environmental contributions to obesity and diabetes etiology. In fact, perinatal malnutrition resulting in low birth weight (LBW) has been shown to correlate with later life obesity and impaired glucose tolerance in aged offspring. LBW can result from a myriad of developmental perturbations including macronutrient restriction, hypoxia, maternal stress and toxin exposure.

Polychlorinated biphenyls (PCBs) are ubiquitous environmental pollutants that bioaccumulate in the food chain resulting in dietary exposure in humans. Maternal and cord blood PCB levels are inversely associated with birth weight, and recent studies indicate that perinatal exposures to PCBs contribute to gender-specific obesity development …

3-D Printing, Kristina Shindyapin

Senior Seminars

The world has seen many technological advances in the last 50 - 100 years. But one of the most interesting and newest ones is 3-dimensional printing. This new technology has been invented and evolved in just the last 30 years. What is 3-D printing? 3-D printing is a special way of printing, using materials such as certain types of plastic and following a 3-D model or 3-D software which tells a printer how to print something in three dimensions. This printer is also different than standard ink printers, in that it is shaped like a box and allows something to …

A Case Of The Red Pants Mondays: The Connection Between Fandom, Tumblr, And Consumption, Megan E. Desouza Jan 2013

A Case Of The Red Pants Mondays: The Connection Between Fandom, Tumblr, And Consumption, Megan E. Desouza

Major Papers by TMD Master of Science Students

Social media networks allow for the interaction of individuals from across the globe based on mutual social connections or shared interests. These networks are of particular benefit to the propagation of fandoms. The unique search capacity of Tumblr enables the identification of fellow fans, a forum in which to engage easily in shared fandom creation, commodity consumption, and activities such as cos-play and role-play. Fandom consumption can manifest in both material and aesthetic, or cultural, forms. This paper presents the fandom of the BBC's series Sherlock as a case study of the connections between social media, fandom, and consumption. The …

Catholic Moral Teaching And Natural Law: Changing The Way We Think About And Teach Professional Legal Ethics, Peter P. Meringolo Jan 2013

Catholic Moral Teaching And Natural Law: Changing The Way We Think About And Teach Professional Legal Ethics, Peter P. Meringolo

Loyola University Chicago Law Journal

Lawyers have had a hand in virtually every financial scandal in recent news. These lawyers are hired to advise clients about how to structure hedge funds, financial products, and financial transactions. Because global economies are becoming more interconnected, when large and risky financial transactions fail, they shake the stability of markets around the world.

The “hired gun” mentality is prevalent throughout the legal profession. In this mindset, lawyers believe that because they are engaged by a client, they must do their client’s bidding, and must be singularly focused on their client’s sole interests. Can we do anything to encourage lawyers …

The Empire Writes Back: Environmental Racism & Indigenous Projects, Gary Egger

All Graduate Theses, Dissertations, and Other Capstone Projects

The production of research is integral for gaining the knowledge and understanding to interpret the phenomena that occurs in everyday life. Historically, both research and knowledge have been under the control of the West while at the same time marginalizing minority groups. Attempts by members of minority groups to participate in producing knowledge has been ignored, discredited, and met with resistance by powerful dominant groups. Standpoint theory, from the perspective of Sandra Harding, supports the notion of strong objectivity, or the idea that the standpoint of oppressed and/or marginalized peoples is necessary to create a more objective understanding of the …

Threads Of Identity: Marisol's Exploration Of Self, Emily Williams Jan 2013

Threads Of Identity: Marisol's Exploration Of Self, Emily Williams

HIM 1990-2015

Marisol Escobar, known in the 1960s as the "Latin Garbo," is a sculptor famous for showing with the Pop art greats. However, Marisol holds a curious position in art history, stranded between the formalism of the fifties' and sixties' male-dominated Pop movement and the conceptual experimentation and radicalism that followed. Trained as a draftsman and painter early in her career, Marisol's main body of work mostly consists of large-scale wooden and mixed-medium sculpture. Lesser known, her lithographs, drawings, collages and small figurines further prove her technical and artistic validity. Preferring to go by surname only, Marisol’s quiet yet intense observation …

A Comparative Analysis Of Present And Past Participial Adjectives And Their Collocations In The Corpus Of Contemporary American English (Coca), Natalia Reilly Jan 2013

A Comparative Analysis Of Present And Past Participial Adjectives And Their Collocations In The Corpus Of Contemporary American English (Coca), Natalia Reilly

Electronic Theses and Dissertations

ESL grammar books have lists of present and past participial adjectives based on author intuition rather than actual word frequency. In these textbooks, the –ing and –ed participial adjectives derived from transitive verbs of state and emotion are presented in pairs such as interesting/interested, boring/bored, or surprising/surprised. This present study used the Corpus of Contemporary American English http://corpus.byu.edu/coca/ (COCA) to investigate the overall frequency of participial adjectives in use as well as their frequency within certain varieties of contexts. The results have shown that among most frequently used participial adjectives there are not only the participial adjectives derived from transitive …

Three Theories Of “Principles Of Fundamental Justice”, Nader R. Hasan Jan 2013

Three Theories Of “Principles Of Fundamental Justice”, Nader R. Hasan

The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference

Nearly three decades after the Supreme Court of Canada’s B.C. Motor Vehicle Reference (“MVR”), we still do not have a satisfactory the ory to explain the “principles of fundamental justice” protected under section 7 of the Canadian Charter of Rights and Freedoms. The purpose of this paper is to identify three possible the ories, which emerge implicitly from Supreme Court of Canada case law. The first the ory is historical: A principle of fundamental justice is a legal principle that was historically protected or is deeply rooted in our legal system’s history and traditions. The second the ory is derivative: …

Section 15(2), Ameliorative Programs And Proportionality Review, Jena Mcgill Jan 2013

Section 15(2), Ameliorative Programs And Proportionality Review, Jena Mcgill

The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference

This paper argues that after the Supreme Court of Canada’s interpretation, in R. v. Kapp and R. v. Cunningham, of section 15(2) of the Canadian Charter of Rights and Freedoms as an exemptive provision pursuant to which a government law or program with an ameliorative purpose may be “saved” from further Charter scrutiny, section 15(2) is now best understood as constituting an internal limit on the right to equality. Given that section 15(2) supplants section 1 of the Charter when an ameliorative law or program is at issue, the contours of the section 15(2) limit should be defined according to …

Home Gardens As Transported Landscapes: Ethnobotanical Encounters With Southeast Asian- American Horticulturists, Lauren A. Munim Jan 2013

Home Gardens As Transported Landscapes: Ethnobotanical Encounters With Southeast Asian- American Horticulturists, Lauren A. Munim

USF St. Petersburg campus Honors Program Theses (Undergraduate)

This research examines the belief systems, knowledge base and practice of Southeast Asian-Americans residing on the West Coast of Florida. The importance of traditional ecological knowledge in the cultivation of home gardens as relocated venues for cultural preservation of migrant horticulturalists is illustrated. Data collection methods include: participant observations, semi-structured interviews, geospatial mapping, and identification of key food and medicinal plant species. Home gardens serve as reconstructed landscapes for immigrant populations by stimulating cultural preservation of plants used in traditional healing, thus space providing a venue for the intergenerational transfer of traditional knowledge. Transported landscapes require traditional ecological knowledge regarding …

Erie's Four Functions: Reframing Choice Of Law In Federal Courts, Allan Erbsen Jan 2013

Erie's Four Functions: Reframing Choice Of Law In Federal Courts, Allan Erbsen

Articles

This Article seeks to mitigate decades of confusion about the Erie doctrine’s purposes, justifications, and content. The Article shows that “Erie” is a misleading label encompassing four distinct components. Jumbling these components under a single heading obscures their individual nuances. Analyzing each component separately helps to clarify questions and values that should animate judicial analysis. The Article thus reconceptualizes the Erie doctrine, offers a more precise account of how Erie operates, and provides a framework for rethinking several foundational aspects of Erie jurisprudence. 2013 marks Erie’s seventy-fifth anniversary. The years have not been kind to Erie and its progeny. Decades …

Influence Of Vectors' Risk-Spreading Strategies And Environmental Stochasticity On The Epidemiology And Evolution Of Vector-Borne Diseaes: The Example Of Chagas' Disease, Christopher Kribs, Perrine Pelosse, Marine Ginoux, Jorge E. Rabinovich, Sebastien Gourbiere, Frederic Menu

Mathematics Faculty Publications - Archive

Insects are known to display strategies that spread the risk of encountering unfavorable conditions, thereby decreasing the extinction probability of genetic lineages in unpredictable environments. To what extent these strategies influence the epidemiology and evolution of vector-borne diseases in stochastic environments is largely unknown. In triatomines, the vectors of the parasite Trypanosoma cruzi, the etiological agent of Chagas’ disease, juvenile development time varies between individuals and such variation most likely decreases the extinction risk of vector populations in stochastic environments. We developed a simplified multi-stage vector-borne SI epidemiological model to investigate how vector riskspreading strategies and environmental stochasticity influence the …
