Effects Of Silvicultural Management On Coast Redwood Forest Composition, Density And Structure In Santa Cruz And San Mateo Counties, Michael J. Papa

The multiple-objective exploratory study investigates effects of various silvicultural management regimes commonly applied to coast redwood (Sequoia sempervirens [D. Don] Endl.) forests in Santa Cruz and San Mateo Counties, California, USA. A temporary forest inventory was installed in 24 harvest origin stands and 4 natural origin stands throughout the study area (sample area = 1189 acres). Data from the systematic sample of 233 one-quarter acre nested cluster plots (sample intensity = 4.9%) rendered overall forest descriptions in terms of species composition, density, and structure. Refinancing pressure may entice a very specific form of managerial misbehavior on the part of borrowers. Borrowers utilizing a greater amount of short term debt in one period may feel pressure to make their firms look as attractive as possible leading into the next period when refinancing may take place. In other words, potential refinancing pressure may lead managers to manipulate earnings. We examine the relation between changes in debt in current liabilities (short-term debt) and discretionary accruals as an indicator of the propensity to manage earnings. For the past 25 years, reality shows, in particular, police reality shows has figured prominently in American culture as a true representation of police/criminal interactions. This dissertation is a case study that examined the portrayal of African Americans as criminals on the police reality show entitled The Police Women of Cincinnati, Memphis, Dallas, Maricopa County (Phoenix, AZ) and Broward County (Ft. Lauderdale, FL). The cities were chosen because they represent the entire five seasons that the series has been on television. Negotiating Jurisdiction: Retroceding State Authority Over Indian Country Granted By Public Law 280, Robert T. Anderson

This Article canvasses the jurisdictional rules applicable in American Indian tribal territories—“Indian country.” The focus is on a federal law passed in the 1950s, which granted some states a measure of jurisdiction over Indian country without tribal consent. The law is an aberration. Since the adoption of the Constitution, federal law preempted state authority over Indians in their territory. The federal law permitting some state jurisdiction, Public Law 280, is a relic of a policy repudiated by every President and Congress since 1970. Fleeing East From Indian Country: State V. Eriksen And Tribal Inherent Sovereign Authority To Continue Cross-Jurisdictional Fresh Pursuit, Kevin Naud Jr.

In State v. Eriksen, the Washington State Supreme Court held that Indian tribes do not possess the inherent sovereign authority to continue cross-jurisdictional fresh pursuit and detain a non-Indian who violated the law on reservation land. This Comment argues the Eriksen Court’s reliance on RCW 10.92.020 is misplaced. RCW 10.92.020 is irrelevant to a consideration of sovereign authority. States do not have the authority to unilaterally define tribal power. A tribe retains sovereign powers not taken by Congress, given away in a treaty, or removed by implication of its dependent status. The Eriksen Court also misinterpreted the state statute …

Fundamental to the American system of justice is the right to a public trial and a general presumption of openness in judicial proceedings. These values are reflected in the First and Sixth Amendments of the United States Constitution and in many state constitutions. Washington is one of a number of states whose constitution (unlike the U.S. Constitution) also explicitly guarantees the open administration of justice. Constitutional dilemmas arise when a party requests the closure of a courtroom or the sealing of documents. These requests force courts to harmonize values of open justice with other compelling interests. U.S. Supreme Court decisions …

Spatial And Temporal Trends Of Freshwater Mussel Assemblages In The Meramec River Basin, Missouri, Usa, J. E. Hinck, Stephen E. Mcmurray, Andrew D. Roberts, M. Christopher Barnhart, Christopher G. Ingersoll, Ning Wang, Tom Augspurger

The Meramec River basin in east-central Missouri has one of the most diverse unionoid mussel faunas in the central United States with .40 species identified. Data were analyzed from historical surveys to test whether diversity and abundance of mussels in the Meramec River basin (Big, Bourbeuse, and Meramec rivers, representing .400 river miles) decreased between 1978 and 1997. We found that over 20 y, species richness and diversity decreased significantly in the Bourbeuse and Meramec rivers but not in the Big River. Most species were found at fewer sites and in lower numbers in 1997 than in 1978. Federally endangered …

Foreign objects in the female genital tract neglected for a long period of time may lead to many clinical problems including recurrent vaginal discharge and infertility. We present a case of 3-year long infertility, and 11-year long recurrent vaginal discharge in a 24-year-old female. She was treated empirically with several courses of antibiotics, which did not resolve her symptoms. Before her marriage, the family declined initial attempts to perform a physical examination due to fear of tearing the hymen, which has many social implications in the Kingdom of Saudi Arabia. The fate of American aviation pioneers Amelia Earhart and Fred Noonan, who disappeared over the Pacific in July 1937, is a continuing Pacific historical mystery. Twenty-three years of interdiSciplinary research by The International Group for Historic Aircraft Recovery (TIGHAR) has produced results supporting the hypotheSiS that Earhart and Noonan landed their Lockheed Electra IDE safely on Nikumaroro in the Phoenix Islands, made repeated efforts to radio for help, but eventually expired. This paper summarizes TIGHAR's data relevant to the "Nikumaroro HypotheSiS."

In the mid-1940s, Banaban Islanders relocated to Rabi Island in Fiji. The decision was the culmination of decades of phosphate mining on Banaba in colonial times. This article examines the context and long-term impacts of policies and legal frameworks relevant to the Banaban resettlement. The Banaban experience is a Significant case study because it involved relocation of an entire island population rather than individual or family migration, and the resettlement crossed international boundaries. Although the Banaban resettlement is unique and was contingent on peculiar colonial and factual circumstances it offers insights for environmental migration. This action research project examined the link between school board governance and effective school district operation. In particular, the link between superintendent leadership, board of education professional development, and community support was studied. The three-year project focused on positive board-superintendent relations and effective board governance. The goals of the project were to establish roles, responsibilities, and procedures for board relations, improve the public image of the school district, improve evaluation systems of school programs, and develop and communicate a district mission and vision. The project documented improvement in community support in multiple areas.
