Going To The Show: The Supreme Court Will Consider Validity Of Same-Sex Marriage Bans, Joanna L. Grossman

Hofstra Law Faculty Scholarship

The U.S. Supreme Court will finally wade into the same-sex marriage debate that has embroiled virtually every other governmental body at the state and federal level at some point in the last twenty years. Last Friday, the Court agreed to review two cases that raise, in different ways, the question whether bans on same-sex marriage violate the federal constitution.

The first case, United States v. Windsor, presents the question whether a provision of the Defense of Marriage Act (DOMA), which precludes the federal government from giving effect, for any federal law purpose, to a validly celebrated same-sex marriage, is …

Marriage Pluralism, Family Law Jurisdiction, And Sex Equality In The United States, Linda C. Mcclain Dec 2012

Marriage Pluralism, Family Law Jurisdiction, And Sex Equality In The United States, Linda C. Mcclain

Faculty Scholarship

In many regions of the world, rights guaranteed under the civil law, including rights to gender equality within marriage and rights in the distribution of family property and child custody upon divorce, are in conflict with the principles of religious law. Women's rights issues are often at the heart of these tensions, which present pressing challenges for theorists, lawyers, and policymakers. This anthology brings together leading scholars and activists doing innovative work in Jewish law, Muslim law, Christian law, and African customary law. Using examples drawn from a variety of nations and religions, they interrogate the utility of recent theoretical …

Designing Pre-Tests For An Intermediate-Level University Spanish Course, Carl D. Gutke Dec 2012

Designing Pre-Tests For An Intermediate-Level University Spanish Course, Carl D. Gutke

Theses and Dissertations

Testing, at times, can be a complicated matter. It takes a lot of time, precision and trial and error to adequately create a valid and reliable test. When creating a test, we should be aware of the impact that it is going to have on our teaching and whether it will be positive or negative. The goal of this project was to create four good intermediate Spanish diagnostic pre-tests that could be taken at the Brigham Young University Humanities Computer Testing Laboratory. The purpose of these pre-tests was to ascertain the grammatical strengths and weaknesses of our Fall Semester 2012 …

Interview With Doris "Dorothy" Ezell Schmitz - Oh 302, Doris Ezell-Schmitz Dec 2012

Interview With Doris "Dorothy" Ezell Schmitz - Oh 302, Doris Ezell-Schmitz

Winthrop University Oral History Program

Interview recorded December 11, 2012 by Robert Ryals for the Louise Pettus Archives and Special Collections Oral History Program. Interviewee Doris Ezell-Schmitz (class of 1973, 1975) describes her decision to attend Winthrop (medical recovery, scholarship), her English major and French minor, and campus life during integration in the late 1960s–early 1970s.

Ezell-Schmitz recalls growing up in Rock Hill amid Civil Rights-era unrest (Ku Klux Klan activity, cross burnings) and remembers the Friendship Nine sit-ins. She describes racial dynamics at Winthrop: a small but growing number of African American students, rare Black-white roommate pairings, social barriers and moments of friendship, and …

Educating For A Common Collective : Pedagogies Of Sharing And Caring, Anita Rampal Dec 2012

Educating For A Common Collective : Pedagogies Of Sharing And Caring, Anita Rampal

South South Forum 南南論壇

Declaring an ‘educational arms race’ with India and China, President Obama warned his country against ‘unilateral disarmament’ with budget cuts, because ‘countries that out-educate us today will out-compete us tomorrow.’ Militaristic jingoism leads to new terms such as ‘out-think’ and ‘out-educate’, reflecting a crassly competitive commodification of knowledge. This is contrary to the spirit of transformative education, which looks at education to reduce inequalities, to ensure sustainable development and to address social justice for all through collective action. Despite the Jomtien World Declaration on ‘Education For All’ with an ‘expanded vision’ - for the empowerment of children, youth and adults …

未来的维度 = The Dimension Of The Future, Jinhua Dai Dec 2012

未来的维度 = The Dimension Of The Future, Jinhua Dai

South South Forum

The focus of this paper is on “the future” as a subject of concern, and the parameters within which it is broached in the context of the 21st century. For the writer, the question of “the future” is not really a temporal one, neither is it another name for utopia. Rather, it is moved by apprehensions of the disappearance of time altogether, that is, the looming of doom. My question is: is the end of capitalism the end of humanity? Or rather, how to avoid the fall of capitalism to bring about the fall of humanity, a question …
