Governments jail people who are perceived as threats. More often than not the governments believe the threats to be genuine and the incarcerations to be legally sound. But governments are sometimes wrong. When a court issues a writ of habeas corpus (also known as the Great Writ of Liberty), it orders jailers to bring a prisoner into court and requires them to persuade a neutral judicial officer of the the Great Writ of Liberty), it orders jailers to bring a prisoner into court and requires them to persuade a neutral judicial officer of the correctness of their legal and factual …

New Orleans Prosecutorial Disclosure In Practice After Connick V. Thompson, Ellen Yaroshefsky Jan 2012

New Orleans Prosecutorial Disclosure In Practice After Connick V. Thompson, Ellen Yaroshefsky

Hofstra Law Faculty Scholarship

The New Orleans Prosecutor's office under the 30 year leadership of Harry Connick was notorious for its failures to comply with constitutional requirements to disclose favorable information to the defense. The Supreme court in a range of cases including its 2011 decision in Connick v.Thompson, excoriated the prosecutor's office for its failures.

Leon Cannizzaro, elected as New Orleans prosecutor in 2008, made significant changes in that office. This article, the result of in depth interviews with key stakeholders in the New Orleans criminal justice system, including former prosecutors, examines the extent and effect of the policy and practice changes. It …

A Historical Evaluation Of C&C Complexity, Conzetti Finocchiaro Jan 2012

A Historical Evaluation Of C&C Complexity, Conzetti Finocchiaro

Theses

The actions of Malware are often controlled through uniform communications mechanisms, which are regularly changing to evade detection techniques and remain prolific. Though geographically dispersed, malware-infected nodes being controlled for a common purpose can be viewed as a logically joint network, now loosely referred to as a botnet. The evolution of the mechanisms or processes for controlling the networks of malware-infected nodes may be indicative of their sophistication relative to a point of inception or discovery (if inception time is unknown). A sampling of botnet related malware at different points of inception or discovery can provide accurate representations of the …

The Impact Of Polarization On The Performance Of All-Optical Flip-Flops, Claudio Ippolito Jan 2012

The Impact Of Polarization On The Performance Of All-Optical Flip-Flops, Claudio Ippolito

Theses

This thesis experimentally characterizes the polarization dependence of an all-optical flip-flop (AOFF) based on a resonant-type semiconductor optical amplifier. Previous demonstrations of such an optical-memory device have exhibited poor on-off contrasts of around 3 dB (2:1). Our work maps out the dependence of the bistable hysteresis on the injected polarization state for the first time and clearly shows how to optimize the on-off contrast to achieve 8 dB. Beyond this optimization technique, it also demonstrate a novel technique to achieve and on-off contrast exceeding 30 dB (1000:1).

Batson "Blame" And Its Implications For Equal Protection Analysis, Robin Charlow Jan 2012

Batson "Blame" And Its Implications For Equal Protection Analysis, Robin Charlow

Hofstra Law Faculty Scholarship

Twenty-five years ago Batson v. Kentucky held that equal protection is violated when attorneys exercise racially discriminatory peremptory jury challenges and supply pretextual explanations for their strikes. Findings of Batson violations are tantamount to rulings that attorneys have discriminated and lied. Not only do Batson findings potentially subject violators to sanction under standards of professional ethics, but they also amount to imputations of personal fault or “blame” for socially undesirable conduct. This article explores, from both practical and theoretical perspectives, the problem of the attribution of personal fault to attorneys that is inherent in a finding of a Batson violation. …

The “Other” Within: Health Care Reform, Class, And The Politics Of Reproduction, Janet L. Dolgin, Katherine R. Dieterich Jan 2012

The “Other” Within: Health Care Reform, Class, And The Politics Of Reproduction, Janet L. Dolgin, Katherine R. Dieterich

Hofstra Law Faculty Scholarship

The Article explores the nation’s resistance to developing a more equitable system of health care coverage. It does that through reference to the nation’s peculiar class system. Americans contend that anyone can avoid poverty through hard work and responsible choices. Yet, in fact, class mobility is the exception, not the rule. Americans are deeply anxious about safeguarding relative class status, but the signs through which they assess class are murky. In measuring their own socioeconomic status in relation to others, Americans consciously look to a wide set of elusive, shifting status symbols. Less consciously, though with equal, if not greater, …

Hospital As A Critical Infrastructure In The Community Disaster Response System, Yixuan Li Jan 2012

Hospital As A Critical Infrastructure In The Community Disaster Response System, Yixuan Li

Theses

The Department of Homeland Security lists 19 groups of sectors as Critical Infrastructure Key Resources (CIKR) such as Water, Emergency Services, and Healthcare and Public Health (HPH). Protection of those interdependent sectors is of vital interest for the country in the event of disaster. Hospital infrastructure systems are basic HPH elements of the CIKR. Local hospitals deliver essential routine healthcare services as well as serving as frontline responders during non-routine disaster events. Currently, hospitals generally extend their routine healthcare activities for external community disaster preparedness and response services. This extension takes the form of coordination with other responders within the …

Modernizing The Virtue Of Humility, G. Alex Sinha Jan 2012

Modernizing The Virtue Of Humility, G. Alex Sinha

Hofstra Law Faculty Scholarship

This paper offers a novel, secular account of the virtue of humility. There are only two such accounts in recent philosophical literature: one defended by Julia Driver, the other by George Schueler. Driver attaches the virtue of humility to people who underestimate their merits, or lack beliefs about their merits altogether. Schueler thinks that humility requires indifference to how we are regarded vis-a`-vis our accomplishments. This paper brings out the limitations of those accounts and constructs a new one which is free of them.

The new account derives directly from the under-appreciated approach defended a century ago by Hastings Rashdall, …

What Is Good Enough For Mobile System Evaluation: A Comparison Of Laboratory And Field Setting, Yao Wang Jan 2012

What Is Good Enough For Mobile System Evaluation: A Comparison Of Laboratory And Field Setting, Yao Wang

Theses

There is no consensus on whether field tests are necessary in evaluating mobile systems. Empirical studies have compared evaluations in the laboratory environment and field environment, but they provide different results due to the lack of consistent testing environments. Contributing to mobile system evaluation exploration, this study conducts a comparative analysis between laboratory study and field study by recreating the natural context in the laboratory and using recording software embedded in the mobile device. The results show that involving natural use context in a controlled testing environment identifies more usability problems than a complex field test, when the objective is …

Determination Of Chromaticness Difference Tolerance Of Offset Printing By Means Of Simulation, Jing Sheng Jan 2012

Determination Of Chromaticness Difference Tolerance Of Offset Printing By Means Of Simulation, Jing Sheng

Theses

Printing quality can be defined as conformance to specifications. ISO

12647-2 (2004), the standard for offset lithographic printing, specifies solid, TVI and mid-tone spread as conformance metrics. The revision of ISO 12647-2 (2010) embraces ΔCh as a new metric for grey reproduction assessment. In order to complete the revision, both the test method and the tolerance must be specified. In his presentation at TC130 in April 2011, Chung proposed a "three triplets' method as input to the grey reproduction assessment. He also proposed the use of G7 pass/fail criteria as the criteria to determine the tolerance in terms of ΔCh. …
