This research examines the identity struggle that the Honduran immigrant Alejandra Paniagua, a character from El regreso de una wetback, and many Hondurans deal with when trying to make a life in the U.S.. It also analyzes topics such as national identity, ethnic loyalty, the fiction-reality lifestyle in the United States, and many more aspects proposed in the book by Denia Nelson. The writer exposes how poverty, mainly, forces Latin Americans to travel abroad in order to find a job that can provide their families the income they need to survive.

This paper investigates the origins and uses of the pronoun 'vos' and its forms in Central America. I analyze the history of the voseo from Latin to Old Spanish to modern Spanish. The second section outlines the verbal forms of the voseo and their uses. The last section is a regional breakdown of how vos is used compared to other pronouns in the different countries of Central America.

One diagnostic criterion of an autism spectrum disorder (ASD) is a dysfunction of or lack of communication. Many individuals with autism struggle to communicate effectively and require extensive training to use verbal behavior. Parent training has been shown to be successful in teaching a variety of skills to children with autism; this paper compiles various aspects of parent training and teaching verbal behavior to children with autism in order to form a methodology of teaching parents to help their children communicate effectively.

Recent studies have demonstrated the important role gender plays in determining the likelihood of involvement in delinquent behavior. Earlier theories of delinquency, including Hirschi’s theory of social control have ignored the importance of gender by ignoring females all together. Using data derived from Wave 1 of the National Youth Survey, the purpose of this study is to conduct a partial test of Hirschi’s Social Control theory to determine whether the theory can properly explain not only delinquency in boys, but also delinquency among girls.

This Article resents a case study in how complexity arising from the evolution and proliferation of a financial innovation can increase systemic risk. The subject of the case study is the securitization of home loans, an innovation which played a critical and still not fully understood role in the 2007-2009 financial crisis. The Article introduces the term "fragmentation node" for these transaction structures, and it shows how specific sources of complexity inherent in fragmentation nodes limited transparency and flexibility in ways that undermined the stability of the financial system. In our classic image of an American lawsuit, including class actions, the plaintiffs lawyer pays the upfront costs and then hopes to recoup them from a share of the winnings. But today, this picture is incomplete. It is no longer only the law firm's own war chest that finances a case – so can outside investors and lenders. As Judge Hellerstein has just reminded us, the 9/11 cases he presided over involved such third-party financing. The Ecuadorian plaintiffs' environmental case against Chevron, now pending in the Southern District of New York, is another prominent example in the news.

A significant and growing portion of the U.S. population is or has recently been in prison. Nearly all of these individuals will face significant obstacles as they struggle to reintegrate into society. A key source of these obstacles is the complex, sometimes unknown, and often harmful collection of civil consequences that flow from a criminal conviction. As the number and severity of these consequences have grown, courts, policymakers, and scholars have struggled with how to identify and understand them, how to communicate them to defendants and the public, and how to treat them in the criminal and civil processes. Scholars and courts have long debated whether and when "parallel pricing" – adoption of the same price by every firm in a market – should be considered a violation of antitrust law. But there has been a comparative neglect of the importance of "parallel exclusion" – conduct, engaged in by multiple firms, that blocks or slows would-be market entrants. Parallel exclusion merits greater attention, for it can be far more harmful than parallel price elevation. Setting a high price leaves the field open for new entrants and may even attract them. This Article examines the unprecedented and deeply underestimated global power that the EU is exercising through its legal institutions and standards, and how it successfully exports that influence to the rest of the world. Without the need to use international institutions or seek other nations' cooperation, the EU has a strong and growing ability to promulgate regulations that become entrenched in the legal frameworks of developed and developing markets alike, leading to a notable "Europeanization" of many important aspects of global commerce. Justice Stevens And The Chevron Puzzle, Thomas W. Merrill

Justice Stevens's most famous decision – Chevron U.S.A. Inc. v. NRDC – has come to stand for an institutional choice approach to agency interpretation. But there is no evidence that Justice Stevens shared this understanding. Instead, he followed an equilibrium-preserving approach, which sought to nudge agencies to reconsider decisions the Justice regarded as unreasonable. Although the equilibrium-preserving approach is consistent with what a common law judge would embrace, the institutional choice perspective is probably more consistent with the needs of the modem administrative state, and it appears the Court as a whole is gradually adopting that perspective.

"Deference" Is Too Confusing – Let's Call Them "Chevron Space" And "Skidmore Weight", Peter L. Strauss

This Essay suggests an underappreciated, appropriate, and conceptually coherent structure to the Chevron relationship of courts to agencies, grounded in the concept of "allocation." Because the term "deference" muddles rather than clarifies the structure's operation, this Essay avoids speaking of "Chevron deference" and "Skidmore deference." Rather, it argues, one could more profitably think in terms of "Chevron space" and "Skidmore weight." "Chevron space" denotes the area within which an administrative agency has been statutorily empowered to act in a manner that creates legal obligations or constraints – that is, its allocated authority. "Skidmore weight" …

The authors offer two arguments for the inclusion of theism in natural science. First, an argument against excluding theism is offered. Though early roots of science promoted a view that it is a way to accumulate knowledge that is untainted by presuppositions and traditions, postmodern critiques call this into question. Scientists have sometimes rejected religion as a context-dependent, tradition-based way of knowing, yet science itself is also context-dependent and tradition-based. This chapter begins with general considerations for religiously and spiritually oriented psychotherapy, including the importance of seeing religion and spirituality as d.imensions of cultural diversity, considering clients' welfare and autonomy, and maintaining competence. Three types of religious and spiritual intervention approaches are then discussed: assimilative, accommodative, and collaborative. Assimilative approaches introduce spiritual interventions or considerations into a standard psychotherapy approach. Accommodative approaches involve adapting a standard psychotherapy regimen to include religious or spiritual matters. Collaborative approaches entail a mental health professional and religious leader working in tandem for the sake of clients' welfare. Next, specific issues related to counseling within …

Second Step: A Violence Prevention Curriculum is a school-based program developed to prevent and reduce aggressive behavior. Three separate age-appropriate curricula are available: preschool/kindergarten level, elementary level, and middle school level. Designed to be teacher-friendly and convenient for classroom use, the curricula aim to prevent and decrease aggression by helping children develop habits of prosocial behavior and thought. Instructional strategies are evidence-based and are built on a broad foundation of research. In addition, these curricula employ strategies that have been found to be effective for prevention of delinquency and substance abuse, and to support children's academic success. Each of the …

Notwithstanding the demands of retributive desert, strict criminal liability is sometimes defensible when the strict liability pertains, not to whether conduct is to be criminalized at all, but to the seriousness of the actor’s crime. Suppose an actor commits an intentional assault or rape, and accidentally brings about a death. Punishing the actor more seriously because the death resulted is sometimes justifiable, even absent proof of his independent culpability as to the death. But what punishment is proportionate for such an actor? Should he be punished as harshly as an intentional or knowing killer?

In this Essay, written as part of a symposium on Judith Resnik’s and Dennis Curtis's sumptuously illustrated volume Representing Justice, I offer a historically sensitive interpretation of the figure of Justice in woman suffrage spectacle and propaganda. American suffragists were drawn to Justice as a symbol of women's claim to political and legal rights. Why? Surely one reason is that, as Resnik and Curtis demonstrate, by the early twentieth century Justice had ascended as a distinctively resonant symbol of law and law's legitimacy in a democratic polity. Western literature provides an array of information regarding resilience within at-risk youth. Resilience research within non-Western contexts, and more specifically with exploited youth, is more limited. Despite exploitation, some youth develop a hardy ability to overcome adversity, allowing them more mastery over their environments and even increased psychological steadfastness. This project involved exploring the protective factors of resilience and psychological functioning in Cambodian youth, specifically a group of 24 survivors of sexual trafficking and another group of 24 rural youth without reported exploitation.
