In Defence Of A Defence - A Demonstrable Legitimate And Non-Infringing Purpose As A Full Defence To Anti-Circumvention Legislation, Andrew Yolles

In this essay, I will argue that making a demonstrable lawful and non-infringing purpose a full defence to copyright infringement by circumvention of a TPM addresses many of the concerns raised by the currently proposed legislation, while avoiding the pitfalls of directly linking anti-circumvention laws with actual copyright infringement. As the ratification of the WIPO Internet treaties is the foremost concern for this legislation, I will begin with a discussion as to how this model can successfully implement the treaties’ anti-circumvention provisions where the Bill C-60 model may have failed. Metal-insulator transition (MIT) phase-change materials (PCM) are material compounds that have the ability to be either conductors or insulators depending on external stimuli. A micromachined test structure for applying external electric fields across MIT wire segments was designed and fabricated. Using this novel test structure, Germanium Telluride (GeTe) and Vanadium Oxide (VOx) were successfully transitioned from a conductor to an insulator. The resistivity of the GeTe wire segments increased three to five orders of magnitude with ∼40 V applied to the parallel plates of the test structure. In a recently demonstrated algorithmic spectral-tuning technique by Jang et al. [Opt. Express 19, 19454-19472, (2011)], the reconstruction of an object’s emissivity at an arbitrarily specified spectral window of interest in the long-wave infrared region was achieved. The technique relied upon forming a weighted superposition of a series of photocurrents from a quantum dots-in-a-well (DWELL) photodetector operated at discrete static biases that were applied serially. Here, the technique is generalized such that a continuously varying biasing voltage is employed over an extended acquisition time, in place using a series of fixed biases over each sub-acquisition time, which totally …

In this paper we present a method for identification of temporal patterns predictive of significant events in a dynamic data system. A new hybrid model using Reconstructed Phase Space (MRPS) and Hidden Markov Model (HMM) is applied to identify temporal patterns. This method constructs phase space embedding by using individual embedding of each variable sequences. We also employ Hidden Markov Models (HMM) to the multivariate sequence data to categorize multi-dimensional data into three states, e.g. normal, patterns and events. Peacebuilding, Power, and Politics in Africa is a critical reflection on peacebuilding efforts in Africa. The authors expose the tensions and contradictions in different clusters of peacebuilding activities, including peace negotiations; statebuilding; security sector governance; and disarmament, demobilization, and reintegration. The integration of EHR in IT infrastructures supporting organizations enable improved access and recording of patient data, enhanced ability to make improved decisions, improved quality and reduced errors in patient care. Despite these benefits, there are mixed results as to the use of EHR. The literature suggests that the reasons for the limited use relate to policy, financial and usability considerations, but it does not provide an understanding of reasons for physicians’ limited interaction and adaptation of EHR.

In the context of e-commerce, personalization system provides customers with recommendations on what products to buy. Grounded on social exchange theory, this study empirically examines and theoretically articulates the effects of willingness to share information and adaptive personalization on willingness to repurchase products. A survey was conducted and PLS was used demonstrating that adaptive personalization fully mediates the relationship between willingness to share information and willingness to repurchase products. Ethical issues are key factors with respect to compliance intention with information security policies (ISPs). As such, understanding employees' compliance behavior with ISPs from ethical lenses is an important first step to leverage knowledge worker assets in efforts targeted toward reducing information security risks. This study proposes an integrated model that combines the Theory of Reasoned Action (TRA) and ethics theories; deontology and teleology, to examine users' behavioral intention to comply with ISPs. This paper adapts and extends the task-technology fit model of performance to the health care domain and the clinical reasoning task. Central to this effort was careful adaptation of the task and technology characteristics constructs to the clinical reasoning task and electronic health record technology. Overall the results indicate a good fit between model and data. The contributions of this study include successful adaptation of a corner-stone information systems theory to a new domain and technology, a validated user evaluation instrument able to assess the impact of EHR use on clinical reasoning performance, and new insight on the factors that …
