The Elusive "Marketplace" In Post-Bilski Jurisprudence, Andrew Chin

The Supreme Court’s 2010 decision in Bilski v. Kappos appears to have provided inadequate guidance to the courts and the Patent Office regarding the scope of the abstract-ideas exclusion from patentable subject matter. Federal Circuit Chief Judge Randall R. Rader, however, appears to have found in that decision a clear vindication of his own view that the machine-or-transformation test is incorrectly grounded in “the age of iron and steel at a time of subatomic particles and terabytes,” and thus fails, for example, to accommodate advances in “software [that] transform[] our lives without physical anchors.” Chief Judge Rader has subsequently authored …

The purpose of this analysis is to examine the issue of overrepresentation of minorities in special education, with a focus on the varying conceptual and theoretical perspectives among scholars and educators regarding the causes and potential solutions to the problem. Views of the issue will be described by comparing traditional perspectives with nontraditional perspectives. Further scrutiny of these views then leads to an analysis of differing epistemologies, contrasting the realist/objective view with that of non-realist constructivism. The life expectancy of individuals with intellectual disabilities has risen with the improvement of medical technology and improved access to health care, which has resulted in a new need to provide supports to these individuals in their later years. Presently there is no clear model on how to provide these services to this growing population. This paper advocates for assignments that are “high risk” in order to promote a less than predictable classroom environment. This paper attempts to create a space specific to first-year teachers of Freshman Composition and specifically for first-year teachers of Freshman Composition. Sample assignments are couched inside of a personal narrative of failure, as first first-year teachers of Freshman Composition are encouraged to explore the relationship between risk and reward, between pedagogical approach and classroom practice.

This study was designed to follow in the steps of a 1969 study of college radio management and structure, both to see how college radio in general has changed, and to update the models presented. A survey was issued through an email listserv affiliated with College Broadcasters Incorporated, and received 50 responses.

Two conflicting stories have consumed the academic debate regarding the impact of deinstitutionalization litigation. The first, which has risen almost to the level of conventional wisdom, is that deinstitutionalization was a disaster. The second story challenges the suggestion that deinstitutionalization has uniformly been unsuccessful, as well as the causal link critics seek to draw with the growth of the homeless population. The Refugee Convention, now adopted by 147 states, is the primary instrument governing refugee status under international law. The Convention sets a binding and nonamendable definition of which persons are entitled to recognition as refugees, and thus to enjoy the surrogate or substitute national protection of an asylum state.
