Prosecutors, like most Americans, view the criminal-justice system as fundamentally race neutral. They are aware that blacks are stopped, searched, arrested, and locked up in numbers that are vastly out of proportion to their fraction of the overall population. Yet, they generally assume that this outcome is justified because it reflects the sad reality that blacks commit a disproportionate share of crime in America. They are unable to detect the ways in which their own discretionary choices--and those of other actors in the criminal-justice system, such as legislators, police officers, and jurors--contribute to the staggering and disproportionate incarceration of black …

Pragmatism dominates contemporary legal thought, but knowing this isn’t knowing so much. Legal pragmatism means different things to different people, and as this essay argues, minimalist and experimentalist forms of regulation both share a broadly pragmatic sensibility about law and democracy. As a consequence, we need to tease out the various threads of legal pragmatism in the hope of distinguishing the pragmatisms that work from the ones that don’t, or less pragmatically, the ones that are just from the ones that are not. As people increasingly use social media to organize both protests and robberies, government will try to regulate these calls to action. With an eye to this intensifying dynamic, this Article reviews First Amendment jurisprudence on incitement and applies it to existing statutes on incitement to riot at a common law, state, and federal level. The article suggests that First Amendment jurisprudence has a particularly tortuous relationship with regulating speech directed to crowds. It examines current crowd psychology to suggest which crowd behavior, if any, should as a matter of policy be subject to regulation. It concludes that many existing incitement-to-riot …

There is an increasing focus upon the material and metaphoric spatial dimensions of various academic disciplines, including law. This essay considers the spatial dimensions of legal pedagogy, focusing on Critical Race Theory (CRT). The essay first explains the "critical program" in law and how CRT grows out of it. The essay then suggests that the critical program, and especially CRT, is as much a human geographic or spatial construct as it is a social, political or historic one, and briefly describes the nature of human geography and legal geography. Issues in Religion and Psychotherapy
A gospel-centered approach to critical thinking that can facilitate psychotherapeutic work and be edifying to faithful counselors and clients would be very beneficial. This article examines what a defensible approach to gospel-centered critical thinking about psychotherapy would look like, how it would differ from secular scholarly disciplines and practices, and whether it should differ at all. Because all critical thinking strategies are framed by a theoretical background of assumptions and values and because not all assumptions and values are true or useful, approaches to critical thinking must be carefully examined by those who would employ them. Deflected Agreement In The Book Of Mormon, Andrew C. Smith

Deflected agreement is a grammatical phenomenon found in Semitic languages—it is ubiquitous in Arabic and found occasionally in Classical Hebrew. Deflected agreement is a plausible explanation for certain grammatical incongruities present, in translation, within the original and printer's manuscripts and printed editions in the Book of Mormon in the grammatical areas of verbal, pronominal, and demonstrative agreement. This finding gives greater credence to the plausibility of the authenticity and historicity of the Book of Mormon. Additionally, the implications of this finding on Book of Mormon scholarship are discussed.

A peculiar artifact of many decades of materialist historical study is the reinforcement of a highly imaginary, cinematic envisioning of the French eighteenth century. Eager to debunk, demythologize, or otherwise demote anything even remotely religious, historians relish pictures of the French Enlightenment and French Revolution worthy of a Cecil B. DeMille or a D. W Griffith. In the rendering of continental Enlightenment now favored among fashion-forward academic professionals, the poor, the intellectual, the oppressed, and the angry increase in number and fervor while the overfed monks, the ermine-draped clerics, and the impudent aristocrats gobble up every last resource. Where does one find the German Enlightenment? General surveys and otherwise highly serviceable scholarly readers on the Enlightenment tend to neglect it. A recent book on the German Enlightenment by T. J. Reed observes that for many outside Germany, including scholars, the connection Aufklarung und deutsch (Enlightenment and German) is almost paradoxical. Why should this be so? One explanation is that the German Enlightenment is overshadowed by the French Enlightenment. A second explanation is that late-nineteenth-century Germany is associated with a turn away from Enlightenment ideas, in part a countervailing reaction to the terror of the Napoleonic Wars and French …

On March 12, 1891, a small group of women gathered in Chicago and founded an organization with the goal of establishing a home for poor Danish women. Прагматика общения, как известно, в значительной мере опреде-ляется спецификой жанра: существуют жанровые каноны, допуска-ющие ту или иную степень вариативности, но выход за рамки таких канонов приводит к коммуникативным неудачам. Попадая в стан-дартные условия общения, люди вырабатывают оптимальные для этих условий способы общения. Новые же коммуниканты, осваивая жанровый канон, стараются ему следовать, и в этом смысле оказы-ваются полностью зависимыми от жанра. Каким же образом можно обучить иностранца русским речевым жанрам? Какие именно речевые жанры стоит рассматривать как объект и предмет обучения на уроках РКИ?

Достаточно долгий опыт преподавания с одной стороны РКИ и истории и поэтики кино, с другой, привел меня к выводу, что изучение цитат из отечественных кинофильмов не только возможно, но и просто необходимо на продвинутом этапе обучения. Повседневная речь носителей языка переполнена цитатами разного уровня сложности и из разных источников. В речи молодежи, а именно молодежь – основной контингент изучающих русский язык в университете, постоянны мимолетные цитаты из видеотекстов, предназначенных для ежедневного, но не долгосрочного использования. Subtle And Overt Forms Of Islamophobia: Microaggressions Toward Muslim Americans, Kevin L. Nadal, Katie E. Griffin, Sahran Hamit, Jayleen Leon, Michael Tobio, David P. Rivera

Previous research suggests that microaggressions, or subtle and covert manifestations of bias, are commonplace in the life experience of people of color, women, and sexual minorities. However, there is a dearth of research focusing on microaggressions toward people from religious minority groups. Using a qualitative approach and directed content analysis with Muslim American participants (N=10), six themes emerged: 1) Endorsing Religious Stereotypes of Muslims as Terrorists, 2) Pathology of the Muslim Religion, 3) Assumption of Religious Homogeneity, 4) Exoticization, 5) Islamophobic and Mocking Language, and 6) Alien in Own Land. Implications for Muslim mental health are discussed.

Most published work in our field privileges theory over analysis, with analysis acting as a subordinate testing ground and exemplification for a theory. Reversing that customary polarity, this article analyzes three works by Stravinsky (Petrushka, The Rake’s Progress, Requiem Canticles) with a relative minimum of theoretical preconceptions and with the simple aim, in David Lewin’s words, of “hearing the piece[s] better.”

For information literacy instructors, a common teaching challenge is how to start a class effectively. Without previous exposure to learners, library instructors have little understanding of students' prior knowledge or research needs. At the same time, the reason for a librarian's involvement in a course at all is usually a mystery for students.
The benefits of introductory learning activities, such as warm-ups, are pedagogically sound, but library instructors may be reluctant to incorporate these strategies into information literacy instruction due to limitations of time. I am honored to follow the many eminent scholars who have delivered the Leary Lecture. Like many prior lectures, mine focuses on a contemporary civilrights struggle. I wish to discuss the issue of same-sex marriage, and more specifically the case of Hollingsworth v. Perry, a federal challenge to a state restriction on marriage on appeal to the United States Supreme Court. Perry’s development has served at least one function of our multi-tiered judicial system, which is to generate several options for the Court.
