The Distribution And Diversity Of Functional Gene Pathways Controlling Sulfur Speciation In Lower Kane Cave, Wyoming, Audrey Tarlton Paterson
The Distribution And Diversity Of Functional Gene Pathways Controlling Sulfur Speciation In Lower Kane Cave, Wyoming, Audrey Tarlton Paterson
LSU Master's Theses
Defining the linkages between microbial metabolic activity and environmental geochemistry can be used to understand how carbonate dissolution in sulfidic karst systems proceeds. In Lower Kane Cave, Wyoming, sulfidic springs support taxonomically distinct microbial communities that are also associated with putative sulfur metabolisms (e.g., oxidation of reduced sulfur compounds, sulfate reduction, and sulfur disproportionation) that influence carbonate dissolution. The distribution of diverse microbial groups in other terrestrial subsurface environments is not well understood, making Lower Kane Cave ideal for study. Molecular genetics techniques were used to uncover diversity of 16S rRNA genes and bacterial soxB and aprA functional genes. Aqueous …

The Legal Dilemma Of Guantanamo Detainees From Bush To Obama [Updated], Linda A. Malone
The Legal Dilemma Of Guantanamo Detainees From Bush To Obama [Updated], Linda A. Malone
Faculty Publications
The stage for the Guantanamo detainees’ commission proceedings was set by the interplay between the Executive’s detention powers and the Judiciary’s habeas powers. The Bush administration turned to Congress to provide less than what was required by the court, instead of the minimum deemed necessary to comply with each decision, or to explore another legal argument for not complying. This article examines how the law for the Guantanamo detainees has been shaped by the US courts and by Congress. The article begins by observing the guidelines issued by the Supreme Court for compliance with the constitutional and humanitarian law requirements, …
The Alaska Permanent Fund Dividend And Membership In The State's Political Community, Christopher L. Griffin Jr.
The Alaska Permanent Fund Dividend And Membership In The State's Political Community, Christopher L. Griffin Jr.
Faculty Publications
Despite decades of unmitigated administrative success, the Alaska Permanent Fund Dividend (PFD) is not immune from political and legal controversy. The symbolic and financial importance that Alaskans ascribe to their annual dividend checks has generated disputes between ordinary residents and executive agencies over eligibility. Litigation concerning three dominant status requirements - minimum residency, U.S. citizenship, and felony incarceration - reveal not only the extent to which Alaskans will pursue what they believe to be valid claims on their share of natural resource wealth, but also the limits of full political membership in the state. This Comment frames a sample of …
The Curious Relationship Between "Self-Deportation" Policies And Naturalization Rates, Angela M. Banks
The Curious Relationship Between "Self-Deportation" Policies And Naturalization Rates, Angela M. Banks
Faculty Publications
Governor Mitt Romney has stated that the country’s immigration problems can be solved through “self-deportation.” Arizona, Alabama, Georgia, South Carolina, and Virginia agree. For example, K–12 public schools in Alabama are required to ascertain the immigration status of all enrolling students. Police officers in Arizona, Alabama, Georgia, South Carolina, and Virginia check the immigration status of all individuals booked into jail. These “self-deportation” laws and policies, also known as immigration enforcement through attrition, are designed to discourage and deter unauthorized migration. Yet these policies are having a broader impact; they are creating a hostile context of reception for immigrants regardless …
Stakeholder Participation In The Selection And Recruitment Of Police: Democracy In Action, Kami Chavis Simmons
Stakeholder Participation In The Selection And Recruitment Of Police: Democracy In Action, Kami Chavis Simmons
Faculty Publications
Modem police culture tolerates or cultivates police misconduct and corruption in many ways. Failures to identify, monitor, and discipline "problem" officers; a belief that violence is a necessary part of law enforcement; and the code of silence; are organizational characteristics that need to be addressed in order to remedy organizational failures to hold law enforcement officers accountable. In order to address these cultural characteristics, police departments should carefully select police officers less likely to engage in these behaviors and adhere to these beliefs. Viewed through the lens of stakeholder participation, however, a fundamental shift should occur regarding how these new …

Falsely Shouting Fire In A Global Theater: Emerging Complexities Of Transborder Expression, Timothy Zick
Faculty Publications
We have entered an era in which potentially harmful expression can be distributed around the world in an instant. In the emerging global theater, speakers and audiences are connected through new and proliferating media; communicative space and time are compressed to an extraordinary degree; domestic expression can implicate national security and foreign affairs concerns; and a new model of global information dissemination is developing in which speakers are sometimes located beyond the jurisdiction of nations that may be harmed by their communications and disclosures.
This Article examines the First Amendment complexities associated with the dissemination of potentially harmful information in …

Is Texas Tough On Crime But Soft On Criminal Procedure?, Adam M. Gershowitz
Faculty Publications
Although Texas is well known for imposing tough punishments on convicted defendants, it is surprisingly generous in affording criminal procedure protections. In a variety of areas, including search and seizure rules, confession requirements, the availability of bail, prosecutorial discovery obligations, and jury trial guarantees, Texas affords protections vastly in excess of what is required by the United States Constitution. Even more shocking, these criminal procedure guarantees come almost entirely from Texas statutes approved by the legislature, not activist rules imposed by judges. This Article explores Texas's reputation as a tough-on-crime state and the seeming inconsistency between Texas being tough on …

Introduction to a symposium issue: "an interdisciplinary conversation between a filmmaker, former prosecutors, law professors, defense attorneys, and graduate students. Several questions prompted this gathering: First, do prosecutors have a distinctive legal 'culture'? What are the shared assumptions that define it? And how do those assumptions synchronize or conflict with the behaviors we deem ethical?"
Interstate Competition And The Race To The Top, Jonathan H. Adler
Interstate Competition And The Race To The Top, Jonathan H. Adler

Federalism is an essential part of the Constitution’s design. The division of sovereign power between the States and the federal government helps foster interjurisdictional competition, which, in turn, checks government power. Provided a right of exit is maintained, the excessive imposition of economic burdens in one jurisdiction will cause taxpayers and businesses to flee to other jurisdictions. For this reason, federalism often is seen as a friend of the free market.
Provided states cannot externalize the costs of their own policy choices, robust interjurisdictional competition facilitates the enactment of better public policy at the state level. Rather than inducing a …

Unique Problems And Creative Solutions To Assessing Learning Outcomes In Transactional Drafting Courses: Overcoming “The Form Book Problem”, Jacob M. Carpenter
Faculty Publications
In transactional drafting courses, students need to practice evaluating and using forms to aid them when they draft contracts. Only by working with forms can students learn to identify forms’ benefits and dangerous pitfalls. On the other hand, when students use forms, how can professors assess whether students crafted the contract carefully based on their own knowledge and skills, or whether they essentially just copied a form? This article provides nine creative solutions that enable professors to assess whether students have attained the skills and knowledge needed to draft strong contracts, even when students use forms to guide their drafting.
Organometallic Heterocycles And Acene-Quinone Complexes Of Ruthenium, Iron And Manganese, Uttam Raj Pokharel
Organometallic Heterocycles And Acene-Quinone Complexes Of Ruthenium, Iron And Manganese, Uttam Raj Pokharel
Theses and Dissertations--Chemistry
A variety of organometallic-fused heterocycles and acene quinones were prepared and characterized. This work was divided into three parts: first, the synthesis of 5,5-fused heterocyclic complexes of tricarbonylmanganese and (1’,2’,3’,4’,5’-pentamethylcyclopentadienyl)ruthenium; second, the synthesis of 1,2-diacylcyclopentadienyl p-cymene complexes of ruthenium(II); and third, synthesis of cyclopentadienyl-fused polyacenequinone complexes of ruthenium, iron and manganese.
The first examples of the convenient, versatile and symmetric cyclopentadienyl-fused heterocycle complexes of (1’,2’,3’,4’,5’-pentamethylcyclopentadienyl)ruthenium(II) and tricarbonylmanganese(I) were synthesized starting from (1,2-dicarbophenoxycyclopentadienyl)sodium. The sodium salt was transmetalated using [MnBr(CO)5] and 1/4 [Ru(μ3-Cl)(Cp*)]4 to give [Mn(CO)3{η5-C5H3(CO2Ph)2-1,2}] …
How A Silent Mutation Suppresses The Activity And Iron Incorporation In Superoxide Dismutase, Xiaonan Mei
How A Silent Mutation Suppresses The Activity And Iron Incorporation In Superoxide Dismutase, Xiaonan Mei
Theses and Dissertations--Chemistry
A mutation (CTG to TTG) of FeSOD gene was found in Escherichia coli. Since they both encode leucine, it is a silent mutation. Site-‐directed mutagenesis was applied to correct the mutation, and the mutant FeSOD (before gene correction) and wild type FeSOD (after gene correction) were purified. The FeSODs from the two genes were Characterized using different assays and spectroscopic methods including EPR and CD. The requirement for the rare codon TTG may result in slowed translation and heavy demand on a scarce tRNA. Cultures expressing wild type FeSOD are better able to grow for long times after addition of …
Investigations Into Modulation Of Brain Oxidative Stress By Various Interventions, Jessica Lynn Harris
Investigations Into Modulation Of Brain Oxidative Stress By Various Interventions, Jessica Lynn Harris
Theses and Dissertations--Chemistry
In this thesis study we examined glycogen synthase kinase-3β (GSK-3β) and its effects over Nrf2 and Pin 1 as it relates to Alzheimer’s disease (AD). AD is a neurodegenerative disease characterized by a prolonged high oxidative environment. Transcription factor Nrf2 is vital in the brain’s defense against oxidative insults through its up-regulation of over 100 antioxidants. Depletion of the brain’s antioxidant defense system results in intolerance to an oxidative environment, contributing to the progression of AD. The regulatory Pin 1 protein promotes cellular homeostasis, and when down-regulated results in increased deposits of neurofibrillary tangles (NFTs) and amyloid-β (Aβ) plaques, the …

The Hughes-Roberts Visit, Barry Cushman

In the 1936 case of Morehead v. New York ex rel. Tipaldo, Justice Owen Roberts voted to invalidate New York’s minimum wage law for women. The following spring, Roberts joined the majority in upholding Washington State’s minimum wage statute. How best to account for this “switch” is a central preoccupation of New Deal constitutional history. In recent years, a number of scholars have called attention to a visit that Chief Justice Charles Evans Hughes and his wife made to Roberts’ Pennsylvania farm in the summer of 1936, in the wake of the public firestorm following the announcement of the Tipaldo …
Child Support Guidelines And Divorce Incentives, Margaret F. Brinig, Douglas W. Allen
Child Support Guidelines And Divorce Incentives, Margaret F. Brinig, Douglas W. Allen
Journal Articles
A child support guideline is a formula used to calculate support payments based on a few family characteristics. Guidelines began replacing court awarded support payments in the late 1970s and early 1980s, and were eventually mandated by the federal government in 1988. Two fundamentally different types of guidelines are used: percentage of obligor income, and income shares models. This paper explores the incentives to divorce under the two schemes, and uses the NLSY data set to test the key predictions. We find that percentage of obligor income models are destabilizing for some families with high incomes. This may explain why …

Natural Law Theory: Its Past And Its Present, John M. Finnis
Journal Articles
The past in which theory of this kind had its origins is notably similar to the present. For this is theory-practical theory-which articulates a critique of critiques, and the critiques it criticizes, rejects and replaces have much in common whether one looks at them in their fifth century B.C. Hellenic (Sophistic) or their modem (Enlightenment, Nietzschean or postmodern) forms.
