The Eichmann Trial, Gregory S. Gordon Jan 2012

The Eichmann Trial, Gregory S. Gordon

Emory International Law Review

In 1960, the Israeli government abducted key Holocaust organizer Adolf Eichmann from Argentina and put him on trial in Jerusalem the following year. On the proceeding's fiftieth anniversary, renowned Holocaust historian Deborah Lipstadt's The Eichmann Trial offers a timely update to the only other book to focus primarily on the trial itself--Hannah Arendt's controversial Eichmann in Jerusalem: A Report on the Banality of Evil. As its famous subtitle suggests, Arendt's book has more of a philosophical, as opposed to a legal, focus.

The Potential Extraterritorial Consequences Of Akamai, Timothy R. Holbrook Jan 2012

The Potential Extraterritorial Consequences Of Akamai, Timothy R. Holbrook

Emory International Law Review

Patent infringement arises when all of the limitations found in a particular claim of a patent are present in a device. For a patented system, the apparatus must have all the required components as delineated in the claim. For a patented method, all of the steps of the method must be performed. Historically, the issue of "who" was the infringer was relatively straightforward because most systems and methods were utilized in discrete, unitary settings. In the modern era, however, particularly with inventions being implemented over the Internet, the issue of "divided infringement" has arisen in two particular contexts.

Stare Decisis And Certiorari Arrive To Brazil: A Comparative Law And Economics Approach, Maria Angela Jardim De Santa Cruz Oliveira, Nuno Garoupa

Emory International Law Review

Two important legal reforms in court procedure have taken place in Brazil recently: súmula vinculante (all courts now have to follow the reasoning of the Supreme Court in similar cases) and requisito da repercussão geral (the Supreme Court only hears cases that are of general importance). These two procedural rules respond to a long debate in the Brazilian legal community on how to address court congestion, the heavy workload of the Brazilian Supreme Court, and the role of the higher courts in establishing case law. We discuss the implications of these two important reforms from the comparative perspective (by explaining …

Catch Them If You Can: Compatibility Of United Kingdom And United States Legislation Against Financing Terrorism With Public International Law Rules On Jurisdiction, Laura Halonen

Emory International Law Review

The world changed on September 11, 2001. Led by a shocked but determined United States, the international community came together in order to take collective and individual action to eradicate terrorism. An important part of this campaign has been the fight against financing terrorism, seen as a key element of terrorism itself: "Today's terrorist advances with an Armalite in one hand and a cashbox in the other . . . . At a basic level [money] is necessary to finance operations, but it is more than that. It can become part of the momentum of terrorism itself."

State Sovereignty And Self-Defense In Cyberspace: A Normative Framework For Balancing Legal Rights, Catherine Lotrionte Jan 2012

State Sovereignty And Self-Defense In Cyberspace: A Normative Framework For Balancing Legal Rights, Catherine Lotrionte

Emory International Law Review

Today's threats recognize no national boundaries, are connected, and must be addressed at the global and regional as well as the national levels. When warranted, [the United States] will respond to hostile acts in cyberspace as we would to any other threat to our country. All states possess an inherent right to self-defense . . . . [We recognize] that hostile acts conducted through cyberspace could compel actions under the commitments we have with our military treaty partners . . . America must also face the rapidly growing threat from cyber-attacks. Now, we know hackers steal people's identities and infiltrate …

Giving Teeth To European Patent Reform: Overcoming Recent Legal Challenges, Matthew Parker Jan 2012

Giving Teeth To European Patent Reform: Overcoming Recent Legal Challenges, Matthew Parker

Emory International Law Review

Europe must transition from a national, splintered patent enforcement regime to a transnational, uniform patent enforcement regime to protect the value of European patents in the global economy. Patent reform in Europe is ongoing and supported by most member states of the European Union (EU), but objections by the European Court of Justice (ECJ), the European Parliament, Spain, and Italy have stymied progress. This Comment proposes modifications to patent reform in an effort to overcome these myriad objections and to enable the realization of meaningful European patent reform.

Chemistry: Faculty Publications and Other Works

A new method of teaching foreign languages to beginning, intermediate, and advancing foreign language students is proposed involving reading out loud passages, chapters, and entire works of literature that are familiar to the student through required pre-reading in the students’ mother tongue. Testing is proposed to evaluate the success of the method.

Conformational And Thermodynamic Properties Modulate The Nulceotide Excision Repair Of 2-Aminofluorene And 2-Acetylaminofluorene Dg Adducts In The Nari Sequence, Vipin Jain, Benjamin Hilton, Satyakam Patnaik, Yue Zou, M. Paul Chiarelli, Bongsup P. Cho Jan 2012

Conformational And Thermodynamic Properties Modulate The Nulceotide Excision Repair Of 2-Aminofluorene And 2-Acetylaminofluorene Dg Adducts In The Nari Sequence, Vipin Jain, Benjamin Hilton, Satyakam Patnaik, Yue Zou, M. Paul Chiarelli, Bongsup P. Cho

Chemistry: Faculty Publications and Other Works

Nucleotide excision repair (NER) is a major repair pathway that recognizes and corrects various lesions in cellular DNA. We hypothesize that damage recognition is an initial step in NER that senses conformational anomalies in the DNA caused by lesions. We prepared three DNA duplexes containing the carcinogen adduct N-(2'-deoxyguanosin-8-yl)-7-fluoro-2-acetylaminofluorene (FAAF) at G(1), G(2) or G(3) of NarI sequence (5'-CCG(1)G(2)CG(3)CC-3'). Our (19)F-NMR/ICD results showed that FAAF at G(1) and G(3) prefer syn S- and W-conformers, whereas anti B-conformer was predominant for G(2). We found that the repair of FAAF occurs in a conformation-specific manner, i.e. the highly S/W-conformeric G(3) and -G(1) …

Using Participatory Scenarios To Stimulate Social Learning For Collaborative Sustainable Development, Kris A. Johnson, Genya Dana, Nicholas R. Jordan, Kathy J. Draeger, Anne Kapuscinski

Dartmouth Scholarship

Interdependent human and biophysical systems are highly complex and behave in unpredictable and uncontrollable ways. Social and ecological challenges that emerge from this complexity often defy straightforward solutions, and efforts to address these problems will require not only scientific and technological capabilities but also learning and adaptation. Scenarios are a useful tool for grappling with the uncertainty and complexity of social-ecological challenges because they enable participants to build adaptive capacity through the contemplation of multiple future possibilities. Furthermore, scenarios provide a platform for social learning, which is critical to acting in the face of uncertain, complex, and conflict-laden problems. We …

Book Review: Metaphors We Teach By: How Metaphors Shape What We Do In Classrooms, Christina Belcher Jan 2012

Book Review: Metaphors We Teach By: How Metaphors Shape What We Do In Classrooms, Christina Belcher

International Christian Community of Teacher Educators Journal

As I sit to write this review, I find myself musing over the sub-title to this text, How Metaphors Shape What we do in Classrooms. Worthy of a place in educational texts, this context of shaping targets a consideration for everyone working educationally with students. In this context, this book provides readers with much to think about. In my perspective, it is this consideration toward what I will call the heart and dispositional sensibility of education, a Christian sense of place, so to speak, that makes this book valuable.

Introducing Better Ideas To An Industry Resistant To Change; Utilizing Approachable Architecture As An Envelope For Serious But Settled Technology, Brian Loss, Kevin L. Rodgers, William Hutzel

International High Performance Buildings Conference

This paper is based, in part, upon the involvement of students and their faculty advisors in the biennial Solar Decathlon Project, a student competition that culminated in the construction of energy efficient residential units at Potomac Park in Washington D.C. in September, 2011. These residential structures designed and built by students, represented differing visions of future housing by universities from the United States, China, New Zealand and the Netherlands. All represented engineering and design excellence and reflected each team‟s vision of a more complete, more holistic approach to the question of what we as a civilization will live in over …

Eastern Experiential Learning: Eastern Principles For Learning Wholeness, Mai P. Trinh, David A. Kolb Jan 2012

Eastern Experiential Learning: Eastern Principles For Learning Wholeness, Mai P. Trinh, David A. Kolb

Management Faculty Publications

Although Experiential Learning Theory originated in the work of Western scholars, many of their theoretical principles have a decidedly Eastern orientation. In this essay we draw out these Eastern principles of experiential learning and suggest an Eastern perspective on learning wholeness in one's life and career based on an ontological approach to adult development that emphasizes existential ways of being in the here and now-centering, balance, harmony and flowing in the watercourse way.

Actualizing Faith Learning Integration: Exploring The Tensions Of Mindful Teaching, Susanna Steeg Jan 2012

Actualizing Faith Learning Integration: Exploring The Tensions Of Mindful Teaching, Susanna Steeg

International Christian Community of Teacher Educators Journal

This reflective paper describes the experiences of a first-year faculty member negotiating the meaning and living out of faith learning integration within her particular institution. The triple tensions of mindful teaching (ethics/power, individual/collective, and contemplation/action) are framing constructs for this discussion of faith learning integration. Autobiographical narratives of three particular experiences in the author’s first year offer opportunities for readers to reflect on the tensions inherent in mindful teaching as it pertains to faith and learning. The author invites consideration of the institutional supports and constraints within these conversations while sharing vignettes revealing the personal nature of these decisions.

Religious Identity Formation Among Adolescents: The Role Of Religious Secondary Schools, Timothy J. Wang Jan 2012

Religious Identity Formation Among Adolescents: The Role Of Religious Secondary Schools, Timothy J. Wang

International Christian Community of Teacher Educators Journal

The purpose of this article is to examine the role religious secondary schools play in the religious identity formation of adolescents. Although several research studies have found a correlation between enrollment in private religious schools and adolescents’ religious identity formation, the researchers of these studies have only speculated about which specific characteristics of religious schools are responsible for this formation in the lives of adolescents. Through a review of the literature, the present article identifies several characteristics of religious secondary schools that may contribute to the process of religious identity formation: a community of religious peers, the presence of religious …

Using Storytelling To Integrate Faith And Learning: The Lived Experience Of Christian Esl Teachers, Monir Nazir Atta-Alla

International Christian Community of Teacher Educators Journal

English as a second language (ESL) settings lend themselves more easily and naturally than others to storytelling-based discussions and activities that integrate faith and learning. Stories and storytelling offer students from diverse backgrounds a compelling mechanism for understanding their world and creating shalom learning community conducive to the restoration of wholeness of the learners. This qualitative study explores the perceptions and lived teaching experience of Christian teachers regarding the integration of faith and learning in ESL settings through using storytelling. Findings indicated that storytelling is an effective tool for the integration of faith and learning in ESL settings. Using storytelling …

U.S. Cross-Listing, Institutional Investors, And Equity Returns, Yui Law Jan 2012

U.S. Cross-Listing, Institutional Investors, And Equity Returns, Yui Law

Lingnan Theses

Cross-listing refers to firms listing their equities on more than one stock exchange. Cross-listing is an interesting topic of international finance. This is because along with the deeper integration of the global financial market, we should see lesser importance of geographic factors. Thus, the motivations and effects of listing a firm on exchanges of different regions should have essential economic implications. The reputation bonding hypothesis suggests that U.S. cross-listing improves the information environment of a firm because of the higher disclosure standard and more analyst coverage. The legal bonding hypothesis argues that U.S. cross-listing improves the investor protection and corporate …

Novel Techniques Of Using Diversity In Software Security And Information Hiding, Jin Han Jan 2012

Novel Techniques Of Using Diversity In Software Security And Information Hiding, Jin Han

Dissertations and Theses Collection (Open Access)

Diversity is an important and valuable concept that has been adopted in many fields to reduce correlated risks and to increase survivability. In information security, diversity also helps to increase both defense capability and fault tolerance for information systems and communication networks, where diversity can be adopted from many different perspectives. This dissertation, in particular, focuses mainly on two aspects of diversity – the application software diversity and the diversity in data interpretation. Software diversity has many advantages over mono-culture in improving system security. A number of previous researches focused on utilizing existing off-theshelf diverse software for network protection and …

Socialization Tactics As Antecedents For Goal Interdependence And Newcomer Adjustment And Retention, Changhong Lu Jan 2012

Socialization Tactics As Antecedents For Goal Interdependence And Newcomer Adjustment And Retention, Changhong Lu

Lingnan Theses

Serial (providing newcomer role models) and investiture (providing newcomer positive social support) tactics have been demonstrated as the most important predictors for newcomer adjustment. This study empirically examines the dynamics of serial and investiture tactics on newcomer adjustment and retention. It posits that goal interdependence between new recruits and their teams critically affects new recruits adjustment outcomes. This study adopts Deutsch’s theory of goal interdependence to understand when newcomers develop cooperative goal interdependence with their teams. It argues that serial and investiture tactics promote cooperative goal interdependence and reduce competitive goal and independent goal relationships and thereby result in newcomer …

A Pleasant Surprise Or Injury Plus Insult? : Consumers' (Dis)Satisfaction With Recovery Strategies For Service Failure, Muyu Wei Jan 2012

A Pleasant Surprise Or Injury Plus Insult? : Consumers' (Dis)Satisfaction With Recovery Strategies For Service Failure, Muyu Wei

Lingnan Theses

Dealing with service failure, one question is constantly asked: why certain consumers are still dissatisfied even though compensations are made? The effectiveness of recovery strategy has been discussed in the context of service failure paradox and second deviation in the past literature. In this thesis, these two issues were brought together under the same framework - from the perspective of expectation. We propose that expectation mediates consumers’ evaluation of recovery strategies, and leads to different levels of satisfaction and re-patronage intention. The expectation is further influenced by the type of resource spending consumers are reminded of and the failure type. …

Understanding Conflict Avoiding Behavior In China : The Role Of Goal Interdependence And Behavioral Intentions, Lin Wang Jan 2012

Understanding Conflict Avoiding Behavior In China : The Role Of Goal Interdependence And Behavioral Intentions, Lin Wang

Lingnan Theses

It is a commonly held belief that people from collectivistic, large power distance or high-context cultures, such as China, tend to be less confrontational, which could be counter-productive in organizations. Contrary to this traditional view, this study posits that conflict avoidance can be constructive depending on the specific actions protagonists take. It adopts Deutsch’s (1973) theory of cooperation and competition to understand conflict avoiding behavior between employees and their supervisors, indicating that people’s perceptions of goal interdependence significantly influence their behavioral intentions that in turn predict their overt actions to avoid conflict. Specifically, it proposes that goal interdependence greatly affects …

The Impacts Of Modernity On Family Structure And Function : A Study Among Beijing, Hong Kong And Yunnan Families, Ting Cao Jan 2012

The Impacts Of Modernity On Family Structure And Function : A Study Among Beijing, Hong Kong And Yunnan Families, Ting Cao

Lingnan Theses

For a generation in many sociological literatures, China has provided the example of traditional family with good intra-familial relationship, filial piety and extended family support which is unusually stable and substantially unchanged. However, with the emergence of modernity, in the forms of industrialization and urbanization; capitalization and public policy transformation, the family structure has undergone changes where nuclear and asymmetrical types have emerged. At the same time, family support for the elderly is affected by the changes in family formation, family dynamics, as well as people’s values and their way of life. Do the theories concerning the relationship between modernity …
