Transcendentalism’S Advocacy And Perpetuation Of Capitalist Ideology : The Physical And Spiritual Profitability Of Henry David Thoreau, Geoffrey D. Borshof Jan 2012

Transcendentalism’S Advocacy And Perpetuation Of Capitalist Ideology : The Physical And Spiritual Profitability Of Henry David Thoreau, Geoffrey D. Borshof

Theses, Dissertations and Culminating Projects

Henry David Thoreau is often perceived as a naturalist, a minimalist, and an anti-capitalist. However, more in-depth readings of Walden reveal numerous fundamental similarities between Transcendentalism and Capitalism. This thesis argues that Henry David Thoreau did in fact advocate a capitalist agenda not merely through his texts, but his lifestyle as well.

Much of Thoreau scholarship places an emphasis on several fundamental points including individualism, the right to ownership, support of the abolitionist movement, frugality, and Thoreau's experience as an inventor and engineer. By examining these values and exploring the foundation of Capitalism through readings of Adam Smith's A Wealth …

Graphic Design + Biomimicry, Margaret Mckosky Jan 2012

Graphic Design + Biomimicry, Margaret Mckosky

Theses

GRAPHIC DESIGN + BIOMIMICRY: Integrating Nature into Modern Design Practices is a thesis that explores how to effectively integrate the methodologies and principles of graphic design and biomimicry. The objective is to create an innovative design process resulting in successful, sustainable and timeless design solutions. This process is meant to remind designers of the benefits nature has to offer in helping us solve many of the problems that society is currently grappling with today. Nature over 3.8 billion years has already used its imaginative prowess to find what works, what is appropriate, and most importantly, what lasts here on Earth. …

Extinction Risk And Bottlenecks In The Conservation Of Charismatic Marine Species, Loren Mcclenachan, Andrew B. Cooper, Kent E. Carpenter, Nicholas K. Dulvy Jan 2012

Extinction Risk And Bottlenecks In The Conservation Of Charismatic Marine Species, Loren Mcclenachan, Andrew B. Cooper, Kent E. Carpenter, Nicholas K. Dulvy

Biological Sciences Faculty Publications

The oceans face a biodiversity crisis, but the degree and scale of extinction risk remains poorly characterized. Charismatic species are most likely to gar- ner greatest support for conservation and thus provide a best-case scenario of the status of marine biodiversity. We summarize extinction risk and diagnose impediments to successful conservation for 1,568 species in 16 families of marine animals in the movie Finding Nemo. Sixteen percent (12–34%) of those that have been evaluated are threatened, ranging from 9% (7–28%) of bony fishes to 100% (83–100%) of marine turtles. A lack of scientific knowledge impedes analysis of threat status …

Phytoplankton identification and abundance data are now commonly feeding plankton distribution databases worldwide. This study is a first attempt to compile the largest possible body of data available from different databases as well as from individual published or unpublished datasets regarding diatom distribution in the world ocean. The data obtained originate from time series studies as well as spatial studies. This effort is supported by the Marine Ecosystem Model Inter-Comparison Project (MAREMIP), which aims at building consistent datasets for the main plankton functional types (PFTs) in order to help validate biogeochemical ocean models by using carbon (C) biomass derived from …

Toxin-Antitoxic Loci Vapbc-1 And Vapxd Contribute To Survival And Virulence In Nontypeable Haemophilus Influenzae, Dabin Ren, Anna N. Walker, Dayle A. Daines

Biological Sciences Faculty Publications

Background: Nontypeable Haemophilus influenzae (NTHi) is a significant human pathogen responsible for respiratory tract infections and the most common cause of recurrent otitis media. Type II toxin-antitoxin (TA) systems are genetic elements that code for a stable protein toxin and a labile antitoxin that are thought to be involved in metabolic regulation of bacteria by enabling a switch to a dormant state under stress conditions. The contribution to infection persistence of the NTHi TA loci vapBC-1 and vapXD was examined in this study.

Results: Deletions in vapBC-1, vapXD and vapBC-1 vapXD significantly decreased the survival of NTHi co-cultured with …

Introduction To Special Section On Recent Advances In The Study Of Optical Variability In The Near-Surface And Upper Ocean, T. Dickey, M. L. Banner, P. Bhandari, T. Boyd, L. Carvalho, O. Wurl

OES Faculty Publications

Optical variability occurs in the near-surface and upper ocean on very short time and space scales (e.g., milliseconds and millimeters and less) as well as greater scales. This variability is caused by solar, meteorological, and other physical forcing as well as biological and chemical processes that affect optical properties and their distributions, which in turn control the propagation of light across the air-sea interface and within the upper ocean. Recent developments in several technologies and modeling capabilities have enabled the investigation of a variety of fundamental and applied problems related to upper ocean physics, chemistry, and light propagation and utilization …

The Role Of Larval Dispersal In Metapopulation Gene Flow: Local Population Dynamics Matter, Daphne M. Munroe, John M. Klinck, Eileen E. Hofmann, Eric N. Powell

OES Faculty Publications

The degree of genetic connectivity among populations in a metapopulation has direct consequences for species evolution, development of disease resistance, and capacity of a metapopulation to adapt to climate change. This study used a metapopulation model that integrates population dynamics, dispersal, and genetics within an individual-based model framework to examine the mechanisms and dynamics of genetic connectivity within a metapopulation. The model was parameterized to simulate four populations of oysters (Crassostrea virginica) from Delaware Bay on the mid-Atlantic coast of the United States. Differences among the four populations include a strong spatial gradient in mortality, a spatial gradient …

Plane And Simple: Planar Tetracoordinate Carbon Centers In Small Moleculesw, Chad Crigger, Bernard K. Wittmaack, Marina Tawfik, Gabriel Merino, Kelling J. Donald

Chemistry Faculty Publications

A class of neutral 18-electron molecules with planar tetracoordinate carbon (ptC) centers is introduced. We show computationally that when n = 3 the neutral singlet molecule C(BeH)n(BH2)4-n and other isoelectronic (18-valence electron) molecules of main group elements collapse from locally tetrahedral arrangements at the C-center to (near) planar tetracoordinate structures. For C(BeH)3BH2 and C(CH3)(BH2)Li2, for example, the tetrahedral type conformation is not even a minimum on the potential energy surface at the B3PW91, MP2(full), or CCSD levels of theory. The Mg analogue C(MgH)3BH2 …

Chemistry Faculty Publications

A series of clusters with the general formula CBe5E- (E = Al, Ga, In, Tl) are theoretically shown to have a planar pentacoordinate carbon atom. The structures show a simple and rigid topological framework—a planar EBe4 ring surrounding a C center, with one of the ring Be–Be bonds capped in-plane by a fifth Be atom. The system is stabilized by a network of multicenter σ bonds in which the central C atom is the acceptor, and π systems as well by which the C atom donates charge to the Be and E atoms that encircle it.

Bundling Solutions For Financing Building Energy Efficiency Retrofit Projects In Residential And Commercial Buildings, Michael Kerstetter Jan 2012

Bundling Solutions For Financing Building Energy Efficiency Retrofit Projects In Residential And Commercial Buildings, Michael Kerstetter

Sabin Center for Climate Change Law

Buildings are responsible for approximately 40% of overall national energy consumption and renewed investment in energy efficiency (EE) projects and measures in that sector, in particular, could potentially save consumers and the U.S. economy billions of dollars, create jobs and significantly reduce the emission of greenhouse gasses. Accordingly, a comprehensive and well crafted economy-wide EE solution should include programs for the upgrading or retrofitting of existing residential and commercial structures. Although there is already investment in these types of projects, significant potential still remains for further investment. The subjects discussed in this paper could serve as a useful starting point …

Going Rogue: Stop The Beach Renourishment As An Object Of Morbid Fascination, Mary Doyle, Stephen J. Schnably

Articles

Scholarly response to the Supreme Court's decision in Stop the Beach Renourishment, Inc. v. Florida Department of Environmental Protection has focused on the plurality's strong advocacy of a judicial takings doctrine. We take a different tack. While the concept of judicial takings is worthy of serious attention, it is wrong to treat the plurality opinion as an ordinary object of analysis. It is, instead, the emanation of a Court going rogue.

Three basic symptoms of the pathology stand out. First, sleight of hand. The plurality opinion purports to be about an institutional issue-can a state court commit a taking? - …

Anticompetitive Product Design In The New Economy, John M. Newman Jan 2012

Anticompetitive Product Design In The New Economy, John M. Newman

Articles

Claims alleging anticompetitive product design and redesign lie at the very core of one of antitrust law's most challenging dilemmas: the intersection between innovation and regulation, invention and intervention. For over three decades, courts and scholars have struggled to determine the proper analytical framework within which to address such cases. Meanwhile, the very industries in which challenged conduct occurs have been undergoing fundamental changes.

As demonstrated by the ongoing and recent antitrust litigation involving high technology firms Apple, Intel, and Microsoft, distinctive features characterize most product markets in what has been called the 'New Economy'"--and what increasingly has become simply …

Liberalism Undressed, Jethro K. Lieberman Jan 2012

Liberalism Undressed, Jethro K. Lieberman

Books

In Liberalism Undressed, Jethro K. Lieberman returns to liberalism's roots to explain, in accessible and readable prose, why liberalism retains its power and appeal. He begins with the memorable thesis of John Stuart Mill, who drew from earlier liberal writers, which states "the only purpose for which power can be rightfully exercised over any member of a civilized community, against his will, is to prevent harm to others." Building on Mill's well-known, but rarely analyzed, Harm Principle, Liberalism Undressed undertakes to show that this widely-accepted precept-"it's a free country; I should be able to do what I want as …

Land Use Regulation: It Just Gets Worse, Michael Lewyn Jan 2012

Land Use Regulation: It Just Gets Worse, Michael Lewyn

Scholarly Works

Some commentators treat suburban sprawl (by which I mean automobile-dependent land development) as the result of the free market at work. This article reviews City Rules, by urban planning professor Emily Talen. In this book, Talen shows not only how zoning and similar land use regulations generate automobile-dependent suburban sprawl, but also how these regulations have become stricter, more pro-sprawl, and more complex over time. Talen proposes to reform these regulations through municipal codes that promote more walkable, less automobile-dependent development.

A Heretical View Of Teaching: A Contrarian Looks At Teaching, The Carnegie Report And Best Practices, Gary Shaw Jan 2012

A Heretical View Of Teaching: A Contrarian Looks At Teaching, The Carnegie Report And Best Practices, Gary Shaw

Scholarly Works

This article takes a position contrary to those of the Carnegie Foundation for the Advancement of Teaching Report, Educating Lawyers and Best Practices for Legal Education. It argues that much of the harm those reports attribute to Socratic dialogue is misguided— that the problems that arise are a result ofbad teaching technique rather than any flaw intrinsic in Socratic dialogue. It then goes on to argue that because many of the problems the two reports are trying to address are due to poor teaching rather than the Socratic dialogue, the reports’ recommendations cannot achieve the results hoped for. Current law …

Religious Consumers And Institutional Challenges To American Public Schools, Aaron J. Saiger Jan 2012

Religious Consumers And Institutional Challenges To American Public Schools, Aaron J. Saiger

Faculty Scholarship

The paradigm of American K–12 education is shifting as the institution of local educational polities, each responsible for own its 'common schools,' faces competition from programs of school choice. Although charter schools and related reforms are generally studied in terms of quality and equity, the rise of consumer sovereignty as an alternative to political sovereignty as an organizing principle for educational governance has much wider ramifications. Paradigms of choice have already begun dramatically to alter religious education and its relationship to public schooling. Moreover, because these paradigms rely upon consumer preferences and the aggregation of those preferences by markets, the …

Law Review Scholarship In The Eyes Of The Twenty-First Century Supreme Court Justices: An Empirical Analysis, Brent Newton Jan 2012

Law Review Scholarship In The Eyes Of The Twenty-First Century Supreme Court Justices: An Empirical Analysis, Brent Newton

Georgetown Law Faculty Publications and Other Works

An analysis of the twenty-first century Justices’ citations of law review scholarship—how often they cite articles, the professional identities of authors of the cited articles, and the rankings of the law reviews in which the cited articles appear—provides an excellent prism through which to assess today’s law reviews. In addition to having had varied and rich legal careers as practitioners, policy-makers, and lower court judges, the majority of the current Justices were, at earlier points in their careers, full-time law professors. Presumably, the Justices are able to separate the wheat from the chaff in the law reviews. The present study …

Effect Of Lower Body Positive Pressure On Cardiovascular Response At Various Degrees Of Head Up Tilt, Vladimir Ilyich Kostas Jan 2012

Effect Of Lower Body Positive Pressure On Cardiovascular Response At Various Degrees Of Head Up Tilt, Vladimir Ilyich Kostas

Theses and Dissertations--Kinesiology and Health Promotion

Various models of simulated weightlessness and resulting cardiovascular effects have been researched in the last 50 years of space exploration. Examples of such models are the Alter-G (Alt-G) treadmill used for body unweighting and head-up-tilt (HUT) model each providing similar cardiovascular effects, but differing in their stimulation of vestibular centers . Advantages of using the Alt-G include: use of lower body positive pressure (LBPP) to simulate hypogravity, it acts as a countermeasure to alleviate negative cardiovascular effects of standing and provides a constant vestibular stimulus. In addition, the Alt-G shorts themselves may be providing a certain degree of LBPP, acting …

From Goods To A Good Life: Intellectual Property And Global Justice, Madhavi Sunder Jan 2012

From Goods To A Good Life: Intellectual Property And Global Justice, Madhavi Sunder

Georgetown Law Faculty Publications and Other Works

Most scholarship on intellectual property considers this law from the standpoint of law and economics. Under this conventional wisdom, intellectual property is simply a tool for promoting innovative products, from iPods to R2D2. In this highly original book Madhavi Sunder calls for a richer understanding of intellectual property law’s effects on social and cultural life. Intellectual property does more than incentivize the production of more goods. This law fundamentally affects the ability of citizens to live a good life. Intellectual property law governs the abilities of human beings to make and share culture, and to profit from this enterprise in …
