The business trust has enjoyed resurgence in Singapore following the enactment of the Business Trusts Act. In March 2011, a high profile initial public offering in Singapore involving a business trust raised a staggering US $5.5 billion making this one of the world’s largest initial public offering of the year. Not long ago, there was a consensus in the legal academy that the Japanese were irrational litigants. As the theory went, Japanese people would forgo litigating for financial gain because of a cultural obsession with maintaining social harmony. Based on this theory, it made perfect (but economically irrational) sense that Japanese shareholders let their U.S.-transplanted derivative action lay moribund for almost four post-war decades, while at the same time the derivative action was a staple of shareholder litigation in the United States.The 1980s brought a wave of law and economics to the scholarship of Japanese law, which largely discredited the …

The willingness to understand the perception and practice of silence is currently receiving an increasing amount of attention in the literature on sociolinguistics and pragmatics. This study aims to investigate silence as perceived and practised by speakers of Australian English and Jordanian Arabic in casual conversation from a socio-pragmatic perspective. It also attempts to anticipate processes in which silence can be created and used in the mainstream of communication. Cannabis is currently the most frequently used illicit drug in Australia. Research has revealed a range of health, economic, criminal and social consequences associated with the drug. Water allocation is a fundamental part of water resources management. Water allocation is often a contested process because it involves multiple uses and users of water. Issues of justice arise when resources are, or are perceived to be, in short supply. When water is allocated the rules for the distribution of the resource may result in just outcomes for some stakeholders but may create injustices for other stakeholders. Using a sequential transformative mixed methods approach prioritising qualitative data, the construction of subjective wellbeing of Australian solo mothers was explored in relation to work, welfare and social justice. A purposive sample of 73 solo mothers was recruited for the quantitative part of the study and 15 solo mothers were selected from the sample to interview for the qualitative component. The study was undertaken on a background of welfare reform announced in the Federal Budget for 2005-2006 with changes taking effect from July 1, 2006 affecting many solo mothers with young children. Most workers adjust well to retirement, but some experience depression due to poor adjustment. No evidence-based treatments were identified that targeted the developmental needs of this complex transition. In phase 1, a treatment manual (IPT-RM) was developed. The manual comprised an adaptation of Interpersonal Psychotherapy. In phase 2, a pilot study was conducted to determine the treatment’s feasibility. A series of non-experimental AB singlecase studies was conducted with nine retirees. All research participants’ depressive symptoms receded into the non-depressed range by the end of the study. The IPT-RM treatment manual was developed to a Stage 1 level, which incorporated peer-reviewed …

I investigated the past, present and possible futures of Australia’s ocean pools, over a hundred public seawater pools sited on rocky surfcoasts, so that waves wash over their walls. My interdisciplinary analysis informed by actor-‐network theory explored their contributions to surf, beach, pool and body cultures and recreational coasts. Ocean pools have since the nineteenth century been far more significant in the surf, beach, pool and body cultures of Australia and South Africa, than in those of Britain and the United States. The selection of information through visual attention can be based on the time course of events as well as on the spatial location where information is presented. The attentional blink (AB) phenomenon reflects a limitation in selecting information based on time. This phenomenon is observed with a rapid serial visual presentation (RSVP) where the ability to accurately identify a second target (T2) is reduced when it follows 200 – 500 ms after the first target (T1). This paper considers whether religious symbols on public property might serve a permissible role within the secular polity, and whether there is a way to understand such symbols as compatible with secular commitments. While some attention will be given to constitutional issues, it is proposed that jurisprudential incoherence in this area is less the result of legal interpretation and technique than with the way in which law has framed the concept of the secular. This Article considers how the idea of human dignity has shaped, and been shaped by, recent bioethical debates, particularly concerning the issue of genetic engineering and enhancement. While the language of human dignity has long had a role in bioethics, the issue of genetic manipulation has raised anew fundamental questions about the nature of personhood and the meaning of dignity. This Article argues that diversifying the federal judiciary with more women and men of color, but particularly with more women of color, is essential to moving forward and strengthening this country’s democracy. Specifically, this Article responds to arguments by prominent feminists that having female “firsts” on the bench is not as critical as having the “right” women on the bench—“right” meaning those women who are invested in and supportive of what are traditionally viewed as women’s issues. This paper highlights the impact of raid, rescue, and rehabilitation schemes on HIV programmes. It uses a case study of Veshya Anyay Mukti Parishad (VAMP), a sex workers collective in Sangli, India, to explore the impact of anti-trafficking efforts on HIV prevention programmes. The paper begins with an overview of the anti-trafficking movement emerging out of the United States. This U.S. based antitrafficking movement works in partnership with domestic Indian antitrafficking organisations to raid brothels to “rescue and rehabilitate” sex workers. As the U.S. population ages, the availability of workers with a basic understanding of aging and health-related services has not kept pace. This is true in traditional health care organizations such as hospitals and primary care clinics as well as in long-term care settings and senior housing, including subsidized housing, the focus of this report. Nearly 1.8 million older persons receive some form of publicly-subsidized rental assistance. This document summarizes the outcomes of an effort to identify the diverse human populations associated with Fort Vancouver. Through a review of ethnographic, historical, and ethnohistorical information found in various research libraries and archives, this research has sought to illuminate the many reasons that Native Americans converged at the fort and to reconstruct the paths taken by these people after their departure. Fifty percent of all students who enroll in college depart before earning their degree; this proportion is even higher among minorities during the first year of college (Tinto, 2006). Minorities have typically had fewer opportunities to gain a college education. Once enrolled in college, minorities have generally found it more difficult to succeed academically and graduate (Strayhorn, 2011). The purpose of this dissertation study was to explore the professional preparation of students in online classes at a Christian theological seminary. Concerns of theological education involve the capacity or incapacity of community development and somatic or embodied learning in online education. This thesis will explore the relationship between the rise of the Know Nothing Party and the modernization of St. Louis, the first Western metropolis. By the mid-1850s, two distinct visions of St. Louis existed. On one side of the ideological aisle, Democrats and conservative Whigs cautiously pursued an economic policy that advocated a slow but steady growth in St. Louis’ city infrastructure. But by 1850, a new faction of wealthy Yankee merchants, stirred by dreams of empire and western supremacy, challenged the traditional approach and strategically joined the national Know Nothing movement. Through a comparative study of two Chicago neighborhoods along the Chicago River, the Loop and Bridgeport, I construct the network of political, social, and economic factors that create the urban environment of the Chicago River in and along these places. The purpose of this research is to examine the dominant narrative of adolescence/juvenile delinquency and to question what makes this discourse possible. I use a poststructuralist perspective that thoroughly questions, dismantles, reveals, and analyzes this discourse in order to uncover hidden or obscure motives that shape how we understand adolescent individuals. Stereotype threat is a situational concern in which persons have uneasiness or worries about confirming a negative presumption about their social group. This apprehension affects the performance of those suffering this threat in recursive cycles, causing continuing underperformance in the threatened domain. The first chapter provides a way of evaluating a player's contribution to their team and relates their effort to their market values. We extend the work of Ballester et al. (2006) by incorporating a network outcome component in the players' payoff functions. As an illustration of the theory, we create a unique data set from the UEFA Euro 2008 tournament. To capture the interaction between players, we create the passing network of each team. This all allows us to identify the key player and key groups of players for both teams in each game.
